Rumor Explained

About a year ago, maybe more, there was a rumor appearing in the comment sections about coppers being subpoenaed to Milwaukee to appear at a Federal Grand Jury. This was assumed to be some involved investigation that was too hot to be handled by a Chicago Grand Jury seeing as how corrupt this town is.

Today, this would appear to have been the source of all those rumors:
  • A veteran Chicago police officer has been indicted on a federal civil rights charge for allegedly striking and injuring a suspect under arrest, federal authorities said today.
Comments have been appearing on and off all day here about how the officer struck an individual going for a pistol while involved in an undercover sting operation and how OPS had already closed this case. We don't know any of the details, though we assume a largish number of them will be revealed in upcoming days and weeks. They won't be appearing in our comment sections from this point forward.

We would remind everyone to be circumspect in any actions that fall in the gray areas of policing. You do not want to be in that position in this day and age.

This is a fucking outrage what happened to Swiss!

Anyone who knows him, and many do, all know him to be a very level headed person, a working police officer, and a down to earth nice guy.

Swiss is the guy who buys your kids raffle ticket or your benefit ticket and never blinks an eye and never asks for anything in return, and he never would ask you for anything even when he needs help. He needs it now, he just needs support. Trust me, this is not some dipshit who went out and did something bad/wrong/etc, he did his fucking job.

What these piece of shit Feds, (the never have been and never will be the POLICE types) did is another slap in the face. While I cannot prove it, I will always believe that that cocksucker who is allegedly in chagre of us, somehow and someway got involved too.

SWISS - stay strong, I know what you did was for the good and safety of everyone involved...and bottom line, you came home that day.

That is all that really matters.

You will get through this and I will be there for ANY benefit on your behalf!

God bless this P.O. and his family. No one should second guess this officer; there should be no Monday morning quarterbacking. I'm sure he did what he felt was necessary to stay alive and protect the lives of his partner(s). I just don't understand why any Chicago P.O. would work on a joint task force with the feds.

A Cook County court reporter(who is obviously not connected) complains that she won't work more than 40 hours per week without being paid overtime. she was told to only put 8 hours per day on her time sheets. she complains that she will not falsify time sheets by saying she only worked 8 hours per day when she worked much longer. then she is fired. 29 years on the job. no explanation. how many workers are signing off on this policy without speaking up?

Do your job as mandated by law and the contract. If an armed felon does not want to go to jail when asked nicely ask again in a stronger voice. If he persists in his felonious behavior include that in your report. See to it that you do not cause him injury by pursuing too aggressively by foot or God forbid by car. Do not, however, use any force that can be seen to violate his civil rights.

God help that Doctor on the Northside when she is federally indicted for stabbing that poor unarmed man who was just asking for directions.

That is a very interesting and yet factual point. The problem we are facing is that most jobs are becoming gray areas and many bosses do not know what they are doing because they are merit or double merit. Gray areas are going beyound proactive police work. Proactive police work allows you to choose your battles to a certain extent, for example; DOPWs, signed complaints, tvbs, and case reports. In many cases gray areas lead to arrests and probable cause is clearly articulated. In some cases supervisors which lack hands on experience will attept to add fuel to the fire by dissecting narratives which should only be examined for probable cause.

Swis, is a good guy. What’s going on here is another reason not to trust the Feds. According to the Chicago Suntimes here’s who did the investigation …. .“The Office of the Inspector General of the U.S. Department of Justice, the Chicago Independent Police Review Authority and the Office of Professional Responsibility of the U.S. DEA jointly investigated the case”. What happen to all of the DEA agents that worked the case with Swis are they all cleared? Or did they leave Swis hanging?

The way this police department conducts business is illegal. It always has been, it always will be.

Investigative alerts with no PC are illegal on their face. A person cannot be held past his bond, or arrested, or stopped, or detained unless there is probable cause to do so.

Forcing an uncooperative witness to do ANYTHING, including forcing them to wait for detectives is illegal.

Handcuffing people during a street stop based only on reasonable suspicion is illegal.

Searching a home under any circumstances without a warrant is illegal.

Arresting people in their home without a warrant is illegal.

Holding arrestees on felony warrants and continuing the investigation without first bringing the arrestee to the judge who issued the warrant is illegal.

Telling witnesses or victims that unless they cooperate their pending cases will be sent to trial, or get longer sentences, or be handled differently in any way whatsoever, is illegal.

This department refuses to supply officers with the tools needed to do modern day police work.

There is no department procedure to expedite warrants or obtain them during off-hours. There is no department procedure for handling uncooperative witnesses or victims.

The department is counting on YOU, the officer, to make justice work in this city, even when this department has failed to provide the officer with any reasonable procedures to conduct police work quickly, efficiently, and LEGALLY!

If you work in any unit in this department where arrests and warrants are the priority, take note that the department has limited its liability if things don't go smoothly by putting all the criminal and civil liability right on your head.

If you think a take-home car, or nice hours, or plain clothes are worth this risk, have at it.

If not, you better make a change. Because this deparment is not going to change.

Ive never heard anybody say a bad word about Swiss. He's a great copper, and the kind of guy you want for a neighbor. I dont know any P.O. in their right mind who wouldnt want him as a partner. Furthermore I dont know what happened that day, but I know there was a man with a gun who was disarmed. I guess the feds screwed us again, maybe they didnt leave one of us lying on the floor bleeding out, but they screwed us.. I wonder if one or more DEA agents got to go home and kiss their kids that night because Swiss took action.. Maybe some DEA agents body didn't get to room temp with a sheet covering it because Swiss had balls. I dont know wasnt there... but I worked with Swiss and I always felt good knowing he was around.

CS case is Case No. 09-cr-566 filed 30 JUN 09. it can be found through the northern district of illinois courts homepage.

This indictment is BS. If you are the police they don't even have to name your accuser! read the indictment. CS is alleged to have done something to "JP". that person should be named. this indictment is un-American.

Here's a scenario for all the crime fighters: You chase bad guy. He pulls gun on you. You terminate the threat.

U.S. attorney's office then goes to the grand jury and says: "Officer shoots an individual named XYZ. You dont need XYZ's name. His initials will suffice. He died." (Feds only used initials in CS's indictment)

True bill. You are indicted for murder. They don't need all the facts for an indictment. Just enough. AUSA gets promotion. You get screwed. (remember the border patrol agents? they got 10 years for protecting the border)

Or look at it this way. Bad guy runs. You wave good bye. 19P. Bad guy later shoots some POS. Do your GOCR. Go home to your family. You are one day closer to retirement with finances and family intact. One less POS in the hood.

Thank you for clearing that up ACLU representative. Some may have been under the impression that the Constitution was for Americans. I suppose that the right to keep and bear arms in the Bill of Rights is also extended to illegal, oh, I'm sorry, undocumented aliens. And our Social Security system should pay them for being here illegally because they are, after all, human beings and we have a duty to support the population of the world.

Pull your head out of your liberal ass. They're going to screw a cop and support a criminal drug dealer who shouldn't have been here in the first place. But of course you'll have to defend that. THe court said that the city must go with the test if the test has 'validity' (this is a psychometric term meaning the test accurately predicts future job performance). The court also constantly uses the expression 'job relatedness.' SO if the test is job related - there could be 100% of any one single race legitimatedly promoted off that test. (hopefully this would not happen). but ANYWAY ... the 'dispate impact' talked about in the Civil Rights Act of 1964, Title VII means noting if the test is job related.

Well, guess what this translates to (in my opnion)? There no need for meritorious anymore.

And just so you know the whole affirmative action thing originates from the EEOC guidelines (the 80% rule). The EECO was given authority by this Act.

Had to go up there this week on a subpoena. Their courthouse/safety bldg is only a hair above 26th and Cal.

MPD guys say their chief is the real deal except that he just got in some hot water for having a brief affair with a reporter. When word got out he publicly apologized to his wife and to the troops for failing to set the proper example. WTF? A chief who apologizes to the troops?

I guess I'm sold. Maybe the fact he got to screw a reporter instead of the other way around won me over.

Swis did nothing wrong, he’s the reason all of the Feds went home that night. There is a rumor that several Feds ran by the illegal with the gun without searching him. Swis, stopped and search the illegal and arrested the illegal with the gun. According to Swis’ attorney in Chicago Tribune, the illegal was “injured because at the time he (illegal) was arrested, he (illegal) was armed with a weapon and my client had to tackle him to make sure that the weapon wasn’t used”. I will not lift a finger until we are out from under this Federal Consent Decree. I hope this city burns to the ground. The city and the feeb that runs this department have achieved their goal. I now am a paid observer. I will only act in a capacity to record incidents. I will not act in a capacity to prevent or deter crime, for that will only get me indicted. I will wait until the incident is over and pick up the pieces.

Don't know anything about it BUT...can it be assumed that one of the TEAM (possibly teh DEA guy or FBI gu or supervisor) witnessed some aggressive act and reported it as per the G.O's of the Federal Government or whatever.

In other word an action taken by CS may have been misunderstood or felt overly aggressive or better yet WRONG in the eyes of the LIBERAL peace officer that was assigned to whatever mission they were on?

In other words......any of you OCD and Narcotics guys or HIDTA or whoever Intelligence boys that work in "CONJUNCTION" with... BETTER RE -THINK your back up and those you trust around you!

Note the use of "the people in amendment one" when referring to the right to assemble peaceably and to seek redress of grievances.

Read the whole opinion. The Court also used language stating in effect that there is nothing binding the city to testing for promotions. It merely noted that was the traditional method used.

Is this the the new "federal model" of Policing we're seeing? Who in their right mind wants to volunteer to work a joint operation with the feebs in this day and age? Their training and mindset is too different from ours. We react IMMEDIATELY to a threat... We knock people the fuck down/out for non-compliance... If violence is the only language a subject understands, our training (at least from ca. mid 1980's to the early 1990's) was such that we could effectively communicate in the subject's language and bring the situation under control. Is that how you normally conduct your investigations? By making assumptions with absolutely no basis in fact? For your information, these federal task forces are made up of suburban PO's, CPD & federal agents (who are more often than not, former police officers themselves; this is especially true for the DEA). Noone is ever forced to join a federal task force. So, you are correct about one thing, if you don't trust the Feds, its probably not a good idea to join any of the federal task forces, DEA,FBI or HIDTA.
