City Giving Away Money - Again

Shortshanks and his crew of idiots continues piss away money at a tremendous clip, this time by NOT pursuing money from moving violations. It has been all over the comment sections recently:
  • Judges have been summarily dismissing all LIDAR tickets since December.

    This is because after numerous requests from defense lawyers for a "Fry Hearing" which determines for Judges to take Judicial Notice of new technology and allow it. The City has not been answering ready for a Fry on a daily basis for the last 18 months or so.

    The City has been blowing this off for years, it costs a lot of money to put on a case like this because of the cost of expert witnesses.

    There was a Fry Hearing in DuPage last month and it (LIDAR) was admitted as sound technolgy. There will be one in Rolling Meadows at the end of this month, that should then allow the LIDAR to be admitted into court in Cook County.

    In the meantime, thousands of dollars in fines and fees have been lost by the City and the County.
Thousands? We'd imagine it was tens of thousands, maybe more. But then again, there aren't that many tickets being written anymore since we're in backlog for eighteen out of twenty-four hours every day.

This is typical of Chicago. They want it to look like we are addressing law violations, but in the end they really don't care. Just like all the silly missions and event numbers every night. On paper it looks like we are doing something, but in the end it's all smoke and mirrors and does nothing! The city doesn't care much about the tickets because they are happy with the percentage of people that just mail in the checks without knowing about what the judges have been doing.

It amazes me how Da Mayo tries to turn the 14 year old cop incident against the police. He stated that if something would have gone wrong it would have cost you the tax payer millions. Well by the grace of God nothing major did happen and Im sure a law suit is coming and a pay out will be agreed to. But Mr. Da Mayo you should not throw stones when under your watch you have blown millions with hired truck, Millineum Park, how about the huge law suit that gave several city employees a total of a 15 million pay out, ETC. Mr. Da Mayo you have your city attorneys settle law suits for millions without thinking about fighting them. Who is getting the 20% kick back from these low life attorneys after their pay day?

I stopped writing LIDAR tickets last year because of this. I am not going to stick it to the honest citizen any more because the City can't get it's act together. If a judge considers it unproven technology, so be it. No speeding tickets from me.

ATTENTION CITIZENS: Plead not guilty to speeding if written by a LIDAR device, ask for a FRY hearing and beat the ticket!

City Corp counsel know about this as does CPD Legal Affairs. When it is accepted in court, I will write tickets again, not before.

As one of the departments LIDAR (LIGHT, DETECTION and RANGE) instructors, I have suggested well over a year ago that a one day class be given for the ASA and Traffic Judges, which would allow them the classroom instruction and a hands on field application on how these devices operate. It's been established long ago that LIDAR is a pin point precise and right on the money system once the officer selects his or her target.

What is happening now is lawyers know we have a loop-hole in Cook County Traffic Court and they are capitalizing on it. (Illinois Supreme Court must recognize LIDAR as a proven scientific means to detect a violators speed).

Having said that, if you were to write speeders, this is child's play. You would never write a red light or stop sign again. It's that good.

LIDAR is a lazy way to pick up a mover...catch a mom driving a few miles over the limit. You cannot go a block in this city without seeing some driver doing something really dangerous, .D.U.I., blowing a light, texting, passing on the right. Write the gangbangers with the junk-mobiles. They cannot move 5 feet without doing something stupid. Leave the tax payers alone...unless they are jerks of course.

You are right about the dismissals, but I think you are wrong on the reason. Judges are looking for any way to dismiss traffic cases because of the absurdly high Cook County "court costs" that have to be paid with any plea of guilty or conviction. I was in court the other day and the judge said he would only fine people ten bucks for any mover. That's because they would have to pay something like $150 when they get to the cashier. who cares. cops should by and large not be wasting their time with revenue stops when there are plenty of violent criminals they could be going after.

thought experiment. take the fines of of traffic enforcement and the citations will drop to near none. that just shows that the underlying reason for traffic citations is mostly revenue.

is revenue generation what we really want out police to be spending their time on? or is it dealing with the monsters in our society?

i remember when they started the bullshit seat belt missions all the movers written for the seat belt violation were thrown out in court. then they made up a parker for the seat belt violation and we were told to write that instead. last night the softball sgt who is mission crazy called for cars for a seat belt mission and used the last two cars that were up on the zone. then of course we were in a backog and lunches were denied. typical softball supervisor with his head up his ass as usual.

Do a search on ask.com of LIDAR and you will see that there are problems with accuracy. A slight movement of the officers hand can cause an 8MPH error. I am not sure if this is the problem here but it is in some states.

frye hearing..people vs mcnown. il state supreme court sent it back to trial court in peoria co. trial court found it to be a good test and can be admitted. lidar also good, no defense atty wants to do a frye hearing it cost them way too much, shove it in their pieholes

Years ago only P.O.'s from the traffic unit were allowed to use lidar for speed enforcement. They were properly trained in the use of lidar. The department used lidar for speed enforcement for about ten years without a problem in the courts.

A few years ago, a northwest side alderman was having problems with high speed traffic fatalities. He fought hard to get the Lidar guns assigned to district law enforcement. The lidar guns appeared in the districts abut three years ago and had immediate success on the street and in the court room.

Here's the part where incompetence of supervisors comes into play: A while back the department spent some serious money to send about ten P.O.'s from the Traffic Unit to Northwestern University's Radar/Lidar instructor school. The coppers were instructed to teach LIDAR as a twenty-four hour class. Two sgts. and the lt. in the traffic unit (who didn't attend the school) believed they knew more than Northwestern University and the P.O.s who had years of experience using radar/lidar, and told them to make it an eight hour class. The instructors told the three it wasn't possible. In fact the supervisors were told NOT to reduce the training time because of liabilility issues (such as all the lidar tickets would eventually get thrown out) regarding poor training. But these three clout-laden supervisors decided upon themselves that eight hours was enough. All of the instructors in the traffic unit declined to teach the eight hour class and the lidar training class was dumped on some poor copper who never wrote a ticket using a lidar gun!

About two years ago, judges in traffic court realized something was amiss with many of the newly Lidar trained P.O.'s testifying in court on lidar cases. The judges were used to years of solid testimony from properly trained traffic coppers who knew the laws regarding the use of lidar. One by one, judges started to throw lidar tickets out in their court room. Now, none of the judges will hear a lidar case. The judges are using Fry as an excuse.

This could have been avoided, but clout supervisors who make decisions without the benefit of experience or knowledge will listen to their egos before they listen to common sense. This is the Chicago Way.

How about the mandatory court appearance on the stop signs since the minimum fine is supposed to be $100? The judges impose th county's mandatory $135 fines, fees and court costs then feel sorry for the offender and fine him 15 bucks for the stop sign. My question is, does the city figure their yearly budget based on the estimated revenue from the $100 dollar ticket or the $15 they actually get? There's a big difference there and taxpayers are covering it.

So why not just keep writing tickets and filling up your call? Who does it hurt? Not us. We're still getting paid our 3 hours just for showing up. Who cares if every ticket gets tossed out? I don't get paid by the conviction. It's the county courts that are throwing out these citations, not the city. The Corporation Counsel attorney can only recommend a ticket be SOLed. It's the Court that accepts the recommendation and dismisses the case. The judges have chosen not to admit LIDAR as a valid form of determining speed.

So, it's the county who's hurting themselves in this deal. They are the ones missing out on the court cost fees on every ticket. What is that up to now, about $135? That's not a fine. That's just court costs. It's the county that's screwing themselves out of tens, possibly HUNDREDS of thounsands of dollars in revenue.

I will keep writing speeders and keep getting my overtime checks. And as cheesey as it sounds, the residents appreciate it and it's nice to have them happy to see the police around their block for a change.

I don't know but.......I do have a close friend who was injured in a bad on duty car crash. He was visited by none other than the Alderscum who heads the committee on finance (they decide who gets paid)while he was in the hospital. This greasy alderman was checking on how the poor officer was doing.
And "Oh by the way, between you and I here is the card of a real good friend who happens to be a personal injury attorney."
I swear on my life that this is the way that this officer related the story to me.

I'm going to let you in on a little secret. I may or may not be a police officer.

I can't stand "Big Brother" cameras. If the streets are desolate, I stop briefly at a red light (as if it were a stop sign) and continue through the red light if all is clear.

OT...Our FOP is asking us to complete a medical section survey and they need our personal information. They claim it's supposed to be kept "confidential" The sad part is I almost started to fill it out, but then began to realize that I can't really even trust my own union leaders. Lets face it they never speak out in our behalf and the past union leaders were in bed with the city and I'm sure this union is also. It's too bad many of us feel this way and something simple like giving our personal info on a FOP survey makes us uncomfortable.

I have the most respect for the trained officers to refuse to conduct improper training. Clout heavy, incompetent white shirts. Traffic unit was micromanaged by a LT who do not care about the right way only his ego. Now we have a typical CPD cluter fuck. The 14 year old is the tip of the ice breaker.

Why is this even discussed? What percentage of us write movers? 2%? I mean the only fuck that has any chance at all of getting a mover is the gangbanger rolling with no DL. And thats just to inconvenience him and tow his car when he doesnt have insurance either. Other than that u can do wahtever u want and im not writing shit. The last person i want getting money is Daley and this fucked up city,and most coppers would agree with me. We cant get a contract for 19 months and were worried about whether or not Lidar works? The officer who wrote at length about the proper training for LIDAR being 24 hours is absolutely correct.

The CPD decided, on their own, to make a CPD style class and to make it 8 hours. Basically it consists of "aim this here thing at a car and read off the speed here."

We ere given no training on technology, testimony, self check etc. Results is as the officer pointed out: Officers testifying who were obviously NOT knowledgeable in LIDAR.

The officers who know this device and have taken the three day course can get convictions. Those of us who go through the phony CPD 8 hour minus early duck time bullshit class get our cases tossed.

CPD strikes again.. One again it would have been better and cheaper to do it right the first time.

Once again it is proven that training on the CPD is good for shit.

Overruling decisions from a trial and appellate court, the State Supreme Court of Illinois determined the HGN Test lacked the general acceptance in the relevant scientific community to be admissible absent proof to the contrary from the prosecution in a ruling from September 2007.

The Illinois Supreme Court overturned the rulings of a trial court and appellate court with regard to entering HGN results as evidence in determining the alcohol impairment of defendant Joanne McKown when she was arrested by police in June, 2002. McKown had veered into oncoming traffic, causing three motorcyclists to be thrown from their vehicles in Peoria County. Two of the three riders suffered serious injury.

The state’s high court remanded the case to the Circuit Court of Peoria County, ordering an evidentiary hearing pursuant to Frye vs. United States (1923). Neither of the lower courts held such a hearing at McKown’s trial, accepting the reliability of the HGN test in determining alcohol impairment based on previous state court opinions. In both trials, the court admitted testimony of the arresting police officer who tested McKown for HGN.

After the Illinois Supreme Court Ruling, Peoria County conducted the requested Frye hearing. The purpose of this hearing was to determine whether the HGN test is generally accepted in the scientific community as a reliable indicator of alcohol impairment.

Over the course of several months, the judge heard from experts and from defense witnesses. Following the testimony, both the state and defense submitted case law, studies, published articles and written briefs for the judge to consider. After reviewing all of the information and persuasive authority, the trial court judge ruled in favor of the state: The HGN test is generally accepted as a reliable indicator of alcohol impairment and is admissible in court

In People v. Canulli, 341 Ill. App. 3d 361, 367 (2003), the State offered the testimony of a trooper who used a "Lidar" laser unit to determine that the defendant was driving 15 miles per hour over the speed limit. The defendant later moved for a directed verdict because the testimony regarding the laser evidence lacked proper foundation. After being given seven days to respond, the State was allowed to present a bystander's report of an unrelated traffic case in the same judicial circuit, in which the trial court conducted a Frye hearing (see Frye v. United States, 293 F. 1013 (D.C. Cir. 1923)) and determined that evidence of Lidar technology was admissible, scientifically reliable, and an accepted means of obtaining proof of the speed of an automobile in that judicial circuit. On appeal, the defendant argued that the trial court abused its discretion in allowing the State to reopen its case to present additional foundational evidence. The appellate court held that the trial court did not abuse its discretion in allowing the State to reopen proofs under the circumstances in that case.

They claim it's supposed to be kept "confidential" The sad part is I almost started to fill it out, but then began to realize that I can't really even trust my own union leaders. Lets face it they never speak out in our behalf and the past union leaders were in bed with the city and I'm sure this union is also. It's too bad many of us feel this way and something simple like giving our personal info on a FOP survey makes us uncomfortable.

A few times I have had them fax over all the information and we'd bring the juvy over to the juvy center or home. I actually prefer this method. Seems quicker...

She obviously had already eaten her 7 course meal. How much clearer can she say I hate the police? People were rude and outright defiant towards her and she still gave them a play. She made it very clear that she totally disapproved of the court costs and even told one guy not to plead guilty that he should go get sr22 insurance and come back next month and plead late compliance. What the heck was that? I just wanted to shove a donut in her mouth!

The training that I went to was more then enough to understand and operate this kid friendly machine. The guys doing the training were right on. Blame yourself if your a little slow.

Why are the traffic judges dismissing all of the lidar tickets?? There are standards for a reason. Management ignores the rules and tickets are dismissed. Other departments follow the rules and judges accept their tickets. But then CPD is in their own world.

I wrote tickets on the traffic accidents I handled as required and they dropped the operating with no license and no insurance tickets. I interjected asked her(city attorney) what are you doing everyone who operates a motor vehicle has to have a license and insurance. She gave me a dirty look and still dismissed the tickets. I thought WTF all these assholes out here getting into accidents causing serious property damage and injuries to law abiding motorists and the city attorneys let them off!!!! Sends a clear message if they don't care why should I.
