So what happens when the "wrongfully convicted" is released and then a witness finally steps forward to say, "Uh, you had the right guy in the first place"?
- In the Danville state penitentiary, a man named Alstory Simon is serving 37 years for committing a double murder. It is a crime Anthony Porter was originally convicted of and came within two days of being executed.
Now, there are new accusations of misconduct against some of those who worked to get Porter free and Simon behind bars.
"I seen Tony Porter do it, I looked right in his face and I seen him, seen his long braids, he's got a tattoo in his face, I seen everything," said witness Ray Brown.
It's things like this that just convince us that Cook County justice is impossible to come by and the system itself is broken, possibly beyond repair.

I agree the Cook County Criminal Justice system is broken. Hell, it barely exists.
That being said relying on the 30 year old memory of a crime by someone who later became a felon himself is silly, silly, silly.
What's this guy's mental state at the moment? What's his IQ?

Maybe he did it. Maybe the other guy did it. Maybe the man on the moon did it.
The weakest link in a weak criminal justice system is prosecutors. I've known cops who will admit that they made a mistake or misjudgment regarding a case.
Have you ever heard a prosecutor admit to error? It happens, but when it does it's a story and it generally only happens after they've been hammered by judges and the media on a particularly egregious case.
I don't know what combination of law school training and arrogance brings that on, but most prosecutors seem congenitally unable to admit error. Maybe it's the adversarial system itself when they are more concerned about winning than truth.
If you disagree with me think of some of the cases in recent years involving off duty cops. I could mention CPD names, but won't. Think about the Lynwood cop wrongly arrested as the "honeybee killer". If his computer use didn't provide a solid and legitimate alibi I have little doubt the wonderful Will County States Attorney wouldn't have some theory of the case involving said cop and the now deceased true offender.
That's an arrest that clearly stunk to the heavens on the day it was announced.
One way to maybe improve prosecutions is eliminate elected prosecutors. How many innocent men have gone to jail so that a prosecutor could claim to have solved some horrid child murder just before an election?
The collar counties are filled with such cases and the last few occupants of the last few elected Cook County States Attorneys have been nothing but political hacks.

The way to improve prosecutors is to remove the blanket immunity they have. Same for judges. NONE of these motherfuckers should be immune from anything. Cops aren't, and cops are the ones dealing with the dynamic chaotic bullshit on the street, not the calm cool stress free office where you should be making perfectly rational decisions.
The lawyers and the judges don't have any skin in the game, which is why they're fucked up like a football bat.

I watched a show on Protess and his idiot, idealistic undergraduate journalism students. He told them to go to Paris, Illinois and "become a part of the town culture" by drinking in bars.
Now those super sleuth kids with hangovers started interviewing people and playing junior detective. Pathetic. Absolutely pathetic. I often wondered how instead of finding the convicted innocent, how well they would fare trying to find the actual guilty party in these capital offense cases. It could never happen because they lack the skills, training and life experience to tackle cases like this.
I know, I know, they're from an "elite" school, so they know better than anyone else how to do everything. That's why they have sex shows on campus for college credit. They're so smart and open minded.

Excuse me, but you are totally wrong about this case. There are as many as eight witnesses who still claim Porter was the murderer. Four of the witnesses have been saying this since he was convicted.
No court ever found Anthony Porter not guilty. The court found him guilty and he as given the death sentence. His attorenies, from Johnny Cochran's office, were looking for a big payday from this exoneration. The case was essentially retried in the civil trial and, guess what? The jury sided with the cops. Porter got nothing.
If you take away Alstory Simon's so called confession, there is no evidence that exists to convict him. None. If you look at the manner by which this confession was obtained, it should not have been allowed in court. It was illegal and unethical by any measure.
On the other hand, there is still a mountain of evidence that indicates Porter is guilty. This is a crucial case for the police, because it was the basis upon which so many so called wrongly convicted were set free.
The conduct of the Innocence Project was illegal in this case. It begs a question: Was this the only case they employed such tactics?
Yeah, the prosecutors rolled over on this case and they still do till today. What's new about that?

Everybody knew that Rimland always just happened to be representing the 'really did it' guys, who just happened to be confessing after being offered tv and book deals, after they just happened to talk to the same Rimland/Northwestern 'private investigator.'

Get off the blog and go back to your liberal disease of a school. My kid is being recruited by Northwestern, it will be a pleasure to let the coach know we're not interested. I'll make sure to let her know a factor in our decision is this very issue with this case.

im no liberal but i have to say innocent people are convicted all the time and many people are overprosecuted. Porter is guilty as hell and I could give a shit about him but think about Cozzi. he was certainly overprosecuted for a crime he had already gotten a disposition for in state court. Shit like this happens all the time. I hate liberlism but I also hate political witch hunts which is what the Cozzi prosecution was.
Ten eyewitnesses have stated Porter was guilty. A jury convicted Porter. A civil lawsuit against the cops who arrested Porter resulted in a verdict on their behalf and their Johnny Cockran lawyer went home without a dime. Every witness used to free Porter and then indict Alstory Simon later retracted their statement and said the whole thing was a ruse to get Porter out. So no, it's not clear at all that Porter was innocent.
