Overreach?

Sorry, but we don't trust this asshole any farther than we can throw him:

  • In Illinois, 114,000 people are banned from owning guns because of legal tangles or mental health issues — three-quarters of them haven’t surrendered their firearms, according to data the Cook County sheriff will present Thursday.

    Sheriff Tom Dart is seeking $10 million from state lawmakers to tackle what he calls in naming the report “A Firearm Regulation Crisis.” The money would train and equip more door-knocking officers to retrieve or ensure the safe storage of weapons from those who have had their state Firearm Owners Identification cards rescinded.

    The aim would be reducing the chance potentially volatile people would exhibit the type of violence seen when a shooter who wasn’t allowed to own a firearm carried out a massacre at Henry Pratt Co. in a Chicago suburb.

The failures across all levels of government here are quite astonishing:

  • gun owners who have their FOID card revoked are sent a letter to surrender or transfer their guns to a qualified individual or nearest police station;
  • should the now-revoked person failure to complete the required paperwork, another stern letter is sent...again and again and again and....

We don't think felons or domestic abusers (looking at you Steinberg) or the mentally ill should have guns. In those cases, a lengthy and thorough investigation should have taken place and been adjudicated in a court of law....just not a court in Cook county.

But what happens if the current FOID case working its way through the courts ends with the card being declared unconstitutional? Don't worry....they'd NEVER go door-to-door trying to take guns.

Team of 5 in a fatal funnel would be a turkey shoot to even the most unexperienced of shooters who have a purpose. Shields can protect against 556 and 762 as long as the person holding the shield does not trip and fall upon entry. Cooking oil can be used for this purpose. There is just so much that can go wrong. Seen it all in Iraq.

Does the county even have the manpower to do this? Sure they'll violate the constitution on 1 or 2 people, all with the media in tow, but I would think their manpower situation is as bad as ours.

Not everybody with a FOID card owns a gun. My son has a card, just so he can go to a range to shoot with his friends.
( he doesn't personally own a firearm )

Fart is looking for the easy gun grab. He claimed tragedies have occurred because these desperados haven’t given up their cards or guns. What tragedies exactly, how many, as many as the tragedies heaped upon Chicago, Cook County, by the under- charged, released without bail, repeat gun offender true criminals?

How many of these revoked FOID holders have been able to buy guns after revocation? If any have, and the state police background check failed to stop the sale, then that is solely a result of failed bureaucracies set up by inept politicians like dart.

The fact is that dart, criminalisha, peckerwinkle, and many clown mayors, allow the real criminals to persist in the terrorizing the citizens of this county. The priority should be street crime being perpetrated by real criminals, that never had FOID cards to begin with and are way more dangerous to society.

It’s election season, dart needs his name in the media for future higher-office ambitions.

Tell Leo to put your laundry down and chase real criminals.

I have had several people over the years use my address to get out of state-mandated drug programs and other purposes, they simply used my house as a number to report and nobody ever checked it out. I have a huge folder of official mail from agencies, hospitals, various law enforcement bodies for 5 different people. I have had County Sheriff's Deputies serving warrants knock on my door looking for persons who have never lived at my address and when told that, demand proof they never have.

This is gone to far. The legislature passed a law last year where any LE can with the clicks of a computer have the State Police rescind your FOID cards. Going on in southern Illinois, another reason to screw over those people that tell them to vacate the land. All they say you are dangerous to yourself because you became angry at them..

Only a Judge in a court should have the right to revoke a FOID card, and Darts people should need a Search Warrant to enter a residence.

Remember a single copper died of natural causes in the 001 First District. The Tac Sgt decided to take all his weapons five and turn them in as a weapons turn in.. No respect for the family, they could have left the weapons there in the deceased po s safe.

His brother and sister tried to get the weapons went and got FOID cards went to the 001 Dist to get the Commander to release the guns..Commander refused because it occurred with his predecessor..they go to Area 4, get the weapons signed off.

Go to ERPS denied. Finally go to Corporation Council. Get order to return weapons.

Weapons returned with engraved inventory number, and coppers name and star. 2 year wonder..

Guns useless, the gun shops would not purchase or accept as a trade in..marked CPD. THIS was 1996..

We even screw are own over. Screw Dart that pandering democratic xxxgina.

Refer these matters to US Attorney’s Office for Federal Prosecution.
Felon in Possession is violation of 18 USC 922 ( codification of Gun Control Act of 1968).
The Elements of Proof are simple and straightforward:
1. Proof of Felony Conviction by US Federal, ANY State, or ANY Tribal Court, or General Court Martial ( UCMJ)
2. Proof of Possession of ANY Firearm ( loaded or unloaded, bought or stolen, acquired before of after Felony Conviction)

It never ceases to amaze me the felons with many convictions carry guns without a worry in the world. It's truly a case when you've got nothing you got nothing to lose.

A legal CC holder that puts one of these felons at room temperature will be put thru the legal wringer.

Seems to me that all law enforcement officers are sworn to uphold the Constitution of the United States of America which includes the Second Amendment. Violating their oath of office by treading on citizen rights under the second amendment makes Dart and his marauderS civil rights violators, no??

Felons ought to be able to arm themselves. The 2nd Amendment is an unassailable right. One's right to self protection is a God given one that man has no authority to infringe upon. The 2nd amendment doesn’t separate out a subset of the population for disqualification. The right to bear arms is absolute!

If you transfer your weapon to a "qualified" person, that person needs a FOID card? That person is not a 'owner' persay. You also need to notify ISP of the transfer.....smacks of big brother.

Interesting how some of the news stories touting Dart's money grab neglected to mention transferring firearms to another person. Some just said you have to turn in your FOID card and guns if revoked. By the way, do you know another reason for FOID revocation? MOVING OUT OF STATE.

There are at least 2 cases winding their ways through the Illinois courts and more cases in the Federal system that challenge the Illinois FOID law as unconstitutional. It is probably illegal under the FOPA (Firearm Owners Protection Act) but that doesn't seem to matter to lawmakers.

Other Federal courts have ruled that requiring a person accused of domestic violence to surrender firearms is unconstitutional as there is the presumption of innocence and it is only an allegation.

There are about a dozen cases in the courts right now regarding assault weapons and magazine size limits. Some circuits have already struck down magazine size limits.

This is a trial run by Crook County for all to look at and add to their ability to take guns away from lawful citizens. If you didn't renew your FOID card does that make it revoked?? If you moved and later returned to that pisshole would you still be revoked?? They don't care. This is a gun grab, period.

I read recently the Supremes will hear a case regarding the demand that the local government makes a potential gun buyer obtain a government issues permit. There is a temporary hold placed by the appellate court for enforcing that law.

I always thought the Illinois FOID card, is a tax on a Constitutional right to possess a firearm. Similar to a poll tax, that prohibited the blacks and poor from voting because they could not pay the poll tax. The Supremes said the government could not place a tax on a Constitutional right. I am not a lawyer, but I know many, and in My opinion the government cannot place conditions or taxes on a lawful purchase of a firearm. Sales tax, I'm sure, should be paid as with any purchase.

I live in Arizona, and we do not need any permit to open or conceal carry here. The law prohibits ex-cons from owning a gun as with almost every state.
