FOP Demands Special Prosecutor

  • The labor union that represents Chicago’s beat cops is striking back at what it believes is a failure of Cook County State’s Attorney Kim Foxx to prosecute crimes committed against officers in the line of duty.

    Leaders of FOP Lodge #7 told Foxx in a letter this week that the union will file a motion for a special prosecutor “in each and every case where you refuse, drop, or diminish charges when our members are the victims.”

    Among the State’s Attorney’s decisions that the union said demonstrate “a disregard for the safety of police officers or an apparent hostility toward them” was a dismissal of charges against an HIV-positive individual who bit a cop at a demonstration; a reduction in charges from felony to misdemeanor for a driver who “recklessly crossed multiple lanes of traffic” to strike and kill an off-duty officer; and a failure to approve felony charges against a man who allegedly issued death threats against police officers, police families, and public officials during the trial of Jason Van Dyke, the former Chicago cop who was convicted of murdering Laquan McDonald.
And let's not forget the two officers at Marshall High School who suffered bites, a broken knee and being dragged down the stairs, and who are now being hung out to dry. There are plenty more examples - cops are not below the law simply because they are cops.

You can demand what you want but when it’s challenged by the states attorney you will be denied. If the FOP cites a dozen or so cases the state knocked down or didn’t follow through on they will put up thousands that they did prosecute over the past year. It’s hot air that will be shot down in a minite

Three counts of attempt murder, uuw by felon, psmv all reduced to psmv because they found (60)9mm shell casings in his car. They said we shot him too many times. I have a .40, my partner has a .45. We both shot less than 4 times each. He did a drive by earlier that day in his stolen car. All of this was covered in the case report. Offender is out already. I still have an open CR. Travesty of justice is an understatement. Let me know who to talk to and I am all in.

Police officers are held to a higher standard of accountability. Consequently, people who commit crimes against police officers should be punished to the fullest extent of the law. There have been other cities around the country that have had special prosecutors appointed due to animosity between local law enforcement and the assigned county states attorney office.

The judges that did these appointments felt there was a disconnect between law enforcement and prosecutors.


So where do we find these judges to assign this?
I for one am tired of the ASA office just hanging up on good arrests.
There is plenty of proof of this along with offenders being released to just go out and
commit further crimes. With no punishment.......

In addition to filing a motion for special prosecutor, file a complaint with the ARDC www.iardc.org to discipline her law license as well.

Is is anyone's guess what the ARDC will do on any individual complaint, but given the volume of Foxx's fuckups, if the complaints start pouring in (meaning multiple complaints on multiple incidents as well as multiple complaints on a single incident), eventually they will have to do something.

Even if she only catches a 6 month suspension, that would slow her shit down, and be a huge and well-deserved black eye to Toni "The Social-Marxist" Prickwrinkle.

I remember the state of justice, blindfolded, with the scales being equal. Equal justice, not what is being seen here. It's a pick & choose system clearly. Then after you get through that, then there's the Attorney General who also has the blinders off apparently.

If you think about it, it's like you go through a maze. Start at the top, avoid getting shot, wounded, written up, stabbed in the back, screwed over by the press, scored by others, see friends hurt, beat down, see families wrecked, have a former president, AG's hang you out to dry, go through more bs, and hopefully, hopefully get to the point where you can retire in good health and leave. (Possibly leave the state that screwed you, taxed you and berated you daily, and they wonder why.)

Too, yesterday (2-13) was the one year anniversary of the loss of your commander,
Paul R. Bauer. I am sorry for your loss, which I am sure has affected you all. Likely, I'm sure all remember where they were and what time this happened.
You really lost a good commander.

This is a good idea. And FOP should rep police in civil trials. Qualified immunity would have precluded liability for McDonald but the city opted to pay. If your name is in the case caption you have a right to contest the claim. Assume the city has ordinance similar to the County that compels indemnification.

You don't have to go on strike just follow the general orders to a tee. Review the general order on Processing Persons under department control. There are stated time constrains. If they can't be processed properly FOP reps should demand a CR number. FOP lawyers should file law suits.
Jam the system. Demand a override from the Merit shit in the pants watch commanders?
Demand CR numbers.

FOP leadership was elected by the rank and file for the purpose of representing the best interest of police officers in all respects. You need to be seen and heard regularly in every local media venue available in Chicago. Coming up for air once in awhile (e.g., coming up late for the Consent Degree, requesting a Special Prosecutor-all have or will be brushed aside - its the Chicago Way). You're not new to the Chicago Way. You know how things work around here.

If FOP leadership is not capable of launching an effective and sustainable positive pro-police campaign in this city then hire a PR firm. You have the money - use it. Right now FOP is an anemic annoyance to "clout city". Your media relations are weak at best. Rarely are anti police news articles effectually challenged, factually corrected, debunked or rebutted in a timely manner. The rank and file are smart and have some very good ideas. Leadership needs to listen to them and take positive and sustain actions. You have a large block of professional well educated men and women on the force. Marshal their resources and be more engaged.

The statute allows a special prosecutor only when a genuine conflict or disability exists, and that doesn’t include cases in which we or anybody disagree with the decisions or think she’s biased. About on the money with this as they were with their dumb intervention strategy in the consent decree case. Another waste of time and ink from the group which spends most of its time berating newspaper reporters and college professors. How productive.

Express your dis-satisfaction about local leadership directly to the FOP National Lodge. This is not a new problem. Other weak FOP Lodges that have bent their knee and alligence to their local politicians. With the right kind of national level support it can get better. They need to be aware of the lack of Lodge activity. All major cities administered by representatives from the previous administration are suffering the same high crime problems and lack of support. If collective barganing (FOP) is ineffective then look to another alternative - think union. For us and the city.

10:53, I’m not wrong about the statute, but nor do you want me to be wrong. It’s a high bar. If special prosecutors had to be appointed every time some goof or some advocacy group disagreed with how the CCSAO was handling something, we’d have chaos. That is how you can tell when a reaction is knee-jerk, not well thought out. It doesn’t account for what happens when the shoe is on the other foot. In JVD, Anita specifically said there was no conflict, but she yielded voluntarily to the demands for a special prosecutor because she got dumped in the primary and had lost credibility over the circumstances of the video’s release. The statute allowed the special prosecutor appointment because there was no prosecutor upon Anita recusing herself. In Vanecko, the CCSAO had an “actual conflict of interest” (those are the words used in the statute — that is the bar) because the court (disagree if you want) found that the handling of the earlier investigation was among what needed to be looked at, as in, did the CCSAO itself obstruct or interfere with the process, and that made CCSAO personnel witnesses. It was an actual conflict for CCSAO to investigate itself. We don’t want court-appointed special prosecutors brought in at the drop of a hat every time someone says the elected prosecutor is biased. Not an “actual conflict.”
