The Rule of Law Prevails

  • Conservative justices on the Wisconsin Supreme Court struck down Democratic Gov. Tony Evers’ [months long] stay-at-home order in a ruling released Wednesday.

The 4-3 decision marked the first time a state’s highest court has overturned a stay-at-home order amid the coronavirus pandemic and sided with Republican leaders who argued the governor’s administration had overstepped its legal authority.

The court rejected the legislature’s request for a six-day stay to allow the GOP lawmakers and the governor to work out new rules. The court’s majority noted two weeks had passed since the court had taken up the case and it trusted the two parties “have been working in good faith to establish a lawful rule that addresses COVID-19 and its devastating effects on Wisconsin.”

As of Wednesday night, neither the governor nor legislative leaders had offered an order or rules to serve as a replacement. That leaves Wisconsin as the only state in the nation without a single protective measure in place to combat the coronavirus, Evers’ office said.
The legislature isn't doing their job and the executive branch is operating as an unchecked branch of government with zero oversight. Sounds like Illinois and twenty other lawless states.

Legislatures should be in session during this "crisis," creating law and checking governors' "executive orders." Madigan is finally allowing the Illinois legislature back into session later this month, meaning that Illinois should be able to handle an election this November....right?

Why do we have a constitution and an elected legislature if we are going to allow ourselves to be ruled by executive order.

Madigan has already neutered the Legislature by setting an agenda where only the budget can be discussed.Nothing about the COVID Plan is allowed to be debated during this Special Session.

WHEN? yes WHEN has the legislature ever in the last 30 years at least, done their job! Oh wait running the state into the ground and filling their and their friends pockets with money maybe they think thats their job! This BULLSHIT has gone unchecked for 30 years so maybe they think it is their job! Anyone that has been in government in the city, county, state level for more than 4 years should be prohibited from running again. Big corporations switch their managers around every few years to prevent them from getting cozy and scamming, stealing, or any other underhanded deal. In illannoy the media used to write about backroom deals which is a group of cozied up democRATS scamming, stealing or any other underhanded deal.

“Due to the Corona Virus, the polls will remain closed and the election is cancelled. Trump will remain president for the next 4 years. (Watch how quickly the epidemic is over)”

With won't be the only state that this happens to. Wait until closed businesses start suing the states lots of very big checks will be written. Cowardly politicians fell for the fear tactics of the media. 2 million plus dead. When China a country whose population is over 1.3 BILLION only had the kind of DOA numbers it reported something was amiss with all the models. Yes I realize they cooked the numbers but even if there numbers were triple what they reported the models were wrong. The real problem was once everyone realized the models were not even close they would not admit the error. In fact fools like Fat Man and Little Boy doubled down on the error to crash the Trump economy. That is all this now anot her attempt to get Biden elected. If he is reelected the Democrats will have a rule scale violent revolt. The good news is Republicanstill have the majority of the countries guns.

Interesting. Up to this point, most of the court cases around the country (including Illinois) Have supported the Governors orders.
I wonder if the Wisc Gov will just ignore the ruling?

Excellent. I am not familiar with Wisconsin. I've always considered it too gauche for ne. However, my hair needs to be styled badly and a mani pedi is long overdue.

Does anyone know anywhere in Cheeseland where my needs are considered the norm?

Now, kees me you fool!!!!

Governor Madigan is ordering them back, however they’re going to use that huge stadium owned by the bank of Springfield to social distance, I would definitely bet that they are upset that they have got to go back and at least do something they’ve done nothing anyway what do you think they’re going to do? Maybe order more recreational weed places to open in an emergency situation crazy isn’t it how is recreational weed is still allowed to be sold I understand medical but recreational let’s get everybody drugged up, on the liquor stores are open so let’s get everyone drunk into a drunken stupor so they don’t realize what’s going on, wonder how the candy and junk food sales are going with the weed smokers needing their munchies!?

The WI governor, Evers, is a former teacher who is in way over his head. But he’s a democrat, and WI is slowly turning liberal thanks to Milwaukee, Madison and Door County. Just like IL with Chicago when the rest of the state is primarily conservative.

It seems to this observer that the reason Madigan is bringing the legislature back is specifically to create laws for Pritzker to avoid all the lawsuits and rebellion.
Seeing Wisconsin's lockdown getting dinged by their Supreme Court must really be giving them pause.
They might get to some legislation of importance too.
Honestly, listening to Pritzker on the radio is getting more terrifying by the day.
The "as a post" metaphor is getting insulting to posts.

Corrupt IL Supreme Court would never entertain any governor’s tyrannical overreach, unless it’s Rauner, and basically because they defer to lower court initial rulings. Appeals would be sent into 2022. They know this, it’s taught in IL judicial training skool.
Rule of law and the constitution don’t do well here.

Legislative crisis:
Here’s why the Dems are so firm on lockdown.
There are only 11 states with gubernatorial elections this November, of that 4 of 24 Dem run states DE, MT,NC,WA = total 33 electorate have elections. Only WA (12) is the only state governorship up for re-election of 6 key battleground states where DJT is leading in polls. NC(15) is a swing state that DJT leads in polls. No other Dem run states have any skin in the re-election game this cycle. Their only worry comes from an panicky DNC.

You will comply...and watch out, JB CornFed will activate the Natl Guard (and the General is on Team JB) to do what local constables wont.
Free the criminals - Jail and fine the taxpaying citizens.

Before COVID-19 hit, Milwaukee only had 3 Early Voting Sites, for 15 Wards. 😑 Madison has 18 Early Voting Sites, for 20 Wards. 😃

Similar to Election Judges, Wisconsin has Election Inspectors (paid $130) and Chief Election Inspectors (paid $160). Who'd refuse that money for a day's work? Milwaukee said seniors wouldn't work Election Day, due to COVID-19. Well then, hire some of the people waiting to vote. ☹️

Wisconsin doesn't elect ward and township committeepeople and alderpeople don't assist with elections. ☹️

SCC, you were a little off, the Republican legislature did their job, so saying "The legislature isn't doing their job and the executive branch is operating as an unchecked branch of government with zero oversight. "

I got the following from Representative Vos - "Madison, WI…Speaker Robin Vos (R-Rochester) and Senate Majority Leader Scott Fitzgerald (R-Juneau) released the following statement after the Wisconsin State Supreme Court made its ruling in Wisconsin Legislature v. Andrea Palm, declaring Emergency Order 28 unenforceable.

“When we met with Governor Evers a week ago, we asked him to begin negotiating with us on a plan for reopening. He politely declined and said we should wait for the court decision. Now that the decision has been rendered, we are confident Wisconsin citizens are up to the task of fighting the virus as we enter a new phase."

Unfortunately, some people's republics are scuttling back to the security of shelter at home. Or was that cower at home?
