Retiree Lawsuit

This is a revisiting of an old issue. Rahm bragged about fucking over retirees, so we aren't sure why WGN finally figured out this was a pretty big deal:
  • It was a cost-cutting move that saved Chicago taxpayers tens of millions of dollars. But the former city workers who were affected say there’s an untold human cost — one that can’t and shouldn’t be ignored.

    Among the perks promised to older city workers — affordable health insurance in retirement. But in 2013, then-Mayor Rahm Emanuel announced he was ending the benefit to save cash. Retirees who started working before 1986 were hit the hardest.

    They never contributed to Medicare during their employment — the city’s choice, not theirs. As a result, many now don’t qualify for government health insurance, even at age 65. “It’s a kick in the gut but I have to deal with it,” said former city worker Dan Sheehan.

    The retirees can buy health insurance through the city. But they pay the full freight because Emanuel cut the subsidy. For a single retiree, the annual cost is now more than $33,000, whereas before it cost a few thousand dollars.
You shouldn't think for a minute the City gives two-shits-and-change about you once you're gone. Hell, they don't care that much about you when you're working either. It's a job, not like it used to be.

Another issue that WE are paying for ourselves. We retirees have been sending Krislov money out of our pension checks to pay for this lawsuit. Just like WE are paying for a financial audit of our pension funds. I hate this fucking city.

Off topic, but needs to be posted to hopefully stem the virus panic. They finally released stats of Covid deaths in Europe. 0-10 year olds who contracted had 0% death rate. 10-20 .1% (Same as common flu). 20-40 yr-olds .2% (double common flu). 50-60 .4% 4 times flu.. 60-70 .6%.. 70-80 4% (40 times common flu). 85 and over 15%. So from intial stats the death rate under 40 is about same or lower than common flu. For older its very dangerous and high death rate. However, they also noted these were people tested who either became sick or in contact with infected person. They noted the death rate may be considerably lower from numerous people off all age groups who have it but have little to no symptoms. So take precautions but don't panic.

Work for 30 years for a city and department that despises you and finally make it to retirement. Grinding out the days with no sleep while trying to make ends meet for the family. Just praying to make it to retirement and enjoy the last years of your life, only to find out you don’t have healthcare. Ironically every illegal gets free healthcare along with medical cards for their “dreamer” children while never paying into the system. The same system that stole 30 years worth of taxes from you the policeman who worked hard for your meager life. America is waking up and sick of this system, as it’s gotten so bad and out of control. The working man really is a sucker!

This is why people need to care about the city purposely defunding the pension too. They lie lie lie. They promised us on day one of employment a pension and we had to sign paperwork agreeing to withholding money from our checks. Lightfoot even promised it to us in an interview when she was running for mayor. What has she done to fix it??? NOTHING! No one trusts them. What they did to retirees was horrible and don’t think they won’t do it again. City hall hates first responders

Be forewarned boys and girls the dispatchers are failing to protect us and I say that because they gave us a job to back up fire and upon arrival discovered it was a coronavirus incident. Our supervisor instructed us to stay a few blocks away and instructed he wanted the address tagged for future calls and the dispatcher refused claiming she would need her supervisors permission first. So much for the ANFM message on corona virus.

Our lodge needs to be negotiating with the city to address the hundreds of officers that are maxed but don't have the age of 55 yet. Put into place a tier system so officers can get health care at a somewhat, not great but a somewhat decent doable rate and retire. Four, five, shit even six percent of an officers salary and they can and will leave tomorrow. A win win for the officers and for the city who I'm sure would like to rid those officers making a much higher wage than a newbie coming out the door. Remember, they'll be hundreds of officers in the same boat in the next year or two in the same predicament. Health insurance should be one of the lodge's highest priorities.

So at 55 you can go out and get another job with insurance. Sorry but the reality is the taxpayers cannot to pay any more for you to retire than they already pay. Your union should have protected you from this when it happened. But the clowns did not look the total picture now you expect the city, no make that the taxpayers, to pony up more for your unions failings. No way Jose get another job or STFU and pay for the coverage. It is called personal responsibility.

I am trying to boil this down, but I do not want to bog you down with details.

There are 5 statutes involved here, the original 1983 and 1985 statutes state, (more or less) the city will pay PART OF retired cops healthcare. (how much? well,it changes in the following amendments to the statute, going up to a max, I believe, of 55%). In 1987 the city simply wants out of paying retiree healthcare COMPLETELY. You are on your own says the city. In 1989 this was codified into law. In 1997, the city amended. All these amendments are doing is extending the time the city will (partially) fund retired cop's healthcare. The 1997 amendment extended the city paying until 2002. I know, this is getting too complex already. So we have 1983, 1985, 1989, and 1997 laws on the books. Now, in 2003 the city amends again. This covered until 2013 (another 10 years). In 2013 the city kind of made the final statement - they said we will pay so much (I think it was 55%) until the absolute final date of January 1st, 2017. We all know what happened on January 1, 2017. ALL CITY PAYMENTS CEASED. End of story. The original 1987 statement by the city saying "we ain't paying" - culminated - 30 years later.

Here's a little more absolutely necessary detail: The 1983 and 1985 amendments to the pension code have been ruled to have been constitutionally protected. (Remember the Kanerva case which recently stated healthcare benefits are constitutionally protected?) But the 1989, 1997, and 2003 amendments had language that "these are not pension benefits for constitutional purposes," AND those amendments had time limits.

So it seems like guys hired after 1985 are fucked, right? Wrong.

What is interesting is that the Illinois Appellate Court said that those that were hired before 2003 (and were thus paying into the system by the time of the 2003 amendment) ARE INCLUDED, and are tied into these 1983 and 1985 amendments. What is that going to amount to - benefit-wise? No idea. The 1983 amendment has language like "$55 paid by the board," not language like 55%. 55% is good, $55 is bad. It's nothing. (And it is bizarre that the statutory language went from $ to % at different times). But then it has language which says the "tax levy" will pay the rest. So does that mean the 1983 statute covers 100%? I can't make heads or tails of that.

In 1983 that covered all of it. The City was self-insured, healthcare-wise (as they still are, I believe, for property),and the premium was only $55. So the Funds paid that $55 (from a city tax). The city was just restructuring the model. This was initiated under Harold Washington. At that time, the retired cop was 100% covered, but he/she was still on the hook for spouse and dependents. But ... and this is a BIG but ... the statute expressly stated that anything above that 'maximum subsidy' was to be taken out of the retiree's pension.

So the city charged only $55, but if they were to raise it to $56, then that $1 would come from your pension payment.


Now Krislov is also arguing Estoppel and Breach of Contract. These counts were shot down by Cohen and also the Appellate Court. Now the Appellate Court ruling stands because the Il. Sup. Court rejected the appeal. That is what this recent news is about.

So now we are just left with the Constitutional claims that the pension cannot be diminished (and medical benefits are part of the pension said Kanerva v. Weems July 2014.

So we are hooked up with the 1983 statute (the 1985 statute just included the city's remaining two unions; Municipal and Laborers). Great news huh? The 1983 statute bound the city to all police hired before 2003.

Not so great news - the statute only promises $55 a month. (A slightly different amount for those not eligible for medicare.)

So I heard some coppers blaming Rahm. Well, Rahm could have put the kabosh on all of this if he wanted, that's certainly true. But this all started under Washington.
Remember Rahm’s recently intercepted text message to his friend? Something along the lines of “I just saved the city $15M.”

From the 1960's until this 1983 statute, cops got free medical for life (but I think they always had to pay for dependents).

So here's the problem that I see - something that doesn't make sense to me: In 1983 the city more-or-less said "we'll pay for all your medical, we are the insurer, we are charging $55/month. But is we raise that price, you will be on the hook for it." That must have been the plan ... raise the rates later on down the line. All the cops are happy with this statute, because we/the city pay everything, but all we have to do is slowly raise the rates. Now at this time the union (sorry the Funds) were fighting this in court. But mid-trial both sides came to an agreement and the trial stopped. What was the agreement? City pays 55% (or 50% not sure.) So, in one fell swoop, somewhere around 1985, the city went from paying all the healthcare premium – to only paying 55%. Why did the Fund (retirement fund) agree to this?

You put your time in and that should alone be enough to warrant a decent health insurance option. Blame the politicians but to state that illegals ALL get free health care is not fact. I hope you know you don’t have to wait to buy into Medicare under wife’s Medicare credits. If you have been married for 10 yrs and your spouse worked and paid into Medicare then you qualify. Even if spouse is younger than you. Spouse, divorced spouse or deceased spouse. Say you were never married you can buy Medicare when you turn 65. Your full cash cost paid to Medicare monthly is a little over $400 per month. Then you buy a supplement. If you wait past 65 you can still do it, but will pay a 10% penalty a year for every year past your 65th birthday.

What pisses me off is I wouldn't have retired at the age I did if I knew rahm would cancel our health insurance. I retired knowing I had to pay $600 a month until 65 years of age. Suddenly that's gone and I'm paying $1500 a month for Obamacare. And that premium goes up every year.

Many cops were injured repeatedly working on the job, but chose not to go on disability. They worked the streets for 30 plus years with bad backs, strained muscles, arthritis, constant pain, etc. It only gets worse as you age, and now these retirees opt to suffer in pain because surgery or therapy or medicine is too expensive. So they should have fucked the job back then and went on life disability??

Thank you Chicago politicians. Lightfoot why don't you change this and worry about us as much as you do the west and south side? At least WE earned it.

Until something is done about this travesty, I suggest that anyone paying nearly 33K a year for city insurance stop immediately, and cut all ties with the city immediately. Go into the private market for private payer health insurance. Every insurance company has their own website. You can choose what level of care you want, and change out anytime that you want to. I use Blue Cross Blue Shield (www.BCBSil.com) and pay about $700 a month. The cost actually went down this year. It's more than I thought I would ever be shelling out, but it is way better than the alternative.
Or you could just get a job until you reach Medicare age.

Took a long time to get that suit rolling again. Don’t expect any sympathy or reversing that deal from Larri.

It’s hard to fathom that any life long unemployed freeloader can walk (transported more likely) to any hospital, clinic and get almost the very same service as the chump with the $33k policy gets. Same service is limited in terms of waiting appointments versus emergency room.

Preventative medicine seems to be the first kick in the belly.
Medicaid (taxpayers) picking put the tab for piss bum ailments. Rahm used the “Pass It To Know What’s In It” obamaCare© to replace retirees insurance, by the way would NOT cover (subsidize) CPD retires hired after 1982 due to obamaCare salary limits.
Now that obamaCare is destined to be totally eliminated upon the second term of DJTRUMP it makes perfect sense to file the lawsuit and likely to challenged. It’s a start.
Until then...Be a freeloader. Go to the hospital, give bs name, no address, no social security number and wait.

When he was running for mayor, many said “oh he comes from a police family, his uncle worked in ...”.
His brother wrote the obama care bullshit and still to this day insists no healthcare for elderly.
Rahm reiterated the same last week in an interview.
The malignant 4 Pension Rahm deserves a good dose of multiple wasting diseases.

All you young gunners say is that I got a long time before retirement etc. But I can just bet that most dont contribute to deferred comp.and have to rely on special employment to pay Bill's. Why, because they live high on the hog, big trucks, bikes, moms needs a big SUV. Grow up folks. Retirement is not a thing to treat lightly.

It’s all about the matching funds employee and the city pay 1.45 percent for Medicare that didn’t start until 1986 and you need 10 years of work history to qualify so the employees that retired without a 10 year history of paying in are fucked unless they worked another job in private industry for 10 years.

I went into private industry after retirement from CPD. It was a very large corporation. They also did not offer healthcare after an employee retired so everyone had to work until age 65 or medicare eligible. But, being a cop or a firefigher is different. A person cannot work in these occupations until that age,the body just cannot do it and a person is too old to be effective. But, I cannot say the same about many other city occupations. The trade unions supported the corrupt democratic leadership for decades in this town with votes and tons of cash. The allowed the corruption to continue . The trades can work into their old age.

Yes, we send Krislov money from time to time. It's voluntary. Don't want to? Then don't send anything. I can get on the FOP Aetna plan but I also send Krislov sone dough. He doesn't get paid unless he wins the suit. Most of the funds are his own. You can resign any time you want. I am retired, I felt like you do too. I worked it out, made it to the end. Good luck.

The prosecutor, Gino Betts, told Cook County Circuit Judge Arthur Wesley Willis that Bradley was in a car that pulled up to another vehicle at 14912 S. Michigan Ave. the evening of July 6. Bradley fired 15 to 20 shots into the other car, striking the driver in the head, one passenger in the neck, shoulder and back and another passenger in a leg, Betts told the judge.

Bradley was caught on a surveillance video at a gas station six minutes after the shooting, after getting out of the passenger’s side of the car used in the shooting, Betts said.

Police obtained a search warrant for Bradley’s car and found gunshot residue on the driver’s door, steering wheel and glove compartment, along with a .40-caliber bullet casing — the type of ammunition used in the shooting, Betts said.

The judge asked whether police conducted a photo lineup for the victims to identify Bradley, and the prosecutor said no.

According to the transcript, Bradley’s attorney Matthew Kaplan said the only identification of Bradley was the video of him at the gas station, where he bought candy.

“He was not identified by any of the victims whatsoever,” said Kaplan, also noting that the car didn’t belong to Bradley.

They finally released stats of Covid deaths in Europe. 0-10 year olds who contracted had 0% death rate. 10-20 .1% (Same as common flu). 20-40 yr-olds .2% (double common flu). 50-60 .4% 4 times flu.. 60-70 .6%.. 70-80 4% (40 times common flu). 85 and over 15%. So from intial stats the death rate under 40 is about same or lower than common flu. For older its very dangerous and high death rate. However, they also noted these were people tested who either became sick or in contact with infected person. They noted the death rate may be considerably lower from numerous people off all age groups who have it but have little to no symptoms. So take precautions but don't panic.

Absolutely wrong....In the 80's a group of CPD officers filed Federal suit against City to pay into Social Security and Medicare...the City fought it saying they could not afford their end and that the employees would have a pension and insurance their whole lives. I moved away decades ago but I return home often and speak to family and friends in Chicago daily. Sadly, I have not heard a positive story in decades. The thing about leaving is.....you have to leave before anything gets better. Your Real Estate can only go down. Your schools cannot and will not get any better, that ended in the 80s. The ONLY thing that can help you is distance. Being happy is priceless, you owe it to yourselves.

Do the math. Even six percentage the pension benefit will only cover a small part of the cost. Even if the average pension was $100,000 (its not), six percent would be just $6000. That is maybe 20-25% of the cost of the health insurance.

In most cases 6% of the pension benefit is probably more like 10% of the insurance cost.

There just is no win in this for the city or the taxpayers.

NOT the correct info, CPD and CFD back then did not have the opportunity to pay into SS#. When it was in the courts "Rahm" said health insurance was not a promised benefit. Although personal emails of his that said he f**ked over CPD and CFD because everyone knows health insurance is a benefit. The "email" was not allowed in court.

This has effected the widows and children of CPD and CFD. I know of 1 widow that was quoted $3000 a month for insurance just for herself. Another put her child on state insurance.

Just my two cents and to agree with the above poster. I am retired now. Came on the job at 21 in 1976. Was told not to worry about hospitalization insurance because we would have it for life. Fast forward to 1986, all new hires were required to pay into Medicare which was an additional 1.45% which I would have gladly paid. I contacted personnel and asked to be included. The answer was “no way” only new hires can be included. Those of us who came on before 1986 were never offered the opportunity to contribute to Medicare. I’m certain that we all would have if we had been permitted. So now, I pay out of pocket for my Plan B Medicare in addition to my supplement and my Plan G drug coverage.

Came on in 1976, was told the same thing about never worrying about health coverage. I kept working part time jobs over the years to enable myself to pay into Social security.under the Rostenkowski bill I lose $190 each money not the 60 percent because I have 28 years of continued contributions. I have Medicare and pay 145 each month from my 1200 monthly check. I started collecting at 65 by choice instead of waiting to collect full social security at 70 years old. I clear 685 per month but am covered by medicare. New hires paid into medicare and any part time work I still do gets medicare taken out.

Be forewarned boys and girls the dispatchers are failing to protect us and I say that because they gave us a job to back up fire and upon arrival discovered it was a coronavirus incident. Our supervisor instructed us to stay a few blocks away and instructed he wanted the address tagged for future calls and the dispatcher refused claiming she would need her supervisors permission first. Let's go with the correct info. City employees opted out of contributing to Medicare so they can have a higher paycheck by a couple dollars a month. That's why they have lost all their court cases so far. Now they are crying. They can go with the affordable care act at a fraction of the cost from the city's insurance. Pure bullshit. I came on in 1965 and we were never offered or were allowed to contribute towards Medicare. We never opted out. But most and I mean 99% were aware of the situation and made sure we had 40 quarters to qualify either thru prior work experience or if we didn’t have the quarters had a part time job that allowed us to pay in. Then when we reached 40 quarters you were gold and could quit working PR if you chose. Some of us had working wives or wives that had the 40 quarters and used their quarters for Medicare After 10 years of marriage(not an easy task on CPD) you are locked in even if she dumps you

Hey "Be careful what you wished for," f*ck right off with that. We signed a contract, we held up our end to immense incalculable personal cost. Golden parachute medical and pension? You should've signed up to serve then.

There is no tipping point in normal circumstabces, the City has billions in Tif funds to square away liabilities instead of using it as a personal Democratic party slush fund/money laundering scheme/political contribution reward treasure chest.

I think it was because I had signed on to the lawsuit a couple of years ago… and I did send Krislov some donations, if anyone is wondering.
And to the angry poster stating that we had 'opted out' of Medicare, I started in 1982, and we had no such option. The city said we take out your pension money every check, and you WILL have insurance after you retire. I never asked for their buckshot scheme, I did not have a choice.

You’re an idiot and a tool. Do the math you numskull. 6% at a high would maybe equal $600-$700 of an officers gross pay rather than spending out of pocket $1,900+ for single care coverage, family plan more than double that.
No brainer stupid. You think the city will go backwards from 2% at 55 or to FREE at 55 or at Maxed 29-1day. You’re dreaming.

Our lodge needs to be negotiating with the city to address the hundreds of officers that are maxed but don't have the age of 55 yet. Put into place a tier system so officers can get health care at a somewhat, not great but a somewhat decent doable rate and retire. Four, five, shit even six percent of an officers salary and they can and will leave tomorrow. A win win for the officers and for the city who I'm sure would like to rid those officers making a much higher wage than a newbie coming out the door. Remember, they'll be hundreds of officers in the same boat in the next year or two in the same predicament. Health insurance should be one of the lodge's highest priorities.

This virus could not come at a worse time for our negotiations. City is losing a fortune in tax revenue. With the bars, restaurants, theaters closing among a few the tax revenue dropped substantially along with city revenue sharing from the state. Not to mention the loss of our pension investments.

When I went through the academy the Medicare deduction was new and plenty of my classmates were bitching that this was unnecessary because we were guaranteed great insurance for life.
