Yes coppers do drink. The main fact is it eases the stress of the job. But many coppers are mean, ignorant drunks who want to fight anyone and everyone when they drink. They get beer muscles. I worked with one guy who always was trying to fight everyone when he drank. To those people who know how they get when they drink, drink at home by yourself and beat your own ass. What Abbate did was dead wrong. For some things I will back a fellow police officer to hell and back. Sometimes shit happens. But in this case as in many others that have hit the media in the last year or so, you are on your own. I am one who believes no matter who you are in this department from PO all the way to the top, if you need help, I'll haul ass to get there and help you. We are all one color, blue. My personal feelings never get in the way of helping a cop. But when you are Abbates size and beat some 98 pound female bartenders ass and kick her while she is down, is wrong. It is wrong for any citizen, but especially wrong for a cop. Always remember we are held to a higher standard. Whether you are in uniform or not. The other thing is what 1 cop does that is that overboard, whether on duty or off reflects on every other police officer on the street. I don't know him, but I can see he got drunk and crossed the line. If his drinking was a problem and this was the cause, he should have sought help before all hell broke loose. Ther are enough resources on this department to help people with stress, emotional, alcohol and drug problem. If you don't seek help and screw up because of it, it is your own fault. I have had coppers backs more times than I can count when they were called on the carpet. But for somrthing like this, I will not back him or condone his actions. Call me a jagoff, but if I was in the bar at the time of the attack, I'm not a rat, but I wouldn't have tried to defend him either. Remember, your actions as a police officer on or off duty reflect on every cop on the street. The oath I took, I believe in. I love the job after 20 years and believe in what I do. I"m proud to be the police and take my duties very seriously. I think for the most part, no matter with the few people who brag about being dogs, over 80 percent of the cops on CPD feel the same way. If nothing else I get the satisfaction of helping people and taking viciuos offenders off the streets. That's why I took the job and most police do. I may not be happy with the bosses, the crap we gey from the press or some people on the street, but that does not deter me from doing my job. Abbate did a wrong to his victim and every CPD cop. Some things are trivial, but what Abbate did cannot be defended by any cop in his right mind. Being a cop is different than any other job except for the military and everyone on this job should realize it. People don't see the person who is the cop, they see the uniform. What one person does makes causes every other cop to be judged the same way. Our job is to serve and protect. I am proud to be a member of this department, no matter what some assinine booses say or do. The Chicago Police is the best department there is. I am proud to be a part of it and the thousand of great police officers who do one hell of a job with constant pressure the department puts on us.

Not to excuse his conduct, but the truth is, had there been no video, he'd be looking at 30 days for excessive force, and that's it.
The felony was based on a person in a public place being battered, not on the injuries she sustained. That means from now on, any bar fight should be upgraded to a felony (HA HA).
He's screwed but hasn't admitted it to himself yet. If he went with a bench trial, the law says he's guilty of a felony. If he goes with a jury, the entire pool has seen the video and no one will let him off with a misdemeanor. The ASA won't even offer it up anyway.
He needs to cut his losses, take the felony probation offered and move on.

You know, I honestly couldn't care less what happens to Abbate. He's a stupid drunk who beats women and good riddance.
What I do have a problem with is the totally unjustified 15 counts against him. They can't reach a plea agreement with a first time offender? Yes, it happened in a bar, has anyone ever gotten even one felony charge for a bar fight in their entire career? I have had people shot, with good witnesses and couldn't get a felony charge. The problem I do have is a unbelievable double standard, simply because he happened to be a police officer. If he was an accountant, we wouldn't even be having this discussion.
My brothers and sisters, this is an incredibly dangerous situation for all of us. If they convict him and give him a harsh sentence it is setting a very dangerous precedent we are all going to have to work and live under. Excessive force in an arrest situation can easily turn into felony charges and being arrested when it should be disciplinary, a CR, at best. Off duty incidents, however minor could easily be turned into something far worse just by using this case as an example.
That woman's lawyer is a complete bottom feeder. You really think he wants that slob to get a bunch of time for justice? I think not, he wants to fatten his wallet by making the case look as bad as possible. That don't really have much in the way of evidence short of that video, so he's going to play on sympathy and a big fat conviction and sentence to make his case.
Thank God I only have a few years left. Pathetic as it is, I stay home to drink, don't really go out that often and absolutely never wear anything even remotely police related.
It's a sad day my friends, please try and control yourself while you are drinking if you are out someplace, get a ride home if you've had too much and mind your business. Do your jobs safely and professionally, go home at night to your families and do not let the city or our lopsided judicial system get the best of you. Load up on retirement savings and get the hell out of this city and state and go live a happy and healthy retirement. The prosecuters rejected the deal, not him. When was the last time you heard that happen? They are going after him because he is the police and they are police haters. They will not settle for anything less than substantial jail time. Think about that next time they offer one of your arrestees probation for a shooting.

what tony did was not a felony, their attempting to charge him with the wrong crime. Yes he probably will found guilty due to the media pressure. HOWEVER, in appeals court it will get reversed. Mark my word. Because it will be based upon the language of the law. No broken bones, No blund object used. No laceration. She doesn't even have a medical report because she never went to the doctor.
Plain an simple look at the tape. When he was f'ing around and put that guy in the headlock and was visably drunk, she should have called 911, did she? No She continued serving him even after he was drunk. Then when he was going AFTER THE OTHER GUY AND NOT GETTING ARGUING FOR ANOTHER DRINK AS THE WITNESSES IN THE BAR VERIFY. she pushed him not 1 not 2 but 3 times with one time her pushing him into the glass and then there was him falling down. Last time I checked that was ASSAULT ON HER fuck this she's a women its a man. I'm not defending him. I going based on the evidence and the letter of the law. HE DID NOT pose a threat to her he was actually assaulted first by her. If that was guy bartender this wouldn't even be an issue.
On top of that Tony according to the law has the right believe it or not to SUE the BAR because there's a little law that states if a person is knowingly intoxicated and they are continued to be served alchohol then THAT ESTABLISHMENT IS HELD LIABLE FOR THE ACTIONS OF THE INDIVIDUAL. If tony would've gotten in a car crash and killed some one it's Jessie's bar that would be held liable for they continued serving an intoxicated individual. Same goes for Jewels, Dominicks or any Binny's your not supposed to serve someone that's drunk and clearly on tape he was served after being drunk.
So simply put with the a video present. hypothetically, someone breaks into your house, as long as they don't assault or threaten you and its on video you can touch them and she touched him first.
If he decided not to settle. which trust me isn't going to be for a year or hell even 30 days as the current belief is, trust me its for less time than that, that is being proposed.
He will once again either A. Get found guilty of a felony. Be sentence Appeal it to a judge that must go with the letter of the law, it will be over turned because it never was a felony, he'll be release, and will be able to sue the state and the prosecutors for putting him in jail for yes a crime a "felony" which he didn't commit. the he'll sue the department and be back in abt 3-4 yrs when all the medea attention has gone away. Becaue don't for get there is PRECEDENT THAT THIS IS NOT A FELONY

Read subsection (b)(8) again - if you concede it is a misdemeanor battery, then he can be found guilty of the felony. And no basis for an appellate court to overturn.
Now you could take the position that the provision of the agg battery statute dealing with public places is horseshit - and then I would agree with you. It is horseshit.
You also are dead wrong about Abbate being able to sue the prosecutors. They have absolute immunity from suit - which means no can sue them.

Individuals intent on violating the 'common sense' laws prohibiting the committing of violence upon another, the stealing of another's property and the reckless and irresponsible actions that cause the injury of others, damage to the property of others and the depriving of other's rights under our Constitution, aren't going to obey and comply with any laws concerning the keeping and bearing of arms.

As all laws must be applied and imposed on everyone, and, as the vast majority of citizens residing within this city's boundaries are not intent upon committing criminal acts, as defined in point 1, it's obvious who the targets of "Mayor Daley's Common Sense Gun Laws" are, namely, law abiding citizens exercising their Constitutional and God Given Natural Rights to defend themselves as they see fit.
4. Any citizen residing within this city's boundaries who chooses to comply with "Mayor Daley's Common Sense Gun Laws", thus relinquishing their Constitutional and God Given Rights to defend themselves, is an idiot and deserves whatever victimization their choice results in.
5. Any citizen residing within this city's boundaries who refuses to comply with "Mayor Daley's Common Sense Gun Laws", said laws being blatantly contrary to our Constitution and their God Given Rights to defend themselves, will be at risk of being treated as the criminals they are not.
6. Any police officer who chooses to enforce "Mayor Daley's Common Sense Gun Laws" will be guilty of infringing upon the Constitutional and God Given Rights of any citizen choosing not to relinquish their rights, in submission to "Mayor Daley's Common Sense Gun Laws", and should consider him/herself no different than the Mayor Daley's of this world.
