Kass

  • In the Chicago Police Department’s Eddie Johnson soap opera — you might call it “Days of Our Lives with Guns” — you probably have some questions.

    Who made the 911 call telling police that a car was stopped on the street, motor running, with (now fired) police chief Eddie Johnson passed out after a night of drinking with a woman not his wife? Was it one of those hell hath no fury phone calls? Or was it merely some concerned Josephine Citizen worried about a man asleep at the wheel?

    And what happens now to the other cops, the responding officers, the watch commander and the commander, and their supervisors, since Johnson was allowed to just drive home without being administered a breathalyzer test? All should become clear in the report of Inspector General Joe Ferguson.
Well, don't count on that John. Fergie sold his soul for a bigger budget and more personnel by covering up the cheating exam scandal.
  • As we reporters peel the onion of the Eddie Johnson soap opera, detangling this woman from that one and this friend from the other one, and figuring out who got a promotion and who didn’t, and how many of the other police bosses in Johnson’s command clique also promoted their own favorites, one thing is becoming clear.

    If Lightfoot truly wants to change police culture, she must examine the poison pith at the center of the plum:

    The merit promotions mess. And that’s no soap opera.

    The question we all might want to ask is how many chiefs and deputy chiefs in the Chicago Police Department ever passed the lieutenant’s exam? Is it more than one?
We'll save you some time John. It's all of them. There isn't a single Chief or Deputy left (after this weeks retirements) who passed a test high enough to get promoted with (A) "merit" or (B) getting the answers at a Gene Wiliams-type study group, where you study the test with Subject Matter Experts who constructed the test.

Lost all respect for RINO Kass when he kisses Dart ass on his low rated show about the great botanical jail garden and pizza parties. Can somebody shed light on the 6 month Wonder Woman who was sent by Eddie to run a DEATask Force team with no experience as a Sgt. EDDIE SHOULD HAVE BEEN FIRED FOR THAT STUPID MOVE. She does not deserve to be in DEA nothing with all her bad luggage, dope dealing boyfriends, lost her gun twice. Come on really, send her back to 007 so she can finish her Sergeants training

Someone needs to FOIA Ald Tunney’s annual budget hearing questions. The ones he submits in writing. It’s obvious he has input from blue shirts. Here is two questions he asked in 2018 about merit promotions and the answers he received. The answers say it all about Fathead Ed’s attitude about merit promotions.

• I've been told that one of the biggest issues within the CPD that contributes to these lawsuits and settlements is merit promotions resulting in individuals managing patrol officers who are not qualified to do so. What are the criteria for merit promotions? Who determines who receives a meritorious promotion?

​Such statements are most often expressed by officers who have personal issues with a specific supervisor, or perhaps are upset at not being promoted. That said, CPD takes the merit promotion process very seriously and has specific procedures that must be followed. These are governed by our directives, including E05-05 Career Service Rank Promotional Process and E05-04 Merit Board. The superintendent has the power and duty to make all appointments and promotions within the Department.

• I can understand that some individuals don't test well, but I am told that there are individuals who have been given two or three merit promotions. Have you considered limiting merit promotions to one for the duration of an officer's career?

​That might produce its own problems and complications, but any way that might increase confidence in the merit system should be looked at.

This year he asked this, but we haven’t answered him yet. He beat Kass to that question by a month:

There has always been different methods of cheating on promotional exams. It only got worse once the merit system was created. In the beginning on the very first list, the supt listed the names of the merit promotees. Well that caused a ruckus amongst cops who didn't make the list, as it was well known all the merit promotees were clout heavy. Immediately the superintendent ensured all future promotion lists did not indicate who was meritoriously promoted. It became a secret for many years.

There was a detective test given in 1991 or so. The second part was at Curie High School. You were given a incident and had to explain how and why you would investigate it to 3 sergeants in a closed door room. The Personnel sergeants running the exam would hand you a list of all the sergeants conducting these interviews, and they asked if you had a problem with any of them. It gave the illusion that they were trying to help you by not putting you in front of your enemy who would probably give you a bad rating. But it really was for cops to say "put me in front of sergeant so and so", to which they did. You could have gone in that closed door room and talked about baseball and walked away with the highest rating.

That same year I was aware of Townsend providing the Personnel Sergeants running the exam that day a list of cops whose names were "red flagged", meaning they were all to receive high ratings.

I know of many cops who were given the test and answers by their exempt clout, so they could memorize it before the official test date. The smart cops kept the test and answers to themselves and only shared the truth later in life. Dumb cops like phattys son shared the test and answers that daddy gave him with his entire tact team. Although it certainly didn't hurt phattys career or his son, who obviously daddy knew wasn't smart enough to pass a test on his own. Let it be known that phattys son got smarter and did not share the lieutenant test and answers that daddy gave him with anyone. Phatty was livid when he got wind of what his dumb son did the first time.

Phatty did share the test and answers with his office staff, not just family, equal opportunity. The useless party girl now boss of a district is one example.

We’ve all been screaming this for many years....merit promotions are the most corrupt and unfair system EVER! It’s a cancer for morale. It’s friends promoting friends and they return the favor over and over. It’s sick! Lightfoot should demote every single exempt that didn’t pass any of the tests. The damage merit has done will be very hard to repair.

Soooo true. Merit "poisoned" the department. Merit should be 5% at the most.
If most of the exempt can't score well enough on a test to get promoted.....why are we taking test ?
The "bad test taker" scenario doesn't fly. Aren't the majority of people "bad test takers" ?????? That's why they're called "test" , that's why you study your ass off. Try putting in the time and work studying and you'll get the results.

Fire Dept. currently promoting 20 Chiefs that can’t pass a written/oral promotional exam unless they’re given a copy of the test & inflated scores. They needed to ‘re-math’ all the failures to get them above a passing grade.

Scored in the top 10 on my Lt Test and was in the first class, almost every merit LT in that class became exempts. The top 10 scorers hit a dead end. I guess that's what happens when you work for a department that is just an employment agency for the clouted, and you have no clout.

Command personnel having illicit affairs with police women is nothing new. I do know of one past superintendent who had his driver as his girlfriend and when he retired and went on to head security at the State of Illinois Building, brought her along and gave her a great job. Many district commanders and others have engaged in this conduct, many openly. Manyh of the participants were married at the time. It was disgusting, but no one could do anything about this. Now with the merit promotions it seems much of this bad behavior leads to promotions. This is improper conduct and in private industry would get a person fired. It seems in the police department adultery leads to promotion and great assignments. It is time this conduct is codified within ethical guidelines of the department and leads to demotion.

Eddie Johnson is African American. He didn’t create the system. It was created by the old white Irish power structure, where racism and political tribalism reigned.
Whites were promoted. The Outfit made their cops. And black and brown patrol officers won promotion if they were connected to a Democratic ward organization with leverage at City Hall.

I seriously doubt that the merit promotion system will ever go away. The horses are out of the barn and the political class loves the power of the patronage. But, I should think that the process be taken out of the hands of the city and given to an independent board, possibly at the University of Illinois or some such institution. Maybe a board of suburban police officials or the Illinois Police Chiefs Association. The certification process was intended to take promotions out of the political class, but that does not seem to be working.

And if you remember, the written part of that test was "race normed." If you were white, you needed a 90% to go to Part 2. Hispanics were in the low 80's and black was 70%. Partner got a 91% and went to part 2, I got 89% and was a no-go for Pt. 2. Next test for Dic in '94 was actually a straight test administered by Arthur Andersen. That Sgt's test also. But when the first 3 Sgt classes were overwhelmingly white, Daley shit and took down the list.

Seems like limiting merit promotions to a one time opportunity, similar to the way veteran’s preference points used to be limited for promotions, would go a long way toward somewhat legitimizing the process and greatly improving morale.

Let’s see, you pay big money for an accounting firm to come up with a tests for promotions. Then when the “right” people don’t score well you say “some people just don’t test well” and then you promote people from the back of the list. I think universally that the people who don’t score well are the people who just don’t know the test material.
Why is it that no other profession puts people in service by merit after they fail a test? What about the people who don’t test well in the medical professions? How about the aviation industry? How about the engineering professions? How about federal law enforcement?

Sgt Janelle had her weapon borrowed by a “friend” years ago. She didn’t even report it missing / stolen for days after. The interesting part is that weapon was used in a crime out south. The weapon was recovered. It was SUPPOSED to be tested. That was BEFORE Eddie Johnson intervenes. Weapon was returned without being tested. That weapon was USED in a crime by someone she knows who borrowed it from Sgt Janelle. Also Sgt Janelle was MERIT SGT by Eddie by using ROBIN ROBINSON. After a whole 10 months as a 007 Sgt (school Sgt 2nd watch) EDDIE made a call and had Sgt Janelle moved into the Task force spot. Didn’t even do a day on the floor in 189 as a Sgt. Guess her war stories about buying “weed” from juveniles have proven how much knowledge she has. FU Eddie. Take this side piece away with the others.

certain info out there in the public realm.......almost all of MSM is owned/controlled by big money liberal Democrats who
are striving for that NWO here......"We are in control, you will see what we want you to see, and hear only what we want you to
hear".....that's why there is barely a mention of what is truly going on in this here city regarding crime, who is committing it,
and the behind the scenes politics of it all.
But you just know that the top CPD echelon is not just dumb as a box of rocks, with no management skills or the educational
knowledge of our rules/regulations (having to go down 2000 spots on a promotional list to "merit promote" should be a clue)-

Ah, yes, Steve Bartman, one of the greatest scapegoats in the history of man. Cubs fans didn't have a black cat or a goat so they had Bartman. 3-0 Cubs in 8th when Bartman did what any fan would do (and others there did too)...try to catch a foul ball. Final score 8-3 Marlins. At least Kass gave a sincere apology for his actions in writing and in a video. After the Cubs did hang a World Series banner they should have comped Bartman for the rest of his life.

So Tribune & Sun paywalls allow a limited number of articles for which they I believe track with browser cookies. I get around these paywalls by switching browsers so instead of Chrome for example switch between Opera, Cake, Safari, etc.

Or use say Firefox and go into settings/privacy/ click "cookies" and check "disabled"; also tap on "clear private data on exit" and check "cookies and logins."

Then use your regular browser for normal browsing where you want sites to recognize you for automatic logins.

The body cam video showed officers asking for identification, apparently not realizing it was the city’s top cop behind the wheel.

The source said Johnson then showed the officers his wallet, which included his police credentials visible.

They asked him if he needed help and the superintendent said no. The officers stepped back and Johnson drove off.

There has always been different methods of cheating on promotional exams. It only got worse once the merit system was created. In the beginning on the very first list, the supt listed the names of the merit promotees. Well that caused a ruckus amongst cops who didn't make the list, as it was well known all the merit promotees were clout heavy. Immediately the superintendent ensured all future promotion lists did not indicate who was meritoriously promoted. It became a secret for many years.

There was a detective test given in 1991 or so. The second part was at Curie High School. You were given a incident and had to explain how and why you would investigate it to 3 sergeants in a closed door room. The Personnel sergeants running the exam would hand you a list of all the sergeants conducting these interviews, and they asked if you had a problem with any of them. It gave the illusion that they were trying to help you by not putting you in front of your enemy who would probably give you a bad rating. But it really was for cops to say "put me in front of sergeant so and so", to which they did. You could have gone in that closed door room and talked about baseball and walked away with the highest rating.

That same year I was aware of Townsend providing the Personnel Sergeants running the exam that day a list of cops whose names were "red flagged", meaning they were all to receive high ratings.

I know of many cops who were given the test and answers by their exempt clout, so they could memorize it before the official test date. The smart cops kept the test and answers to themselves and only shared the truth later in life. Dumb cops like phattys son shared the test and answers that daddy gave him with his entire tact team. Although it certainly didn't hurt phattys career or his son, who obviously daddy knew wasn't smart enough to pass a test on his own. Let it be known that phattys son got smarter and did not share the lieutenant test and answers that daddy gave him with anyone. Phatty was livid when he got wind of what his dumb son did the first time.

Phatty did share the test and answers with his office staff, not just family, equal opportunity. The useless party girl now boss of a district is one example.

Command personnel having illicit affairs with police women is nothing new. I do know of one past superintendent who had his driver as his girlfriend and when he retired and went on to head security at the State of Illinois Building, brought her along and gave her a great job. Many district commanders and others have engaged in this conduct, many openly. Manyh of the participants were married at the time. It was disgusting, but no one could do anything about this. Now with the merit promotions it seems much of this bad behavior leads to promotions. This is improper conduct and in private industry would get a person fired. It seems in the police department adultery leads to promotion and great assignments. It is time this conduct is codified within ethical guidelines of the department and leads to demotion.

I just wanted to leave a word with who ever had the final call with Kidney Bean in his car. Regardless of a reporter saying Mr Bean should have been given a “breathalyzer,” a preliminary breath test is only allowed after an officer has established reasonable suspicion that the driver may be under the influence. This requirement is set by state law, 625 ILCS 5/11-501.5 in the Illinois Vehicle Code. This law was put in place to keep officers from unjustly having motorists submit to a PBT randomly and without reason.

The odor of alcohol on someone’s breath alone isn’t enough to establish reasonable suspicion of DUI. There must be other signs of the driver being under the influence (People v Boomer 2001). An officer can’t quantify a level of intoxication based upon the strength of alcohol on someone’s breath (People v Mckown 2010).

The officer cannot force a civilian to conduct field sobriety tests. There’s no ticket or arrest charge for refusing. The officer has to decide if there is enough evidence to arrest (beyond just an odor of alcoholic beverage on breath), or allow the person to drive.

A police officer, or in this case a Chief, could be forced to submit to testing as part of an internal investigation of a policy violation. But the result of those tests wouldn’t be admissible in a criminal case based on the officers Garrity rights. You could have the Chief absolutely nailed with a slam dunk policy violation, but you’ll never get a license suspension or DUI conviction with that same evidence. And does Chicago policy allow for a patrol officer to conduct an internal investigation of policy violations on another officer, let alone the Chief of Police? Would another internal investigator have to be ordered to the scene? Does the Chief have to stay on scene for the internal?

There was no alleged traffic violation. The Chief allegedly gave a reason for his drowsy state. Without reasonable, articulable suspicion of DUI beyond the odor of alcohol, and the driver having been identified, there would be no reasonable suspicion to allow further detaining the individual without a civil rights violation occurring.

There are 2 Compelling Government Interests that are recognized to allow such a process. 1. Diversity ( a facially neutral system with a disparate impact would have to pass through a burden-shifting analysis, that the CPD merit system would not survive) 2. Remedial action to cure past discrimination. Either one must be so narrowly tailored
to pass the most Strict Scrutiny. The means must perfectly fit the ends and if there is any other way to achieve the Compelling Government Interest, the merit system will fail Strict Scrutiny. It is very likely that the current system is Unconstitutional and would fail a Strict Scrutiny analysis. But it is also true that an Illinois court would screw that analysis up and go the wrong way. Any challenge would have to go up the appellate ladder.

everyone takes part one of the promotional examination. The passing score is usually set pretty low, and it has been as low as 40% in past exams. Then if you pass, and everybody usually does, you go on to part 2 which is much harder. The merit promotees do not have to take part 2 and most do not. I have had people brag that they will be a merit promotion and actually walked out of the exam room. I also know people who came back from a eave of absence, often for more then a year, to make a merit promotion. Yes, the system is rigged. It is rife with corruption and cronyism. Then you have high ranking command staff who are considered " subject matter experts" who help write the exam. I find that pretty funny and ironic since these " subject matter experts" never scored on an actual examination of job related topics. Then somehow these " experts" help coach the insiders for the upcoming examination. And, you wonder why the honest hard working rank and file are pessimistic and cynical and disgusted? The deck is stacked against them. These multiple merit promotees run the department. Funny how that works

no wrong most current (as of last week) exempts did not pass the Lt.s test and please do tell where the answer fairy is. 90 percent that made it off the list legit are still Lt.s........ The merits got the spots right away and /or made exempt. Simple run their names in the scc blog search box and compare. To demonstrate a prima facie case of disparate impact per Title VII (Affirmative Action) of the Civil Rights Act of 1965, one has to show the less dominant race was promoted (or hired) at less than 4/5, or 80%, of the ratio of the more dominant race. If 5 out of 10 whites are promoted, that’s 50%. 50% x 80% = 40%. So if less that 40% of blacks gets promoted, they have established a prima facie case of disparate impact. Now they can sue, but that doesn’t mean they’ll win that just gets them in the door.

The City can fight any racial ratio if they can prove the test (promotional/entrance exam) predicts job performance. This must be done by the test designer. This was done in Wash. v. Davis, 426 U.S. 229 (1976) where SCOTUS upheld the racial results. Chicago no longer even tries to do this. Now, they set the bar super low and just use the last number of your social sec# for hiring, all the while balancing the racial make up so no one is hired at less than the 4/5 ratio. Poof – no lawsuit. Remember when the entrance exam categorized you as: Well-qualified, qualified, and some third category (I forgot what they called it)? In that scenario the city had to defend the predictive power of the exam. Here's a case where merit was fought but the case didn't survive.

Barnhill v. City of Chicago, 142 F. Supp. 2d 948 (2001)
• P’s alleged racial discrimination due to the fact that the 1998 Sgt’s test included 30% merit.
• This is both an EP claim and a title VII violation claim. With regard to the EP claim, the court said P’s failed to show discriminatory intent. With regards to Title VII claim, the court said P’s failed to showed disparate impact on white males.

You completely lost it all by you last sentence. Are you aware the top of the appellate ladder is the Illinois Supreme Court headed by Justice Burke. Need I say more. I’m sure you are also aware that the CPD retirees filed suit regarding healthcare being guaranteed in the state constitution. Well the state employees had filed a suit in 2014 using the same arguments and basically mirroring the retirees case. Illinois Supreme Court ruled in their favor so how could the CPD retirees lose once they went up the appellate ladder and ended up at the Supreme Court who rules for the state employees. They can’t contradict their previous ruling
Guess what they did? Refused to hear the case, with no comment
My point is don’t count on anything going up the ladder

It would go up the ladder in the federal courts, not the state courts- based on the Civil Rights Act of 1965 Title VII. But Merit has already stood up to strict scrutiny in the federal district court - that's a trial level court I beleive - I don't know that the case has been appealed. The case is Barnhill v. City of Chicago, 142 F. Supp. 2d 948 (2001)

Burke was the sole vote stating Illinois could change the police pension remember that? The rest of the justices said it would violate the Illinois constitution. This was sometime around 2014.
