Iowa Stupidity

  • A Chicago Police officer has been sentenced to five years in prison. He says he was defending himself against a drunken attacker while off-duty in Iowa. A judge in Dubuque, Iowa, says the police officer should have simply run away.
So now we're required to run away from attacks? Even off duty?
  • This is not just a question of whether the punishment fits the crime. Chicago Police Officer Mike Mette says there was no crime. Nevertheless, a judge in Iowa this week sentenced Mette to five years behind bars for slugging a Dubuque college student, even though the judge admits Mette was being attacked at the time. No one is disputing the facts of the case of what happened that night, only the outcome is being questioned.
  • When the case went to a bench trial in December, Dubuque County Judge Monica Ackley found that Chicago Police Officer Mike Mette "was not the initial aggressor of this incident," Jake Gothard was. Nevertheless, Judge Ackley ruled that Mette was guilty, because even after Gothard struck him three times, Mette should have just ignored it and retreated.
We're hearing rumblings that John Kass is going to make this a column on Sunday. This would appear to be a case of an over zealous prosecutor attempting to make a name for himself and a complicit judge abetting this miscarriage.

One would hope that after Goudie's piece on the news Friday night and if Kass covers this Sunday that the next step would be a public statement of support from the Superintendent's Office and maybe a few more exempts. This is some of the stupidest crap we've seen come out of Iowa in a long time.

This country is doomed, commonsense and justice are gone.

How can the great American citizenry be so ambivalent and ignorant to what is happening to our great nation?

For an injustice of this magnitude to occur in a conservative rural state like Iowa stuns me.

I pray that Officer Mette receives justice and that this nation wakes up from its slumber.

Superintendent Phil Cline must intercede on this officers behalf and initiate media interviews broadcast here and in Iowa to illustrate the ludicrousy of this verdict. He also needs to contact the Chief of Police Assosciation to demand justice for one of his officers.

The Superintendent is a lameduck and always stated if you are RIGHT I will go to bat for you. Now is the time to bat Phil.

Boys and girls demand that Phil takes action before he departs office. This is an unprecedented INJUSTICE and a huge miscarriage of justice.

Where is the FOP??? Always MIA, why do we even have a union? Did Mark call the FOP in Iowa about this injustice?

I just looked up the story online and all the various news outlets take the basic tact and fact you do.

This is crazy. The idiot who started the fight is now considering civil action against Mette.

Just like police need to use discretion on who to arrest prosecutors need to use their brains on who to charge.

Don't even get me started on the judge.

The only question I have is why the Dubuque Police arrested Mette. It would be interesting to know why.

By the way the President can't pardon Mette. I assume that only the Governor of Iowa can since it was a state charge. I don't know what power the governor has in Iowa as to that.

Yes judge was correct so lets extend this logic back to the Judges. Lefkow should have cleared her elderly family out of the house in anticipation. Because the fact that her family was their and might have resisted the aggressor they should have escaped the attack of that deranged hillbilly. Thus saying "Please don’t kill me" makes them liable they should have crawled away. YOU JUDGES SICKEN ME"

Something tells me this is a backlash for the Abbate and Jefferson Tap videos.

They must have finally gotten electricity and cable TV in Podunk and the irresponsible media must have played those tapes like they did here. How could the judge and jury not be influenced be this; a Chicago Cop, he must be guilty of something.

Maybe now the city attorneys and officer's defense attorneys should demand a GAG ORDER in these situations.

Beware, Richie likes cameras, and has said he wants to make Chicago like London in that way. He has proposed that certain businesses be required to have surveillance video systems.

BIG BROTHER IS WATCHING YOU!

Oh, but you forgot the part where he was fired from the city. The article I read doesnt specify if he was fired as a result of this, because of a FELONY conviction, or some unrelated matter. Anyone know? The article also said that he did walk away, only to be followed by the college student back to Mettes brothers property where the student then proceeded to hit him 3 times. Poor guy probably took a bench trial thinking that with his knowledge of the law, the judge would easily see that this was a case of self defense.
Only the outcome is being questioned?? So if the student just received a black eye from the incident he would have been found not guilty even though Mettes intent was the same (to stop the attack). The only question is were his actions reasonable. It doesn't matter if you suffer brain damage as a result of being punched if it was a reasonable response. If some drunken fool follows me and is being verbally abusive and then proceeds to hit me 3 times, I would say a reasonable response would be to hit him back. Unless there is a lot more to this story then I read, this is a complete miscarriage of justice and shows a gross predjudice towards police officers. This judge should be taken off of the bench. Hopefully he wins in an appeal and then sues to get his job back (if he still wants it after all this).

At first I was going to say: "Someone ought to take a trip out to the sticks and teach these hillbillys a lesson in etiquette"

But then I realized: this judge and prosecutor have a legitimate beef against Chicago. This copper isn't the issue, it is the arrogance of the City of Chicago that is the issue

MOST Americans citizens live somewhere in the USA that allows them their the freedom to protect themselves in the face of immediate threats.

Currently, 48 U.S. states allow some form of concealed-carry of firearms for qualified citizens. Illinois (and especially Chicago) is not one of those places.

I don't blame this judge or prosecutor in the least for making such a powerful political statement. "Hmm, a Chicago police officer, eh? Aren't those the same Nazis that steal people's guns and put folks in jail for excercising their 2nd Amendment rights?"

As ye sow, so shall ye reap!

This poor officer is being done a great injustice. The judge claims the officer should have ran away instead of defending himself? The department better issue a statement backing this officer and his actions or moral is going to go even lower if thats even possible. They way things are going the public is getting a message that we as police officers are now human punching bags, so feel free to take some free blows. Let me know when the benefit is, because there better be one. We need to support each other because nobody elese will.

SCC, you're headline should more likely read:

Illinois Stupidity Comes Home to Roost

As I'm sure you remember, Hale DeMar was the Wilmette hero who shot the sh!thead trying to burglarize his house (for the 2nd time).

Wilmette authorities, in their infinite wisdom choose to prosecute DeMar on weapons charges. Asked today why he continues to fight Wilmette, even though legal fees could end up costing him thousands of dollars, DeMar said, "It's a question of (village officials) usurping my right to defend my home. I don't think the municipality has a right to contravene my 2nd Amendment rights."

Rural people aren't just slack-jawed yokles. They actually keep up with the news. With such an offensive attitude towards the 2nd Amendment, Illinois people (especially law enforcement) are going to have to pay the piper when it comes to such matters.

I feel bad for the copper, but I don't blame the Iowa folks in the least. So you see, it's not "Iowa stupidity", it's pure genius!

What the F*CK else is going to wake up these Chicago Democrat-voting sheeple (including us)?

But to expect our Top Brass to defend a copper who got into trouble out of State? Are you all fucking crazy? We'd be fucked just like that poor guy. Like any media driven incident, we as the Police are supposed to Lay down when Off-Duty, and when where being attacked in Public. Wether it be at a bar, restaurant, Jewel Parking Lot, whatever etc... This is fucking ridiculous. That's why I tell everyone I meet I'm a Garbageman or used car salesman. NOBODY Will Fuck with you cause they don't care. They now have nothing on you. The worst part? Just think when you have to defend yourself or your family in public... are we supposed to lay down then? They tied are hands on duty, and thanks to that piece of shit ABATTE and Powers kid and crew? Our hands are even more tied off-duty. I have about 5 Years until I retire. I certainly wont have the age, and certainly won't have a whole lot when I do leave at 20 years, but one thing's for sure... when I go to jail for defending myself, it wont be as a policeman, it will be as an average Joe! And the case report will read: He's unemployed.

If I learned anything on this job that applies to On and Off-Duty shit... "They don't pay us enough to fight, and they certainly don't pay us enough to get our asses kicked!"

Iowa is far from being a conservative state. Our neighbors to the west have always had a left leaning slant to things. Remember they were the first ones to give us George McGovern, Jimmy "the Commie" Carter, and "Algore the Ass."

Old Grey Guy has a lot of it. Iowa is in some ways more liberal than Illinois, albeit without a lovely Chicago problem. Concealed carry there is "may issue", which means you have to be connected. Apparently there's no castle doctrine, meaning you have a duty to retreat when attacked.

OT, but they also have imprisoned people for homeschooling their children in Iowa, which would not happen in Illinois (for the time-being.)

Also off topic, what lovely attitudes and mouths some of you coppers have. I don't expect you to be happy about this, but this isn't about you, you know. If you don't want to "serve and protect" then get a different job, but to say that you're going to abuse your authority to get back at Iowegians for this is as stupid as what this judge did. It's a bad situation, and it's a pocket of blue la-la land here in the heartland, but it disgusts me to hear you guys do the victim act. This is a VERY GOOD guy and a great copper. Don't want to rumor monger, just looking for the truth as I have been IOD for a while and am kind of out of the loop.

Understand something what has happened to this officer is what happened in North Carolina to the collage students(stripper rape case). Present Bush pardons Libby yet the border patrol agents go to jail. Police officers no justice! only just us.

Last time I look IOWA was not a bastion of LIBERALS! Once again without benefit of the court files, testimony, or evidences........there are still some who think coppers can't do no wrong and when they do the world should look the other way. The Mayor, superintendent don't have any juice in IOWA and their big city, liberal democratic response wouldn't make it pass the public toliets. Chicago Officers should stay out of bars and Iowa, Wisconsin and other points not mentioned

I saw this story on Channel 7. Unless there is more to this story, this is a complete and total miscarriage of justice! Where is FOP and the leadership of this department regarding this incident? Does anyone have any ideas of how to help this poor guy out? How about on line petitions and or letters to the Governor of Iowa. Are people running a benefit for him. Though I don't know this officer personally, I would certainly contribute. And to those of you like 7/14/2007 03:54:00 & 04:09:00 who blame this verdict on our misguided gun policies and liberalism of this city's leadership, shame on you, you are totally wrong. There should be no connection between that and this unjust verdict. Also to "Old Grey Guy" you are right, many of these so called good hard working people in Iowa, Wisconsin amd Minnesota are a lot more liberal than you might think. I know, I have family in Iowa.

I've met some asshats in my day but you two are obviously the king and queen of asshats. You are somehow going to try and justify this obvious miscarrige of justice because you don't like the Mayor and his policies or because concealed carry is not allowed in Illinolis? That is the height of stupidity. I thought the courts and the Officers of that court were supposed to be the arbitrators of the truth. Whatever happened to that concept? You seem to feel that because YOU don't happen to agree with the Mayor that it's alright to put people in jail even though the facts in the case don't warrant it and because you two have a hardon for Illinois? I don't happen to like the mayor, his policies or his cronies but that doesn't give me the right to arrest a person who does now does it. You two should move to iowa asap. You will fit right in.

An off-duty Chicago Police officer died early Saturday morning after his motorcycle collided with an SUV in the Bridgeport neighborhood on the near South Side.

Wayne Smith, 34, of the 1300 block of West 98th Street, was pronounced dead at John H. Stroger Hospital at 12:09 a.m., according to the Cook County Medical Examiner's Office. An autopsy was scheduled for Saturday afternoon.

Authorities said they have a suspect in custody, but that he has not been charged as of Saturday morning.

The incident unfolded at about 11:20 p.m. Friday when Smith was riding his Harley Davidson motorcycle southbound on Ashland Avenue when a Ford SUV heading northbound turned into his path to head west on Robinson Street, according to Chicago Police News Affairs Officer John Henry.

The male driver of the SUV then fled on foot, but was apprehended a short time later, according to News Affairs Officer Laura Kubiak.

It was unclear whether Smith, an 11-year-veteran with the department, was on his way to or from work, Kubiak said.

The suspect was being questioned by Wentworth Area detectives. No charges had been filed as of 10:30 a.m.

Kubiak and Henry said it was not yet known whether speed, drugs or alcohol were factors in the accident.

This Judge is abusing her power and is DIRTY, PERIOD! Something needs to be done even to the prosecutor(maybe both of them can be disbarred never to practice law again), how can someone be GUILTY OF SELF DEFENSE? It is clearly displayed, when someone comes after you, to do harm, you must NEUTRALIZE the attacker in anyway possible. If he dies, oh well. It is the responsibility of our justice system to deal out justice in a responsible and impartial manner, uninfluenced by politics. It appears the judge in the case is a California transplant who brought her liberal self to the California of the Midwest, Iowa.

Some research is needed to find the links between the plantiff's family and the so called judicial and prosecuting officials involved.
Officer Mette was definitely railroaded and was not allowed the same right to self defense that every other ordinary citizen has. The POS plantiff had daddy pull some strings for his over grown vaginal ass.

The officer has been done a great injustice, by the Prosecutor, and the Judge, who admits that there was not intent on the part of the officer to commit any crime as he was only defending himself.
These are the people who should answer for their actions not all the people who live in Iowa.
What is really scary is that the above respondent claims to be a Chicago Police Officer and wants to punish (sandbag) everyone from Iowa. It appears that Chicago now requires its officers to have a college education but makes no attempt at testing them for common sense.

The Mayor, and the Superintendent with the backing of our brass should be appealing the officer’s case with the Governor of Iowa. Please let us know when and who will start a fund for the officer’s legal defense, and appeal.

**********************************

Mette is probably getting fucked because of that asshole Lt. that was pulled over for speeding in Iowa a couple of years ago. Then came to court with a CPD sargeant to testify, that he and his wife were passengers in the car and that they weren't speeding and that the Iowa copper was a jag-off and beligerent to the ranking Lt.

Well after the CPD officers testimony the "dash-cam" video is played..guess what? It only show's the Lt. and his wife.

The Lt. changes his plea to guilty to speeding and the sargeant gets arrested for perjury or miconduct or something and gets probation.

ANY ONE REMEMBER? IT MIGHT HAVE BEEN POSTED HERE.

**********************************

Let's make some noise about this "sandbag" and support P.O. Mette.

***********************************

Didn't know P.O. Smith, but are prayers are with him & his family!

P.O. Bob Rawa, I did know very well. God bless you buddy..we'll miss you..say hello to all our CPD brothers & sisters when you arrive upstairs..and look-over all of us here..WE CAN USE A GUARDIAN ANGEL RIGHT NOW! It's a bad time to be THE POLICE in America!

**********************************

Lastly, Is there any kind of legal insurance that will defend us and pay legal fee's associated with a costly defense, in a case such as Mette's? Whether occuring on or off duty?

I seem to recall years ago ICOPS (union?) offered one.

While the townsfolk of Iowa are indeed conservative, the political culture of Iowa is very leftist. Remember MEGA-liberal Senator Tom Harkin?

If I'm not mistaken, Iowa is the only state in the nation that is not home to at least one substantial military base. Whether that is by choice or not I don't know...

Imagine how much time he would have gotten if he hadn't been a cop.
Should that make a difference?
Lets face it you guys have a hard job, but you are just people. People go to jail for stupid laws and judges every day.
But hey I will give you the benefit of the doubt. If you can assure me beyond a reasonable doubt that there is no combination of prosecutor, judge and cop in your city that could have done the same thing to a normal citizen then I will feel for the guy.

****Nobody in this city would get five years for a battery.
They wouldn't even see jail time. Community service/Swap maybe!?

Wayne Smith, 34, of the 1300 block of West 98th Street, was pronounced dead at John H. Stroger Hospital at 12:09 a.m.

** It took 17 hours for charges to be approved against the driver of the SUV. He was under the influence.**
The next time you don't want to be bothered with the paperwork of a DUI, think about who's life you may be saving!

Please write the Dubuque Police Department about their cowardness with regards to this incident. I did. I hope everyone else does. Please do not stop writing. Let your thoughts be heard. Let them hear how you feel about them as a department and how they destroyed another police officer for political gain. Their chief needs to hear it over and over again.

Correct me if I’m wrong, but I don’t think the FOP can do anything under the contract because it was an off duty incident. But perhaps they could hold a huge benefit for the legal fees and the needs of his family, and also put pressure on our politicians to contact the Gov and get this mess straightened out.

I'd like to think that the few posters who are attempting to incite "retaliation" against the entire State of Iowa are trolls and provocateurs

Certainly, no current or former member of the CPD could be that stupid.

Acting in self-defense after already "retreating" and being struck 2-3 times by the intoxicated (BAC: 0.27) so-called "victim", Mette has the moral high ground.

This obscene injustice is a huge 10-1!

Michael Mette needs OUR back-up--big-time!

Is anybody here a member of ISRA/NRA? Perhaps a "delegation" of CPD/NRA members could get word to NRA bigwig Kayne Robinson about this matter.

Robinson was Deputy Chief of Police in Des Moines, Iowa before retiring. He likely has some useful insight into this mess.

RUN??? RUN YOUR HONOR?? I'm sorry, the Constitution of the United States of America doesn't say if you can't outrun the motherfucker then go ahead..bear some arms! Road trip is right. Every law enforcement officer in this country with time off needs to get a bus and head to Iowa. Same courthouse, same time, big numbers, lots of flags and salutes, somber, sorrowful law enforcement officers just showing their grief at this BLATANT abuse of power. FOP should be all over the news right now and not a peep! This guy needs someone and it's us and it's now. THIS is the terrorist attack we've been anticipating.

I know youre JUST writing this to get a response - so you can sit in your mothers panties and jerk your only friend while laughing at the arguments you created. But this isnt the time or place for it. Go back to sleep, think again about how everyone made fun of your lisp and bad hair in grade school, and consider being on the receiving end of your service revolver.

----------------------

this has nothing to do with sandbagging (which is a made up BS which = perjury and a false arrest). When a crime has been commited one has the discresion to arrest or ANOV, or let go. Correct.
I'm not advocating coppers to go out and make shit up.

After this cools down, ( I cooled off). You make a vaild point. To fight the people who did put Mike away, and not the people who happen to live in/from Iowa. Instead of invsesting my energy towards certain folks. Write polite letters.

The childish responses by many on here is disturbing. No wonder so many people have little respect for the police. This case is clearly an injustice. But to say that Iowans should be "punished" in response is adolescent thinking.

Would you feel the same way if one of our own moron judges screwed over some poor guy from Iowa? And then the Iowa police targeted you just because you live in Illinois?

Calm down. People are pissed. Let em cool off. It's all a bunch of talk.

You have got to be one of the sickest human beings I have ever seen. To say to a FELLOW POLICE OFFICER, "consider being on the receiving end of your serice revolver" is about as low as a person can get. THIS is what is wrong with the department - people like you. Then when an officer does do something, I'm sure you will be the first one on the ignorant blog to write "RIP brother, you will be missed." How about next time try to state your opinion without the vulgarity, rudesness and use a few common sense statements and facts. How dare you say that to a fellow police officer!!!

Many officers disregard DUI drivers. They believe DUI is a waste of time. How many officers have been injured or killed by DUI drivers. Next time you stop a DUI driver and let him go, think about Smith or any other officer or family member who might be the next victim.

Leave and never show his/her cowering face again? Absolutely.

Not a good representation of CPD. If it is OK with you that someone who tell a police officer that it would be better for them to be on the receiving end of his service weapon, then you don't deserve to be the police either.
