This is Legal?

If you have less than fifteen years, your seniority just went down by one:
  • Remember the [recruit] in the academy in 2017 with the cane? She broke her ankle in the academy in 03, sat on payroll for 14 years because she “fell thru the cracks”. Was told in 2017 to come back or she’s gone. She came back, but zero PT because she’s allegedly “disabled.”

    They fired her. She sued.

    Guess who won their suit and is supposed to be in the next class? Along with her 15 years seniority? And yes, she’s still supposedly disabled.
So now we're going to hire a fourteen-year medical abuser, who can't/won't do physical training, give them permission to carry a gun that will never see street time?

Oh, and she's five years from a pension. Brilliant.

Only this silly ass Dept would take it up the ass like that for obvious scammer. I don’t understand can’t you as a ppo get fired for whatever reason. Dept doesn’t even have to give you one as long as they didn’t violate Equal Opportunity Employment rights. Well part of the condition of becoming a police officer is that you fully complete the prerequisite training. Injury or no injury. How did she get away with it the first time? Did she claim it was the academy’s fault she injured her ankle? Did the clout baby inept instructors force her to do something stupid? Did the dept fold and eat it up just like the rabdo bullshit. This whole dept needs a serious enema and complete overhaul. And the change needed doesn’t start with Merit command staff morons demanding ISRs and blue cards for Compstat.

So, who dropped the ball on this one? Was she on the payroll or disability? Did she ever report to the Medical Section after her 365 days were up? I mean she had to be going regularly and she had to know it was expected.
Someone had to continue to mark her present for duty on the A&A's in order for her to continue to get paid.
Or did no one mark her, yet her name just appeared and Finance kept paying her?
Whose got the real answers?

As I understand it...after 18 months she wasn't a PPO anymore since she wasn't fired from the academy before the Injury.

14 years Time as a employee of the Chicago Police Department later...they should have stuck her ass into a Non-Sworn position because "You can't physically pass the PT, but we can't fire you because you were legitimately injured. Go be a House Mouse Desk Dolly in 015."

Here I am 27 years on the job 27 years working the streets in the district with almost no comp time on the books, because youz know when you work in the districts your whole career and you want a day off you actually have to use your time (SPECIALIZED UNITS). Anyway I’m disgusted with this! This is bullshit! The working man is a SUCKA!

I pulled a muscle at the academy and asked if I could work out in the gym with weights instead of doing the run. The assholes at the academy told me I either run or quit. I ran and faster than a lot of my classmates that day. Wish I had taken down their names so I could party at their graves someday.

I give her and her attorney credit for winning the lawsuit though. She shouldn’t be treated differently then any other officer hurt on the job. Usually have to take a disability pension.
So now precedent has been set for many others also......

I worked with a copper from 024 once on special. He told me they have their own on 2nd watch. Female P.O. who can't work the streets because of "arthritis" in her hands. Can't grip anything. So she's found a spot inside. Yet, she was allowed special employment.

On the other hand, if this person could get into the weeds of all the rules and regulations to find the tiniest, obscure 'loop-hole', to where she can legally pull this off for all these years then she has to be a certified genius, a MENSA member, and is obviously smarter than every current person wearing Gold Braid and should be seriously considered for Police Superintendent by new mayor, Lightfoot.

We had some infamous people that spent a decade on disability. Or longer. I retired and they re still gaming the system. A good , friendly family doctor.. is as good as a great iawyer. Don’t you get 1year disability for 4 years service? Then, you get regular disability? I knew people that were certified disabled once a year for years?

and ya, she has paid into the pension, but disability in Chicago is paid via the pension funds, correct? Most depts. don't do this they pay disability out of a separate fund

No precedent has been set. Each case is desided on its own merit. How many other young healthy officers are in insides spots and have been in the spots since they came out of the academy. Look in any district or unit

And your point is? Has it occurred to you that the video might have been brought to the attention of the pension board and that’s why she had her duty disability terminated and told to report to the academy for reinstatement. Read your monthly pension board minutes. Happens every month

Had to go thru the pension board. Doubt you could be carried on the medical for 14 years. Timekeeper, unit of assignment would have caught on

I take it you are not an officer or you would know that answer. Officers do not work under workermans comp rules. They do not get settlements for injuries sustained in the line of duty

I was with her in the academy on her second attempt after her injury ‘healed’. Couldn't qualify with her firearm or pass the run. Got pregnant by some tact guy in 12 and washed out.

If you really "worked" the streets for 27 yrs and you have no comp time on the job;

A. Never really worked while you were assigned to the street.

B. Took a shitload of time off.

Not true, your thinking is wrong. Example would be an officer with say 9 years on the job gets shot several times resulting in paralysis he’s 40 with 9 years on and will never be able to return active duty. With your logic with him not getting pension credit, he could never retire and get a pension. He would never have more than 9 years pension credit

There is or was a woman on the job by the initials LR that was on the medical for over 20 years and the pension board finally voted her back to work. During the 20 or more years on the medical she went through 3 CPD husbands. Nice.

There is someone currently pushing the pension boards buttons right now on behalf of all of us by uncovering all sorts of shenanigans that the board is doing with our money. One of which is that the city is supposed to pay the officer's disability salary (any i.o.d./duty-related injury that caused that officer unable to work and go on duty disability). But that money has been coming out of our pension. Why isn't the city paying for that?

Leroy Ladendorf came out of the academy in 88 with over 20 years seniority because he won a lawsuit against the city. As soon as he was off probation he bid for 016 and got it.

It isn't just Chicago. In a similar case in LA injured recruits won a $12 million dollar suit, that was reduced on appeal

"The most important impact of the Atkins case is the finding that FEHA potentially applies to a police recruit that is injured while still in the Academy. If an agency has created or maintains policies or practices under which injured recruits are permanently or indefinitely accommodated it could lead to significant liability exposure. My question is this: How does one get IOD when you're not even a sworn officer? How can someone without a star be "in the performance of their duty"


I don't care if she was jogging in the academy when she hurt her ankle or not - she was not performing a police duty.


And for all those guys that still thing just because you got hurt while on the clock that you get an IOD - you've got another thing coming. NOT TRUE.

Do you really believe that the pension board is paying for the duty disability pensions when the city is supposed to be paying. It’s no secret who is paying. The pension act dictates who is required to pay
No one else has discovered this over the last 50 years.
I’m sure glad this someone has made this discovery and that for all these years the pension board hasn’t had to produce an annual report and be audited.

In a competently run Organization, this would never have happened. The Taxpayers are the ones stuck paying for this mess all these years, so the Leadership responsible for this waste of Taxpayer Dollars should be made to pay back the wasted money to the Taxpayers, then all involved should be terminated.
It is way past time for actual full responsibility by ALL in Leadership positions
