Sixteen Counts and a Cover Up

After causing sixty Northwestern Hospital employees to forget their HIPAA training over a made-up crime, Jussie now has some actual crimes to answer for:
  • A Cook County grand jury has formally indicted Jussie Smollett, heaping 16 felony counts of disorderly conduct on the “Empire” actor for allegedly staging a hoax hate-crime attack on himself in January.

    Smollett, who was arrested last month on a criminal complaint with a single count of disorderly conduct, will be arraigned on the new charges on Thursday.

    The indictment, which was made public on Friday, cites Smollett with disorderly conduct for each crime he said he had suffered, with separate counts related to statements he made the night of Jan. 29 to a police officer, and then for repeating the same account to a detective the same night. The charges all are Class 4 felonies, the lowest category of felony offense under Illinois law.
They're going to force a plea, one way or the other.

That's right, Smollett is the lowest class of felony offender.
The hospital used the computer system to track all employees
who signed on pertaining to Smollett's care. If they were not
directly involved, they had no business in his medical files.
For a patient who was treated and discharged under his own
power, no way 60 employees were directly involved. That
would be one hell of a hospital bill.
These hospital fools should have resorted to the verbal
grapevine, rather than logging on individually. Let this be
a lesson. Big Brother is active in every line of work and
the golden "ring the ship's bell" in HR is attrition.
I hope they fight this. No harm came to the patient. It's a
tragic cluster fuck that happened on the spur of the moment
over this POS.

No prior convictions means no prison time. Hell, even if he had prior convictions there is no way the state of Illinois would actually sentence him to prison for this.

On a side note I retired a year ago. I am curious with the JVD shit is charging for each individual shot a charge something that the ASAs are doing now? I always thought a shooting or battery charge was all part of the same act. I don't remember from the academy this even being an option. So if you get into a fight and punch someone 4 times they are now separate charges? Not being sarcastic here I just don't remember that being an option in regards to charging.

Unless of course it was you or your family member who was looked up. What if you found out that 60 hospital employees took a look at YOUR medical records for an I.O.D. after some kind of major incident that made the news. Then it went south and your personal information was out there in the hands of 60 people. You would then sing a different tune. If it doesn't apply to your job stay out of it. Now we find out that Jussie told the Detective that, allegedly, he and his two attackers rolled around on the ground while 'fighting'. Which makes his holding on to that dam sammich all the more laughable.

Annnnd now we find that he told the Detective that one of his attackers was definitely White! But thanks to the hard work of a dozen (or more) detectives who tracked down the two figures on that one surveillance video, we know they were BLACK -- and weren't really attackers but co-workers and 'friends' of his who were part of his phony 'Hate Crime'.

And that tidbit proves that what he told Robin Roberts in that ABC interview -- that the two figures on that tape were definitely the 'attackers' because, as Jussie said: 'He was there.' (f--kin' moron) -- was a pack of lies. And IMHO, that tape should be part of the prosecution's evidence against this asshole.

Bottom line, with 16 Felony Counts and a possible total of 48 years in the slammer, Plea Deal or not, there's No - Way - In - Hell!!.. that this jagoff should get off without serving some time behind bars.

Not after all the time and money wasted by the Police Dept, NOT after how he tried damaging Chicago's reputation even further -- Chicago's politicians do that all on their own, and NOT after he tried 'framing' every person who voted for President Trump and still support him as Racists and Homophobes.

So no, sorry, no excuses. Jussie's next 'acting role' will be an inmate in an Illinois State Prison.

I obviously don't know, but I suspect that many of the people who accessed his records were folks who where on his side and wanted to see if the CPD was lying.

They can fight it but I highly doubt they’ll be successful.

They can all consider it a bitter and costly lesson.


There’s been coppers fired for running plates that they didn’t have a legitimate reason to run.

That's ridiculous. HR departments terminate people reluctantly, thus progressive discipline, appeals process, etc. Arbitrary firings is a sure recipe for a union coming in, if not already in. And there are violations that even a union can't back. Turnover is expensive and retention of quality people is the goal.

I'm an ex hospital CFO and my wife is a health information (medical records) expert, and risk management executive. Every employee in that hospital received training at least annually on HIPAA and signed off that they understood that violation of HIPAA is a terminable offense. The liability to the hospital for breaches of patient confidentiality is potentially very high. There's just no excuse for voyeurism in medical records, no matter who the douche bag is.

Just a guess, based on the over the top press conferences designed to over sell this was all about per show salary, and the States Attorney trying to force a plea...

There is some evidence lying out there tying Senator Harris or Rep Schiff to the planned attack. Either directly, there are some joint events, or more likely through Jussie's sister. The timing of Harris's gay protection bill suggests her office may be involved.

Thanks for the information. And, I get it, but why do they even have access to the medical record of someone other than the people they personally treated or where they were not part of the treatment chain and/or regimen? It seems like a long-set mouse trap, but the newly-changed cheese proved to be irresistible.

Also, is zero-tolerance the past practice or were there times when others were not fired, but disciplined? If Smollett was a decent person, he would give all 60 written permission for viewing or having viewed his record.

It's most often just based on a need to know honor system but everyone with access knows there is an audit trail available that shows each employee who accessed a specific record using their log in. Many people may have a legitimate need to access someone's records besides the hands on treatment team - registration, coders for breaking down the patient care procedures and applying codes for billing purposes, for charge audits, those who have to access doctors' orders, for billing, for follow-up, for investigating patient complaints or lawsuits, etc.

The system my wife works on has the option of adding kind of a warning step on attractive nuisance records like Smollett's which requires the person accessing the record to "break the glass" to access it and that person not only knows that their access will be reviewed but they are required to record their reason for breaking the glass prior to entering. That feature might have made some of those 60 people think twice, but my wife commented that it shouldn't have been necessary since all records are supposed to be treated the same. It's that irresistible Pandora thing.

On the possibility of people receiving warnings previously, I don't know. I think the hospital fired those people to send a message internally and externally to mitigate the hospital's culpability if Smollett turns around and sues them - just a guess. Firing 60 people, if they did, is no small thing. Hiring and getting 60 people up to speed is going to take time and those who were not fired are going to have to pick up the slack until they fill those positions. My guess is those fired were from a variety of departments from registration on through.

This prick tried to light the fuse for a race war, but excellent police work discovered his story to be bullshit. He is too stupid to realize he is in a bad spot and his nuts are in a vise. He should have been begging for forgiveness and trying to make a deal when it was just the one charge, but no, he is not the least bit apologetic and is still professing his innocence. They are going to make him pay and rightly so. Pleading to one charge is no longer an option. Plus, he needed a local, savvy attorney to guide him and advise him about cutting to the chase instead of hiring some west coast glamour boy who involvement is over the phone or in television interviews from 2,000 miles away. Juicie is fucked and it is only going to get worse until he comes around to making things right.

Well said retired guy. The new breed would pinch their mother' for burning trash for an honorable mention. It appears they have zero communication skills and feel that all citizens are jag off'. I have had zero interaction with an on duty copper since retired over 5 yrs and know I can run red lights without getting stopped by these masters of the art of L E.
They get jammed u[ doing stupid and blame the department. No respect for chain of command and think they can just go speak to the commander cause the sgt called them out for staying on a job of cdtp for 2 hours. Us old fucks did the job and never called a sgt to a scene unless we popped somebody. The city cannot find a 21-to 31 year old that can be hired.

Mayor Rahm Emanuel’s failed legal battle to keep secret government-related emails and texts that he had sent and received on his personal accounts will cost taxpayers $1.18 million following a court ruling Friday.

The Emanuel administration’s outside lawyers already have billed the city nearly $800,000 to handle the mayor’s fight with the Chicago Tribune and others over access to his emails and texts messages.

Now, those costs have gone up further. Cook County Judge Anna M. Loftus ruled Friday that the city also has to pay the Tribune’s legal bills in the case — amounting to more than $387,000.

The open records law, known as the Freedom of Information Act, allows those who successfully sue a government agency to recover their legal costs.

Loftus agreed with the Tribune’s argument that the case against Emanuel was of “great public interest” and reiterated a prior finding that the mayor and his office had violated the state’s open records act. “Tribune was clearly the prevailing party in this case,” Loftus said as she announced her ruling from the bench.

Loftus' decision is the latest setback for Emanuel in his years long battle with the Tribune over the public’s right to see emails and texts about public business that reside on government officials’ personal, electronic accounts.

Another judge, who has since retired, earlier found that Emanuel and his office violated state law by withholding emails about public business that resided on his personal accounts. That judge sided with the Tribune when she found the public records law does not distinguish between official and personal accounts so long as the matter relates to government business....

The Tribune previously reported that the Emanuel administration paid out more than $670,000 in 2016 in other lawsuits that alleged government workers repeatedly violated the Illinois open records law. That was nearly five times what the city paid in the previous eight years combined. Those lawsuits were brought by taxpayers, advocacy groups and news organizations.

In seeking its lawyer fees in its case, the Tribune argued Emanuel and the mayor’s office violated state law by withholding public records for 1½ years. Lawyers who worked on the case for the Tribune reduced their standard fees, adding that what they were seeking in reimbursement for over three years’ worth of work was more than reasonable.

“There is no question Tribune prevailed in this action, and decisively so, in the face of an opponent that, determined not to comply with what the law requires, deployed a combative litigation strategy asserting every possible legal challenge and refusing to accept the court’s conclusion that defendants were wrong on the law,” the Tribune’s attorneys argued in a court filing.

The Emanuel administration has already been billed $793,393.73 from the city’s outside lawyers through the end of 2018 for the Tribune and BGA cases. With the Tribune’s fees, that brings the total bill to $1,180,788.23.

That amount will only grow. The city has not received legal bills from its outside lawyers for work done so far this year.

The city has not decided whether it will appeal Loftus’ ruling. “We are disappointed in the ruling and are evaluating our options,” said Emanuel’s spokeswoman, Shannon Breymaier.


The mayor’s office refused to search for any emails or texts pertaining to city business from Emanuel’s personal cellphones or his non-city accounts.

The Tribune sued in September 2015, arguing that Emanuel and his office violated the open records act and the Local Records Act relating to the preservation of government documents, including emails and texts.

I don't know who's more corrupt. Rahm Emanuel or the Chicago Tribune.

The NYT reporter should be criminally charged. The reporter broke the law and superseded the duties and acts of a reporter. The reporter became an de facto investigator and submitted knowingly false evidence to a law enforcement agency.

On a side note I retired a year ago. I am curious with the JVD shit is charging for each individual shot a charge something that the ASAs are doing now? I always thought a shooting or battery charge was all part of the same act. I don't remember from the academy this even being an option. So if you get into a fight and punch someone 4 times they are now separate charges? Not being sarcastic here I just don't remember that being an option in regards to charging.

You’re correct. Prior to the railroad job on JVD I had never, ever in 31 years seen someone charged with Agg Batt for every shot fired.
It was racial, political bullshit that caused that to happen.
