Preparations? (UPDATE)

We just had a flurry of e-mails that got our attention:
  • JVD sentencing is scheduled for tomorrow. Is there a plan in place for anything if he gets a sentence that is less than what the "community" demands?
An email points out he's a first time offender with zero criminal background. Another person writes that the likelihood of concurrent sentences is high.

So what is the Department's plan ..... just in case? We haven't seen a thing.

UPDATE: Pre-Sentencing? So we'll have an actual date that they'll be cancelling days off shortly. Can they wait until the first snowfall?

This turns out to be a status hearing only and not the date of actual sentencing. That date will bring day off cancelled, 12-hr tours etc, same as the verdict.

He’s been on EM since he was bonded out 3 years ago so that time works in his favor. If he got 6 yrs each charge to run concurrently he could theoretically be released time considered served.

No plans. Dept too busy stripping 3 year 'veterans' in 011 for trading guns for freedom and doing damage control for the 005 XO for shooting him self in the leg during a DD. Best & brightest on this job I tell ya. God bless JVD, may he get the minimum and beat it on appeal. I wonder..... were the shitbirds on 005s desk cheering to hear their XO shot himself???����

Sentencing is not scheduled for tomorrow. If it was it would be shoved down our throats through the media and the news outlets would taking about all the live coverage they would have of it. 12-hour days and cancelled RDOs are likely given that the "activists" won't be happy that he'll get the minimum. Sentencing is more likely to be at least a month or two away.

(a) A person is justified in the use of force against another when and to the extent that he reasonably believes that such conduct is necessary to defend himself or another against such other's imminent use of unlawful force. However, he is justified in the use of force which is intended or likely to cause death or great bodily harm only if he reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or another, or the commission of a forcible felony.

The "Plan" is highly detailed, well-thought out, and on a shelf next to the plans for other events such as the NATO Summit, Highway takeovers, BLM blockades, and how to reduce crime on the South/West Sides.

he will serve more time for the agg battery charges than the 2nd degree murder. My guess is they are all concurrent and he does 4 or 5 years, or whatever the minimum sentence is for agg battery these days. I don't think the judge has a whole lot of leeway. I think he could be sentenced to probation on the murder charge but has to do 80% of the sentence on the agg battery charges. So even with the minimum sentence on those 16 charges done concurrently, he is in jail for a while.

The Chicago Police Department administered a promotional exam for the position of Lieutenant. A Deputy Superintendent named Eugene Williams was the SME for the Department who worked with the company that constructed the test. Williams was given a copy of the final version of the test as part of his review process. Williams was also the head of National Organization for Black Law Enforcement (NOBLE), in Chicago. Williams, while in possession of the test held invite only private study sessions where primarily (not exclusively) African American members were invited. Those who attended achieved the top scores on the test, and have since been promoted to Lieutenant. Many of them were assigned to the Internal Affairs Division. An investigation of the cheating conducted by a Sergeant at Internal Affairs was promptly closed. Of those promoted, there are those connected by marriage to the former 1st Deputy Superintendent and the current Superintendent, NOBLE members, and African Americans. It appears on its face that high ranking black members of the Chicago Police Department conspired to assist black sergeants in getting promoted by cheating, thereby discriminating against non-blacks. The IG’s office closed an investigation into the cheating but never issued an available report to be viewed by those negatively affected. There was a not-sustained finding. In other words, not enough proof to prove or disprove the allegation. What methods did they use to investigate? The statistical improbability of the results of the top performers causes this phenomenon, to be erroneous. It could not have happened without there being an unfair advantage for the cheaters; and a corresponding unfair disadvantage for those who were righteous in their preparation. They Cheated! There is at least one Sergeant who made a formal complaint, which facilitated the IAD and IG investigations. It appears that this criminal activity was covered up and swept under the rug; as is common in Chicago, the most corrupt city in the USA.

Hope you are right, but a conviction of a class X felony requires you to serve 85% of the sentence. Also one commentator stated he was released on a cash bond which is true after like 6 days in jail and he was not required to be on EM. I sure hope you are correct because that would changed a lot of things

Those connected can just get the test and answers from the CPD subject matter experts and those exempts who request for a copy of the test and give it to their secretaries and cronies. I'm sure some of the counts of "aggravated battery with a handgun" will get knocked down but the arrogant Judge favored the prosecutors at the trial and won't be easy on him. Anyone who think he gets less than 5-7 years isn't thinking clearly.

I find it amazing the judge determined that Van Dyke could get a fair jury trial in Crook County but the second he is convicted he had to be shipped out of Cook County Jail all the way across the state for his safety.

He CANNOT find JVD Guilty of the precedent setting 6yrs for 16 counts and has told those near him to get out on the day of the sentencing. He's not going to be made a Legal Fool at the Appeals Process and knows the charges were ridiculous. Pray for cold and snow it's going to get ugly.

That trooper deserves what he gets. Lean out and taser the kid while he is going 35 to 40 mph on the ATV? It doesn't take a brain to figure the kid will lose control and either hurt or kill himself or someone else. For what, a minor traffic charge? And this was in Detroit, where the MSP was just helping out by doing extra coverage patrols. Back off and let DPD handle it. Let them chase him down if they feel it's important. Why put yourself at risk for some minor crap in the hood. This guy is a moron with the common sense and brains of a fruit fly. I have no sympathy for him. At the same time, the parents of the kid should be charged for their own negligence.

It seems the courthouse at Belmont/Western will be closing. I had a very very far fetched idea; why not turn that property into, say, an Amusement Park ???
Something like the "Vanecko House of Games" comes to mind. Think of all the no bid contracts, the obligatory graft and kickbacks, the substandard materials bought at inflated prices, the sham minority set-asides, insider property speculators, not to mention the necessary insurance coverage with connected brokers - the list is practically endless. In fact, just the increase in property taxes alone will cover the various automobile leases needed to go to O'Hare for the contractor financed fact finding missions to warm climates during the all important months of November through April as well as the local strippers needed to keep the chill off. The scale of this is such that every single member of the Vanecko family, not to mention their friends, will have their hands in the pot! And what doesn't help their family and friends will almost certainly help their friends and family. I have been told that "God helps those who help themselves." And I bet I can name 50 Aldercreatures as well as other unemployable people (and folks) who would gladly help themselves on this project. I will even go on record stating the entire project could be completed with less than 25 indictments handed down. To quote no less an authority than inmate number 40892-424, and current resident of Englewood Colorado, "This is Golden."

Well it should be a mess, after protesters were allowed to take over the lobby at 26th St. for hours yesterday afternoon; while other protesters blocked the front doors with their bodies and picket signs. The sheriffs stood around like they were security guards who had no responsibilty to maintain order in the building. Tom Dart has now shown all of the radical protest groups that 26th & Cal will allow them unimpeded access to do whatever they want. How do protesters enter through “security” at the courthouse while carrying zip ties / flex cuffs?

I am hearing that FLOP spent over $1.2 million on Herbert's defense of JVD. Could this possibly be true? If yes, the entire FLOP Board needs to resign. What a joke. Also, police across the country are WINNING cases involving on duty use of force and shootings. Herbert has three police clients imprisoned for on-duty actions. Time for someone new.

Home monitoring works this way. For every day a person is on home monitoring is a day taken off the persons sentence. In JVD's case he has been out on bond for three years. That is three years that CAN BE TAKEN OFF HIS SENTENCE. Here is the problem: JVD's attorney did not ask for home monitoring, therefor JVD was not on home monitoring, loosing the three years that can be taken off his sentence. This was THE FIRST OF MANY MISTAKES MADE BY HIS ATTORNEY! When this debacle is over with, I wish that the FOP are you listening Kevin, undertakes a serious independent Investigation as to how he got assigned to this incident. This incident was one of the most controversial police involved death in years. How could Herbert be assigned to defend JVD. Look at his record as a attorney, how many complicated cases has he handled in his career?? How many murder cases was he the lead attorney? Who was responsible for him being assign to this case? Who is Herbert's backers at FOP? Did any FOP member push for Herbert to be assigned to this case? When the city has heater cases, they hire outside attorneys. Why didn't they follow the cities lead. The JVD case should have been handled by a season attorney who has handled many murder cases. The FOP especially Kevin Graham failed JVD big time. Kevin are you listening. I think the membership of the FOP deserves better from it's leaders.

You're right. He CANNOT find him guilty of anything. He's already been found guilty. We're talking about sentencing now. Try to keep up.

Media wasn’t allowed in the courtroom today due to a “scheduling snafu.”

The liberal bloggers from the Tribune and Sun-Times who were tweeting live from the trial everyday must have been devastated.

Dan Herbert was assigned to defend JVD by disability Dean. Instead of hiring a top lawyer for a flat fee, Dino gave Herbert a blank check, with no cap on the amount he could be charged. Enquiring minds want to know why. I wouldn’t hire Herbert for a traffic ticket.

Inside sources say 12 year sentence. Won’t be doled out until after the holidays. He’ll have to serve 3 hard with day for day of last few years on monitoring and day for day on his 3 hard. Not too bad.
