Scumbag Remains Silent

  • [Scumbag]’s lawyer had promised jurors that the man accused of killing Chicago police Cmdr. Paul Bauer would take the stand and tell them what really happened in the Thompson Center plaza in 2018.

    But attorney Scott Kamin (also a scumbag - SCC) rested his case Thursday afternoon without calling [Scumbag] to testify in his own defense.

    [Scumbag] had been expected to tell jurors that he did not know Bauer was a police officer, and that he fired in self-defense after a strange man chased and started to attack him, Kamin said as the trial began last week. He was also expected to say that after he opened fire, he heard someone else fire a gun.
Can the prosecution ask the judge to tell the jury to disregard all of the defense's opening statement as pretty much none of it was supported during the trial? The lawyer promised one thing and didn't deliver. Now, we know lawyers are typically liars, and constantly over-promise, but to present a theory in opening statements and then to completely neglect even offering a scintilla of evidence to back it up....it should be specifically disregarded in jury deliberations.

The defense has no case for self-defense. The ASA will draw attention to the jury of what the defense promised in opening statements and did not deliver. Opens it up to incompetent counsel for a new trail on appeal and drag this out for a decade with no cost to the scumbag. Long time for closure to Bauer's family. Thanks to that asswipe Ryan, this cop killer will not get the death penalty. I foresee problems over the years with this killer sucking up clean air for the years he deprived Cmdr. Bauer and his family.

Prosecution should just point out that the defense didn't prove any of the nonsense they mentioned in their opening bullshit. No need for special jury instructions.

Often times we plan to have them testify, then during the course the trial, everything goes south and it’s better to keep them under a rock. I don’t want to speculate, but in other cases we do it when we anticipate a guilty verdict and we want to mitigate/damage control for the appeal/post judgment portion of the process.

There is a jury instruction about this that the jury should receive:

Arguments Of Counsel
"Opening statements are made by the attorneys to acquaint you with the facts they expect to prove. Closing arguments are made by the attorneys to discuss the facts and circumstances in the case and should be confined to the evidence and to reasonable inferences to be drawn from the evidence. Neither opening statements nor closing arguments are evidence, and any statement or argument made by the attorneys which is not based on the evidence should be disregarded."

This case is filled with scumbag pieces of shit. The shitbag killer of course. Prosecutor Risa Lanier was Kimmie’s quarterback on Jussie Smollett and ran that whole shit show. Then you have Scott Kamin. He’s the asswipe who was taking money from several lawyers who were subletting office space from him but never paying the landlord the rent. The lawyers never knew until the sheriff shows up in their offices to evict them.

But hey, that’s just our Cook County criminal justice system we all know and love!

Opening statements are not "testimony." The prosecution can address it in their closing, telling the jury that the (scumbag) said he promised to show this, and show that, but he didnt show it at all.. better to soft walk it and let the jury connect the dots (yes, the jury does get it right many times). Generally, judge wont sanction defense for unfulfilled promises . . .

No, because those statements are not counted as testimony nor evidence, judges do instruct juries - lawyers are not testifying.

In a just world, it would take the jury about 15 minutes to convict the scumbag.

With five of the minutes to pick a Jury Foreman (in pc-speak a 'Foreperson, and ten minutes spent making sure the jury spells his name correctly so no other scumbag of a lawyer could appeal the conviction for any reason, like juror error.

ps: Bring Back The Death Penalty asap (at least for the Murder of a Police Officer).

Saw pic of this shirt bird sitting in ct with his suit on-at taxpayer's expense. Testified many many times at 26 and Cal during my career with CPD and know that is the game dressing these fucksticks up to look like successful hard working citizens just like the lil banger with his kindergarten graduation cap. Always thought looking at these shirt birds during the trial was , "Who ties the fuckstick's tie for him?". Fuck this shirt bird!!! Back in Lockup at 26th until sentencing. Touchy subject, if they bring up anything that even hints that the scumbag should have testified it'll either be a mistrial or overturned on appeal. Hope the jury is smart enough to realize the defense over promised and under delivered. I know, that's a lot to hope for, but it's about the only way. Scumbag's defense attorney probably knew all along that he wouldn't testify, but that opening statement was his way of getting scumbag's story out there to the jury where he couldn't have done that any other way during the trial.

Great job to Risa Lanier, John Maher, #3C as well as your other ASA helpers. I watched what I could and from what I saw, your case was spot on. It is, however, very bittersweet. The taxi video was especially brutal to hear. Makes me weep just thinking about it. God bless you all. May God continue to bless Cmdr. Bauer's widow and daughter.

did the scumbags lawyer in opening statements misstate to the jury on purpose that the scumbag was going to testify, knowing all along that he wouldn't. The purpose being for an appellate lawyer (provided for free by you and me) to be able to raise on appeal an ineffective assistance of counsel argument, and hence get a reversal of a guilty finding.

As far as the City is concerned, they want your full attention to what they are paying you for. And you should give full attention to the police job just for safety reasons.

It could be more trouble than it's worth. Suspension, possible lawsuit to recover wages, legal fees.

If the it is that lucrative, quit and do it full time.

There are ugly unseen aspects of being a lawyer.

John Adams, second POTUS, defended the British soldiers accused of murder in the Boston Massacre. John Adams defended them to keep the politics out of it and to show the world the fairness of the American judicial system. No one else wanted to defend them.

No matter evil the accused is, he is entitled to legal counsel.
There wasn't much if anything this attorney could do in this. It was tight. But he still has to make the effort.

He was publicly criticized and harrassed. But eventually became President.

Yeah...it is the job of the CCSA to remind the jury during closing of what was promised in opening and how the defense failed to follow through. Don't know whether the generally substandard politically connected CCSA did it in this instance as that hasn't been reported anywhere.

I’m a criminal defense attorney and I admit there are far too many scumbag liars in the profession.

Legghette’s lawyer helped the prosecutor by over promising. If a defense attorney doesn’t deliver on the opening, it sinks his integrity and the lawyer’s lack of integrity reflects on the client. Jurors notice those things and will feel the defense attorney tried to pull one over on them and it pisses them off.

It’s stupid to tell the jury in opening that the client will take the stand because you usually don’t know it’s the right move until the final moment before the client must make the decision to take the stand. If the client doesn’t take the stand then lawyer and his client look like a cheap, lying, scumbags.

After doing this for a couple of decades, I have developed a deep respect for cops because I learned what you guys go through on the job.

Thank you for your hard work risking your lives to protect us, especially Chicago cops. I mean that.
