Taxpayers Spared

  • The Illinois Appellate Court ruled Wednesday that the city cannot be held responsible in the deaths of 13 people after a 2003 porch collapse, according to a release from the City of Chicago's Law Department.

    Thirty-eight lawsuits have been filed against the city after a porch collapsed during a party on the 700 block of W. Wrightwood Ave. on June 29, 2003. The collapse resulted in 13 deaths and numerous injuries.

    The plaintiffs in the case, including a relative of one of those killed in the collapse, Jean Ware, claimed the city was negligent in inspecting the porch. City attorneys argued that municipalities should not be responsible for damages that occur on private property that does not comply with city code, the release said.

Government can't be everywhere. Government shouldn't be everywhere. The only reason the City got dragged into this lawsuit was the potential "deep pockets" payouts. The City could only have levied fines once the malfeasance came to light - which it did in the form of 13 dead people. The only way to prevent crooked construction companies and shady landlord from circumventing the law is to make the fines so onerous so as to deter them even thinking they could get away with something. Otherwise, bribes, fly-by-night construction and more collapses are inevitable.

fines and such are way up there already. Plus do not forgot about how corrupt the inspectors are.

The city has its issues. I do agree folks should not think the city is to blame. Still, alot of folks on a wooden porch.

Its a case of bad luck

Now if the courts could just rule on a few more things like you can't sue the police who were doing their jobs in a lawful manner or you can't sue the police when some idiot hits you because he was fleeing from the police. Remember, the police NEVER initiate a traffic pursuit, the fleeing shithead does.

The courts ruling is absolute bullshit. The city currently hired 1,000 inspectors to visit private residences and buildings throughout the city (except the ghetto cause they would never pay fines or rebuild anything)to screw over the middle class again and are writing violations and forcing owners to tear down and replace porches. Porches that were built and inspected anywhere from 10 years ago to just this year. If the city and its inspectors had not been negligent and done their jobs in the first place owncers like myself would not be digging into my pockets to spend 70 to 80,000 that I don't have to replace a porch that was inspected just a few short years ago. The city is forcing owners to comply to the "NEW" code, when the porch was up to the "OLD" code... so much for being grandfathered in unless your going to pull a permit to do some work on your place. Just wait folks, if your house is not up to current code (electrical, plumbing, ventilation, building materials, paints chipped, etc..) inspecters will be coming in your home and threatening you with fines until you get a second mortage or home equity lone to replace your entire home. The city fucks the middle class again and again and again!

If the inspectors were legit then I would agree with the ruling, but their not.
Remember the 22year old connected kid who became an inspector. Wouldn't this make the city liable? The people responsible for checking porchs are not qualified. They are political hacks.

let's not forget that when the overloaded porch began to sway, a few drunken children of privledge began jumping up and down to increase the effect.
i guess blaming the guilty is futile due to their relativly shallow pockets.

DUDE,Time to change the Bong Water. The city inspected the Porch TWICE,The 19yo Inspector signed off on the shit bolts and admitted he knew better that the Porch was improperly constructed.
That Stoop was, A KEY ELEMENT TO THE PORCHES COLLAPSE.
THE CITY IS CULPABLE.

I noticed a couple of things in all this--WHY should the City be responsible, because your kids were STUPID and Drunk.
When you sue the city it's those of us that live here AND pay taxes that foots the bill. Shortfalls in revenue-- stop all the civil lawsuits.
How come the city/police/fire/doctors get sued all the time, but you never hear about lawyers or judges getting sued. There are a LOT of incompetent lawyers. Maybe there is a thin stripped suit line, that lawyers don't sue lawyers. So in effect a cover-up?
How about the media, like the Amy Jacobsen "story". ALL the media was astounded that another station would show another reporter messing up. They just don't air each others dirty laundry--and AMY saying " I can't believe they showed the video out of context". Like the media showing the parking tickets on their vehicles in A/5 but NOT the signs behind the vehicle saying no parking. Do you mean out of context like that Amy?
How come the female copper won $150,00 BUT the FUCKING lawyers got $500,000? It's NOT about the money the lawyers say, it to stop or correct a problem, BULL SHIT. You asshole lawyers are WRONG 50% of the time or more (one side always loses) so why shouldn't the clients sue the losing lawyers as they didn't represent them correctly. Or the people that were "wrongly" convicted (yea right) sue their lawyers as they fucked up royally, and let them get convicted!
They can ask for a new trial saying the lawyer didn't represent them correctly, but they never sue the lawyer or law firm? Lawyers work on these cases for months or YEARS and still get it wrong, but a copper acts in a split second and everyone wants to sue, and normally the copper is correct.
OK-I am done with my rant-- society is going downhill fast, when we turn out more lawyers from schools then occupations that actually contribute to society. Soon the parasites will have sucked the life out of society.

So right brother! if this was any police officers family we would be singing a different tune. The city should be sued. Understand something they inspected the porch and the 19 yo connected kid passed, and signed off on the work all the while knowing the porch was unsafe. WHY have inspectors? Your Wrong on this one SCC. This city needs to be held accountable.

Unless of course it was your family that was killed. You guys are sickening. THE CITY SIGNED OFF ON THE WORK, SAID IT WAS DONE UP TO CODE? not once but twice. Has nothing to do with how many people on the porch. Five people could have taken that porch down. Have a heart.

THATS the problem-- They have created this mess-- Lawyers--Judges--Legislators (most) are lawyers-- They are like parasites-- they feed off society. In many nations they are not needed as society is not as sue happy. Someone/everyone pays for the lawsuits.
