Off Duty Cop Kills Dog - Owner to Sue

  • The owner of a dog that was shot and killed by an off-duty Chicago police officer is distraught Tuesday.
  • There's a candle burning in David Pino's dining room, a little memorial to his dog Capone, a 2-year-old boxer who was shot to death by an off-duty Chicago police officer last Friday.
  • Pino says he is going to get a lawyer.
Anyone know who he's going to sue? The cop? The City? We're betting on the Cty - deeper pockets. And Corp Counsel will settle, setting another bad precedent and costing taxpayers even more money in the long run just to rid themselves of a case that ought never be filed because this owner is completely in the wrong, regardless of how his dog got out.

I have no knowledge whatsoever regarding the temperament of the deceased dog or the circumstances of his death.

I am an animal lover.

Still, I can't help but wonder what kind of person would name his pit bull "CAPONE".

It was my understanding that a dog is considered property. So he'll get about $200-$250, that's it!

But, in our highly litigious society, he's hoping to get punative damages too, a lottery payout, so-to-speak.

If you look closely at the newscast you can see that those weren't tears in his eyes..they were dollar signs!

Here's a better idea..HOW ABOUT TAKING A LITTLE PERSONAL REASPONSIBILITY YOU FUCKING CRYBABY! MAYBE YOU CAN GET YOUR HOMEOWNERS INSURANCE TO PAY YOU FOR YOUR FAULTY GATE DIPSHIT!

Doesn't matter who was right or wrong, this was a companion animal and the owner is hurting. Do the decent thing.

The dog chased the officer and is now DEAD to bad! Why was the gate where this dog lived broken? It is the owners fault 100% maybe animal cruelty will give him another free dog!

Years back I was involved in a squad car accident. Got busted up pretty bad but so did everyone involved. Of course I got sued. It was expected. Rather then settle the corp council fought it and it went to trial. Although the city still ended up having to pay some it was a fraction of what they were originally planning to settle for, even after court costs and everything were taken into consideration. The two CCs were dancing their bosses came to court and congratulated them on a job well done. Hell I even made a bundle on overtime. You wopuld think that they would learn that it does work out well to fight. I bet it was a while (very short) before that attorny was so anxious to take a case to court.
Fighting can be a good idea but you have to understand you might take a loss if you want a win.

I hope the copper sues the dog owner for allowing his dog to terrorize innocent people. I am a dog owner and take that responsibility very seriously. I have a responsibility to both my neighbors and to my dogs. if I allow the dogs to get out and attack someone it is my fault and no one elses. People have to remember dogs are dogs and therefore property. Don't expect them to act like people. As far as the owner hurting TOO F&$%#@G BAD shit happens

The officer told investigators Capone began chasing him and attempted to attack him.

What if the dog had attacked a kid? Would the Media put a different slant on things then?

The entire article made it sound as if the off-duty shot the dog just the hell of it.

IMO, the off-duty had every right to defend himself when being attacked from the animals out there, whether it's got 2 legs or 4.

so if the security camera tape shows the po was in the right will the owner pay him for the pain, suffering, trauma, nightmares, etc that the PO suffers? Leastwise if the po has a good lawyer he will.

As a retired PO, I have my gun when I take the garbage out.
Years ago, the job was a way of life, now it is a job, that most younger officers don't really like. They look for excuses to "not get involved".

There use to be a great instructor in the academy, Dan Scalia, who used to say "what are you going to do, call the police; You are the police."

I was proud to be a small part of what was called "chicago's finest".
Today too many of the police have no balls, and I mean that literally and figuretively.

I could be wrong, but that's my opinion

Boxers aren't known to be vicious, but who knows what happened. Who goes jogging with their gun? If the dog didn't attack, then shame on the gun-toting off duty jogger..get the guy another dog, he's hurting....if someone blasted my dog away for no reason I'd be crying too.

We have enough to worry about in this country with terrorist. People in this world want to slit your throat if they had the chance just because you are AMERICAN. In Chicago, we have several brands of terrorist. The racist politicians who will make every attempt to play the color card, A mayor who drains your money and gives it to his friends in the form of contracts, and lets not forget the gang bangers. And now they will fight with you, but when they loose the fight, get a lawyer to file a suit against the city knowing the city pays out. If you try to pull them over, they know your not supposed to chase them so they take a chance and flee. If they crash, again the lawyer files suit and Chicago pays out.
Well as for the CR issue, I have to say, since I do as little work out there as I can, my CR collection has dropped substantially, so the next time one of those punk ass gang bangers decides to look me in the face and spit on the ground, there getting a punch in the face and a kick in the balls hard enough so they hopefully can never re-produce another shithead. It will be my one and only CR number for the year. And well earned.
Im not doing a thing for this department. I backup my fellow officers so we all go home safe at the end of the tour. 2 more years to go. OORAAA

This is correct, and is a direct result of a department not backing it's officers if they take any kind of action while off-duty, now a days they don't want to back you when you are on duty. The city doesn't want any kind of proactive activity from it's officers, police work has become too much of a liability to this city. Taking police action means calling 911, that's it unless your personal safety is at risk. That's what they want, thats what they get, just my opinion.

In reference to the 2 coppers in 022,

I have been hearing some coppers saying I hope it's not true, or the fuckin media already has them convicted. Im also hearing coppers saying dam feds.
I must say, Two things I hate to hear.
1. Terminate the pursuit
2. Chicago Police officers caught in sting.

As for the feds, there on our side. If you are going to take this job just to be a criminal, Fuck you. I hope you get caught before too much damage is done.
As for the media, there not our friends, but when the feds and IAD are conducting an investigation, they dot all the I’s and cross the T’s. They know what there doing. There working on good information and the coppers deserve to get caught. When the media takes it to the citizens, at least in a situation like this, I already convicted them based on there own stupidity and are now going to be but buddy’s in prison.

Big Cline commented on the news that there is allot of temptation out there and its going to happen again and he hopes to catch it. Lets prove him wrong people. Yes there is allot of temptation out there. Were under paid, over worked, under staffed, but just do your job or get out. Have some pride and integrity and do the right thing when your at work. If you don’t like it, and many times I don’t, go home after work or stop at the mill for a few, talk or complain to a few people who understand what were going through, then get over it and move on.

Don’t take anything that doesn’t belong to you. Do paper when its needed, arrest when required and for god sakes, don’t lie in court. If you have a good case, it is what it is. Don’t put yourself out just to get a win in court.

The moral of my story;
Go to work
Do your job
Backup fellow officers
Do the right thing, inventory and documentation
Collect your paycheck and pension
Go home safe and sound at the end of the tour, hug your wife and kids
And most off all...
Thank GOD for what has been provided to us for all the good we try to do. Be glad were in America and working.

To those officers in 022 who are guilty in conspiring with this stupidity or feel for those two criminals, fuck you. For those of you in 022 who are good coppers, I hope you can manage to clean up the mess and move on. I feel for you and hope can overcome this.

And to any officers out there who want to be a criminal, I hope you work by my side someday. I will turn you in faster than fly’s on shit.

Why was the owner so suprised that his dog was shot? The owner himself thought the dog was enough of a threat to have a beware of dog sign on the gate that was broken. It's a dog owner's responsibility to be sure their dog is secured. I hate to see a dog get killed but rather that then the copper or someone else injured due to the owner's negligence.

My hat is off to the officer who shot the dog. If the owner was a responbile dog owner the gate on her yard would not of been broken, and if the gate is broken they should of gone out each time with the dog or put the dog on a leash in the back yard. Who cares if the officer was out jogging with his gun(Isnt it a oath you take as a officer to serve and protect 24 hours a day wether your on duty or off)Thank god the dog didnt attack a innocent child who couldnt defend themselves, the dog could have mauled a child or anyone who couldnt defend themself. I am a dog owner also and if my dog got out without me knowing and went to attack someone I couldnt live with myself and I would understand that someone shot him. Yes I would be very upset and probably scream at the person who shot him, but after I calmed down and realized what happen I would understand. As far as this lady being able to sue anybody is completely ridiculous.It was her own fault her dog was shot, she should be happy someone isnt sueing her for losing a arm,leg or eye. And I cant even believe someone would suggest that the officer should buy this lady another dog....Oh please what is this world coming to. The city should stop settling these stupid law suits and spend the money on there own employees who put there own lives on the line daily

So he shot a freakin dog, boo hoo! Until you have been bitten by a dog u can't say shit. I would be suing that owner for allowing his dog to get out! Don't be rippin on the guy for defending himself. I have a 110 lb german shephard and I have taken every measure to train and effectively control my dog, he is an ANIMAL with animal instincts. If my dog bit anyone due to my negligence I would shoot the dog myself. Owning a dog is a big responsiblity, if someone can't handle it don't own a dog. I carry a gun everywhere also, not because I want to stop crime but because I want to live another day and be able to protect myself if I have to.
They guy did what he had to do and I hope he will do it again if he has to! This is what I call preventative policing. If we could do the same to the criminal element we would be a much healther crime free society.
