Jefferson Tap

A number of readers have commented about the Jefferson Tap story and video and a few others have e-mailed us, including a FoxNews producer. Here's the video link.

In our humble opinions here, the report and the released portions of the video would appear to back most of the officers' story. The Fox report states and the video shows that it is unclear if the officer leaving and one of the plaintiffs had contact or words. The video has no sound, so the allegations of verbal sparring back and forth becomes a "he-said he-said" contention with zero legal standing. Same with the "brawl." The most allegedly damning part of the whole encounter takes place in the vestibule where there are no cameras and the Sergeant "waving off" cars has been described as a "slow down - no one get hurt" response by the Sergeant's lawyer.

At any other time in any other place, this is a mutual combatant incident with no charges filed.

In any other state with an actually legitimate legal process and competent states attorneys, this is misdemeanor battery at the most with plenty of reasonable doubt.

The video obviously shows a distraught officer drinking at a bar. And as someone told us, if you make fun of someone crying at a bar in Chicago, it's practically an invitation to have your ass beaten. By all the evidence seen so far, even that didn't happened.

Yea, I saw some liberal jagoff media whore on ch. 11(ponce's hour) a few months ago. He was one of a group who was allowed to see the video. He stated how it showed how the POs clearly beat these yuppies. BULLSHIT!!

What pisses me off the most about this video is the reporter's narration when Powers' friend took his weapon..."this view clearly shows another officer taking Powers' "service revolver". It is unclear whether the officer viewed him as a threat, or if he anticipated trouble leaving the bar".

Ok, asshole. You just got done showing and telling the world that this kid was distraught over the death of his father. Everyone can see he's upset. But the media proclaims him a "threat". He was a threat to no one but himself that night, and his fellow police officers recognized it.

Kudos to them. As the old saying goes, "I'd rather be judged by 12 than carried by 6." Powers may be in some trouble now, but the important thing is that he's STILL HERE. Who knows what tragedy could have occured if that copper had not had the foresight to take away his gun.

At least on todays times the cover has amy jacobsen she was fired at channel 5 for being caught on tape a little reminder news stations and reporters are whores and even turn on their own! Wonder how much the "neighbor" was paid to allow channel 2 to set up cameras in their yard? The media will do anything to destroy a reputation even one of their own assholes that they are! Just another story for the media whores to get ratings. It's a typical bar fight, no big deal. And you can bet that one of those big-mouth yuppie stupid f*cks started the whole mess. The beginning of the video shows the officers together in a corner obviously upset, but not engaging anyone else in the bar which leads me to believe that a person or persons not involved with the officers precipitated the altercation by his own actions. Now poor yuppie dumb-ass wants to sue everyone and everything because his ass couldn't cash the checks his big mouth was writing! He deserved getting a boot in his face. Grow up and take your medicine like a man instead of running to lawyers to clean up your mess!!

These "attorneys" did more to damage the relations between cops and attorneys since greylord. This is such an obvious money grabbing swipe at the city and doesn't have a single thing to do with Powers & Co. I will personally spend the rest of my life referring people and companies to anyone not involved with these goofs. They forgot that police officers have family members in high places too.

Off topic here. A prisoner escaped from a traffic unit p.o. in 020 last night. As a result of good cooperation among various units and districts the prisoner was eventually taken into custody again. Just want to commend all the p.o.s and sergeants who worked on it. most everyone performed solidly.

As far as I'm concerned, anybody and everybody that has to be asked to leave a bar at 3:30am should have their ass beat. If the lights go up and you're still in there, you're getting your ass beat, period.

Go home, get some sleep. Read a book, watch a movie. Don't want to go home, need to meet friends? Go to Golden Nugget.

There is no excuse for last-call stragglers other than: WASTED.

I'm sure all these guys were going to catch cabs or have designated drivers, LOL.

Biggest mistake they made was to not make an arrest and if they weren't gonna make an arrest they should have left. Just goes to show you that politics and anti - police pc mania trump precedent, law, and common sense always. Don't know the sgt. and po's but hear most are ok people. Generally I agree with much of your take on things in the CPD. This time I don't.

I don't know completely what happened and I doubt the people directly involved know.

I do know near where the end of the tape where soon to be former Sergeant Planey pins the guy up against the wall outside by the neck.......uncalled for. Criminal even. How was the guy a threat then?

I know the responses that some will post here. "F them yuppies. They deserved it. We need our own bars without any F civilians. It was mutual combat. F the States Attorney we are being treated differently. F "Fat Phil"."

Just because we managed to graduate from a police academy, not all that difficult, does not mean we get to flout every damn law we choose. You don't have the right to pummel anyone who offends you. You are challenged and sometimes that means walking away.

Taking Power's gun away. That can be interpreted two ways. It's just as likely his buddy thought Powers was too distraught to be safely carrying a weapon as it was preparation for the coming fight.

Sweeping the pool table of balls.....what the hell was that?

The off duty cops in that bar could have walked away. They didn't I don't know if they were really provoked. Perhaps it was an "imagined" provocation.

What isn't imagined is that they outnumbered the "yuppies". Were clearly larger and should have walked away.

They are an embarrassment to themselves. Whether they deserve what happens to them I can't say. Maybe they are good guys who had a bad night. I do know that they brought it on themselves.

The most important thing I learned from my oversized, alcoholic, drunken Irish cop dad was to not drink to excess. He used the job as an excuse for everything he did. He was never at fault for anything in his personal or professional life.

If a group of aldermen beat the hell out of a smaller group in a bar and it was caught on tape many of you would be screaming for blood.

These guys screwed up and they are going to pay a price. That is the way it goes. If you imagine that a camera is everywhere you go then maybe you will be more careful about what you do.

I watched the video and I really didnt understand what the attorney representing Sgt Planey meant when he stated that Sgt. Planey did not waive off the on duty police and that he only told them to slow down and not rush into the bar. Was Sgt. Planey attorney attempting to put any/some blame for this onto the backs of the ON Duty responding officers.

You are so far off the mark it isn't even funny. It's more than apparent you know one if not all of the officers involved personally. You cherry pick what is seen in the video. What is shown;1) one of the officers sweeping the balls off the pool table. That's provocation.

2) The Sgt is seen escorting Powers back into the bar.Sgt exits and grabs one off the plaintiffs by the throat slamming him against the wall. AT NO TIME WAS THE SGT BEING PROVOKED.

3)If Powers was so distraught and had to be disarmed why would his supervisor allow him to return to the bar?

4)Are you as a Chicago Police Officer per GO allowed to consume Alcohol while armed& off -duty? Then plead mutal combatants when engaged in an altercation?

The tragedy is 3 POs from the 012th district were fired for doing their job meanwhile the officers who instigated this situation remain on the payroll.

The worst part was the Sergeant going after the "businessman" who was trying to make a cell phone call outside. That part of the video is damning.
They say that Powers was 25 years old at the time of the incident. He could have only had three years on the job tops then.
The daddies on this job should think twice about getting cush assignments for their offspring. Are they really doing them any favors? This is a prime example of clout gone bad.
By the way, did any camera pick up on when RICK FLAIR arrived and when he left that night??????

I have seen tons of fights and arguments from time to time in the city and nothing ever happens, but some fruitcake hears those guys were "police" and boom lets start a war. Rule 1: go to Tavern-Leave Gun Home, locked up.
Rule #2: If any trouble breaks out, call the on-duty police,if possible, or at least try to, or tell the bartender/doorman/security/waitress to call.Let the on-duty police then handle it. Sign complaints if necessary. Remember always; You have 2.5 strikes against you, just for being an off-duty Cop, and being in the joint in the first place. Remember, especially in Chicago, We Do NOT have the same rights as the routine rowdy bar-room drunk, the bar-room drunk has way more rights than us, and civilians can sue us and the City and get WAY, WAY more money from us and the City than from the rowdy bar-room drunk. The over-zealous prosecutors can score way more brownie-points for charging one of us than they can for charging the bar-room nobody drunk. The politicians can score more political points for hanging us out to dry than by hanging the nobody rowdy bar-room drunk. Be safe, be cautious, be prepared, be fore-warned.....

Hey this is the anonymous from 1:56.

Sweeping the balls off the table to avoid them being used as weapons is a good point. I remember there was a guy killed in Canaryville by one of his neighbors who was carrying a sock full of billiard balls. Only in Cararyville!

As my brother said "Hey, it's Canaryville. Whaddya expect?"

Only problem is that if you accept that theory, and it MIGHT be true, is that it shows the cops had intent to start the fight. It doesn't help their case.

As for those of you talking about "mutual combat" and "f the yuppies" thanks for proving my point.

It would have been nice if one of the cops there was sane or sober enough to stop his buddies from this stupidity.

As for the commenter who said firemen, traders and brokers are worse drunks than cops I tend to agree. Gives us something to shoot for. Oh shit. I know the traders do like their coke. Not the diet kind I'm forced to intake to keep just under obese.

Oh well. Maybe one of the aldermen will be charged with a crime and that will take the focus off CPD for awhile. Hopefully something involving drugs, underage girls, videotape, cash, illegal aliens, Paris Hilton, and a wannabee terrorist.

I worked at the Board Of Trade for 10 years before becoming the police. Stop calling theses guys yuppies or businessmen. The businessmen label is a touch added by their attorneys to soften their image. The atmosphere at the Board is that of a "blue collar" mentality while dressed in polo shirts. I have known many (not all) that were heavy drinkers and snorters, big gamblers and arrogant as hell.
You guys are making assumptions based on bits and pieces of video....shame on you.
The King video (partial) showed a group of coppers beating an innocent "motorist". Remember King was described as a "motorist" not as the criminal he was.
Again I do know one of the involved(so I am biased) and for those of you passing judgement on partial information ought to be ashamed of yourselves.

Off topic: Did you see where Mike Madigan introduced a bill where now a 2/3 majority vote in the house and senate will be needed before enacting any new pension laws. Geez, I remeber when Lisa Madigan was running for Attorney General and the FOP endorsed her over the pro police, career prosecutor from DuPage County, Joe Brickett. Mark Donohue came to our roll call and told us they endorsed her over Brickett because Speaker Madigan had given them "his word" that he would get the 80% pension passed if the FOP endorsed his unqualified daughter, who had never been a prosecutor, for the state's job of top prosecutor. Department rules should not dictate our behavior but instead our professional code of conduct.

There is no reason why police officers should engage in behavior such as bar fighting.

From viewing the tape inside the bar, it appears the the off duty p.o.s were asked by the bar staff to help them close up shop! That part wasn't caught on tape. So they started to ask the Yups to leave and it looked they they were refusing, so then they started to clear the pool table. The Yups then got pissed off and attacked the off duty p/o's and lost. Outside of the bar there is also no sound, Yup acts like he is making a phone call and provokes Sgt. JP into an altercation.
Remember we still haven't seen the whole tape, just bits the media wants the public to see. Again no charges filed for anything that happened inside the bar.
Shit with no sound on the tape even a PD could get these guys off!

I just want to say this situation was blown way out of control and thank god as a I read there a some sensible people that can see through all the bullshit.
I hope these guys stop getting raked over the coals for this stupid shit.
I suppose that maybe there should be some punishment for their actions but not to the extreme that it has been taken to.
I for one drink, I go to bars and people start shit all the time but I, by the grace of god manage to stay out of shit. Unfortunatley sometimes you cannot avoid stuff, sometimes you cannot just leave and you have to defend yourself.

It's easy to say just walk away, its easy to say they should have locked them up, its easy to judge actions that you only know little about, but a lot of people on this blogger are doing the hardest part and being supportive not condoning or judging. Another reason we have pension law problems is that Richie is in the Illinois legislator's pension plan. There they can write their own rules. Richie's generous benefits have followed him through every elected office, including being elected as Cook County States Attorney even though unqualified.

You think Richie cares, his attitude is, “if they don’t like it they can quit…”

How about a law where the city would pay interest on retro checks. Just dreaming.

The fact that the officers went back into the vestibule after they were outside (presumably to continue the confrontation) will be their undoing. If they continued to walk away, no intent could be shown. I'll bet the sgt. is fired and the officers suspended after being convicted of misdemeanor battery.

Regardless of the outcome of this case, there is a lesson here for everyone. Your whole life is being videotaped. And that will only increase. Everyone has to conduct them selves as if there is someone standing 3 feet away with a camera. Drunk, sober, at the mall, in a restaurant, in any store, walking downtown......EVERYWHERE. And not only us, tell your non police family and friends as well.

Next point....when we came on the job, we accepted the responsibility to conduct ourselves in a manner which befits our position. You have to learn to walk away. That does not mean be a punching bag for someone, the constitution allows us to defend ourselves just like everyone else in the world. If you are going to drink, leave the gun and car at home if possible. Can anyone tell me of an off duty incident in which a copper has been disciplined or fired which did not include alcohol? I am sure that there are some, but you sure don't hear about them. The officer on Vincennes, the guy from 005 in Orland, the list goes on and on. And that does not even begin to mention the coppers who have been killed or maimed in drunken car wrecks. What will it take for people to learn? I speak from the perspective of 54 years of age and 25 years on the job, so I've seen and done some shit. But man, times have changed. Get with the program.

As far as bad tippers and the worst drunks:

Worst drunks as a group ( I was a bartender before the police):

1. Firemen
2: Tradesmen
3: Coppers

Worst Tippers:
1. School teachers, they don't make much money.

Best Tippers:

1. Other Bartenders
2. Nurses
3. Coppers
4. Firemen

I have viewed the videotape several times and can objectively concur with SCC and any rational mind this is a media hype job.

The media sensationalized this incident following on the heels of the Abbate incident. Ask Amy Jacobsen how it feels.

FELONY charges for what was depicted on that tape??? Please, a complete abuse of prosecutorial discretion. This incident is a weak misdemeanor at best.

The most important thing I learned from my oversized, alcoholic, drunken Irish cop dad was to not drink to excess. He used the job as an excuse for everything he did. He was never at fault for anything in his personal or professional life.

If a group of aldermen beat the hell out of a smaller group in a bar and it was caught on tape many of you would be screaming for blood.

These guys screwed up and they are going to pay a price. That is the way it goes. If you imagine that a camera is everywhere you go then maybe you will be more careful about what you do.

All of us have responded to drunken bar fights nad have locked people up at them. I'm sure those arrestees also felt "provoked" because they were WASTED!!!!! If you can't hold you liquor - drink at home. It is time for police officers to take the consequences of their behavior and quit blaming others. It is times like the Jefferson Tap incident and the Abbatte incident that take away from the true injustices like the case in Iowa.
