As Predicted Here and Elsewhere

Those "Weed Amnesty" boxes at the airports? Not very secure at all:
  • Marijuana has only been legal in Illinois for 23 days, so in the minds of some, the crime that occurred Wednesday at Chicago's Midway Airport was only a matter of time.

    Chicago Police confirm that a traveler arriving in Chicago grabbed the pot inside Midway's so-called "amnesty box", a storage unit near security where passengers can surrender their newly-legal marijuana before traveling.

    A source told NBC5 the marijuana in question had been discovered on a traveler early Wednesday, and that person was escorted to the amnesty box where they were allowed to deposit their weed without penalty.

    When police went to empty the box around 8pm, the marijuana was gone. A check of airport surveillance cameras showed a man grabbing the pot and hurrying away, around 6 p.m.
Um...so what? A traveler, in order to avoid running afoul of Federal Law, voluntarily deposits a completely legal (in Illinois) substance into an "amnesty" box. An observant citizen accesses and removes said substance that is completely legal (in Illinois) and voluntarily surrendered.

It's like rifling through someone's garbage can in the alley - there's no expectation of privacy or possession when you toss it out in a publicly accessible area. There's no crime here that we can see. What say the readers?

I was at a airport in the uk where outgoing travelers could leave a umbrella that they had purchased while on vacation, and the umbrellas were free for anyone to take upon arrival. I would imagine some were recycled several times. The weed amnesty box is the same thing isn’t it. Unless some enterprising young scamp was collecting free weed from the box to sell on the street.

Maybe not a crime, but technically that is a city owned (recovery) box located in a bldg that is governed by the federal government who still considers weed as an illegal substance.

In the pols’ minds, the person voluntarily transferred care, control, custody AND OWNERSHIP to the Chity.

Years ago, when the cigar embargo against Cuba was going strong, I was flying back from Aruba. Cuban smokes were legal there, and I bought a couple of boxes. Outside of the airport there was a trashcan overflowing with Cuban cigars,still boxed, packaged, dumped by nervous Americans. I helped myself to a few handfuls and went through customs without a hitch. If customs found them, they would have taken them, and I might have paid a fine. Aruba DIDN'T CARE who took the cigars. You can now bring up to two boxes, I think, without paying a tobacco tax to customs. THE ONE THING OBAMA GOT RIGHT!

Didn’t think digging into and taking from these depositories for unwanted items was illegal.
Water bottles must be emptied before entering the line or pitched into barrel...but your allowed to drink it beforehand if you want. Anything liquid, aerosols over 3 oz. is voluntarily pitched or it has to go as checked baggage.
Are there weed disposal notices posted that such may prohibited, that your weeds, once surrendered voluntarily are property of CPD, DOA, TSA or DHS ?

Knives, guns, various other implements and substances are legal but prohibited by TSA as carry-on
They post this. Once in line and your property goes on the scanning belt it’s the travelers responsibility whether they detect contraband or not.
TSA has a civil notification process that may fine a traveler if they’re caught with a prohibited item other than a defined firearm or explosive.

Agreed. What's the charge for removing discarded items. You can argue that the receptacle is specific for marijuana but that is now legal. Therefore the act is as insignificant as removing a recyclable from a bin specifically designed for recyclables.
This crime was so bad that it required two case reports.

I don't think the person taking the pot is doing anything illegal.
However, if the person finds 100 reefers in the trash and puts them in his backpack and the police find the 100 reefers on him, I think the quantity (100 reffers) exceeds the legal amount you can possess, even if you intend to use it yourself and not sell it.

Also amazing, no further news about how $200K of untraceable cash walked out of one dispensary. Anyone who worked at the place does have a great excuse though under questioning. Replace marijuana with bottled water. Water is not allowed past security check point. So if they put a container out for bottles of water to be thrown out, and someone takes a tossed bottle, is that theft? No. It’s garbage and has no value to anyone.

If it is legal for police to go thru someone’s trash it is legal or this guy to take the weed. Look at what I found. Would’ve very careful though someone could poison or spike the weed. Than what. State gets sued because the picked up weed was in state packaged containers. All ash samples and I bet dry poor video quality at point of purchase if any.

Ha ha this is great. So now, it's still illegal federally, but legal LOCALLY, to have pot here...but if someone disposes of theirs because it's "less" legal (more illegal?) where they're going, and someone picks it up, that's a crime?

So how about if someone deposits some tainted pot, and someone else grabs it, tokes up, and gets sick or dies? Have the depositor AND the receiver then committed crimes?

I've got a GREAT idea. Why not just make pot ILLEGAL?

Yeah, this just sounds like dumpster diving on the part of a clever citizen. Normally airport drop boxes for things like knives that TSA doesn't like will have local-mail envelopes so you're effectively mailing it to yourself, but I gather that the city authorities didn't think things through? Unless there's been some heavy duty legal maneuvering and appropriate signage indicating that you're gifting possession of your weed to a named agency or the City itself and not just dumping it in a glorified trash can, I fail to see how any sort of crime could be charged here.

TSA is federal why should police officer havew anything to do with a FEDERAL agency that doesnt enforce federal laws.

I have seen TSA agent steal peoples oversized cologne bottles,expensive whiskey, and those lovely CUBAN cigars. YEP they put them in a trash can near the area the search and then recover them after the crowd lets out.

So why now does a lowly AIRPORT clouted needed for weed which is equivalent to cigarettes with a state income tax stamp.

YOU airport exempts really need to read and start thinking ahead. the days of waiting for a special order are falling behind.

What if a person flies to Denver and weed is legal there? (i know follow the order)
What if a 2 persons have a medical card and load up the suit case to the maximum? (City will be sued)

Just think the TSA is just changing rule for those asshat that have pets on the plane with fake pet paper work!

OH my another college grad! City carts are city property too and those lovely alley you drive through to your garage is city property too.
If the garbage receptacle is not secured and not available to the public then it fair game.
WEED is now a perishable item. the city is moving about 5 years behind on all its rules.
And wait till an officer locks someone up who refuses to show a receipt? a NEW order will pop up and tell you to just act like weed is cigarettes.

Correction to earlier comment - Apparently these Weed Boxes are not marked CPD, nor was an arrest made. But the whole system is ripe to called upon (for Unit Activity) as agents for Merit birdbrains to arrest any folks tampering, rummaging and or pilfering from them, without due warnings. Since no arrest was made, its still a pisser to have to standby, ready to sandbag someone because of inept knee jerk policy and clueless supervision, that now has to answer to the mystery if such voluntary disposal boxes are necessary or protected property of CPD, TSA or DOA. Once defined, they may just create another added duty (sign an inspection/weed box check event number book10x a day) or maybe an exclusive house mouse courier detail.

Wonder if the traveling thief used a fish hook and line or Juicy Fruit on a stick.

You are quite wise, however, your solution requires common sense and forethought. Those two things are quite rare in Chicago city government. Along the very same line, they could have used the drug safe from the front desk in 013 and in 021, with one safe going to O'Hare and the other one to Midway, but the "geniuses" making the decisions never thought to ask us.

Here in Massachusetts, weed's legal. TSA are State employees. And so I can fly legally with one ounce or less down to Tampa, Florida out of Logan. Now, it's not legal in Tampa, but no one has ever been waiting for me at the Tampa end. TSA has other stuff to deal with I guess. Been doing it since the election. Dunno what the BFD is with all this. Illegal pot is over folks.

If marijuana possession is no longer illegal why is the aviation department even getting involved in any aspect of it. Outside of the airport, like any other public location being a non smoking environment, there’s nothing to enforce. If TSA screeners have a problem with passengers bringing marijuana with them, let them be the conduit to dispose of the item that’s not allowed to be transferred interstate. The aviation department has no part in the collection, inventoring or disposal of confiscated materials. Those are issues for the TSA.
