FOP in the Dark

  • Mayor Rahm Emanuel’s administration is being accused of concealing from the police union and an independent arbitrator a ruling against the city that could have impacted the union’s quest for $1 million in disputed overtime for 3,100 Chicago Police officers who protected the city during last year’s NATO Summit.

    At issue is one of four class-action grievances filed by the Fraternal Order of Police after a deftly handled summit that could have been a disaster for Chicago, but instead gave the city a chance to shine on the world stage.

    The dispute stemmed from Emanuel’s decision not to pay officers time-and-a-half overtime for working a sixth or seventh consecutive day during a calendar week. The matter is now before an arbitrator.

    The Chicago Police Lieutenants’ Association contract has language that mirrors the FOP contract on time-and-a-half compensation for working a sixth or seventh consecutive day. In March, an arbitrator ruled against the city in the lieutenants’ quest for NATO overtime.

    The FOP found out about the ruling last week — long after it could have made a difference in the pending arbitration — only after the lieutenants’ association voted to disclose the information to the FOP, said FOP President...

Of course, Roderick Drew spins truth for a living, so you can't put too much trust in what he says.

In any event, everyone ought to hope that the arbitrator is a little more aware of other decisions that might have a direct bearing on disputes he's involved in than others seem to be.

Check the date on this story before you get your panties all in a bunch.

The City failed to disclose an adverse ruling that could effect a current arbitration proceeding.

This was discussed at the FOP General Meeting on 21 May.

Instead of jumping on FOP (like Rahm's lapdog bitch media hack wants you to) realize that this is a very serious breach of legal ethics on the part of the city and show the kind of slimy POS you are dealing with when you do business with Rahm.

Maybe because they held their noses and pushed their membership to support him?

They'll play nice with each other until such time Rahm decides they've served their purpose and knifes them in the back on something big...

I still believe all rank and file should be under one umbrella. Not knowing what the other is doing is working against us. I just don't get why we have differnt union representation when we are all from the same Department. We would be a much stronger union is we all stood together. Yet-- something that seem so simple to me will never be done; at least in my career.

Before you dump on the FOP/Shields, consider the Lieutenant Assoc.; what was on their minds, to not immediately advise FOP! We may be of different ranks, but we are shipmates and colleagues on the same voyage. Do they think their jobs as supervisors would be enhanced by pissed off, low morale subordinates? This incident shows that Labor is not united, while the Politicians are. If we don't work together Rahm will destroy us.

Ive been on this job 25yrs and all I do know just like any other politician because in reality thats what they are they do what gets them re-elected and puts money in their pocket. All this little stuff means nothing you should only be concerned about your pension and healthcare and if you think our union or any union for that matter has the power to be a deciding factor in those two important issues you are sadly mistaken. Here is what I think about FOP. The lot of them don't like Shields. So instead of doing their jobs and helping the young lad along for the good of the membership, they let him stumble and make mistakes.

Not sure the city is obligated in any way to notify the FOP of the results of an arbitration with a different union. Put this one on the FOP, they should have a friend over at the sgts and lts associations and unions to keep them up to date The FOP should have been following the Lts arbitration if they felt the results could affect our grievance

FYI, the rules do not indicate any breach of ethical duty here. The Illinois Rules of Professionaal conduct prohibit a lawyer from failing to disclose to the TRIBUNAL legal authority from the CONTROLLING JURISDICTION known to the lawyer to be directly adverse to the position of the client and not disclosed by opposing counsel. So a) not telling the FOP about this ruling is NOT a breach of legal ethics because they are not a tribunal. b) failure to tell the arbitration panel about such a ruling is also not a breach of legal ethics, because one arbitration panel's ruling is not controlling over another; thus, there is no obligation to disclose.

I guess it's a good thing that Mike Shields is paid $209,000 a year and the V.P.'s range in salary from $149,000 to $159,000. Those salaries are right from the Mark Donahue days and continue today. All paid with money collected from the dues paid by the P.O.'s. What is anyone getting for that salary? Not much. That place is run like a clown circus.

Good Luck Friend, you might try the Employee Assistance Program if your other half will go along with it.

Many years ago we tried a marriage counselor and the only thing we could agree is that she was more screwed up than we were. Professional psychologists make their money by keeping you coming back for more. That was the mistake I made with my daughter when my wife passed away. At the rates we were paying I figure we were the shrink's car payment and I did not like the results.

I suggest that you two set a goal, that you get better with professional help in a year then if it doesn't work out try something else.

Yes you can. Same union, FOP, different Lodge and different leadership for a different bargaining unit.

All lodges combine for items of common interest, each individual lodge does their own thing for things that effect only them.

As it is, there are so many differences that little is left that is common, but still, we should stand united on wages, pensions, don't let city divide and conquer.

Could be wrong but my understanding is that each side presents their case, then each side gets to question the other side presentation and after that it goes to the arbitrator for a decision. At that point no new info can be presented. Almost like once the final arguments are given and it goes to the jury

BTW- I heard from a Board member thst Shields wanted to give $3200 of FOP money to the CPD Pistol Team for two members to further their hobby in New Mexico. It must be nice to be in the inner circle. The FOP has a new Girl Friday- how long before the next sexual harassment lawsuit? I heard that her only qualifications are that her dad is a physician and she has student loans.

I read this book which might not be what you need therapy wise but its good info for police spouses.Think it's called Emotional Survival for Law Enforcement by dR. kEVIN? Gilmartin. It was a great book AND broke down some stuff we say all the time in regular speak.

There's also a proposal to the FOP by-laws to eliminate the positions of 3rd VP and Financial Secretary. These positions are a waste of money and should be eighty-sixed!

Hey brother first off peace be with you and take it day by day. Stay away from hospitals or anyone who are mandated to document and report stress at home or at work. It could cost you YOUR FOID card.

Try Anita Verone in the city. She is Police friendly and I know she has helped out a few Troopers with marital issues and deaths of family members. She is off the radar.

Lastly I used Willow Creek Church in South Barrington. Check it ot on line. Honestly it saved my life. They have many proactive group sessions (Marriage Matters, Broken Families, Devorce Recovery ect.) cost is a few bucks and nothing is documented. The bottom line is your getting away from the city and savage and that is healing in itself as well as recovery.

949pm. Yeah, heard about that bylaw proposal myself. Then found out it was presented by none other than Dean Angelo Sr. If memory serves Dean was a part of the Nolan team who agreed we would start paying for healthcare. Only a buck a check. Great move. What are you paying today?.

He's also been on the pension dime (disabled) while working a full time job for Calumet College for the past decade. Disabled? Really? Hasn't been involved with FOP for over ten years and hasn't paid a dime in dues, but now suddenly he knows whats best for the working coppers?

I have a pension idea. Why not pass a bill that says you can only receive a pension payout at your earned rank, i.e. LT? Tell me which one of you out there would make LT and turn down CMDR or Deputy if they said your max pension is that of a LT? In other words your pension is that of a LT but your day to day job is that of a CMDR, etc. and you get that associated pay. I mean half of these bosses get handed Deputy for 3 years then out the door they go. Or make it the opposite with the time. Once you go above LT now your pension pay is the average of the last 6 years and not the last three. How crazy is it that once you make a gold star your time is reduced to 3 years in grade? It should be the opposite.

6:44 PM is right , in todays southtown a reporter states the state of Ill spends over$$2,500,000
for cable television for inmates.
wtf , this would cover alot of 3% cola for retirees. Now think about every new school in chicago built for illegals and CPD could receive pay raises and fund pension funds.
It's politicians getting the working people against city workers,smoke and mirrors . No talk about reducing aldewrcreatures from 50 to 20 or middle mangaement political workers,parks , libraries , bilingual education .

Just a civilian here and can't comment on interagency politics, but I would like to thank all the police people I saw on the streets for days, sleeping in their cars and looking completely wrung out during that idiotic conference. Many years ago we tried a marriage counselor and the only thing we could agree is that she was more screwed up than we were. Professional psychologists make their money by keeping you coming back for more. That was the mistake I made with my daughter when my wife passed away. At the rates we were paying I figure we were the shrink's car payment and I did not like the results.

I suggest that you two set a goal, that you get better with professional help in a year then if it doesn't work out try something else.

Couldn't agree more, they just want you to keep coming back. You are smart to realize if nothing is changing or getting better after a year, its not going to.
My biggest complaint was the standand answer from them which is repeated after about 95^ of the questions "What do you think" I know what I think, I want to know what you think, Thats why I'm paying you $250.00 an hour

The PBPA will be hosting sessions in the benefit of decertifying the current union , loosing all contractual rights and starting over . At these meetings the FOP leadership will all be kicked out and yelled at to "get out of my house" ! Oh wait that was the FOP or FLOP's idea ! Gods job Mickey Mouse ! If the language in both contracts read the same it should be an easy win. When an arbitrator rules on a case he has to look for other like incidents that can back up his ruling on an issue. So this shouldn't be much of a problem. It also makes it rather easy for him to rule on.

You should get a pension based on your civil service rank, no more than that. Lt. is the highest civil service rank, captains sold their rank rights to the city for a few pieces of gold.

Pension contributions over that required for Lt. can go into an IRA, matched by the city but IRA, not pension. When you retire you can get that IRA and roll it over or let it sit or take it to the casino or to Arlington Park.

Try Catholic Charities, even if you're not Catholic. They are familiar with our benefits, and refer you to qualified people (not clergy unless you prefer).

I went years back when I screwed up at home, too. I went thinking nothing would work but I had nothing left to lose.

It was very helpful, picked up great ideas that we still practice ten years later and I recommend counseling to anyone willing to try.

Why don't you show up at FOP Hall on June 18 at 700pm and ask him yourself? It is at 1412 W Washington. After the opening prayer and the Pledge, Shields will say some things and you can step right up to the microphone and give your name, star number and unit and ask away.

While you do some research into how to decertify the union you will likely learn that it was tried once before. There was a decertification vote taken and the membership elected..... the FOP to represent them. That's twice now the FOP was voted on to represent the membership since 1980.

But you would have learned that while doing the legwork necessary to do the necessary things and compile the necessary signatures to force another vote.

So get on with it.

in our district Lts only work part time anyways---on watch with 2 they "split the shift" and on watch with single Lt they shanghai a Sgt to open or close (usually only give Sgt a slight slide- 1 or 2 hours)....and LTs can get off whenever they want- XO just plugs in any nitwit Sgt--but Sgts are denied time due because "they" want two on the street....in a normal world, the watch lts/sgts would make system work but instead we see slips submitted to XO w/o regard to other supervisors plans

Dean voted for our health insurance to be a percentage of our salary, which is actually the reason we pay so much today. It is a little strange that someone can work full time at Calumet College, but not work limited duty for the police department.
