Can We Get a Witness?

How many people were present when this went down?
  • Last night [in 025] a p.o. was seriously injured because a lazy Sgt. tossed beat tags while calling off the officers names. She was warned before about tossing beat tags at officers. What's wrong with handing it to them?

    She tossed a beat tag at an officer and he was seriously injured. He had a very large laceration to his head (he required stitches) and he was complaining of lack of ability to see through his left eye.

    Oh, the best part. She ordered another p.o. to do the report and classify it as an "accidental injury". How about telling the fucking truth!

    I am sick of the fucking double standard in this department.
Well, the double standard has been around since the inception of the Department, so we can't say you weren't warned. But seriously, how many people saw this? They should be lined up with witness To-From reports for the IOD.

"Accidental Injury"?

How about an Accidental Rule 14 violation up the entire chain of command?

Get all the witnesses you want.

There's a little thing called "intent". It's definition was sandwiched, I believe, somewhere between the probable cause and reasonable suspicion chapters in the Police Academy 101 textbook. Sarcasm off...

Unless the "lazy Sgt." (which sounds like a complete fucking asshole, by the way) wanted to purposely injure this officer, it IS an accidental injury and should be documented as such.

Flipping a beat tag (which is really stupid - they do have some weight to them and jagged edges/corners) to a copper during roll call is one thing. Whipping it with force and/or purposely aiming for any body part other than the hands is another. A reasonable person wouldn't commit such an unreasonable act. Unreasonable doesn't translate to intentional, however. Even if "warned before" about the same shit.

Document it properly...as an ACCIDENT. But don't let that preclude the discipline process from taking it's rightful course against the Stupidvisor. And if I were the copper injured by this asshole, you can bet my attorney would be exploring any and all means of restitution from the City and the sergeant personally...ESPECIALLY if there's the possibility of vision damage. Losing an eye is pretty much a career-ender in this field.

im sure she didnt mean for him to get cut in the head... Im sure she didnt mean to hit the officer. I work nowhere near where this happened or know any details except that is given here but sounds accidental to me. Sounds like the author has a beef with the sgt in question and is trying to amplify it on this site.

If the officer had a set of balls he or she would have went over the Sgts head and made the report with the correct classification.
What is this sgt going to do for this officer that she hurt? If the officer has side jobs that help support his family, is the sgt going to give up a few hours of pay each day to compensate him? Sgts, glorified patrolmen, most of which dont know their asses from their elbows.

How many POs have the courage to speak out or stand up to a bad boss? Most of us do not have the courage to step forward and be a witness against a boss the their conduct against a fellow PO. I know from experience. Yet they will post on this blog about how something needs to be done. Grow a pair!

The NFL case comes to mind, where the ref threw a penalty flag AT a player and hit him in the eye causing permanent injury. The penalty flags had a weight of some kind tied or sewn in them so that they would not blow away when tossed in the air. I believe it ended the player's career.

that reports first couple of words should read " in summary: ro being ordered by sgt. dumbass to report the following..." which of course wasn't witnessed as such by ro.

BUT, for reporting purposes, a Hospitalization Case/Accidental Injury is the right thing to do...

Those beat tags have very dangerous sharp edges when new and are too heavy to fling at someone.

Sounds to me like this was an unsafe workplace and that this type of repetitive hostile behavior was tolerated, and seemingly, encouraged.

I would have NO problem if a fellow office in blue filed a suit in a case like this.

If so she is the one that ordered the hispanics not to speak Spanish at the desk because she "knew" they were talking about her. Used to throw the mail away before the W/C saw it so she would not get assigned any work. A new Lt. came in took her off the desk and gave her a choice, find some where to go or it will be found for you. Amazingly Sodini backed it up and the girl returned to her former home of 1st watch in 025.

This sergeant sounds pretty stupid. That being said, making a report for flinging the tag and accidentally striking an officer would have resulted in nothing more than a slap on the wrist.

Now, ordering someone to generate a false report, will likely result in ten to thirty days. And, unfortunately, anyone who signed that report, including the generating officer and maybe even the injured officer, is going to bring down an easy five days, minimum. "I was just following orders" is no excuse when the order was illegal originally.

Unless the sgt planned on hitting the p.o. with the beat tag it is accidental. even if she "ordered" someone else to do the report as "accidental" that's exactly what it is. now it's a totally different story if she ordered the p.o. to lie as to how this accident happened when documenting it. THEN there'd be problems. As it reads here, the Sgt. did nothing wrong, except for being a complete asshole by throwing a heavy, sharp piece of plastic at officers after being asked not to in the past. Get a number on the sarge, and see where it goes...probably NOWHERE for the lack of INTENT on her part, and the lack of prior incidents being documented anywhere (this goes back to coppers being cowards when it's time to speak up for yourselves, i.e. horrid cars, piss-poor ventilation and toxins in buildings, and bums sleeping in lobbies, etc, etc).

BUT...DO sue the shit out of her and the City for hiring such a doofus.

That doesn't seem to be a problem, we've all seen
people carried IOD for worse.

It may not be reasonable, but it sure doesn't rise to the level of a crime. I believe Battery says something about the act being knowing, intentional and without legal justification. For those of you that are mentally challenged, intentional means, among other definitions: desiring the probably outcome. Try and proe that in this case.

she doesn't care about anybody but herself...and taking one good look at her unkempt, huge appearance, you'll know if she cant take care of herself she can't possibly care what happens to you. she's been warned before, and yet she cant get up from her chair and walk around 'once' around (4 times a week) the roll call room and hand out beat tags, how do you think she's on the street? she made his head bleed, causing a staple to the head, and she had the audacity to laugh about it? hope when w.c. comes back, she gets put in her place.
and about the 'accidental' report, wow.....really.....it just flew out of space and accidentally hit him in the head. what if it had caused blindness in the eye? then what?.....i dont get it.....i just dont

Sorry that this happened to the officer. It should nothave. Maybe something good might come out of this incident, that is, get rid of the stupid beat tag. It is not needed in the first place. No other city uses a beat tag affixed to the top of the light bar. Outside car numbers are enough.

At least you got it right the first time and called it a traffic crash. There's a big difference between making an unintentional mistake while operating a motor vehicle and acting in a negligent and reckless manner in general. How about a guy that's doing 100mph and swerving in and out of traffic when he hits someone and kills them. He didn't INTEND for it to happen but his ass is still going to be charged criminally and he's going to jail. You don't throw things at people. I don't care if you INTEND to hit them or not. It's reckless, negligent, and stupid. A four year old knows better but it seems a sergeant as well as some commentators on here do not. She was ordered by the Lt and W/c to stop throwing the tags. Read the law,its reckless conduct.She continued and failed to obey an order. The Lt got a cr on her. If the patrolman was smart he should sue the Sgt and the Lt and W/c for failing to take action against her after she continued to do it.
