Good News for CCL!

It is now legal to carry on the CTA and Metra....for exactly four people:

  • A US District Court Judge ruled that an Illinois ban on concealed carry of firearms by permit-holders on public transportation is unconstitutional, providing summary judgment and relief to the four, individually named plaintiffs.

    Ruling in the United States District Court for the Northern District of Illinois Western Division, Judge Iain Johnston, found that the state, “failed to meet their burden to show an American tradition of firearm regulation at the time of the Founding” as it relates to elements of the Illinois Firearm Concealed Carry Act.

    The case, known as Schoenthal v. Raoul, challenges a list of prohibited areas for concealed carry permit holders in the state of Illinois (which does not allow open carry of firearms). Gun rights organization, Firearms Policy Coalition, supported the case.

There is a note attached to the article:

  • A district court judge ruled that the Illinois ban on concealed carry on public transportation is unconstitutional. However, the relief granted by the judgement only applies to the individual plaintiffs in the case, not the public as whole.

This is a District Court ruling, and the State is sure to appeal it to the Seventh Circus Circuit, whereupon it will go the the US Supreme Court in a few years. But in the meantime, be sure if you get called to a person with a gun on the CTA and/or Metra, it isn't one of those four people who just won their case in court. You'll be on the hook for a few million dollars personally.

Kind of darkly humorous that this comes out right after Monday's shooting.

I was under the impression that the constitution was the law of the land and applied to everyone. How can an unconstitutional ruling only apply to 4 people? What about the equal protection clause? The law should apply to everyone.

I'm waiting for a black 70 yr old grandma to be on the train with a .38 snubby in her purse when all of a sudden she's accosted by some undemonized yuff's who try to rob her...

Granny puts a few into one of them at point blank range, the other roaches scatter, and she steps over the body at her stop...

What's the O/U on Crimesha chargin' ole Granny with carryin' in a prohibited area? Because once she doesn't - the pool suddenly expands from 4 on up to the rest of us.

So it was ruled UNCONSTITUTIONAL by a US district judge. So what he is saying is the constitution only applies to the four plaintiffs??? Makes a lot of sense.
