Opening the State Constitution?

This is the first we're hearing of this and it needs thorough researching and verification. Opening the State Constitution via a back door method which would end up screwing up all current and future pensioners:
  • When FOP Board Members like Donahue, continue to support their progressive political pets, like Senator Rob Martwick, they are supporting opening the Illinois Constitution. Opening the Illinois Constitution will allow these progressive politicians to change the state’s pension clause.

    The FOP has continually claimed politicians like Martwick and Madigan are fighting to protect or pensions and that’s what makes them “qualified” to be recommended by our Union. Donahue has thrown 10’s of thousands of dollars of our dues, at Martwick and Madigan to “protect our pensions.”

    The interesting part of this is, politicians like Martwick and Madigan have been pushing the Graduated Income Tax or also known as the Progressive Tax , since 2016. If the Graduated Income Tax passes, the Illinois State Constitution will be opened up so the wording can be amended to change the flat tax to a progressive tax. What Donahue isn’t telling the members is that while the Sate Constitution is open, to amend the tax clause, it will also be open to change the state’s pension clause. That piece of paper that states, “Membership in any pension or retirement system of the State, any unit of local government or school district, or any agency or instrumentality thereof, shall be an enforceable contractual relationship, the benefits of which shall not be diminished or impaired,” is all that’s standing in the way of politicians, like Martwick, from completely gutting our pensions.

    Once they get their Graduated Income Tax passed, they can use that as a back door to change our pension clause to diminish or impair our pensions. So Donahue is supporting a politician who is not interested in protecting our pensions, but is pushing to open a door for them to walk right in an take it.
So they can use the Graduated Income Tax as a crowbar to amend the Constitution to comply with the new passed law? If we're understanding this, it would circumvent the Constitutional Convention vote that is required to be held every 20 years and endanger all pensions immediately.

We have stated before, we aren't pension experts. We can't go around to the Board and ask for info, post it and someone puts two-and-two together. Is there someone out there suitably versed in Pension Law who can enlighten the readership.

Martwick has already proven he can't be trusted, appointing "progressive" convicted-felon-supporting candidates who worked for former alderasshole Arena. Martwick is a snake and those in the FOP who supported him need to be made to explain their actions.

For the people that continue to say “ our pensions will be there. It’s state law”, keep saying that. Something needs to be done but NOBODY is doing a damn thing. The pension is not sustainable and will be gone eventually. Be prepared and don’t cry when it happens This has been tending this way for decades

They will not let this happen. This is a done deal. Save all the cash you can. Invest in any retirement accounts that catch your fancy. Buy land/property in other less corrupt, better managed states. Only CPD’s pension will be affected by any changes made. We’re the only ones with over 80% deficit. This plan was in the works for a long time. Missed holidays, weekends, birthdays, days off cancelled for nothing, now you need to learn to enjoy your retirement on the cheap. The Illinois General Assembly already approved the proposed amendment to article 3 of the constitution, which would allow a progressive income tax. This proposed amendment will be on the ballot this November 3rd and requires a simple majority of voters to vote in favor of the proposed amendment before the amendment would be valid. This does not require a constitutional convention and no other amendments to the state constitution could be enacted as a result of the vote.

Martwick is still an undesirable candidate and those within FOP who endorsed him should explain their reasoning to the membership they claim to serve.

KMA in a year. Harry “The Hat 🎩” Holmes approached me at a University Bookstore away from his table where the gym was being used for Career Day. I thought he was gonna ask me to leave seeing as I already graduated from EIU and was taking a Biz class cuz the place I worked for paid 100% Tuition. C//O The Hat told me to come over to The CPD Table and do them a favor. He suspected I had a Degree and asked me to fill out the paperwork. C/O also said no Midnights for more than 5 years, you’ll get a pick of Districts, Tuition Reimbursing, and testing for promotion is run on the up and up. Also getting time off would be reasonable(same with Furloughs)and given, not used against you by some Juiced up boss. A Lot of Bullshit I’ve witnessed in almost 20 years. Partners dimming each other out, thieves, petty jag offery, bosses being dicks just to do it. “Iron” Mike Ryan purposely made times hard on his own guys just to do it. A true Coward if I’ve Ever met one. Side piece taken care of while Ald. O’C was watching him and a 20 hour work week for a Damn good Salary.
He also said that the papers weren’t going anywhere. Lo & Behold I visited my Ps and they were sitting together on a coach in Strike Mode. There was a City Envelope on the table that had written CPD on it. My Dad’s from C.O. Laois, Ireland 🇮🇪 so fucking with The Police 👮‍♀️ simply isn’t tolerated. Mayor Daley contrived the "pension holliday" to side step making the contribution needed to properly fund the pensions, Mayor Emanuel engineered what was essentially a check kiting scheme that made the shortfall worse. With the chickens coming home to roost the state power brokers are trying to find a way of screwing the people that made promises to. (anyone in this state who thinks a politician can be trusted obviously needs their meds adjusted)
Am I grasping at straws, but once one is "vested" is that not a contract that the vested person has completed their obligation regardless of the the state constitution? would not any vested individual ,retired or still in pay status be grandfathered in ? otherwise the state could arbitrarily change their obligations of what to pay after products or services were rendered?

That’s all well and good, but the legality of what you’re stating here is what doesn’t hold water. Further, it seems like you’re trying to pin it on Democrats, which again, is all well and good, except that it was Rauner and the Republicans who wanted who started the war on pensions.

There’s a reason that all of the big labor groups throw big bucks at Madigan and the reason is simple. It’s up to you to do the math. An angel he is not, but he is not out to bite the hand that feeds him. Use your brains.

Very Sad that an Officer survives 20 plus years working the streets of Chicago, protecting it's good citizens, decides to retire, does so, and has to worry about his/her financial future, because the pension money has been stolen. Living in limbo the rest of his/her days, which is probably cut short, because of the pension situation, sucks. We all followed the rules, had our pension monies taken out of our checks every 2 weeks, and this is the return we may get. Not fair, and should be against the law, if our pensions are even cut or changed in anyway. This city has many assets, and if they have to sell a few of them to cover pension obligations then so be it .As far as saving as much money as you can, and invest wisely, how well does that work, when your pension contributions are a fortune. We cannot sit idle and allow these things to happen. The powers to be, that would destroy peoples life
need to be voted out of office.

If I want to buy options and essentially bet against Municipal Pensions, there is no such mechanism to do so. There is maybe one Pension Guaranty corporation left out there and there are limits.

There is a reason for that. They are certain to fail, the only question is when?

In that election, a female Sgt. from 008,023, 019 and 016 ran against him, AND THE FOP WOULD NOT ENDORSE HER! So once again, we are our own worse enemy! Remember, less than 20% of the Illinois Population receive pensions. When people always said “our pension is law” I laughed to myself and thought they must be very naive. There is no such thing as law when it comes to politicians. Especially Chicago and Illinois politicians. They can do whatever they want. Remember, all the judges are there friends.

Remember to Vote in the March Primary and November General.
The Grad Tax still hasn’t overwhelming support when it hits the ballot in November, but it’s being sold as “only for the rich”, most won’t see any change from the current rate of 4.95%. Which could be the reason for Dems secrecy to trying a back door amendment when it fails.

The real secret mystery back door deal is in the Taxing of Pensions.
One reason any back door attempt to overcome and change the IL Con is sketchy is the many former elected are receiving hefty six figure pensions. Another quagmire is the lobby of the consolidated Teachers unions and there are many. Not every tax dime collected will be come from the purse of just the everyday joe as far as IL Dems are concerned for revenues grabs.
I recall reading some finance rag that any IL pension reforms would only be for new hires, if that matters. Example was the CTU agreeing to increasing pension contributions to 9% for its new hires in 2016. That increase essentially effected a pension.

The Constitution Convention is controlled by the voter too, (failed in its last attempt to make changes and to even get one formed in 2008) Dems see the only way change anything is through amendments proposals. Tax all pensions or just gradually raise the regular working joe?
But again, will the other private and public unions go along?
What Dem will put there political career on the line to support this? All talk and expect little action.
If it’s only going to affect just the First Responders....sure as shit, then they’re always all in.

Vote-Vote-Vote.
I think Dems have bigger issues to tend to, like retaining at least 2 vulnerable U.S. House Reps to push the IL Grad Tax as a beneficial talking point. Though they all pushed it, JB Slaugherhouse signed it, they’re all quiet about it as a miracle revenue booster.

The thought of this should scare everyone to the core including the public! Can you imagine what this would do to the morale of first responders across Illinois??? It's unthinkable. Who would ever apply for the job again after seeing politicians and judges(also politicians)completely deceive and screw over first responders? It's too late in the game to find another job or change financial arrangements, especially since we also do not get social security. Any change to the pension would completely deprive us of the opportunity to plan financially. We CAN NOT go back in time. If we knew this was going to happen, would we have even taken this job? No one told us on day one that, "oh yeah, there's a chance the politicians will purposely defund your pension and then change the law near the end of your career or in retirement." Most of us would have walked out and found employment elsewhere. What should be done is the elimination of the Gold Braid(connected persons)pension. That would be a start.

Fact is, the state is broke. The debt is so great that the Dim's usual game plan of raising taxes to fix it simply isn't going to work anymore.

Lots of reasons for this, mostly lies on the part of the Dims, especially Madigan. But none of that really matters anymore. Where the new money comes from should be all that matters.

Everything should be on the table. Income tax, property tax, future pension payments out, future pension contributions in, etc. The question will be, to what extent will the voters of Illinois be involved? Or will we not be involved and end up with the greedy politicians cramming it down our throats?

The graduated income tax is the most threatening because it will immediately affect take-home pay for everyone in the state. While it spreads the burden over the widest possible taxpayer base, the potential threat is that it then leaves the door wide open to future rate changes. You may not be considered "wealthy" today, but what about tomorrow when even more is needed?

Property taxes? In our area, property taxes are already the highest (or nearly the highest) in the state. Other areas of the state maybe not so much.

The point is, the dirty pols are coming after us. And they're determined to get our money one way or another barring a Republican takeover. Getting Madigan out of office would be a great first step to head them off. To most Dims the taxpayers are simply a resource to be mined.

Then it would seem wise for each of us to determine in what area we can afford to bend a small amount to help get the debt down and beyond which we're unwilling to go. And then remain involved and vigilant and ready to raise a stink in Springfield when the pols exceed those limits.

If leaving the state is a realistic alternative, go for it. Makes it tougher for those who remain to compensate for your absence, but it creates more pressure.

There is no possible way to solve the pension crisis anymore. Sure, the rulers of this doomed state will raise taxes, because that is all that they know how to do in Springfield, Crook County, and Chicago.

That will only increase the flow of taxpayers out of this state, and the people moving into Illinois are mostly tax consumers, not tax payers. I'm leaving for Iowa in April.

I saw the handwriting on the wall some years ago, so when I hired on at Northern Illinois University as a lowly adjunct, I had a once in a lifetime choice from SURS, and I selected the Self-Managed Plan. So I get modest direct deposits each month from TIAA-CREF. My gamble was to last long enough to get vested in SURS, because then, federal law makes the state put in their contributions into my retirement account. I lasted a few years longer than the requirements for becoming vested.

One of my mentors is a noted expert in government finance, and Illinois governmental finance in particular. He told me some years ago at a Christmas Party, that he fully expects to get IOUs from SURS, instead of payments.

The only solvent Illinois Public Pension Plan is the IMRF, but they have a mandatory increase every year, and that will hit the fan during the next recession, most likely.

All the other public pension funds have been borrowed from, and the state seldom put in the matching funds required by law. The state bought peace from the public unions, by making pension promises that they knew full well could never be made.

I hate to be the bearer of bad news, but those are the facts.

A couple of week ago before the Martwick vote someone posted that Mark Donahue was a 2 million dollar man. That’s 2 million of FOP money into his pockets. But I see on Facebook that 990 tax filing for 2110 showed Mark Donahue made $209,709.00. That figure of 2 million needs to be adjusted to 2.5 million. Dougherty, Capparelli, Aguilar have all made in excess of 1 million also. Closer to 1.5 million. And they are all sellout to the democrats. 100% right on endorsing Kessem to draw vote away from O’Toole. You cannot claim Donahue is dumb, just very devious.

Everyone sucking up the government kool aid on the doom and gloom. Number 1, there are two ways the constitution can be amended, one is chronological and the other is every general election. This is the general election version. It still has to be voted on either way, so take past history for what you will on where it will go this time around.

Also consider that although past legal attempts to impair pensions have failed in Illinois, changing the constitution also has legal ramifications. In Illinois, pensions are considered a contractual obligation, not a gratuity as most people like to think of them.

Litigation has to follow it's course. The course for past attempts demanded state court review, where it always failed. There was no cause for any past litigation to be reviewed by any other judiciary because the circumstances were never proper for a different venue.

IF, and that's a huge IF, the legislature either used this opportunity to ammend an area of the constitution not put before the voters who passed it based upon different circumstances, that too would likely fail at the state level. In the event the legislature were to correctly attempt to inform the public and ask for their vote to open the constitution for the purpose of diminishing benefits and the vote passed and the pensions were diminished, you now have the proper course of legal action to refer the case to the federal court system to apply federal contracts law on your behalf. Once the state has taken and passed measures to diminish pensions at a level higher than the state supreme court has the authority to review, you move the case to federal court and make the complaint the federal contract law has been violated by the state.

Make no mistake, in Illinois pensions are and have always been considered a contractual benefit. This history cannot be removed as it's already happened and has been thoroughly vetted. Take that fact to the federal courts and the following kicks in:

Article 1, S10 - Contracts Clause

The only way around this is bankruptcy. Only the congress can pass laws allowing states to file bankruptcy, state court doesn't have the power. You think anyone in congress wants to present to the world that state governments in this country can legally escape their financial responsibility? There is no provision in federal . bankruptcy that states only state emplooyees can be taken to the woodshed for a financial haircut. No, EVERY creditor gets shat upon and that includes major corporations and foreign entities as well.

If you think congress will ever allow states to escape their obligations due to poor financial management I have a bridge to sell you.

Now ShitCago on the other hand, that's a different story. Municipal bankruptcy can happen, it's already happened elsewhere the state just has to authorize it.

Once again, what happens to ALL the creditors who've done business with the city? No matter who is at the helm, they can try to sell it any way they want to the peons who pay the taxes but in the end, municipal bankruptcy screams loud and clear PUT YOUR MONEY ELSEWHERE.

Take a look at Detroit. Still a shithole, everyone that left aint coming back. City services are still shit and it hasn't gotten any better. They can just pay their bills now is all that's changed. And I mean just now, because they still have a financial cliff waiting for them in the near future. They will once again likely attempt to file bankruptcy. And what do you think happens then?

There ain't no manufacturing hub in Detroit anymore. They have nothing else and attract nothing else because there's no one there who can perform high functioning jobs. Samsung wouldn't put a headquarters in Detroit when the only people left living there can't even hold down a job at McDonalds.

There is wide spread pension abuse in Illinois, that is for sure. The teachers and school boards are the biggest offenders. They pad the last years salary to add to the pensions and give huge pensions to administrators. Education, in general rapes the Illinois tax payers from the universities to the grade schools. Trades in Illinois also get great pensions based on inflated salaries, pay and benefits that are not within their reach in private industry. As far as the police go, the average cop does not get a great pension, not great for the beating his body and mind takes for decades. That is except for the Gold Braid bill in the police department which is used as a patronage tool. Then there is no reason state legislators should be getting a pension as well as Chicago aldermen, all of this for a part time job. Not sure how this will turn out, but the media is all aboard for a change in the constitution and the public is not on the side of public employees, especially the police. If you go on the BGA website, you will find the top pension getters are all in the education field. You know, they must have the best and brightest only. Double dipping for the connected is common.Taxing pensions is next.

There is no way that change can open a back door to your pensions. It would take another separate amendment to do that.

States broke? I doubt that. An example why is the State offering lifetime HEALTHCARE for employees AND families! And the City took ours away.

Highest property tax...? Probably. I know I need two months pension checks to pay my property tax. Thank God the house is paid for.

I was a part time university instructor. I had 1-2 courses each semester, usually one, for 7 years. There were a few semesters that I did not teach. When I hit 60 years of age, not only did the state give me a pension but free health care for life. Now as a tax payer, I object. But, as a former part time University employee, I think this is great. Not a great pension, a little over $200 a month, but the health care, for free, is the best thing. I really did not know anything about this until I got a letter from the state a few months before my 60th birthday. I also get greatly reduced eye and dental. The fact the mayor ended health care completely for retirees is just plain wrong. But especially for police and fire. That profession will beat the hell out of you and you cannot be effective as you age. So, what do you do? Go bankrupt to get health care if you retire anytime in your 50's ?

We have alot of cops on disability that need to get back to work. The pension board needs to be more proactive in investigating these abusers. I have no issue with somebody that is obviously disabled. This money is needed to help fund the plan.

I'm a retiree with skin in the game, and I think there are a lot of reasons to worry about public support for taxing our pensions. In some way, sentiment against our situation has to grow every time there is a story in the media about pension boosting, extravagant final numbers for a select few, and cumulative lifetime payouts after very modest career contributions.

Both so called Parties, yeah like theyre actually separate, know without any doubt that the PARTY ha ha is indeed over. Their precious progressive income tax, actually known as systemic inequality, is finally made mandatory as the only thing possible that bankers will continue to loan money to.

Pat ourselves on the back guys and gals. Yer Unions have succeeded in totally destroying this state. Now, yet no longer exempts and you will finally feel what the rest of us have been enduring all along.

As SCC has warned for a very long time, play stupid games...win stupid prizes. indeed.

They finally realize they are running out of people and things to tax so now they are going to begin cuts. won't cut welfare to many votes at stake but you on the other hand. Suggest next election you all stop pulling that D lever. Way to late to save your pensions but it might help in other areas.

Your screwed and nit much you can do to stop it. Welcome to the real world of much less than six figure pensions. No way that those promises could be delivered. Your about to eee a move to 401 type plans for all city and state workers. Blame the politicians AND your unions for the unreasonable demands.

I would totally trust a union ex-president like Donahue (sarc). After all in 2003 at the retirement seminar, when he was president, he personally guaranteed that if I retired now with 30years I would get the 75% (instead of 70%) just as soon as the new contract was settled. He also told members with 33 years to stick around for 80% that he expected to get them. When the contract was finally settled (I believe 2005) he agreed with the city to only make it retroactive to retirees after Jan 2004 even though the pension multiplier was adjusted back to 1998 to bring it to 75% for 29+ years of service. After initially being told by the pension board that we would be getting 75% we received another letter saying nevermind. Those who stuck around for the dream of 80% also never saw it. But the important thing is Donahue still draws from the teat of the union and city, so all is well.

Me too brother. I was planning on leaving in three years at 55 but if they mess with the pension I’ll stick around and start to use this Medical and IOD Program a bit. They’ll have to fire me at 63. I’m sure there will be many that would stay. Can’t sue or fire us for doing nothing. Just saying. Don’t know how the city thinks they’re going to get rid of medical and cut our pension and expect people to retire.

Maybe the city should take a second look at the $1 BILLION they gave to Lincoln Yards from the TIF accounts. Lincoln Yards is rumored to be financed by Pritzker’s and Crown’s. Both families already billionaires.

Anyone was stays in Illinois after retiring is nuts. Move to a state tax free state like I did. My tax man was able to get me reimbursed from Illinois after they taxed my last comp time payout.

Illinois IS a tax free state, for pensions right now. They don't tax your pensions or def comp payouts. It's a friendly retirement state. The problems are the state is broke, the property taxes pretty much make up for the lack of a state income tax on retirees and the weather blows. Our pensions are in definite peril and it's sooner than you realize. Once these charlatans open up the state constitution for a progressive income tax, they'll tax the hell out of everything that moves and then they'll tax those retirement funds. Our last Hope was Rauner who completely screwed the pooch but he had a mandate to reform the corruption and failed so we got this inflated, fat nincompoop that hasn't got a clue how to balance this states finances without crushing the working class who will leave and the problem will never get fixed.

Pay off your bills, plan on whatever pension money you've got coming, being cut, maybe in half and contribute as much as you can to def comp and private retirement savings plans because our pension is gonna change in probably 5 years and I guarantee you won't like it.

What’s the grievance...3-5 hours in round trip travel time or that traffic is a bitch and the twitchy Sgt keeps looking to log you?
Just hope that propane off-gassing doesn’t get mistaken for fentanyl compounds.
The MS RDU done this before.
Special Units get their turn in the barrel, least often then Dist Patrol.
The cycle will be over by 2nd Per and in 7 -10 years they’ll do it all over again.

retired here so i get to see more local news than i can stomach. every day, yes every day, fat man and little girl hold a presser giving away 20 million here there and everywhere for some uselss new program while the existing bills go unpaid. gotta feed the taxeating beast or no votes for you ! when exactly does welfare run out of money ? pensions, s.s and medicare all have use by dates when they expire. what about the sittin at home checks ? also a correction to mr 5:12 that i have heard so often. union tradesmen do not make more than private sector in wages benefits and pensions. illinois is a union state and union scale IS the prevailing rate that all big jobs are supposed to pay. even playing field and all that. we are talking about real tradesmen not some drunk hillbilly that built your deck. govt tradesmen actually make LESS because they have to pay their own pension and medical out of that union wage, on the outside its paid 100% by the union. we make roughly seargents pay. if you think we are overpaid make the switch and work all day every day outside in our beautiful weather in the mud and drive 60 miles plus each way for the rest of your life to ever changing locations. most of our jobs are 6-7 days a week 10-12 hrs a day all winter holidays included. no days off until job is done or you have bones sticking out. take a day, dont come back. long time multi generational cpd family, worked for the union and the city, have children on the job and also part of the citys failing pension. point here is the evil unions didnt kill the city, nor did the cpd or other govt employees. the govt pension scheme was never inherently unworkable if after setting them up to secure the union vote the politicians had done the hard work to fund them from the get go.we know politicians love ribbon cuttings, but the behind the scenes funding mechanisms to maintain bridges and roads, schools and pensions dont have the glitz and glamour as the unvieling of a new program. everyone wants to point their fingers at the workers who never had a choice in any of this.they set up the pension, they decided the amount out of every check, they invested it, and they decided how much you get when you retire. now theres no money and its my fault. progressive logic at its best. united we stand, divided we fall. oh, and fuck you daley !

I could care less what that fat bastard and the rest of his goons are planning down in springfield. I work for the city of chicago and want just what I was promised when I accepted an offer of employment from them almost 30 years ago. The unfunded pension liability is fast approaching 40 billion dollars and a lot of that is attributable to the city not making required yearly payments into the fund. Many other cities have healthy pension funds because someone with a brain handled the finances. If there's money to give to these slobs who sit on the couch all day then there's money to give me that I earned.

I'm in municipal employees pension. I read that's also where the alderthiefs get theirs from. So imo that's a safety net. They're not going to let it go bust then they get nothing. Haven't heard anything about police pension since jb consolidated it what's going on with that?

If they open a constitutional convention, a new state constitution will be drafted. Maybe not in whole but enough tweaks to allow them to access and diminish pensions as needed. Anything they are talking about now is only a guise to get in and address the pension issue in the Constitution. PERIOD. We can only hope the teachers unions are smart enough to see through this and put their foot on the throats of the politicians proposing it. ONCE IN, THEY WILL SCREW US OUT OF OUR PENSIONS. DO NOT BE FOOLED!!!!!

So what. Let them send you for testing every week, what difference does it make? You are getting paid to go and piss in a cup.
Now if you are inhaling, injecting, or ingesting illegal narcotics, or like a little nip from the bottle while on duty, that's another story, and I can see why you would be concerned. Wise up.
