- A federal lawsuit filed today claims a Chicago police officer was caught on tape punching a man who questioned the use of force against his neighbors in 2009.
The complaint alleges LaMonte Simmons' constitutional rights were violated on Aug. 3, 2009 when he was stopped from engaging in First Amendment-protected speech and assembly. It also claims the officers retaliated against Simmons, 22, by battering him, arresting him and causing him to be charged with crimes all without probable cause to do so.
The suit names the police officer who is accused of punching Simmons in the face, several other officers and the City of Chicago as defendants.
There's a video at the attached link, but for the life of us, we can't see anything aside from the arrest at long distance. We see the police pointing out someone, most likely the loud mouth in question, and most likely the one yelling abuse and attempting to rile up the crowd. The officers approach to diffuse the situation and then....the camera conveniently jogs around at the moment the arrest begins. The jagoff probably took a swing at the officers and went to jail.
But the lawyers have obviously been holding onto this one until the last moment of the statute of limitations, hoping against hope that someone in power would somehow manage to screw up the outside counsel contract that is producing record wins and millions of dollars in savings from frivolous lawsuits involving the police.
And their prayers were answered in the form of Rahm Emanuel shutting down the outside counsel program and directing everything back to the understaffed, incompetent and ill-prepared Corporation Counsel's office. Be prepared to see lurid headlines again, insane payouts and the specter of punitive damages coloring everything the Department does once again.

Our legal system needs tort reform very badly, but we'll probably never see it, since that will affect the income of all the bottom feeding lawyers!
How about LOSER PAYS on all these BS lawsuits? That would go a LOOONG way toward stopping the abuse and keep the unworthy suits from being filed.

I wasn't aware Rahm did away with the recent procedures regarding fighting these lawsuits. That was one of the ONLY things that built any little bit of morale in my eyes.

You have to stop and ask--where is Rahm getting all of these ideas? Surely he has not had the time to research each decision he's made. So who is advising him, that is the question we should be asking.

I have a FOID card and have to show it even to look at guns or buy amo. I do not live in Chicago. I never see any mention of these charges when reading of these arrests. Thanks
I hate to mess up your bone-deep preconceived notions with actual facts, but the "understaffed, incompetent and ill-prepared corporation counsel's office" has been winning a ton of cases lately. At one point it was like 16 in a row. They are understaffed, but they are also extremely talented, hard-working and dedicated public servants. Also, many of the outside counsel you love so much are former assistant corporation counsels.
I was in a Loevy lawsuit. They are simply the lowest scum of the earth. Any Piece of shit attorney that just makes his living by suing the city and STEALING from taxpayers is SCUM. I know an attorney at a private downtown lawfirm that has basically told me straight out loevy will believe anything the rats say when they come in knowing the city is an easy settlement.

The Officer definitely flinched prior to the correct use of force. There is nothing unfortunate about it. The officer responded in the proper manner. The offender made what appeared to make a threatening movement in the officers direction and the officer responded one step higher as is listed in the Use of Force guidelines. An Officer does not have to wait to be hit first or even swung at first to respond to a threat of force against him/herself. You are allowed to defend yourself !!! It is the same as an offender with a gun. You don't have to wait for someone to shoot at you before you get to fire your weapon.
Unless you are right at the scene of these incidents where you can hear what is being said, or done, there can be no honest idea of what really happen. That is where these ignorant souless corrupt attorneys make their money. There are more than a few that have built their living on suing the police. Go overseas and see how many "victims" ever get to sue the police. Enough said.
America is like anywhere else, I mean corruption wise. In other countries it usually more open and flaunted, like in a dictator situation. But here it is more covered and subtle. Amusingly here is like ancient Rome, where they hand up a public sacrifice to be eaten alive by lions for a perceived frivolous act, where others get away with murder in a media circus because the mob wants it that way for amusement purposes. It appears that Doty and Lynch have won, regarding the firing of two of our most senior Lts. here at the UCPD.
Consultations with attorneys have conceded that the University 'did a good job on those above the rank of patrolman.' Specifically, there are no unions allowed here at the UCPD for anyone of higher rank. It states in the regulations that anyone above the rank of patrolman can be released from their employment 'at any time, for any reason' by the University of Chicago. That's a pretty shitty way to run a police dept. especially when one considers that it is the same U of C that has recently hired (former) Mayor Daley to 'enhance the image of the University.'
(what a fucking joke that is!). The two recently fired Lts. ('for budgetary purposes') have apparently agreed to a shitty buyout/compensation package offered by the U, which will be concluded by the end of this week. But this entire debacle has left all of us wondering if the U is planning to dismantle the entire Dept. It's been said that chief Lynch may well be offered a full Vice Presidency on the board here at the U of C in the near future. This would likely push Doty into the position of chief of the UCPD, which would be unacceptable to the vast majority of UCPD employees, both sworn and civilian. No one here likes or trusts a man referred to by many simply as 'Satan himself.' The number of UCPD employees has steadily dwindled since Doty's arrival, through a combination of firings of some of our better supervisors to relentless pressure by Doty the Nitpicker until the employee resigns under great duress. We've gone from a high of 85 sworn to a new low now (approximately 59, last time we counted). A pending lawsuit filed against the UCPD by a former employee looks promising for a victory on his part, which will likely increase our numbers by 1 this fall. Should this employee win his lawsuit and return to duty, as expected, it's going to be very uncomfortable for Doty and Lynch to show their faces around the building. We heard that some whopper lies were told on the part of management at the last deposition for this case.

The only good thing that comes from this is that the overwhelming evidence in this case will result in a settlement instead of a long drawn out trial. When there is video like this the city settles because they know they will get killed at a jury trial. Its almost better for the officers, they wont get hit punitivly and once it is over then its over. This case will go to depositions then settle out in about two years from now. Dont worry about it too much officer... If you were gonna get indicted, it would have already happened...

When we charge no FOID it gets tossed out of court. It's a useless charge. In fact most cases in Chicago either get tossed out or pled to some bullshit supervision and the criminals here get chance after chance back on the streets. Welcome to our little "Utopia" called cook county

im just playin devils advocate and im not sayin that this "victim" is a stand up guy but he makes a great "victim"/plaintiff for these lawyers. This thug you speak of has never been arrested as an adult of juvinile.. a high school and college graduate. It dont matter if its John Q public university the jury will hear this over and over and over again. Never been in trouble, has a job, graduated and has never been affiliated with a gang.... So your thug theory will never ever stand up in this trial.... but it will never get to trial for the above reasons and because of the video. This will be quietly settled after depositions are taken and a few motions filed. give it two or three years and this will be settled away. No matter who is handeling this eg; corp counsel or private attorneys they both know its suicide to go to trial with this case. He will get 750,000 to maybe 3 million in a settlement...easliy. If it goes to a jury hes gonna get about 10 million then 50 or 60 thousand in punitive damages.
OT-- I was wondering if anyone else has had an experience like I did recently in traffic court. A few months ago I stopped a guy who was driving like a real jagoff and wrote him a hazard mover and gave him a court date. On the court date he shows up with that pudgy m/2 lawyer with the squinty eyes that's always in the halls outside the minor rooms. The driver pleads not guilty and the city lawyer asks me if I remember. I say yes because he was such a jag. The lawyer asks for, and gets a continuance for my next key date. Why she granted it when we were all there I don't understand(sarc). I go to my next court date and the driver and his lawyer aren't there, and the case is not on my printout from the court sgt. $ure make$ me wonder how they $plit it up down there.

off topic but they got a hell of a situation going on right now in grand rapids,mi. 7 people dead including two little kids. pursuit all over town with a grand rapids squad car shot up(officer ok) and another two random citizens shot in downtown. High speed pursuit all over the city when the offender crashes and runs. He kicks in the back door of a random house and takes the man and wife hostage in a nice neighborhood. Of course this all started in the ghetto part of grand rapids. Offender is saying that he is going to kill the hostages to force the police to come it, he says when the police come in he is going to kill as many of them as he can before they kill him and has zero interest in commiting suicide himself or surrendering..... I really dont see this one ending good for anyone. pray for the hostages and especially those swat guys who are gonna have to eventually go in and get this guy.

I was involved with a law suit and ended being represented by Jim McGovern of the Corps. Office. His unit has the responsibility of fighting these law suits instead of settling. McGovern knows his business as well of the other attorneys from this unit. We would have won at trial except the police killed the plaintiff a few months before trial.

Incompetent and ill-prepared? Corp. Counsel is anything but. They have an extremely intelligent staff, both lawyers that are young and new and lawyers with 20+ years at corp counsel. A team which combines these two talents is formidable. There's good and bad in every bunch, I guess. As every cop knows. All they want is honesty, because they can see through a lie just as any cop can.

I'm in fact a liberal democrat but guess what, I think the officers of this city have been chiseled down to armed security guards at best and think its bullshit. I'm all for cracking heads and doing things the way they were done in the good ol' days. Thug lips off, BAM! crack him so hard he'll never lip off again without hesitation. The system is broken, the public are liberal sheep that have lost sight of the big picture and police powers seem to have been stripped away. I'd give anything to see Police having jolly beat downs on the thugs, addicts, degenerates, and social service recipients out there making living in Chicago a living hell.

Been sued a couple of times in another life. Kids, wife and a mortgage has changed that. I will not be put in that position again.
That being said, the Corp Counsel has some great workers in it. Very competent and cared about me first, not their reputation or the Cities. They are, however, VERY understaffed.
There are more would be vultures in law school than already out. This is a problem.
This really should come as no surprise.
Rahm was quoted early on as saying "if an officer uses his nightstick instead of his head" he'll be dealt with severely.

I'd give anything to see Police having jolly beat downs on the thugs, addicts, degenerates, and social service recipients out there making living in Chicago a living hell.

The rockford paper does the same thing. It go so bad that you would see fairly detailed descriptions of suspects but no mention of race.
the paper would periodically print a piece claiming they only left off the race of the suspects when it was unhelpful in identitifying the suspect. like a green jacket is meaningful but not the guy's race?
they also stopped showing pictures of black arrestees. I think they eventually stopped printing pictures of most arrestees.
I'm all for cracking heads and doing things the way they were done in the good ol' days. Thug lips off, BAM! crack him so hard he'll never lip off again without hesitation. The good ole days were not all that good.
No reason for coppers to do this kind of thing and risk everything.
All that is necessary is some balls at the SA office to follow through on the worst cases and do what they can to see jail time.
Plea bargaining is a necessity or the system would be jammed. But there are those who should not get that opportunity.
