Koschman Ruling 13 November

  • A Cook County judge said Friday he’ll rule next week whether to unseal a special prosecutor’s report in the David Koschman case.

    Judge Michael P. Toomin scheduled a hearing Wednesday to rule on the motion by the Chicago Sun-Times and WMAQ-Channel 5 to make the report public.

    Toomin had sealed the report at the request of Dan K. Webb, the special prosecutor he appointed last year to reinvestigate the 21-year-old Mount Prospect man’s 2004 death and also to determine whether police and prosecutors should be charged over their handling of the case.
And here's an odd bit of info:
  • Lawyers for Daley’s nephew don’t want the report made public before Vanecko stands trial in February, saying that could prejudice potential jurors.

    Adding its objections Friday was the Fraternal Order of Police, which said the report could harm the reputation of police officers.
Really? How? We mean....how, more than already? This entire event has exposed the sordid underbelly of the connected being covered up for their actions. Why shouldn't taxpayers and everyone else see exactly who was doing the jumping when Daley pulled the strings? Just our opinion here, but the FOP should stay out of the way here and let the chips fall where they may. The ones calling the shots weren't any people in blue shirts and probably weren't even D-2A people. They were D-3 and upwards.

What happened in the Koschman investigation was controlled out of the 4th floor office of the Superintendent and those who him from the 10th District can confirm how devious and manipulative he can be!

Detectives have been standing in lineups as long as lineups have been conducted and I cannot ever recall any complaints about their cooperation until now,

Release the report and watch how Phat Phil spins same.

It seems clear that we have lost even a modicum of influence over the direction the FOP is taking. Between the child that we have elected to run it and the rubber-stamp band of simpering imps that round out its ranks, I feel embarrassed to be counted among its financial supporters. Besides a vote, what else can we do to this herd of political sheep. Once we all get shafted on retro (thereby displaying a financial harm), perhaps a class action against the President? (I realize we will be footing the bill for the defense, but perhaps we can bankrupt him.) He has either sold us out or is just plain incompetent. Either way, he is a liar.

well Judge - it has come to my attention that there are indeed deaths that occur where no one is charged - I can remember one specifically but I won't bore you with the details ..


add to that - when the concealed carry comes into full play there will be some dead robbers where no one will be charged - it's called 'justifiable homicide'

Amen! I recall a couple of Dicks wound up in Federal Court because of witnesses being held in interview rooms after a boss told them to put them there. That order was never put in the report. Document, document, document!!!

Yes, sergeants and up were doing what sergeants and up are paid to do, make the decisions. But, a detective did not have to go along with an order if it is clearly illegal or unethical. You cannot hide behind " it was an order" defense when that order flies in the face of policies, ethics and morality let alone the law. I, for one, would like to see this report made public right away. If it truly does cast a bad light on the department as it has been hinted, then I would only wish the people responsible face some retribution and the department make changes to keep this from every occurring again.

That way a cloud of suspicion hangs over the entire Chicago Police Department for being corrupt instead of a few politically connected Clout Cops who dance(d) to the tune of the Democratic Machine (Who do you know and who sent ya?), and to that of Mayor 'I-Know-Nothing' King Richie II.

And what can be more useful during contract negotiations between a cop hating mayor Tiny Dancer & the police, and pandering to *The Community* by cop hating politicians, and those seekers of truth and justice -- the Community Activists -- than a 'dirty' Police Dept that covered up a murder?

Not to mention, which really makes better news; A story that maybe dies after a few names of the bad actors are released, but who can't be prosecuted now anyway due to various statutes of limitations, or one where some vast conspiracy by the entire Police Dept can be speculated on for decades to come by Chicago's crack journalists?

Please don't make me answer that.

Fat Phil micromanaged every high profile case during his tenure as Superintendent. Those that went along with the show were later rewarded with promotions or great retirement opportunities. The rest of us, who were left out of secret negotiations and told to go home, remained at our ranks and just continued working. Now it all comes back to haunt us. But will the real players pay the price? I doubt it.

The Koschman report found some wrongdoing involving those who were to investigate, but determined that the statute of limitations had run for a criminal prosecution. However, Department members can still be separated based on a rule 1 violation if the report determined that a law was broken. Rumor has it a certain "bad" Lt., incidentally one of Mcnitwit's favorites, will be wearing the shirt on this one. Karma is a bitch.

Was in court last week for a sentencing hearing in Bridgeview, listening to former crimes on defendant's record. Defendant hit a former classmate a decade ago (both were around 18 years old then), he hit his head on the sidewalk and was pulled off life support 5 days later. The defendant got boot camp. May have taken into consideation that the deceased had a blood alcohol of .193, making it more likely that he would easily lose his balance and fail to break the fall.
For his new felony (not related to homicide), this south suburban aggressor got 2.5 IDOC.

Well my take is that it became a shitty case the night it happened when, after 2 o'clock in the morning and a night of intensive drinking, a drunk punched another drunk and all the drunken witnesses couldn't/wouldn't identify anyone. And after a waste of taxpayer's money a Special Prosecutor and his staff find a single witness who claims he remembers -- again, after a night of drinking -- and a rubber stamp Grand Jury indicts.

This is so true. Anyone in the D unit during Phil's tenure is well aware that Phil had his thumb on every heater case. He personally organized and set up meetings and invited who he wanted at those meetings. Phil called the shots and wanted everything emailed to him constantly. Quite frankly, it was a pain in the ass and insulting to the D unit in the way that some of Phil's direction was common sense. But heater cases that involved a cop or political or famous persons ~ those were definitely investigated by supervisors and detectives hand picked and known to be friends of Phil.

To everyone saying that this case was swept under the rug or covered up by high ranking police personnel and/or political pressure, you are simply wrong.There is not a Detective on the CPD that would actually want to catch this case. For all you conspiracy theorists, take a breath and think logically. Not one person positively identified Vanecko as the person who punched the victim in line ups. Let me repeat that. Not one person identified Vanecko in line ups. Not the victims friends or the uninvolved parties who saw the altercation. One of the uninvolved even identified Kochman as the aggressor who charged at the Venacko group. Employees and patrons at a bar Kohman was patronizing said he was loud and appeared intoxicated. Vanecko did not give a confession. The state rejected charges and they should have. Just because you know of a case where a guy was convicted of manslaughter for punching someone, doesn't mean this case also qualifies. I know cops fired for stealing or brutality. So does that mean every cop accused of the same thing is guilty as well? Each case has its own set of facts. The facts in this case did not justify charges. If a police officer was charged with committing manslaughter for punching someone off duty and nobody identified him, and others pointed to the victim as the aggressor, would that be fair? A lot of coppers are letting their hatred for Daley cloud their judgement on this one.

These are the facts and are not in dispute, not by the special prosecutor nor by those very witnesses. The only evidence is the single witness discovered by the Special Prosecutor who himself was out on the town after 2 a.m. and probably drinking as well. Would you want anyone convicted on this evidence? Would YOU want to be convicted on the testimony of a single witness when many others, much closer to the center of the action, can't or won't say what happened?

I am upset. I'm upset the witnesses were too drunk to help, I'm upset Vancecko's friends wouldn't talk, I'm upset Vanecko wouldn't talk, I'm upset I've see dozens and dozens of cases like this and the State's Attorney refuses charges, I'm upset they constantly use excuses like 'mutual combatants' or 'gang-bangers make poor witnesses'. I'm upset you won't accept the fact that despite the facts good police officers/detectives have their reputations ruined by supposition and innuendo because the witnesses would/could not help.
I'm upset people are screaming and praying for coppers heads to sacrifice because they hate the Daley clan so much.

Stop with the crap that there was no conspiracy and that there just wasn't enough to charge. The truth is this case was handled like shit from the very beginning - by design or by stupidity by design?

The kid was in critical condition in the hospital and the midnight shift detectives first assigned go on furlough and no other detective follows up with the hospital every single day to keep tabs on the kids status? That lack of follow up alone stinks to high heaven. For Christ sake, even the detective division cmdrs office kept logs of hospitalized victims and called the hospital periodically to keep aware of the status - in case the person died! So fk you area 3 with your defense, because this case was not investigated properly from the night this incident happened. Again, was it done on purpose or was the entire area 3 that incompetent from the cmdr on down?

And now lets skip the whole middle part and jump to the end - years later the massive file folder on a huge heater case disappears and suddenly reappears behind a file cabinet??? Get the fk out of here. No one is buying it. Very lame and un creative excuse.

WRONG -- plenty of hood rats are in prison and awaiting trial for similar situations. the only difference is that these rats didn't have a mayor uncle or a cadre of expensive lawyers to go over your "perfect" case report.

At least from the media reports, the P.O.s who responded should be commended. they chased down one of vanecko's friends (presumably after vanecko was driven away by cpd bodyguards (accessories??)) and actually found out the identities of the offenders.

P.O.s will not face any blame. once they do the GOCR, it's on to the next call. the blame will be somewhere between detective and superintendent.

If Vanecko was acting in self-defense, and did nothing wrong against the aggressor half his size, why did he run away??? Why didn't he stay on the scene and tell the police what happened when he saw the unconscious "aggressor" lying on the street after he hit him?? You know why: he ran just like any ghetto POS ran when they commit a crime.

Some have questioned the exorbitant taxpayer costs put into this one. Why not blame the Daleys and Vanecko himself. If Vanecko believed he did nothing wrong, he should have stayed put and none of the special prosecutor costs would have occurred. But that's not a Daley trait.

Yet Vanecko's friends won't "snitch" on Vanecko. Shouldn't they tell the truth?? After all there's a dead kid and a mother who lost her son.

Yet Vanecko's friends won't "snitch" on Vanecko. Shouldn't they tell the truth?? After all there's a dead kid and a mother who lost her son.

Let them tell the truth. Then let the jury decide.

I will accept the jury's decision.

The no snitching rule applies to everyone except those living in the 'hood. If you don't live in the ghetto and snitch you're a rat,but in the 'hood we expect you to step forward immediately and tell the police what happened. Double standard as usual.
