Officers, Greg Bella, Tim Fallon, Sidney Davis and Bill Dougherty that they were being stripped of their police powers by J-Fed for failure to complete annual firearms training. They were notified to surrender their badges and identification cards next week.
Last time we checked, failure to qualify was the basis for a Complaint Register investigation. The CR process has many numerous and well defined steps that must be adhered to. The Superintendent circumventing the entire process without any form of investigation, process, rebuttal and appeal is unprecedented.
If true, it would be a massive contract violation of the highest order. Can anyone confirm?

I know state law requires annual qualification. We were told this could happen if you didn't.

The triannual reassessment calls for increases. We are currently way under market value which is what most counties in IL pay taxes on. The goal of the CROOK county is to bring everyone up to this standard thus greatly increasing taxes. Expect to have property taxes double in 10yrs 6mos just on the 7%cap currently in place. If the cap is not in place the taxes will raise sooner.
Maybe they should have qualified!

Assuming for the sake of argument that this actually happened, it's brilliant. If they failed to qualify, they are subject to decertification by the State Police Board. Doesn't matter what the contact says about progressive discipline. If the Reps are decertified that can't be employed by the CPD as police officers. If they can't be employed as PO's then they can't be members of the Union or run the Union according to the Union's charter.
Like I said, a brilliant way to get rid of the "loyal opposition" without doing anything but complying with State law.
I think it probably did happened. It's the same kind of maneuver that was used to avoid bringing back Officer Cozzi when the state court's said the CPD had to. Have the guy indicted federally and the City can't bring him back because he can't get certified.

On 15 August 2008, at 1715 hours, the Department stripped Greg Bella, Sid Davis, Bill Dougherty and Tim Fallon. This unprecedented action was taken by the Department because these union officers refused to comply with a Department order to qualify with their firearms. Why would we take this stance?
The Collective Bargaining Agreement, Section 17.2 Leave from Duty, states in part, “In addition to the Lodge President, six (6) officers covered by this Agreement shall, upon written request, be granted leave from their duties from the employer for the purpose of performing full time duties for the Lodge.”
We are on leave from the Department and working for the Union representing all officers below the rank of sergeant. We are not paid by the City; we are paid by the membership. We do have bosses, the 11,600 men and women who are members of this Union. This is to whom we answer, not to Weis, Brust, Kirby or Skahill. Not yesterday, not today and not tomorrow.
We have filed a grievance over this issue and the arbitration is set for a hearing on 29 August 2008 before Arbitrator Benn. So why, after an arbitrator has been picked and an arbitration date set, would the Department take action to strip the officers of this Union? Would not sensible people have waited until the arbitrator rules and then take the action ordered by the arbitrator?
This is a direct attack on our Union; can the Department order us not to represent a member? Can the Department order us not to enforce the contract? The answer is NO! At this time we have filed an injunction against the City over this matter and we will only respond to the ruling of an arbitrator or the courts.
What effect will this have on contract negotiations? What impact will this have on programs the Department is trying to roll out and they need consent of this Union? We think the answer is obvious to everyone except those in charge.
All this crying and no one gets involved. I feel like we could be a loud voice on LaSalle street in front of City Hall.

FOP officers are on leave from the Department and past practice has held qualification was not necessary.

I generally sit quietly and read. Not today. Congratulations to our four "leaders" that failed to qualify with their firearms. You should be ashamed and embarrassed. But not for the reasons you might think.
Even if you "win" and did not need to qualify, you each chose to not submit to firing a lowly 30 rounds from your weapon AND simulataneously FAILED to preserve our Union's resources as some of these resources are now required to defend your sorry examples in court and/or in front of an arbitrator.
Too busy to qualify? Too proud to do so? Maybe and maybe. As fas as I can tell, the City has a pretty strong argument if you play the "leave" card. State Law seems to require you to qualify...even while on leave as "leave" status falls under the same guidelines as that of our retirees: Qualify or lose your right to carry concealed.
Further, did each of you really want to be considered, at least by the membership, as being on "leave" as your represent us? I thought not.
I know three of the four of you and expect more from each of you. Do I think that it was petty that the Department chose this course of action...ABSOLUTELY. However, your individual failure to perform a function that your fellow brothers and sisters perform, and the lack of recognition that failure to perform it would impact the entire union and negotiating process, is unconscionable.

Do these FOP bosses, while on a 'leave' still have their stars & ID's, and can they carry guns and do they have the power of arrest? Seems to me they can/do, in which case they are not really on a 'leave', as they would like to think.
And, they are granted 'leave' from their duties from their employer, not 'leave' from state law, which requires qualifying.

Why wouldnt any sworn law enforcement officer qualify with his weapon as required by state law. If they wnt to be stripped thats OK. When they decide to qualify they can get their powers back. This is no more than typical Power Play. You want to screw with the rank and file, you screw with those who represent them.

We all know that most exempts never fire a round at the range, and if they do, it's in a closed session that you and I will never see.

It's the timing folks. They've been there for years and never had to qualify before. They are being muscled into submission before the April '09 deadline. Not a good way to motivate the troops.

Even if you "win" and did not need to qualify, you each chose to not submit to firing a lowly 30 rounds from your weapon AND simulataneously FAILED to preserve our Union's resources as some of these resources are now required to defend your sorry examples in court and/or in front of an arbitrator.
Too busy to qualify? Too proud to do so? Maybe and maybe. As fas as I can tell, the City has a pretty strong argument if you play the "leave" card. State Law seems to require you to qualify...even while on leave as "leave" status falls under the same guidelines as that of our retirees: Qualify or lose your right to carry concealed.
Further, did each of you really want to be considered, at least by the membership, as being on "leave" as your represent us? I thought not.
I know three of the four of you and expect more from each of you. Do I think that it was petty that the Department chose this course of action...ABSOLUTELY. However, your individual failure to perform a function that your fellow brothers and sisters perform, and the lack of recognition that failure to perform it would impact the entire union and negotiating process, is unconscionable.
