Anita Looking Bad

The person who comes off looking the worst in the entire Koschman affair seems to be recently re-elected Cook County States Attorney Alvarez.  The Sun Times investigation is damning:
  • The indictment marks a stunning swing in a case that current and former police officials and prosecutors had insisted didn’t merit criminal prosecution.

    “There’s no basis for criminal charges,” then-police Supt. Phil Cline said in May 2004.


    But, facing new questions about the case, the police reinvestigated last year, again declining to seek charges. They said Vanecko — who never spoke with investigators — acted in self-defense.


    “Absent evidence that would enable us to prove guilt beyond a reasonable doubt, there is not a good-faith basis to bring charges,” Sally Daly, Alvarez’s press secretary, said last year


    The judge didn’t buy it.


    “The system has failed” Koschman, Toomin said in April when he granted the request by Nanci Koschman for a special prosecutor.


    The judge ripped “the fiction of self-defense” that he said was “conjured up by police and prosecutors,” and he questioned why Vanecko wasn’t charged.
And this:
  • Acknowledging those discrepancies and under fire for not being able to find any files on the Koschman case from her office’s involvement in 2004, Alvarez asked the Illinois State Police to investigate the police department’s handling of the case. “I think there should be an independent police investigation,” Alvarez said.

    At first, the state agency agreed. Then, it got a new boss: Alvarez’s chief deputy, Hiram Grau, who had been a deputy superintendent with Chicago Police Department at the time of Koschman’s death, in charge of the department’s detectives. And the state police quickly reversed course and declined to get involved.
Imagine that - Grau shitcanning the State Police investigation after he was working for Anita and before that, in charge of the Chicago D-Unit.  Hmmmm.
  • The petition went on to say: “Despite . . . witness statements, the 2004 Chicago police investigation was closed without charges in part because the police claimed to be unable to determine the identity of the person who had thown the fatal punch. Such a blatant failure to connect the dots has the hallmarks of an investigation governed by politics, not professionalism.”

    And it singled out Alvarez —
    who now was arguing that she should oversee any new investigation, even though she had declined to step in earlier — for criticism: “Despite the suspicious circumstances surrounding the Koschman investigation, Alvarez has publicly defended the work of the Chicago police and the Cook County state’s attorney’s felony review unit, insisting to Sun-Times reporters that there was insufficient evidence to charge Vanecko.
 So after calling for a State Police investigation, then her former deputy scotches the whole thing, she then demands to oversee the investigation?  What manner of bi-polar office is Anita running?  Judge Toomin fires a final broadside:
  • “Upon being apprised that Koschman met his death at the hand of an identifiable and known assailant, one might reasonably anticipate that law enforcement officials would bring the offender before the bar of justice.”

    Instead, though, Toomin said Alvarez "seems consumed with finding legal justification for Vanecko’s use of deadly force."
That would be the job of the defense attorney, something Vanecko never had to provide for since Anita was running interference for him from her office.

And she got an FOP endorsement after all this.  Amazing.  How about we rescind it?

The cover up in this case is beyond obvious. First the CPD brass, then the States Attorney's office, now the States Attorney's office again, and next the State Police, which is run by a former CPD brass. The Daley crime family democratic machine influencing everyone.

Everyone knows the bosses would never allow this case to hit the courts. Once again the lowley Det.'s get fucked by doing what the bosses tell them. We all know how it works. Play ball or you will fall.

I'm not a detective, but a veteran street officer who knows that at the very, very least, a charge of reckless conduct was warrented. Funny how our D-units unfound and clear a case using the term "mutual combatant's".

if any of you have ever worked a heater case with the clouted you would know that the ivory tower sends many call through SGTs not on the case.

My favorite is when a deputy of a unit shows up that have no business even asking question and then send their clouted driver around asking for copies of documents related to the case.

Don't worry i took notes on the cases and wrote names. and i didn't lose any of the GPR's.

collects a salary, benefits as well as a take home car all paid for by the charity he formed. Now the department is left in shambles after countless incidents he let happen on his watch. Many that resulted in millions of dollars being paid out because of them.

Problem is it's the bosses not the Det.'s. It still happens today. Bosses tell us to do things that isn't on paper. Daley's people never spoke to the individual det.'s. This comes from the top and everyone knows they can't put a good case together against the Mayor's family.

The cook county states attorney's office is a joke. They tout a 95% or better conviction rate and hide behind a felony review system that basically tries the case over the phone or they send out an ASA to do it in person. So the only way any shithead gets charged with a felony besides narcotics is if you have a slam dunk case so juries are almost forced to convict. And that masks an even bigger problem, cook county jury pools. The burden of proof in cook county is absurd. Unfortunately that is partly caused by our police dept's widely publicized corruption and the good'ole boy network of appointed ranks. that's the chicago way. The other part of that is the states attorney's office ineptness to screen a jury. I could go on and on but I don't really give a fuck anymore. Squad, we're always in a RAP. Just give me my lunch.

When Webb reviews the CLEAR/CHRIS reports he will see how the reports were modified.

The mainframe for CLEAR/CHRIS retains all editing done to reports and also retains the identification number of those working on the report.

If a detective or supervisor edited a report and then denies same that is perjury and he can be prosecuted for a felony, which would be considerd job related. If convicted bye-bye pension!

I did too. Alvarez was endorsed by the hypocrites on the Tribune editorial board. Their editorial today is full of verbal gymnastics... "innocent until proven guilty" bullshit. Like Judge Toomey said, we have a corpse. THIS IS NOT A WHO-DUNNIT. As for the FOP, the brass endorsed Alvarez because (1) they were acting like the Democrat party stooges that they are, and (2) Alvarez does not support the use of RICO statutes against corrupt cops or politicians.

The Trib editorial board is complicit. Their ilk have allowed corruption to fester in Chicago.

Let them seek another form of employment instead of promoting them to judges.

He was promoted to sergeant before they officially had merit promotions, but they reached way down the list for him as part of a quota deal. From there, everything else has been meritcloutorious. As far as brains, he is no more than one-half notch above Adrienne Stanley, but he is 2 inches shorter than her.

The RJV "trial" will go like this: The case will be assigned to an old fart Judge that is getting ready to retire. He owes his seat to a Daley. The defense will forego a jury, putting th case in the Judge's hands. The case will be tried, a prosecution side and then the defense. Closing arguments made. The Judge will render a verdict after taking it under advisement. The verdict will be not guilty with enough reasonable doubt being raised being cited by the judge. Alvarez gets to claim a type of victory, saying this is our justice system, the defense gets indignant. The public will scream for blood. Carol Marin will flip (the only good thing in this scenario) and the true offender: Army Boy gets away with it. Chicago, Cook County and Illinois at its worst

Don't forget that Alvarez has been sitting on five witness interviews with witnesses who saw John Gacy digging at that Miami Ave. location. Why so long to make a decision on a search warrant. Could it be that one of the people who lived with Gacy and helped him to kill was related to a big time Chicago alderman? That cover-up would really take many people down.

This case is BS from the get go. Drunken idiots lying to the cops, not identifying the goofball Vanecko, and basically being so hammered they couldn't remember anything. Skip 8 years ahead and they have total recall? Toomin "had" to appoint a special prosecutor to cover his ass, and Webb "had" to come up with an indictment because it would look bad to collect his 500G for doing nothing. Guy's gonna get off IMO

Mrs Koschmann stated that she does not see Vanecko going to jail as doing any good. Worse case scenario for him is a plea deal with probation.

Witnesses state later that they didn't tell the detectives what was written in the reports, everyone involved in this was reportedly very drunk, how much credibility is there? Everyone here has handles plenty of drunk disturbances and arrestees.

Six witnesses failed to identify Vanecko in a legitimate lineup. How do you charge after that?

I don't understand how this self-defense issue got put froward by the dics without a statement from Vanecko. They got some explaining to do on that.

To 4:06am, according to the Scum-Times witness Kohler said that Koschmann's friends were trying to pull him away and he rushed Vanecko's group twice. However, turns out Kohler was on the wrestling team with Vanecko at Loyola Academy even though he claimed he didn't recognize him at the time.

This is amazing!! The brain power of these people who are in high places amazes me! "proof beyond a reasonable doubt" is not needed to charge a person with a crime. Yes, boys and girls there are incredibly dumb people with big jobs.

Gentlemen: let's not lose track of what happened here. One mother lost her son and another mother's son is going to stand trial for involuntary manslaughter. Many families have been irreparably harmed by this horrific incident. Let's just think about that during this holiday season.

Problem is it's the bosses not the Det.'s. It still happens today. Bosses tell us to do things that isn't on paper. Daley's people never spoke to the individual det.'s. This comes from the top and everyone knows they can't put a good case together against the Mayor's family.

Tom Breen and Terry Gillespie usually take only cases that go to trial and don't cop out.A Plea is unlikely in this case.

The lawyer's from both sides will call this a CPD "cover-up" or "code of silence". Thats what I would do if I was an attorney.

And the press will run with it, because its gonna' sell a lot of headlines.

It worked very well in the Abatte case.

Good luck Detectives, I hope you can find a decent attorney because your about to be hung out and dried.

All true. Drunken goofs who couldn't tell or remember correctly and couldn't ID the offender. Eight years later they DO 'remember'. The Grand Jury buys it and indicts Vanecko. In order to get a conviction the prosecution must prove the detectives changed statements, etc. That is the only way to make the case fly. You have to say the witnesses told it right eight years ago and there was a conspiracy. Coppers will be indicted soon, no matter that they are innocent.

I take it you are one of those of whom you speak? There must be proof Beyond A Reasonable Doubt--no less--to convict someone of a crime. You don't charge someone with a felony crime without evidence to prove BRD.

Obviously you are not attorney who practiced in front of him, or a cop who testified before him. Judge Toomin is one of the smartest, most fair-yet tough Judges ever to sit at 26th Street. Don't know whether he's right on this one or not, but he is a great Judge.
