Camera Saves a Beef?

Anyone who can expound upon this incident?
  • scc,
i know this will get buried in this post, but let the troops know: the in car camera has saved a southside p.o. from an excessive force beef. the kid was never touched, ran from the po-po and busted his OWN face when he fell. next day, he's in the station with the family, saying the po-lice did it. so, yes, the cameras are saving p.o.'s.
One incident does not create a trend. And we'd like to see if anyone was prosecuted for False Reports or signing the Sworn Affidavit. Just because one person may have been saved the inconvenience of dropping a To-From, without a vigorous prosecution of the false allegation, nothing is prevented in the long run.

With the video, even a Cook County ASA could win the case.

Video in the car saved me from a racial verbal abuse beef. Asshole Korean came into the station complaining I called him a gook and other names on a stop.

He was the aggressor and I didn't say shit other than the usual stuff said on a stop.

The video was uploaded and watched by the W/C, Desk and my Sector Sergeants. My side of the story held and I asked for a DVD of the stop for court and my records.

He said something about it being illegal to tape someone, but it ended at that.

I worked in the burbs before the city. I have mixed feelings about the cameras, but I will say this. They can save your ass at times. You have to be smart about working around them, but they can be your friend in situations like this.

Just think of all the savage behavior we deal with. Well, now it can be captured by the camera for the people in court to see. Use it to your advantage.

How many coppers have been jammed up by GPS? Zero. GPS has been around for about two years now, just now in mass.

yeah, big deal, is the City and the States Attorney going after the kid and his family for false allegations vs. the P.O? The family should have to pay thousands for this B.S. Should be charged and made an example of. But they will eventually let him slide cause of the wimpy Liberal DemocRAT one-sided system here. Therefore, it will keep happening, even though the kid obviously lied, no responsibility will be incurred to him or his family.

Someone please help me wityh this one. I read this comment and am curious about it:

9/16/2008 02:23:00 AM

************************

If Dick Devine refuses to prosecute, is that a violation of a person's (officer's) civil rights?

If IAD refuses to arrest after an allegation is found to be false, is that deprivng a person (officer) of police service?

If the FOP refuses to help an officer follow through on any action against the "false complainer"/the CC SAO/IAD, is that a violation of a member's rights as a due paying memeber?
****************************

Just curious what rights we have as offcicers (second class citizens in Chicago).

---------------------------------------

It's NOT going to happen! What does the city have to gain by prosecuting false accusations against the police? Absolutely nothing!

Just think about all the ridiculously stupid complaints that OPS and now the IPRA take from people. Part of the problem is that the city does not require an affidavit to be signed before a complaint can be made. A signed affidavit is only required to have that complaint investigated.

The only reason that the city is using an affidavit at all is because it is now state law.

Off topic but important------HR 418

Several felony charges were filed in South Dakota this morning against a Seattle police officer who shot and wounded a Hells Angels member during a fight inside a Sturgis bar earlier this month.
Other officers who were with smith were each charged with carrying a concealed weapon without a permit. They include: Scott Lazalde, 38, of Bellingham; James Rector, 44, of Ferndale, Whatcom County; Erik Pingel, 35, of Aurora, Colo.; and Seattle police Sgt. Dennis McCoy, 49, of Seattle. Lazalde and Rector are members of U.S. Customs and Border Inspection in Blaine.

even when the camera shows that the accuser lied or after signing the affidavit it is discovered that complainant was lying, ops/iad/cook co asa will not prosecute because they do not want to discourage people from beefing on the police. the highly touted affidavit means nothing. it has reduced the amount of complaints, but that was not what it was designed to do. it was designed to punish people criminally for making false allegations of misconduct against peace officers and to that end it has failed.

9/16/2008 01:00:00 AM

Who said "something about it being illegal to tape someone"???

If it was the Sgt/Lt/W-C ask them how in the fuck they passed the promotional exam! What were you viewing in the first place? (Hint: A “DEPARTMENT” VIDEO TAPE OF SOMEONE!) If the person is on or about the public way, the Supreme Court stated they have NO reasonable expatiation of privacy, and video taping is permissible! Ask the same people why the Dept spends so much money on blue light cameras! As far as IVC goes, you can video AND AUDIO tape it ALL DAY LONG! Did Mr. Kim Jong Il get arrested for filing a false police report? I know the State wont prosecute, but he can still get arrested!

The City wants this "New and Improved" police department... Well, give it to them! In-Car camera? "Yes sir, no sir, here is your ticket sir, can’t give you a break sir, because this is the way you wanted it sir, now you have a nice day sir!" GPS? Park in the middle of your beat until you get a job. Re-read the G.O. on CAPS and Beat Integrity, use the departments rules against them!
The Dept wants to get “pimpy”, well, can you play the same game?

Sue.

Go to small claims court and file a claim asking for the $5000 max. You don't need a lawyer, only half a brain.

Even the dirtiest POS out there has a momma who will die some day and she just might own a home outright.

Besides. That judgement will be stapled to every Section 8 housing request, every credit card application, every job application, every college entrance application, every car loan, and every mortgage the POS seeks till the end of time.

A filing fee and a little time out of your life and you can get the one thing that almost no one gets in Cook County. Even.

Not long ago a two guys on a gang team were accused of attempting to rob a guy. The guy called in, requested a supervisor, and demanded a CR#. But he changed his story, and told the responding Sgt that the officers only pointed a gun at him and used profanities. When the Sgt. asked why he stated that the Officers tried to rob him, he denied making that allegation. The Sgt. got the CR# for the second story, and also listened to the 911 call that clearly recorded the subject accusing the officers of trying to rob him. The subject was arrested by the Sgt. and charges for Felony D.C were approved. This case is currently being adjucated

while it would be nice to go after some of these thugs for the false allegations it is very hard to prove them false in court to the extent required for a conviction.

essentially what IAD is doing is saying there is not enough evidence to determine the cop did anything criminal, or perhaps punishable. that is a far cry from determining that the complainant committed a crime.

besides, you really want to go down the path of losing a bunch of these cases in court because juries just do not trust CPD?

First of all, the affidavit provides for Civil Penalties not criminal ones. Second, IPRA/IAD use preponderance of evidence not reasonable doubt, making criminal charges an entirely different thing than a tort. Finally, good luck proving that someone knowingly lied.
