Special Prosecutor

  • A Cook County judge on Friday ordered the surprise appointment of a special prosecutor to investigate the sudden dismissal of all charges against Jussie Smollett, saying the short-lived prosecution may have been legally invalid from the beginning.

    Judge Michael Toomin ruled that State’s Attorney Kim Foxx had the right to withdraw herself from overseeing the prosecution of the onetime “Empire” actor but held no legal authority to then delegate that responsibility to her top deputy.

    With the deputy holding no real authority, the Smollett case made its way through the court system without a prosecutor at the helm, the veteran judge said.

    “There was no master on the bridge to guide the ship as it floundered through uncharted waters, and it ultimately lost its bearings,” Toomin wrote in the 21-page opinion. “… The unprecedented irregularities identified in this case warrants the appointment of independent counsel to restore the public’s confidence in the integrity of our criminal justice system.”
Some high powered legal minds think this is an entire "do over" for the case since there was no actual States Attorney in charge except the one who had "recused" herself. That means a Grand Jury and charges. And this time, there better be a "guilty" plea to negate the inevitable lawsuit over "The police are picking on me" lawsuit that is sure to come.

This really ought to be before the ARDC for possible disbarment of Crimesha and before the County Board for removal from office.

Smollet goes all the way back to the Obamas. Jussie is personal friend of Michelle and Michelle's Chief of Staff, attorney Tina Tchen -who served as Assistant to President Barack Obama; Chief of Staff to First Lady Michelle Obama and served on Board of Chicago Bar assoc interviened personally on behalf of Jussie to Kimm Foxx to drop charges. Many photos exist of Jussie and michelle together. Jussie is also pals with Kamala Harris, who was introducing Anti-Lynching Bill with Corey Booker when Jussie committed his crime spree. Booker and Harris are Presidential candidates for the Democratic Party.

Kim Foxx recieved $400k for her election from George Soros and his Restorative Justice initiative to place disgruntled racist District Attorney's in Office in majot cities. Kim Foxx was awarded with a walk on the Red Carpet at the Oscars for her role in aborting Justice. The same George Soros also partnered with Mastercard to fund the wave of Illegal immigration that are currently overwhelming Public budgets with free housing, healthcare, education and food.

The stakes of the Jussie Smollet retrial could not have larger implications for some very big Players. If enough pressure is applied to the obviously dim Smollet, he may just crack and name his handlers; we can only hope.

Crimesha gets burned by her former ethics officer:

After questions were raised within the office about the legitimacy of Foxx’s recusal from the Smollett case, Perry revealed in her statement Friday, she advised Joseph Magats, Foxx’s first assistant who had been named by Foxx to head up the Smollett prosecution after her recusal, to seek a special prosecutor.

But Magats told her that Foxx had decided a special prosecutor should not be sought, Perry said.

“It is a Chief Ethics Officer’s job to provide the best advice and guidance possible based upon the facts given to her at the time," Perry’s emailed statement said. “Sometimes that advice is followed, sometimes it is not.”

Well here we go....after the Smollett case, Foxx goes on National TV and says that this case was no different than others in that he was treated the same way that "OTHER" cases were done in the same manner...SO, if the judge finds that Foxx did not handle this case appropriately and a special prosecutor now needs to go in and clean up her mess...Perhaps her office needs to be investigated and find out just how many other cases were treated unprofessionally and covered up. The judge slams FOXX in how she handled the case all wrong but yet no repercussion?

Damn straight this whole thing should be before the ARDC. Another poster out there stated that there was complaint filed with the ARDC, then we never heard from him again. Where ya been, my friend?

FWIW, the ARDC does not move at light speed. Probably took them a couple weeks to digest the initial complaint. Then, they would send a copy of the complaint out to Crimesha for her response, and probably give her 2-4 weeks to respond.

This case had the stank of Cook County all over it from the get-go and it included the dismal decision making and interference of Jugghaid SpecialEd.
Remember, he had to be told how to respond and I wouldn’t be surprised he was advised to cease the investigation somewhere in between.

Disbarring KmmmFxxxUp is a start, but will likely be spared unless there’s another Cook Co town that can use a corrupt politician w/o any credible law or integrity background.
2020 will be interesting to watch the dismantling of the Prickwrinkle Inc empire.

Excuse me but don't everyone get excited over this. The key to Judge Tumem's naming a special prosecutor is this: WHO WILL BE THE SPECIAL PROSECUTOR? Will it be someone who will not be influence by the Democratic Party or will it be a democratic insider who will sweep it under the rug. If he names a person who is truly independent from the Democratic Party then it should be interesting. If he names a political hack then it is a waist of time and Kimmy gets to go on and run for Durbin's senate seat.

That likely won't help Magats, since he signed off on the illegal deal, and sandbagged the Judge into approving it. Wearing a (Fed) wire doesn't necessarily save you from State criminal charges for Official Misconduct and being an accessory to Foxx's misconduct. Once he had audio of Foxx's misconduct, he should have headed for the nearest emergency exit. Moreover, Magats had a legal duty as an attorney to report Foxx's misconduct to the ARDC; time will tell if that ever happened. I'm not betting on it.

That would let us all know that there is a god in heaven. I’m not getting my hopes up though, I do not know who would want the headache. He is a sitting judge, not a bad spot out in Skokie, with a different pension. Although he has county and state time built up. It will be interesting to see if this rumor is true. To everyone reading, the Honorable Judge Michael Hood is a fair, compassionate, and has great integrity. It does not matter what side of the law you fall on, Judge Hood is fair. One can only hope.
