- Cook County State's Attorney Kim Foxx recused herself from the investigation into the alleged attack into "Empire" actor Jussie Smollett.
First Assistant State's Attorney Joseph Magats will be the acting state's attorney for the matter, a spokesperson said in an emailed statement Tuesday. No further explanation was given as to why Foxx recused herself.
"Out of an abundance of caution, the decision to recuse herself was made to address potential questions of impartiality based upon familiarity with potential witnesses in the case," the spokesperson said in an email.
That's a pretty piss-poor excuse. Were there political fundraisers held with these "potential witnesses" or what? We'd say taxpayers are getting screwed paying for both unwarranted police overtime to investigate a fraud AND paying a States Attorney who can't do her job because of "conflicts."

I am a member of the LGBT community and I am outraged by Jussie Smollett as are many of my friends in the LGBT community (and virtually everyone else I have talked to of all backgrounds). As to Kim Foxx, her recusal is a shameful and outrageous act. She is only willing to use her power as State's Attorney when it serves her left winged social justice goals: emptying jails based upon race, vacating old convictions even when she admits the defendant committed the old crime, handing lawyers who sue the police and the city a boat load of new cases to file that they will use to pillage the taxpayers wallet (those same lawyers who give her big campaign donations), selectively choosing which laws she will enforce and which laws she will ignore and now being the newest and best example of someone who plays only identity politics. She likes to say that her administration is transparent. Simply put, by recusing herself, Kim Foxx has revealed that she is not willing to do the job that the voters entrusted her with and she is, therefore, not up to the job. She should resign and find something easier to do.

I don’t understand what she’s recusing herself from. There’s no pending prosecution. She would have to recuse herself to a tribunal (ie judge) and in which case, her office would be recused. If she’s got a conflict, the office to which she supervised and allocated resources is conflicted. They just make shit up.

You think they’re going to jeopardize promotions and their careers? Recusal was a way for Crimesha to shift blame to whatever poor sucker gets assigned this case. When her ASA says “there wasn’t enough to charge” or names some petty charge with probation as the only consequence (Juicy will NEVER pay back the money it has cost CPD to investigate this), Crimesha can now say “not my fault - blame the ASA who handled the case.”

And, reporters should be asking if this decision was approved or recommended by Prickwrinkle, putting this in it's proper mayoral election context.

I'm just a citizen and don't have college degrees or police training and even I knew that this guy was lying from the get go. How stupid was ANYBODY to believe that this could possibly happen in below zero temps, no bleach on his body or clothing at the ER, one small scratch on his face (he allegedly kicked and beaten....), still had his wallet and phone and his damn Subway, refused to turn his phone over to CPD and then only turned in redacted cell phone info. HOW MUCH MORE INFO would be needed to say he was lying and stupid? And where are the apologizes by all the asshole dems who claimed this was MODERN DAY LYNCHING? What world are these dems living in that this is the first thing that comes to mind??? This "lynching" took place days before the start of Black History Month right as Harris was trying to gain traction for her "anti-lynching" bill. (Gee, I thought murder was already illegal...) I think it seems a little far-fetched that Harris had any hand in getting him to orchestrate this farce, but it's not so utterly fantastic that it defies belief. The investigation, especially the federal one, might have some reach to it.
Maybe a brave reporter should ask... are you friends with the empire crew? Did they donate to your campaign?

The feds are the only law enforcement group that could successfully prosecute this case. Cook County Courts and the State's Attorney's Office are incapable of prosecuting this case.
Kudo's to the Detectives that worked this case. Outstanding work. Same for the ET's and Crime Lab. Recall when Mayor Rahm and the Superintendent had their pressers saying we will find these horrible people that did this crime. We believe the victim.
