Off Duty Shooting - In Utah

  • An off-duty Chicago police officer shot a suspect who stabbed a man, apparently at random, outside an Orem restaurant, police say.

    Both the stabbing victim and the suspect were in stable condition at separate hospitals as of late Saturday morning. They're [sic] names have not been disclosed.

    About 8 a.m. Saturday, a Boise man and his girlfriend were leaving the International House of Pancakes at 850 W. 1250 South. In the parking lot, Orem police said, a 33-year-old man approached the couple and somehow startled them. The man apologized, then began attacking the Boise man with a pair of scissors, police said.

    An off-duty police officer saw the attack and went to help. The officer drew his gun and ordered the suspect to drop the weapon, police said. But when the suspect made another move to stab the victim, police said, the officer fired.
Well done Officer.

Excellent story! Great job to the officer. I'll be honest, unless my kids are with me, I'm kinda lazy about carrying a pistol off-duty. However, when I travel -- I've ALWAYS got one. It just makes good sense to me when you're in unfamiliar surroundings. How horrible would it be to stumble into a situation and not be able to protect your family when you've got the right and the ability to do so? Thing is, I get shit from other coppers about this all the time. When it comes up, they act like I'm nuts. "Why would you want to have to worry about a gun on vacation?", "Why would you want to be bothered with it in an airport?", "..or if you get pulled over out of state..", "When I'm on vacation I want to relax..". I hope a few of them read this Utah story. Sounds like a bunch of people are glad that guy was armed! Thanks for posting it.

Nothing and I mean N.O.T.H.I.N.G ever good happens when you go to an I.H.O.P. to eat. I always avoid I.H.O.P., Denny's and Red Lobster. Everytime I go to one of them it's nothing but T.R.O.U.B.L.E.! Do yourself a favor and go to McDonald's and get yourself a Big Breakfast Deluxe. Pancakes, Eggs, Hash Browns, Sausage and a tasty muffin. Now that is good eating with all the trimmings.

Under the head of "no good deed goes unpunished", I hope this officer remembered to notify the department that he fired his weapon in a timely manner. Also, is there a problem or not with him carrying his weapon, while off-duty and out of state? Not trying to start anything, honestly, don't know the answer, but I thought this was a no-no. Can anybody provide the Rule that says this is OK? BTW, good work officer - here's your 30 days suspension. . .

This was made possible by someone carry a concealed weapon. Utah has had a concealed carry law since 1995. I hope the stabbing victim realizes that it should have been HIM who shot this offender. We as Peace Officers have a moral obligation to carry our guns at ALL TIMES!!!. We are the front line defense against domestic terrorism which includes pookie trying to gangster your car or wallet. Be careful out there.

Great job, and I'm glad the copper is OK. Just think, if that would have happened here in his home town surrounded by the support of CPD, he would have been forced to blow - God forbid he had a couple of drinks before he SAVED SOMEONE'S LIFE! Then the bosses, IPRA, and IAD would run him through the wringer. And let's not forget the headlines - "Off Duty Cop Kills Man", and they'd refer to the jagoff as a "victim" in the story, too. And if the "victim" was black and the copper was white, look out. And, of course, no matter what the City would settle with the "victim's family". Sorry for the rant, but it sucks to think how much more shit would've happened to this copper if he was on his home-turf. GREAT JOB! One more for our side!

Yes Mr. Daley, we CAN carry anywhere in the United States. It's called the federal law HR-218. I know you've never heard of it because federal laws don't apply in shittycago but in other parts of the country they still believe and respect them.

Heard Daley went crazy when we were allowed to carry throughout the US by the new law. He lobbied against it just as much as the lifting of the eventual gun ban. Its esy when you have armed security around the clock to protect you and your family. When States Attorney he used to carry a snub for protection. Im sure he is concerned this Utah offender is going to sue the city of Chicago. City will settle for $500,000 and move on just how they handle all suits against the city.

Heres a good one...Ive been told that Utah loves to sell non- resident concealed carry permits...one of King Daleys loyal disarmed subjects( his honor calls them "citizens") could send his prints and a pic down there, with the appropriate fee of course, and recieve a permit by return mail. Florida does non- resident permits, too ...

H.R. 218 Inquiry:

My agency has a policy that does not allow me to carry my firearm while I am off-duty. Does this mean that this legislation will not benefit me?

If you are a qualified active law enforcement officer, you are legally able to carry a firearm under the provisions of H.R. 218.

There may be agencies which enforce or adopt policies, rules,
regulations, or employment conditions which discourage or punish officers who choose to carry
while off-duty, but such actions do not mean that the officer cannot carry under the provisions of the bill.

Bottomline: H.R.218 may say that you can carry around the county but CPD can have its own policies forbidding, restricting, or disciplining officers carrying off-duty, or in other jurisdictions, etc. Question becomes not whether federal or state law permits off-duty carry, but what is the departments policy????

the Law Enforcement Officers Health and Safety act AKA HR 218 was passed on 22 July 2004 which allows him to carry almost anywhere in the country
