Understanding Miranda

So what's the liability factor for the Detectives who didn't explain what a lawyer was to a 15 year old juvenile who probably has more time in the justice system than in the classroom?
  • In a blow to prosecutors, a Cook County judge threw out the confession of one of two teens charged with the May 2007 murder of Julian High School student Blair Holt.

    Judge Michael Toomin ruled that statements Kevin Jones made to police and prosecutors could not be admitted at trial, because Jones -- who was 15 at the time -- did not understand his Miranda rights.

    “The state has failed to show ... that there was compliance with the mandate of Miranda, that he understood the right to counsel, that he understood the right to remain silent,” Toomin said this morning.

    “It cannot be concluded that he really knew what an attorney was,” Toomin said.

So in addition to being social workers and marriage counselors, it falls on the police to teach the dropouts what they couldn't be bothered to learn in a fifth-grade civics class.

Anyone think we'll ever get to be the police again?

You only hear how the police "screwed up" never the ASA's office or the Judges.

Former Commander of Airports and now demoted Lt. James G. Carroll maybe trying to set up a similar defense in regards to the OVERTIME FRAUD AND DECEPTION investigation.

Jim Carroll is now seen walking up and down his block in his bathrobe and fluffy slippers while carrying a newspaper. Not unlike the famous mobster who also try this trick on the feds. Acting all crazy and talking to himself while still running the mob.

Carroll is also seen walking and empty leash and pretending a dog is attached to it.

The 50-year-old driver was taken to a hospital and released after receiving treatment for minor injuries, including cuts to his neck and face, Los Angeles Police Department spokeswoman Officer April Harding said. His name was not immediately released.

Two 17-year-old girls flagged down the cab at about 12:30 a.m. in eastern Los Angeles and asked to be taken to a nearby housing project, police said.

The girls were Alexous Ann Sandoval and Daisy Orozco, both Los Angeles residents, the coroner's office said.

The judge is bias. This judge is making a statement to the victim's family and society. Seems like police families can't get justice in any court room. Not just cops but their kids too.

A lesson learned is to vote out judges. You should vote all them out. Unless proven to be competent.

Judges and politicians have agendas and this must be the year of the pig, contrary to the Chinese calender year of 2007.

You have to read the Miranda "rights" (by the way, judge made law, not legislative, certainly not in the Constitution) and ask the interviewee if he understands. If the answer is yes, then you're good to go. You do not have to "test" the subject's voluntariness to answer questions. Toomin is a piece of shit and this could get reversed by the Appellate court.

Can past CR#'s that are being reopened affect current retirees? How far back can they go on a past CR# in terms of years? I know they allegedly only keep CR#'s for five years but there is a rumor that a PO was stripped on an eleven year old beef in 023,WTF???

The latest firings occurred at the medium-security Roxbury Correctional Institution near Hagerstown, where nine officers were fired Friday. All were terminated amid allegations of excessive force during the weekend of March 8, the Department of Public Safety and Correctional Services said in a statement.

Sorry to hear that. Even though we don't have the specifics of the case, I'm going to assume it wasn't documented properly. Here's another life lesson.

We are required by law to advise the subject prior to beginning any interrogation of his rights, and you must document such. We are required by law to make sure the subject clearly understood his rights, and you must document such.

Some like to read each right and immediately ask the subject if he understood that right.

Most Judges not all, are just like the ASA's . They don't give a shit about the police. For a judge to make a ruling like that is ass-in-nine. Just because a defendant said he didn't know what an attorney was "HELLO" Did you spend any time awake in school ? Long ago I had Judge Pincham (God rest his soul ) NOT !!!! Let an offender go who was a Blackstone Ranger because he told him he didn't even know what marijuana looked like even though he had a pound in under his coat that he threw to the ground. In the Miranda ruling the State has the burden of proof to show that a person knowingly waived his rights. That's why you see all that extra stuff from your FOP book. It makes it easier for the State to show that the suspect knowingly waived his rights. In reality, officers only have to hit 4 things per Miranda. 1.) right to remain silent 2.) right not to self-incriminate 3.) right to an attorney and 4.) the State must supply an attorney if the suspect does not have the funds to afford an attorney. That's it.

It sounds like there were other factors involved also. As Dicks were going to have to eventually read the whole ruling to really grasp why he ruled the way he did.

Judge Toomin is considered to be a fair judge and has a lot of knowledge of the law. Both sides like him. Usually his rulings stand.

When Mike Shield took over for Johnh Risley he told the officers at TRU that everything was going great, but a few things might get treeked.

First they dump a popular commander, and a unpopular Assist. Deputy. Next they divide the platoons in half. Then on Tuesday Shield meets with the FOP and advises them that the city plans on offering the unit a ten hour day schedule, ten hours thursday - sunday,( RDO'S MON-WED.) No rotating RDO's.

The FOP stands up to him and tells them there is no way they will go along with that, and that again it is a contractual issue, to bring it up at contract talks. Shield walks out.

Now we are hering that even though the Commander, T Williams has stated we will not be down sized, all the officers detailed, approximately 120, will be sent back to districts, this may happen as soon as change day. In adition they may not be sent to there original districts at first.

Now you may or may not like TRU, but you better watch out, because this administration does not give a rats ass about our contract or our personal lifes, and they will do whatever they need to do to better themselves.

Question: I know if you are detailed they can send you back to your original district, but, contractually, can they send you to another district?

You're right it ain't worth it.

I only go out to certain private and family functions. Even then I have to admit I'm nervous as hell. It sucks but that's the way it is for now. Until this blows over, I'll stay out of the taverns. It's easy for me to say this because I have two small children and low funds anyways, but even if I was a young single copper, I'd be taking it easy for sure.

Stay local, don't drive, and be aware of cameras in bars.

It's getting harder and harder to feel sorry for POs involved in off-duty stuff when we're reminded daily of the consequences.

I'm even considering leaving the job and becoming a civilian. Who wants to live their life in constant fear of being disciplined for nonsense? I know I don't.

I hope this all blows over, but it won't be anytime soon.

I have over 10 years on the job and I don't think we've been the police since I started. Things are 300% worse now but, it wasn't great when I was a ppo. I can't imagine what it must have been like to be the real CPD.

Lets face the facts, in the very near future there will be a camera on every street corner that will watch stop signs, traffic signals and every move you make. The police won't make arrests of any kind without a warrant signed by a judge and approved by a states attorney.

The democrats aka socialists/communists have all but won and taken your freedoms away. The only things you will be allowed to do in this country is have gay sex on the corner and curse Jesus Christ's name any way you choose.

Judge Toomin is rock solid and he knows the law better than anyone at 26th & Cal. He had no problem agreeing with the State when he ruled that Harry Aleman's first murder trial was a sham and thus double jeapordy did not bar a second trial on the murder.

I heard that the advisement of rights didn't go real well in the interview room.

That's pretty basic, something any 15 year-old can understand.

What's a cop to do? Take each suspect before a judge to have the Miranda rights explained in multi-lingual and cartoon format?

As I get older I get more certian that Judges do crap like this to actually increase crime thereby ensuring their job security and that of the lawyers that make payoffs to the Judge thru the Judge's Bailiff.

Yes he/she is. However, if you can't find one (which isn't uncommon on the west side), a cross trained detective can act as the guardian. That det. just can't have anything to do with the case at all.

We do it all the time in A/4 ('cause momma won't leave her 3 month old baby with the other kids (who might stuff it in the garbage can while she's gone) or grandma is too sick and old to come in.

I've always thought as a good rule of thumb that if you have a real case you have to get the kid's parents in there to give permission. I am told by youth dics that the judge ALWAYS throw out confessions without the parents, even if a youth dic is present.

An alleged gang leader who has been linked to former Ald. Arenda Troutman (20th) was arrested on federal conspiracy charges after nearly four years on the run, the FBI announced Wednesday.

Donnell Jehan, 40, turned himself in to Chicago police Tuesday night and will appear before a U.S. magistrate at 2 p.m. at the Dirksen Federal Building, the FBI said. An alleged leader of the Black Disciples street gang, Jehan was one of 46 members and associates of the gang indicted in May 2004 on federal drug conspiracy charges.

Jehan, formerly of the 6500 block of South Ashland Avenue, was the subject of a nationwide manhunt led by the FBI's Chicago office and was featured on the TV show "America's Most Wanted."

He has been tied to Troutman, who was indicted last year on federal charges that she accepted bribes to smooth the way for a mixed-use development in her South Side ward.

Troutman has acknowledged that she knew Jehan as a businessman, but she has not said whether she had a personal relationship with him. But before he was charged in 2004, FBI agents spotted the alleged gang leader driving her luxury sports-utility vehicle.

Chicago police officers fired shots at a 15-year-old boy who allegedly started to point a gun at them during a chase Wednesday morning on the West Side, but no one was hit, police said.

The incident occurred about 10 a.m. near 23rd Street and Millard Avenue, police said. The teen was suspected of selling drugs and was running from officers when he raised the gun toward them and they opened fire, police said.

The boy was not hit and did not fire back. He was arrested on the scene, and his gun was recovered. Charges were pending

I don't know the exact words used in the interrogation or Judge Toomin's ruling but I have testified at motion hearings numerous times. ALmost all of these hearings deal with evidence whether it is physical or statements. We go through each of these rights with the prosecutor and after we read each right we are asked if the defendant understood each right. This happens a hundred times a week at 26th St. and other outlying courts. All murder admissions should be taped and either the ked said yes or no if asked if he understook each right.

I have always thought that if we could prove that an asshole has been arrested a number of times and each most of those time was given the Miranda warnings they should not be nessessary each and every time. Judge Toomin is a very knowledgeble and fair judge. I'm sure the statement of this kid was not tossed out on a whim.

Michael Toomin is the type of judge that Mike Mette should have had, that Iowan case would not have lasted 5 minutes in his court.

In the Miranda ruling the State has the burden of proof to show that a person knowingly waived his rights. That's why you see all that extra stuff from your FOP book. It makes it easier for the State to show that the suspect knowingly waived his rights. In reality, officers only have to hit 4 things per Miranda. 1.) right to remain silent 2.) right not to self-incriminate 3.) right to an attorney and 4.) the State must supply an attorney if the suspect does not have the funds to afford an attorney. That's it.

It sounds like there were other factors involved also. As Dicks were going to have to eventually read the whole ruling to really grasp why he ruled the way he did.

Judge Toomin is considered to be a fair judge and has a lot of knowledge of the law. Both sides like him. Usually his rulings stand.

LOS ANGELES — Two teenage girls who attempted to rob a cab driver, slashing his face with a box cutter, were thrown from the taxi and killed in a wreck on Tuesday, police said.

The 50-year-old driver was taken to a hospital and released after receiving treatment for minor injuries, including cuts to his neck and face, Los Angeles Police Department spokeswoman Officer April Harding said. His name was not immediately released.

Two 17-year-old girls flagged down the cab at about 12:30 a.m. in eastern Los Angeles and asked to be taken to a nearby housing project, police said.

The girls were Alexous Ann Sandoval and Daisy Orozco, both Los Angeles residents, the coroner's office said.

If a youth is under 13 yoa he must have counsel for a crime like homicide. If he, or she, is 13 or over then they SHOULD have a parent or legal guardian there during questioning. (Play aunts, uncles and reverends do not count) If the parent can not be reached or does not want to be involved, which happens far more than you may think, then a youth officer has to sit in for the statement.

Years ago me and my partner "EL Mac" responded to a call of youhts blocking the street.(007)

Upon our arrival we observed two shitbirds(about12-14yrs)standing in the middle of the street.

We grab em and one shitbird has a 32 revolver(u dont see that often!) in his pocket.

I testify in court and I stated the wrong street I was involved in the chase on.(Juvy CT.)

Even though we were in the right. Even though we recovered the pistol on him. I was ohhhh so wrong

Charges dropped. The defense attorny apologized,(he caught my stating the wrong street). The state says "we cant believe it." The court stenographer says,"Holy crap!" The Bailiff says"Thats unreal." The judge Stralka(SP?) states he belives me ,but I messed up on my testimony.

I say, "Fuck it." Everyone in the room knows I was not lying.

That judges name is Stralka(SP?) U may know him as the judge who asks"Whats ur favorite subject in school?"

It has always been this bad men. What we need to do is stick togehter.

4 and 2 has same amount of work days per year as does 6 and 3. 4 and 2 would be much preferred but no one has mentioned it, I ran the schedule for a year, it has IDENTICAL work days in a year as 6 and 3 and would require same adjustments with give back days to City etc. I go with 4 and 2.

With 6 and 3 you still work 6 in a row, isn't that what we want to eliminate? with 6 and 3 many guys will just use the extra days off to work more side jobs, not take more time off.

As for myself, whatever they agree on is OK. I am looking at all my days off and no work days in a few years so it won't effect me that much.

Screw 6 work days in a row, no matter what, 4 and 2 would keep you healthier and give most officers more opportunity to work out and get in Jody shape.

There was no Det. from SVU in for the interview the det. fucked up. So the admission is out, the video is what makes this case if it shows the kid handing the gun to the shooter. other wise the det made a mistake in a heater case with the preessure on and will have to live with that. Solving crimes has nothing to do with the perception of white officers. You should take a close look at the HIGH level of disrespect displayed by white officers to coworkers and anyone else that isn't white. Think what you want but it's obvious "were all blue" is a myth. All you have to do is read what's posted on this board. Once again there is not unity, period! White offices (not all) but a majority have drawn a line between themselves and others. You can use the standard line of "thug cops" or "the black officers are dogs". Realize the door swings both ways there are "thugs and Dogs" among white officers also.

So he threw out the confession? I have a couple of comments:

#1 some said the state has the burden of proving the shithead understood his Miranda warnings. That’s fine if that’s the law (I’ll assume the poster was correct). How to we prove this? I’ve taken many confessions after giving Miranda. My only ‘proof’ that the shithead understood them was that he SAID he understood them. What am to do beyond that? Should I do a lineup which includes a picture of an attorney .. a doctor … a fireman? Which one’s the lawyer kid? What is the lawyer’s job description? The kid was not drooling on himself, your honor, so I assumed when he said he knew what an attorney was … he knew what an attorney was.

#2 Youth Dic present at interview. A youth dic is not good enough. They are almost useless ( no offense – let me explain). The youth dic is supposed to look out for the juvenile’s BEST INTEREST. They are not taking on the role of a Det. That means they should tell the shithead to SHUT THE FUCK UP. That’s why, as I understand it … you NEED a parent there. (I know – sometime’s it’s impossible – I don’t know how to answer that).

#3 Someone said the confession was on tape. I don’t know if this is accurate or not. The Dept rules/state law mandate turning on the camera for murders. I guess the dics should have spent a good hour making it clear on tape that shithead knew what a lawyer was/ what his rights meant. I am guessing the dic read the Miranda warnings on tape. I am also guessing the shithead answered ‘yes’ when asked whether he understood his rights. What else? What else could the judge want? Give him an IQ test? Is it the presumption that juveniles do NOT understand (that may be the case – and as a general rule it may be legitimate), but the 15-16 year olds can be charged as adults, so if their parents are present, they can waive the right (meaning the parents) …. That don’t seem right … if the shithead is old enough to be punished as an adult, then how in the hell can their parent waive the right? It doesn’t jive. It just doesn’t jive. If the presumption is that they are too stupid to waive their Miranda rights – then don’t punish them as an adult. Leave it in juvenile court.

#4 We, as a Dept. gotta learn from this shit, instead of just getting pissed at the Judge in some knee-jerk fashion. He may be wrong, I don’t know, but what I DO KNOW is that I personally, will make very clear, in non-bullshit cases, in my GPR that the shithead (juvenile or adult) understand his waiver. #5 If the simple act of reading a shithead Miranda, getting a “Yes, I understand and want to speak,” is not good enough, then the Dept. should issue a training bulletin …or one of those legal advisor things. If the defense attorney can simply argue “Your honor, my client is a Public school moron, he didn’t understand his rights,” and get the confession thrown out, then …we need more information.

#6. You think Jody will take interest in getting us this training? I think Phil Cline would have (because he was a cop for his entire life – whether you loved him or hated him is irrelevant). Jody probably is NOT EVEN AWARE of the ruling. He's probably just finished shaving his chest and is enroute to the tanning salon.

#7 someone said we should read the Judge’s ruling. Trial court stuff is not published like appellate court rulings as a general rule. Is it?

I only go out to certain private and family functions. Even then I have to admit I'm nervous as hell. It sucks but that's the way it is for now. Until this blows over, I'll stay out of the taverns. It's easy for me to say this because I have two small children and low funds anyways, but even if I was a young single copper, I'd be taking it easy for sure.

For all you ill-informed "go-getters" I have had many murder trials in front of Judge Toomin and I can honestly say he is one of the best judges at 26th street, and he is not a police hater. The detectives in this case fucked up...the JUVENILE had no one (parent, youth officer) present when he gave the statement. Had they put a dumbfuck youth detective in the room the confession would have more than likely been admitted. What you know-it-alls don't know is Toomin knew the appellate court would have overturned him if he allowed the statement into evidence. Before you start calling judges assholes learn the law and rules of evidence.

You bring up some good points. There is case law already that the courts have ruled that if a suspect answers he understands his rights and continues the interview with the Dick, that is enough to show that he knowingly waived.

I talked to a couple of ASAs today and they told me that one problem was that the mother was on tape asking the Dick about a PD and the answer hurt us.

We all know that the way things are now we have to take that extra step with juveniles.

There are some Dicks that have brought up their concerns about what can and can't be done and the bosses are aware of it. Hopefully there will be some type of guidance soon.

Wait for the Mom to arrive, then question him, or if she's unavailable, document it&have a Youth Officer present for questioning. Det.s have been coming out Youth qualified since 02shouldn't be too hard finding one on the floor..

Please enlighten us with some examples of this....most white officers I know go out of their way to be polite to black officers.. if anything its the other way around.....rude black officers( especially the women) trying to intimidate white officers with their loud mouths and aggressive behavior..yeah you know who you are...hispanic officers speaking spanish in front of their white co workers and then saying "hey we were talking about you bro......."Please you are so full of shit.......

With all due respect to those involved....looks like we didn't do all that we should have. Hopefully, the Dets. learned from this episode, so that incidents like this won't have to cleaned up in public, or in the courts. And don't blast Toomin, he's been overall a very decent judge for many years. We've been very fortunate as a Police Dept. Our gaffes have, for the most part, been few and far between, if you don't count the past two years.
We've sat back and learned from embarrasing public failures from LAPD, Cincinnati PD, and others. Now, it continues to be "our turn" in the bucket...bottom line is, we have to do a better job, and not cut corners. Training is still, and has been, a major issue.

To all you Clarence Darrow wannabes...Toomin DID NOT FIND THE STATEMENT TO BE INVOLUNTARY...he found the statement to be VOLUNTARY, but faulty under Miranda, meaning the kid's statement cannot be used against him (he supplied the gun used in the homicide), but IT CAN AND WILL BE USED against the guy who actually pulled the trigger. What Toomin essentially did was ensure that the kid's statement is used in the trial against the other asshole. If this kid flips on the stand or starts to backtrack then the ASAs can and will play the video-taped statement and use it against the shooter. It may STING a little, but Toomin did the right thing. He could have found the statement INVOLUNTARY and faulty under Miranda, but he essentially made the case better against the shooter.
And to the guy bashing homicide detectives-Cops like you make me sick. You don't know what you're talking about and probably haven't spent an hour in court in your pathetic life. I know where I can always find cops like you-at the bar telling war stories you never participated in and bashing all the cops who do the job.

Have to agree with the poster who complained about lack of respect to bosses who aren't white. Been monitoring the posters of "best bosses," and none of those named were black or hispanic, or even female. I've worked for good bosses in all three catagories, and I've noticed that all the black bosses I've ever worked for have bent over backwards to be fair. Can't say that about a lot of other bosses I've worked for, and I'm white, male, with over 20 years on. I guess that's why the Dept. to this day doesn't have any black or hispanic Capts. in any of the North side districts. The job may have changed, but Chicago hasn't.

I completely agree. Maybe Maas made a mistake maybe not. But he is a real cop who works hard and has his heart in the right place. I have known him and worked with the man for over 15 years.
