BOOM! FOP Contracts Fixed?
- Fighting for survival, Fraternal Order of Police President Mike Shields is making an explosive allegation: that the last two police contracts dictated by an independent arbitrator were “fixed” and that the recent sergeants’ contract may also have been “rigged.”
Shields leveled the stunning charges Monday in a letter to Inspector General Joe Ferguson, demanding an investigation. A copy was delivered to FOP board members, including a handful of potential rivals whom Shields is now accusing of being in cahoots with the city.
“I was advised by the organization’s general counsel Paul Geiger that the last two arbitrations involving the City of Chicago were . . . fixed,” Shields wrote in the letter to the inspector general, obtained by the Chicago Sun-Times.
“Specifically, Mr. Geiger informed me that past president Mark Donahue, current and past First Vice-President Bill Dougherty, current and past Financial-Secretary Rich Aguilar and past Third Vice-President Greg Bella had entered into ‘pre-determined’ and backroom deal’ arbitrations — which included precise, agreed-to findings and language — with the city and an arbitrator.
“Mr. Geiger further explained that this tainted process was used in order to give Donahue, Dougherty, Aguilar and Bella political cover against FOP members’ potential accusations that the FOP leadership had ‘sold out’ to the city.”
We have no idea what's going on over there on Washington Blvd. and neither do a lot of people.
We're going to have to call for the State and National Lodges to come in and take over until such time as an investigation is completed and certain people end up deposed and maybe before a Court.
UPDATE: By the way, this stink is going to go back years. We recall rumors of crazy shit going on when Nolan was in charge and how he ended up with a County job paying six-figures after his tenure. If you have lists of the trustees going back three or more elections, it might be good to keep them around just for a list of people to vote against. Something like this doesn't appear overnight - it breeds over years.

Apparently Lil' Mikey will stop at nothing. The man, make that kid, has really lost it. Talked to several of the board members at the unit rep Christmas party last night and Mike only had the support of five members there; Bill Burns, Rick King, Dan Shields, Danny Trevino, and Mike Underwood. Paul Geiger was brought down and flatly denied everything Mikey claimed he said.
This kid might just be the loosest cannon in the department. Someone there ought to consider sending him for a psychological evaluation. After all he does carry a gun.
oh by the way you know what the board was upset over? Letterhead. They were made that Mike used FOP letterhead with their names on it. They don't want the city to think that they were writing this letter which is clearly signed by the president. They forced mike to compose a letter stating that he's only one making allegation to post on website. Really? Not the allegations. Also they made it so it takes three vice presidents to approve any letter Presidents wants to send off so he can't sends letters like this calling for investigations. Nothing was really discussed. When paul was questioned by board members, he did not deny that he said it. He only was being evasive and tried to not answer the questions. He never denied that he said it boys and girls repeatedly to people over the years.
Let's see. Aguilar, Bella, Donahue, Dougherty, the Lodge attorneys, the Lodge labor attorneys, the President and board of the Sergeants Association, the City's attorneys, and three of the most respected arbitrators in the country are all in cahoots? Now, along comes Mike Shields to save us all?

Anyway the national FOP and perhaps the U.S. Attorney needs to investigate these allegations.

It was sure interesting to see the look on Donahue and Dougherty yesterday. Fear followed by we have to try to play it cool. They both knew this was very serious. Perhaps that is why Mark motioned for the letter that Mike sent to be redacted. Mike pointed out that this motion was illegal and that is why Graham (who is running with both Mark and Bill) motioned to censure Mike's communication. So Kevin Graham motioned to "Prevent President Shields from sending out any communication without the consent of all three Vice Presidents or the Board of Directors approval". It was pointed out by Trustee Underwood that this motion was illegal on the grounds that the Board cannot prevent the President from doing his job. Trustee Murphy challenged it by stating it was in the by-law's but could not cite where it states that. Graham then immediately rescinded his motion to "prevent Mike from sending out any and all communication with Board members name on the communication and post a letter to the membership within the hour to FOP members stating the letter was from Mike and not the Board". President Shields pointed out the letter starts with "as President of the FOP lodge" and ends with"my signature". Attorney Geiger was brought down to the meeting and questioned regarding his comments about the validity statements cited in the letter. He danced around the question until directly asked to answer yes or no if "he believes or has knowledge of past contracts to be fixed". He answered "yes". This is just the tip of the iceberg. What a sad day for all FOP members knowing that there was gross impropriety during the negotiations of the last two contracts. I think Mark, Bill, Rich and Frank are officially done! Let the truth come out.
A confidential source is leaking info that Shields wore recording devices and has a lot of the talk of backroom deals on tape. There is audio of some of the board members that have been in office for a number of years telling Mike to 'just play ball' and 'don't rock the boat this is the way it's always been'. Rumors of more than a handful of people going before the grand jury as we speak. I guess Mike the Reformer had tried since day one to make the organization more transparent for its membership but was dissuaded and even threatened to just leave things go as they always have. Sounds like Mike has been compiling evidence for the better portion of two half years. Somewhere right about now a bunch of buttholes have just slammed shut.
So, if this is true, than Mike missing the deadline was NO MISTAKE.

This was rumored for years! It was always amazing how anyone with previous FOP executive experience left for a high paying job with the County. I never trusted or respected Donahue when I worked with him in the old 009 district. Shields and his crew got in on the protest vote against Donahue and his crew. Now I can't figure out who is worse. I agree with you, SCC, it is time for the state and national lodges to come in clean house and strengthen everything out.
How do we get the State Lodge to take over? This needs to be done now. I can't think of a more dangerous time for our members in light of contract negotiations and pension reform. Our future is at stake for active and retired alike.

If this is true, the rank and file can file a federal class-action lawsuit seeking monetary damages. The persons involved from both the FOP and the City of Chicago can also be sued PERSONALLY under the civil racketeering act. This might just make up for the retro check we aren't getting.

I'd say this is definitely worthy of an investigation. Shield's character is questionable at times, but his accusation does bring up some possible opportunities for greased hands at our expense.

These are very serious charges leveled by Shields. Allegations such as these can not only destroy someone's good name but potentially send them to jail. If Shields is lying not only should he be thrown out of office, but he should be sued for all he is worth. If he isn't then some people should be in jail. Either way let the chips fall where they may, and lets see how this all plays out. I think it could get very interesting.

Some thing to ponder:
1. Paul Geiger was hired by Donahue and Dougherty not Shields. His law license is his means to support his family. He is not going to lose that to save these four scumbags (Donahue, Dougherty, Bella, and Aguliar) that sold us down the river. This info was just disclosed a few weeks ago. Mike was not sitting on it. There are two other major issues that are not addressed in the Sun-Times article. If they are true the U.S. Attorney may have to get involved in at least one of those problems. I'm getting this second hand from a guy that used to be on the CityWide Team. But everything he has told me has been right on the mark. He like a lot of others fell betrayed.
2. Since he let it out about the last two arbitrations the city wide team has been working nonstop to get Shields out of office. Shields didn’t make this up it was dropped on him like a bomb.
3. Tom Pleines, our former labor lawyer, went to work for the city after being fired by FOP. After a short stint in the city law department he went to work for the Sgt’s union and brokered the agreement that was turned down by their membership. His email account when he was working at FOP is going to make very interesting reading for the membership!
4. Dean Angelo guys on the board are now also trying to silence Shields on this issue. Could it be that this practice actually started under the Nolan Team which Dean Angelo Sr. was a member of the board?
5. We - the membership of the lodge - paid for at least two arbitrations that were a sham. How do we get that money back? The legal defense money Bella gave away. The sexual harrasment suits settled under Donahue’s tenure. Hey wants a million here or there it’s not his money.
Now you know why there has been such a full court press to get Shields out of office. If the info on the last two contracts was not accidently disclosed they could have just gotten Dougherty elected and then it would be back to business as usual. May all of the CityWide guys rot in hell.
This is fucking outrageous. Our leadership is a goddamn joke and the dog gone infighting at the fop is ridiculous. Membership needs to take a stand. Whether this is true or not it's utterly ridiculous.

Pension fixes
While repairing Chicago's troubled pension funds is an absolute priority, one should note that there are some substantial differences between the state and city pension systems. As such, be wary of one-size-fits-all fixes.
For instance, most of the savings in the new state pension reform law are derived from reducing the annual 3 percent compounded cost-of-living allowance state retirees receive, an expanded benefit granted to them by the legislature in 1989. Chicago police officers and firefighters have never received such a benefit. Their COLAs have always been flat. And for Chicago public-safety retirees born after 1954, COLAs won't be paid until they are in their 60s and will then be cut off after 20 years — unlike the lifelong COLA benefit that will still be paid to state annuitants.
In other words, Chicago police and fire retirement benefits are already reduced. In fact, if the same reform measures contained in the state's new pension law were imposed on the Chicago police and fire funds, many current officers and firefighters would actually see their retirement benefits increase.
What's even more alarming is that despite a more modest benefit package, the Chicago police and fire retirement systems are still the among the most underfunded in the state. Why? For starters, they have been devastated by the same shameful history of underfunding from City Hall that the state systems have been subjected to by the General Assembly. But on top of that, the Chicago public-safety funds are drained by extra financial stresses not experienced by most state pension systems. They must make tens of millions of dollars in payments every year to line-of-duty widows' benefits, retiree health insurance programs and disability pay (police officers and firefighters injured on duty aren't eligible for worker's comp; their disability salaries are paid by the pension funds).
No "fix" of the Chicago systems can be achieved without recognition of these realities — and because of the structural differences, no viable solution exists without an infusion of revenue from new city sources. Simply asking Chicago public-safety workers to accept sacrifices beyond what is being imposed on their state brethren won't only be wrong, it won't work.

I find it highly unlikely that multiple arbitrators would be involved. Also, if I am not mistaken, the PBBA finished their contracts first, just like the Sergeants already finished theirs. Once one of the unions settles or gets an arbitrators decision, the other unions pretty much follow those decisions. I think this is Mike trying to save himself.

The main things to be arbitrated in the last contract were the length of the contract, the raise and the breakdown/timeline for the raise. Most aspects of the contract had agreed upon before negotiations began.
Benn had previously revealed himself to be a 'status quo' kind of guy and should have been eliminated by the FOP in the most recent negotiation.

The reason Shields gave for the sergeants contract being fixed is because the arbitration was finished in a record short period of time, therefore it was rigged. No evidence, no witnesses, no documentation, no wiretaps, nothing. It happened quickly therefore it had to be crooked. This from a police officer. It was quite embarrassing to hear a police officer say this, much less the President of a major police union.
It made me squirm, like when you listen to someone talk in public and they are making a total complete mess of it and don't stop but it just keeps getting worse and worse and the audience is sitting there with mouths open and cannot believe the shit they are hearing.
It was like that. One thing is certain, outside of his brother, Mike Shields has zero support and for that reason alone ought to look for the door. He is finished, finito, kaput, done, goose is cooked. Now Caparelli has to watch the bank accounts and we limp along till the election in three months. The board of directors could take over the running of everything and appoint an interim president.
Mike has to go. I hope someone who knows him and likes him takes him aside and tells him what time it is. There are 17,000 who depend on this union. Mike cannot lead it, that much is certain after what I saw tonight.
Contracts rigged? With what, maybe 12 or 15 or 20 police officers involved in negotiations. And labor attorneys on both sides, lawyers with successful practices, all those people are going to conspire to rig a contract for what? To save the city some money? Bullshit. What do they get? Some side jobs after retirement? A bonus? Risk losing their form of livelihood and going to prison to rig a contract and they are NOT going to get rich but might go to jail and lose everything?
No fucking way.
All those people could not be counted on to keep it secret.
Remember, two people can keep a secret if one of them is dead. 20 people? Hah!

While I agree that the current head is not the best, is the answer to the problem putting back the same four who got us that great 10% over 5 year contract?
In other words put back the same guys we kicked out and replaced with Mike?
Let the national lodge take over until we can get someone that both knows what they are doing and not place thier own personal agenda before ours.
This entire BS "letter not sent" stuff, while bad, was used for political gain by those trying to get their old jobs back. Did a single one of them post here about this letter "before" it was due? I mean come on... they "claim" they were asking Mike about it before it was due but no word at the meetings, the blog or any place I could see.
Me thinks they kept quiet in order to use this as a way to kick Mike out (he still should be) and re-establish power and to me this makes them just as bad or worse.

Excellent and true observation. I hope that officers use their critical thinking skills rather than side with one group over another. It is clear what's happening here. The sad thing is that those who perpetrated this will be back at the helm and we will still be screwed. Officers, being people, do not vote in their best interest.
If Shields was aware of this then why would he hire Donahue and furthermore why has he not terminated him?
I think Mike Shields is desperate and this is all a distraction. He knows he is done.

Donahue as past president receives a salary anyway. He might as well do something for it.
Shields main goal bankrupt the FOP so the Teamsters can move in and appoint him president. Let's see how many people he slandered with this past allegation of backroom deals. 4 specific current or past board members, 2 arbitrators, the Sergeants union, Franczek and all the rest of the board members who were listed on the FOP Stationary. Just thinking out loud here but if you wanted someone to know that you were personally alleging wrongdoing, would you put these allegations on your own personal stationary or your company letterhead????????? Lot of people going to make a lot of money because of this ass88loes actions. Having fun at the expense of others. Midnights in 011 here I come, Armani is not an accepted uniform vendor.

oh by the way you know what the board was upset over? Letterhead. They were made that Mike used FOP letterhead with their names on it. They don't want the city to think that they were writing this letter which is clearly signed by the president. They forced mike to compose a letter stating that he's only one making allegation to post on website. Really? Not the allegations. Also they made it so it takes three vice presidents to approve any letter Presidents wants to send off so he can't sends letters like this calling for investigations. Nothing was really discussed. When paul was questioned by board members, he did not deny that he said it. He only was being evasive and tried to not answer the questions. He never denied that he said it boys and girls repeatedly to people over the years.
FYI you should have been at the meeting because they played the tape and Paul said he knew nothing because he was not there. And would you not be pissed off if someone used your name without the consent or permission as you can bet law suits to follow.

It was sure interesting to see the look on Donahue and Dougherty yesterday. Fear followed by we have to try to play it cool. They both knew this was very serious. Perhaps that is why Mark motioned for the letter that Mike sent to be redacted. Mike pointed out that this motion was illegal and that is why Graham (who is running with both Mark and Bill) motioned to censure Mike's communication. So Kevin Graham motioned to "Prevent President Shields from sending out any communication without the consent of all three Vice Presidents or the Board of Directors approval". It was pointed out by Trustee Underwood that this motion was illegal on the grounds that the Board cannot prevent the President from doing his job. Trustee Murphy challenged it by stating it was in the by-law's but could not cite where it states that. Graham then immediately rescinded his motion to "prevent Mike from sending out any and all communication with Board members name on the communication and post a letter to the membership within the hour to FOP members stating the letter was from Mike and not the Board". President Shields pointed out the letter starts with "as President of the FOP lodge" and ends with"my signature". Attorney Geiger was brought down to the meeting and questioned regarding his comments about the validity statements cited in the letter. He danced around the question until directly asked to answer yes or no if "he believes or has knowledge of past contracts to be fixed". He answered "yes". This is just the tip of the iceberg. What a sad day for all FOP members knowing that there was gross impropriety during the negotiations of the last two contracts. I think Mark, Bill, Rich and Frank are officially done! Let the truth come out.

Shields was asked that, no advice from anyone, not the board and not from any lawyer. They have a couple of lawyers on the board. They stood in front of the news cameras claiming no knowledge. Shields is now officially thrown under the bus by everyone. I know of no elected official in that office who still backs Mike.

Amen brother you hit the nail on the head!!!! This is gonna sting SHields really bad and he gonna get sued and so might the FOP as well. He just messed with some serious "good" reputations who might go after Shields civilly. Time to put your house in a relatives name Mike SHields. You might of really messed with some very very credible and no nonsense professionals. I hope you have good home owners insurance or a umbrella because you may have just caused defamation. Defamation falls under 3 categories and one of those categories is giving the impression a crime has been committed. I can just see the plaintiffs lining up for this huge civil lawsuit.

FYI, I believe even if he put his house in a trust it won't matter because it would be after the act. Just like if you put your house in a trust today and a mutt you arrested 6 months ago sues you, it's too late. At least that's what I was advised awhile ago after some mutt filed the usual federal suit naming myself and others.
Perhaps someone with more legal knowledge could advise on this issue, but I would think every copper out there should have all assets in a trust.
Will Mike Shields be remembered later as the Adrian Schoolcraft of the Chicago PD??
Will he be remembered as the mythological Cassandra of CPD, the complex where predictions are made but no one believes them?
