Self Defense? In Chicago?

  • A Cook County judge ruled today that a South Side man acted in self-defense when he fatally shot a man who accosted him and his daughters at a bus stop on Super Bowl Sunday last year.

    Elliot Mayfield, 53, looked back at his family in triumph and then dabbed at his eyes with a tissue after Judge Maura Slattery Boyle acquitted him of first- and second-degree murder in the Feb. 7, 2010, slaying of Samuel Fullilove, 33.

    Mayfield, who has been held in lieu of $500,000 bond since his arrest the day after the shooting, will be released from Cook County Jail later today.

  • According to testimony in the bench trial, Fullilove had been celebrating the Super Bowl victory by the New Orleans Saints and was extremely intoxicated when he approached Mayfield and his two daughters -- 15 and 11 -- and their young friend as they waited for a bus at 6114 S. King Dr.

    When Fullilove offered to sell drugs to those at the bus stop, Mayfield told him, “We’re just trying to get home -– we’re not with that,” according to testimony. After Fullilove became aggressive, Mayfield showed him the gun and said, “I’ll use it.”

    Fullilove walked away but came back moments later and was captured on a city surveillance camera swinging his fists at Mayfield and chasing him. At one point, the eldest daughter got in between the men and said, “Leave my daddy alone.” Mayfield then pulled out the gun and fired once from about three feet away, according to testimony.

    “Mr. Mayfield was not the aggressor,” the judge said in her ruling. “Here is this man just trying to get home, and their paths cross and tragedy ensued.”

    Relatives told the Tribune last year that Mayfield kept a gun for protection because crime was so bad in his Woodlawn neighborhood.
We would object to the judge's characterization of this as a "tragedy" in any sense of the word. This was an assailant getting exactly what he deserved.

You can't always pick the standard bearer who leads the way, but it would appear that the right to self defense exists in Chicago, even in the face of all of Daley's anti-gun ordinances and in defiance of Illinois' prohibitions on carrying concealed.

Seriously, we need to have a fundraiser for this man to help him and his family get back on their feet.

We could probably fill up the Navy Pier ballroom for that one.

He was protecting his kids, the other kid and himself. That's what he was supposed to do.

This man should not have served even one day in jail. The State’s Attorney should be jailed for bringing charges against him. This case certainly gives creditability to those who advise that civilians who defend themselves successfully in such circumstances should say nothing and leave the scene immediately.

Defending yourself is not a crime and one is under no obligation to report such events to the police. This man might have avoided six months in the shit house if he had taken his family and walked on down the road instead of putting his trust in a State’s Attorney who is all for the criminals.

Judge Boyle is pro police. I have had several cases in her courtroom and have always gotten a guilty be it a bench or jury trial. Boyle has signed a few search warrants for me as well. Good decision Judge Boyle!

The ASA's in that room (if its still the same ones) are not what I would call bleeding hearts by any stretch of the imagination. I guess it shows they don't pick their cases.

Elliott Mayfield exercised is legal and moral rights of self defense and should never have been arrested. He rotted for 18 months in that dark and dank place called Cook County Jail and had to endure the stress of a trial. He protected his children and himself from a drunken assailant and the system deprived him of his liberty without just cause.

The video showing that his self-defense claim to be reasonable was available from the start. Even if charging him was in some way thought of as a legitimate thing for the prosecutors to do, WDF was bail set so high that he had to sit in jail until now? WHO thought that this guy's actions amounted to crazy ass killer status?

A CONVICTED violent felon might serve no more time than he did awaiting trial. Reasonable bail, electronic monitoring at home or some such alternative would have been the way to go here.

Question from a non-cop; to what extent do the police and detectives influence whether the State prosecutes? Could the officers on the scene simply not have arrested him or is it a case of arrest them all let the SA sort it out?

Be interesting to know how best to proceed if ever I am forced to fuck up some honor student, Jersey-style.

You have to wonder why the SA would proceed on such a case that was almost certain to lose on the charges presented.

A homicide occurred thus an investigation is conducted and the facts are gathered.

In the old days (pre July 2005) certain phrases would be repeated to the legit citizen until the legit citizen would mimic the detective. Then the State would be called in.

Go to post July 2005 and the legit citizen now hangs himself on video due to certain phrases being left out.

I can understand why the initial arrest was made early in the investigation. However, once the tape showed what happened the CCSA should have declined to charge.

This case was completely off my radar until yesterday. Apparently Mr Mayfield had a twenty year old drug conviction. I don't know the specifics, but since he was working and raising his daughters it seems like the he had put that past him.

He gave the dearly departed a chance to walk away. He even retreated a bit, but when the drunk deceased continued to be aggressive and went near the daughter he fired one shot.

This is not some vigilante movie where he fired one shot then stood over the soon to be deceased and said "Do you like that? Have two more. Bang Bang."

The CCSA should be ashamed.

Hiram Grau was well rewarded for covering up for Daley/Vanecko in the David Koschman homicide.

Hiram protected Vanecko while on the CPD then he is made Chief Investigator of the CCSAO's to cover any investigation there.

When the media heats things up and something needs to be done to make things look legitimate, the ISP decides to review the case.


Better move Hiram "Da Coverup Guy" Grau to head of the ISP to contain any investigation into Daley/Vanecko.

The 12 locations identified as High Gang threat conflicts were so designated because of their potental for violence. They were identified with the goal of eliminating the conflict. With that in mind also intended within the construct of this strategy was the notion that sufficient resources woul be supplied to lock down those areas in particilar. 1. A lack of a sense of urgency
2. Failure to initiate oversight
3. Lack of committment
4. Failure to convey the message down the chain of command.

Watever the reason this is unacceptable. If you have a district and yuou cannot cover them all prioritize and advis me but you will own a conflict.

For each of you who had a shooting within your conflict area, I will need a summaruy of the following;

1. Whayt resources you had in the conflict area- number of personnel
1a. What was their mission.
2. What they were doing

I think we are all jumping to conclusions on the Mayfield case.

First of all, since he shot someone under what may be criminal circumstances, he has to be arrested and the investigation have time. Witnesses have to be interviewed, statements taken, checked, etc.

What were ALL the circumstances surrounding the shooting? There may be a lot more going on.

So the Det's presenting the case to Felony Review, well, that is SOP and has to be done.

Why was he charged??

I think the CCSA and the courts will charge a working-class, no-record person in a heart beat. Since de-policing has been in effect, their workload is way down. They need cases to justify their existence. This guy had money, so that means that some defense lawyer got some needed billable hours. The bear has to be fed.

What is irksome is that we all know that every week, 2 or more SH's with long felony records bang away at each other. Arrested, they are taken to the Area for questioning and processing. And the f-n ASA denies charges, even weapons charges that could/should/would violate them back to prison, citing "mutual combat-mutual self-defense" because they (the ASA's) know that these SH's will be back in the courtroom with cases that no one cares about, so the ASA keeps his job without having to do any real work.

I don't think that the police have anything to worry about as far as lawsuit goes. The procedure calls for an arrest.

CCSA Alvarez's views on private possession of guns is well known. So this charging may have something to do with her personal agenda more than the facts of the case.

Would like to hear from those involved if we could for more details.....

On Friday, 17 July 1970, forty-one years ago tomorrow, Sergeant James L. Severin and Officer Anthony N. Rizzato were both shot and killed by gang members while patrolling community housing in the Cabrini-Green Housing Development for an all-volunteer "Walk and Talk" project.

As the Sergeant and Officer proceeded across the Cabrini-Green baseball field, the assailants opened fire from an apartment window. The purpose of the shooting was to seal a pact between two rival gangs. Both officers were mortally wounded in the attack.

Three adults and one juvenile were later apprehended and charged with murder. The two shooters were sentenced to 100-199 years in prison for two counts of murder. These killers have parole review every three years.

Years later, newly-elected Mayor Jane Byrne dedicated the field to Sgt. Severin and Officer Rizzato. A small brick memorial was constructed that served as the base for a brass plaque. Subsequently, the memorial and plaque were continually and repeatedly vandalized by the neighborhood residents, so much so, the brick memorial was deconstructed and the plaque was subsequently moved to the lobby of the Training Academy where it remains to this day.

I think you should check the actual law on this. There is pretty good protection for people using deadly force to protect themselves. It provides immunity for both criminal and civil liability. Both in and out of the home. It is not perfect, but it is pretty good.

Here is a hint where you should start looking. 720 ILCS 5.

I have two respectful corrections however...
It's been 41 years since their death.
That plaque was relocated out of the academy (with a to/from) and now sits in a display case in the SEVERIN and RIZZATO COMMUNITY ROOM in 018 along with other memorabilia on their behalf.
Department members are encouraged to stop by 018 and view these artifacts along with the Honorary Street Sign(s) in front of 018 dedicating Larrabee St. in front of 018 as, Severin and Rizzato Way.

You have no clue how the felony trial system works. The judge would not have seen the evidence, such as a tape, until trial. (Barring pretrial motions to bar it--and maybe not even then) The judge would have only seen the defendant and his lawyer for pretrial status dates until the case was set for trial.
Judge Slattery Boyle is a great judge and is fair to Law Enforcement.
The problem here was that Detectives brought the case to the SAO and somebody approved it.
This should put the lie to the prevailing attitude on this Blog that the SAO only charges dead-bang winner cases. A lot of very close cases, and even shit cases, get felony approval everyday. The ASAs in the courtroom had no choice but to prosecute once it was charged.

I was charged with domestic battery 25 years ago, went to the old State st. courthouse. Penile-phobic asa wanted me to go to jail because I wouldn't accept her plea. Case was b.s. went to trial. Judge saw through the b.s. and found me not guilty (the only one of all the cases I saw). The asa literally threw a hissy fit in the court.

Dave in the good old days, cops used to protect and watch out for citizens. Citizens who defended themselves and who were not career criminals. All that is a thing of the past. If a citizen shoots someone then a case report must be generated and the FACTS are gathered. No police officer is going to stick out his neck these days. It's a fucking shame. This city does not care about honest law abiding citizens. The ruling class gets bodyguards and can even conceal carry but the honest working man can't.

It's getting more frequent that law abiding citizens are asking this question. What I would suggest is to simply walk away from the scene if you have to put one of these shit heads down. There is no crime in walking away. Also, in the event that you are somehow identified and the police come knocking, don't say anything without your lawyer present.

For all of the liberals who want to do away with the 2nd Amendment I say if you want to cut crime, do away with the 5th Amendment. Criminals in the European countries have to testify at their own trials. Then let people in Illinois carry concealed. In a few short years crime might be close to non-existent.

When bonifide gang bangers shoot at each other, whether detectives are asking for agg batt or murder charges, the asa's refuse and call it "mutual combatants" - citizens defending themselves, and they all go home to do it again tomorrow.

Yet a man defends himself and his family from being battered and possibly murdered and its on film, and the asa's charge the victim.

FYI - He wasn't arrested at the scene or even on the scene when the officers arrived. Due to witnesses, the shooter was identified and arrested a day later.

Besides your being a total asshole, why don't you google the name "David Koschman," then come back and tell us how a punch can't cause death or great bodily harm. We can name half a dozen other cases where a punch killed people. And we suppose if someone with Fullilove's record had attacked a 110 pound female with her daughters, and she happened to have Mayfield's criminal record, you'd still be screaming about a disparate use of force.

And the law is fine as written, it just isn't equitably enforced due to political posturing and pandering from the Chicago and Cook County Machine.

You're not just an asshole, you're an ignorant asshole, and that's even more dangerous. So why don't you go educate your dumb ass, then come back without the sanctimonious attitude toward what obviously was a horseshit case prosecuted solely on the Cook County attitude toward guns and not the facts at hand.

There are more than a few people here making an issue out of Mayfield having a criminal record. From what I gather it's twenty years+ old.

Considering he's an involved father in a ghetto neighborhood where "baby's daddy" drama is the norm I suspect age and maturity caught up with him and like many of us he's not the same goof at 50+ that he was in his twenties and thirties.

I came on the CPD in 1985. During my misspent Catholic youth I was an altar boy.

Therefore combining the two gives me the right to "absolve" Mayfield of his prior criminal sins.

He needs to say two "Hail Garrys" and watch the PBS special "Oh Come Oh Come Emmanuel" documenting Rahm's rise to power. Also one act of contrition where he regrets his past bad behavior.

Prior criminal behavior or not at that moment and at that place the man defended his daughters, the other girl and himself. I'm sorry he was charged, I'm sorry he spent 17 months in County, but I'm not sorry that the dearly departed is departed and that Mayfield and the girls are physically allright.

The south and west sides need about 50,000 more former goofs like Mayfield to step up and maybe then those areas would be liveable again for decent folk.
