New York Terror Trials (UPDATED)
- The move to put the self-proclaimed Sept. 11 mastermind on trial just blocks from ground zero raises a host of legal, political and security questions, chief among them: Can a fair-minded jury be found in a city still nursing deep wounds from the attack on the World Trade Center?
Some also worry that the trial of Khalid Sheikh Mohammed will make New York an even bigger terrorist target, and that he will use the proceedings to incite more violence against Americans.
The loudest protests Friday came from relatives of the victims, many of whom oppose any civilian trial for terror suspects - especially at the federal courthouse 1,000 yards from the spot where nearly 3,000 people died.
And just imagine if one of these jagoffs gets off on a technicality.

A near-empty prison in rural Illinois has emerged as "a leading option" to house suspected terrorists currently held at Guantanamo Bay, Cuba, an Obama administration official said Friday.
As they work to shutter the controversial detention center, federal officials are talking to Illinois officials about buying the Thomson Correctional Center, a maximum-security prison about 150 miles west of Chicago.
With Illinois Gov. Pat Quinn and other key officials warm to the idea of a federal purchase of the prison, federal officials have stepped up investigations into turning Thomson into a super-maximum facility with a unit for former Guantanamo detainees.

First, since I think we agree that terrorism has evolved into Fourth-Generation Warfare (4GW), we need to examine the goals of the involved parties. Terrorists are attempting to destroy the legitimacy of the state, which means to demonstrate that it cannot provide services such as rule of law.
The way that you fight that is to, first, deny them standing as combatants. That means that you treat them as common (or, in this case, uncommon) criminals. Make being a Jihadist or a Neo-Nazi or any other form of terrorist no better than being a street corner crack dealer. That's how you cut off their financial and human supports.
Second, demonstrate that the tools of state, such as rule of law, can handle common scum like these. Don't give them the credibility of being anything more than an above-average murderer.
Their power is only in our minds.

I don't think it's a bad idea at all. Let that asshole have his trial right where he did his dirt, in the Big Apple and just down the street from the scene of the crime. NYC is far better prepared to deal with terrorists than any other City in the US.

I think there is a good chance the government can get around the procedural issues the defense might raise.
I worry more about the jury. The government is either going to have to release a lot of secret testimony or the jury will not see the most important information.
Its going to be very hard to get a US jury to convict without seeing hard evidence or allowing the defense to cross examine witnesses against the defendants. As it should be.
This has the potential for turning very bad.
I don't know what the answer is, but this seems like a really bad way to handle the situation.

not by our civilian justice system prosecuting them, not by our politicians artificially characterizing them as such, not by either a majority, or minority, of public opinion considering them as mere mass murderers, not by our executive branch declaring them to be less than enemy combatants, and not by you thinking that anything we do will, in any way, alter their terrorist minded fellow Islamic fanatics' insane belief in 'jihad'.
no matter what we do, they will, in the twisted minds of their followers, be 'martyrs' to 'the cause'.
and the practical, real world consequences of how 'they' react to both the prosecution in a civilian court and the location of said prosecution are the only things that should be considered by responsible authorities, whether civilian, or military.
