Finally, a Good Decision

It's been years, maybe even decades since we've seen common sense prevail at the City Council - don't get used to it:

  • A key City Council panel on Friday rejected a $1.25 million settlement to the family of Dexter Reed, who was killed in a hail of Chicago police gunfire after he shot and wounded an officer during a controversial West Side traffic stop last year.

    Two months after the payout had stalled in the Finance Committee amid bitter opposition from some of the Council’s staunchest police allies, it was turned down by a 12-15 vote, blocking it from consideration by the full Council next week.

    City lawyers had recommended the settlement, arguing that taking the case to court would cost taxpayers several times as much money to defend with outside counsel.

    But a vocal bloc of Council members rejected settling in a case that saw Reed fire the first shot before officers instantly returned dozens of bullets that continued even after the 26-year-old went down, authorities have said.

A few aldercreatures ventured into the unfamiliar area of actual truth: 
  • “I don’t want to be associated with any conversation that justifies the shooting of a Chicago police officer. This is a bad day for Chicago, if this is the way the conversation is going to go,” Ald. Marty Quinn (13th) said.
  • “When I hear someone vocalize that they don’t know if they would do anything different than what this young man did to try to take the lives of Chicago police officers, if they were in that same situation, what the hell is going on in this room?” [Ald. Ray Lopez (15th)] said.

    “We have an officer who nearly lost his hand because this young man took it upon himself to open fire,” Lopez added. “Yes, his loss is unfortunate, but he is the responsible party for it. You want to settle because you say it’s cheaper. You are sending a message to every criminal, and you are also sending a message to every officer on the street, that their lives do not matter any more.”

The family claims "racism!" the way ignorant people (or folks) always do. The black offender shot a black officer as his first target, so who's the actual racist? The tact team was actually racially balanced and reflective of the city as a whole.

This was a can of worms that shouldn't be opened. Ever. Because there is a subset of people (or folks) who will actually attempt to get shot for the resultant payoff. We met more than a few over the decades, all most likely mentally ill to some extent, but all wanting to get shot or bragging about it after they succeeded.

UPDATE: This was the Finance committee only. Trust Conehead or his lackeys to try to find a procedural end-around at some point.

It’s a good decision, but you have to wonder if the officer that got shot had been white whether they would’ve come to the same conclusion or whether they would’ve caved.

SCC, you hit the nail on the head when you said there are people and folks who try to get shot to get the payoff.

Two stories. First is an offender who walked into a CPD station (not named to protect the victim officer). The offender puts his wallet and keys on the counter, then points a gun at an officer at the desk (not wearing body armor). Another officer fires, striking the offender in a place causing the offender to drop the gun. In the ambulance, offender was crying and screaming that the officer was supposed to kill him.

Next story is a little different but involves a payout. How many have heard about family members taking out life insurance policies on their gang banging children and grandchildren? It had and does happen. And the companies pay out.

Dexter fought the law and the law won. The city should be looking to recover medical costs related to the treatment of the injured officer from his estate. Paying out money to award his criminal conduct is preposterous.

In this world of soft ass "Demolition Man" policing , nobody is going out of their way to get in a shooting yet alone any interaction with anybody. With that said, the general pattern being noticed is discrimination and racism against police. The black community is stuck on being racist. Our police community is diverse and we as police get along fine with other coworkers of different races. This isn't the 1960s ! The department is mainly hiring Hispanic now but there are still many black and white officers in the mix that have not hit 50 yet.. In fact, when we hang out off duty we poke fun of one another without worrying about CRs and libtarded things hahaha. Whike truth nothing but the truth aint no thang!

For the 35 years I’ve been paying attention, the City of Chicago has been settling the cases they should fight, and fighting the cases they should settle. While my optimism is very low, this is a small step in the right direction.

Honestly, to me 1.25 million is safe and it ends any stress for the officers. I would leave this 100 percent up to the officers who are getting sued. If they want to settle for this amount then do it, if they want to fight then fight. For them, this may be the end of a lot of stress they don’t want or need. Also, jury trials are tricky things. Plaintiffs attorney will harp on the stop.. harp on how stops happen on the west side.. how he believes there was no justified reason for the stop. It has zero to do with the use of force but it’s a slick lawyer trick. They will paint the officers as over zealous. They will say they shot way too many times. They will say it could have been handled differently. Other tactics could have been used. Etc etc. now I’m not saying ANYTHiNG that I just posted is true, but in civil court you don’t need facts.. you can make your opinions truth to sway a jury. 1.25 million can quickly become 15 million plus now paying attorney costs for another 5 million plus. Go with the 1.25, family gets about 700k which will be gone in about a year and they will be back where they started.

THe injured officer should hire a lawyer who will countersue the offender for said pain and suffering hopefully the court will subtract any award and compensate the injured officer.

Any changes to any equipment or uniforms must be covered by the city:

Section 21.4 — Uniform Change or Modification The Employer shall pay for the first issue of any change in, or modification of, the prescribed uniform announced and effective after November 15, 1981.

Screw that. Leaving it up to the individual coppers will result in the same thing happening now. Most won't want the prospect of a trial even if they think they were 1000% correct in their actions. The money grab by these p.o.s plaintiffs and lawyers will just continue. I say fight all cases where the circumstances are overwhelmingly in our favor (like this one) and only settle the ones that are overwhelmingly not (say like a JVD). Those going to trial, fight for a bench trial. In recent history they've actually had better outcomes than a jury

This was a known thing the day the Chief and Deputy Chief of the Minneapolis P.D. testified that the manual contained no directives about neck restraints. Just in black and white. Officer Chavin's mother had 2 copies of that training manual. The Chief was actually in that photo of the neck restraint in the manual. The judge denied the defense's request for admission. The manual was one of the main pieces of evidence of the defense. There was no way this would be a fair trial, and the appeal would be denied. Minnesota and Chicago have a lot in common for the fix against the police. Please read Liz Collin's book about this travesty of justice.

The Corporation Counsel's office is "Let's Make a Deal", and The City Council is the banker. I agree with another poster that there is no (real) reason the city should not hire competent attorneys to defend the city in these money grab lawsuits. Of course, the reason is no give-a-ways, no "donations".
