Embarrassing

Everyone covers the recent debacle at FOP:
  • The Illinois Fraternal Order of Police has suspended the president of the union representing Chicago Police officers — and prohibited Mike Shields from negotiating with the city — after accusing him of violating his oath of office and branding him a “dictator.”

    The extraordinary step by State FOP President Ted Street was announced at a general membership meeting Tuesday night where a Monroe District beat car was called to “police the police” amid fears it could get ugly.

    Street’s power play comes just two days after Shields leveled the explosive charge that the last two police contracts dictated by an independent arbitrator were “fixed” in the city’s favor and that the recent sergeants’ contract arbitration may also have been rigged.

    That was the final straw, but not the only reason Street triggered a disciplinary process that will culminate in an investigation by a five-member committee and a hearing before the State FOP’s 30-member board, where Shields will have the opportunity to present a defense.
The FOP (sans Shields) released a statement on their website:
  • As many of you are aware, this past Monday Lodge President Michael K. Shields publicly accused respected arbitrators, City and FOP labor lawyers, and present and former Lodge officials of fraud and conspiracy to commit fraud during past contract negotiations. Due to the recent actions of President Shields, Illinois State FOP Lodge President Ted Street was forced to suspend President Shields’, “membership rights, duties and authority and therefore is suspended as President of Chicago FOP Lodge #7,” pending a hearing before the State Lodge Board of Trustees. Based on the FOP Lodge 7 by-laws, First Vice President William Dougherty will be the Acting President of the Lodge until the next Board of Directors meeting.

    The remaining Field Representatives would like to publicly extend a deep apology to those who were named in the Chicago Sun-Times article. Lastly, to our members, we want you to know that we are deeply saddened by these recent turns of events and understand the present “crisis in confidence” the members have in their Union. Based on your dedication and duty to the welfare our City, your wage and work conditions must be our number one priority. With that in mind, we promise that our commitment to you will not change in the remaining months before the Lodge election. Any and all press inquiries should be directed to the Lodge’s media consultant Patrick Camden.
"Crisis in confidence" is putting it mildly.

Everyone on the Board of Directors failed us. Everyone was so busy keeping their job that they forgot to do their job. The "retro letter" scandal was just the most visible fuck-up and when we told the truth about it over a year ago, we were lambasted by many of those expressing shock and dismay today. It is our studied opinion that too many of the current Board let a megalomaniac run unchecked for too many years for the sake of political gain and 10,000-plus coppers along with 6,000-plus retirees paid the price. This is not easily forgiven or forgotten.

I still think Mike Shields deserves a fair hearing and another chance. He's still getting my vote for another term.
I, for one, feel we as police officers make too much money and maybe we should even ask legislators to lower our pension benefits and increase our contributions, while raising the minimum retirement age to 55 with a minimum of 25 years.

We should all pile into the districts with the highest need for police presence and service to let our citizens and residents know they come first, while making sure to use as little force as possible and always provide service with a smile.

Last, but not least, what's wrong with a little medicinal marijuana?

Does anyone know if that tea works? You know, the one that's supposed to clean your pee?

In a left handed way this forces the CityWide guys to actually work on getting a good contract w/o all of the give backs the Sgt's gave.

If we get screwed then shields might have been right - not how he handled it - but by bring this to the light of day. Many of us who are getting ready to retiree believe that the last three (3) contracts were rigged.

The bunker is secured now in Ford Heights. The FOP president and his few generals are safe for now and demanding safe passage to Peoria, Illinois if the Lil Guy will not be prosected.

Looks like Shields was right...... these old fucks are gonna give it up to Emanuel on health insurance costs and pension, the TWO things Emanuel wants to fuck us all on anyway.


You heard it from their own mouths people, Dougherty and his clan of hacks is gonna end the contract process swiftly with a strong fucking in insurance benefits and possibly pension givebacks. He's gonna "take it to arbitration" with an agreed fucking on 2% insurance giveback and 2% for pensioners. BANK ON THAT, GUARANTEED.

Take it to the bank, you're fucked on health and retirement folks. Thank the Emanuel paid for stooges who're running yours and the state lodges.

And watch for political support for Emanuel based legislation to fuck us in pensions as well, all against our wishes.

What's wrong with retiring at 62? That's the minimum age for social security. There are many professions that involve manual labor that have to wait until 65. Gone are the days of working 20 years and collecting a pension for 45. Sorry, it's not economically viable.
People are living longer. There are less cops to pay into the pension, less people in the state paying taxes. Soon private sector employees will be working to 67-70 and getting social security of $20-30k.
Should pensions be capped at 1x social security? 2x?
Getting quadruple social security for working half the years is fucked up.

I'm retired 15 years (30 year CPD) and living out of state. Imagine my shock when this hit the fan.

Recently (past 3 years), I have voiced my concern about the whole FOP movement to align with unions. The FOP was originally voted in because it was not affiliated with trade unions and because it was not subject to the corruption and back stabbing so prevalent in those unions. We had Teamsters and AFLCIO options on the ballot but we selected the FOP.

Not once in all those years did a trade union offer to stand with us on a single issue but now they are begging us to stand with them.

Now the "union labor movement" aligned FOB is behaving more like mobbed up, corrupt political activist, back stabbing union thugs than the independent brotherhood of cops we originally were.

Lets not forget one simple fact. Mike told the members who attended the February 21, 2012 General Membership Meeting that he was going to send a demand letter. It's in the minutes of that meeting. The meeting was a week before the deadline. He and he alone failed to live up to his statement and responsibility as president of our Lodge.

The comments posted here about electing all candidates without any past FOP experience is dangerous. We all need to take a deep breath and realize that inexperience is exactly what failed us. There are some people on this Board who have performed their jobs well. They should stay while removing some of the dead wood. If you don't know who they are. Shame on you. You are as much a part of the problem as Shields.

This does not change a single thing on Washington Street. Dougherty is a coconspirator to this entire 3 year mess. This is the reason why you elect members to individual offices. You expect that someone that has knowledge of wrongdoing will step up and expose the issue for what they are. Dougherty never did and what is worse let it go this far before he decided to put seperatiion between him and the Shields team. Dougherty could have exposed the personal issues of the President, could have exposed and helped remove Geiger that will cost us millions, could have and should have immediately came out and said something about the letter not going to the city.

Nothing has changed and it will not change until the members vote by mail or in person. Tickets dont make an election, indivuals do and we all have a choice to vote for the individuals for each office or trustee.

Keep in mind the enromous rubber stamp that Shield and Dougherty had and how they put us in this possition of embarassment and financial hardship. Every one of them from Dan Shields down to Mike Underwood. Nobody want to rock the boat, they are just there for their monthly stipend. You are paid to do a job and you failed to do it. All are responsible and all sholuld be removed.

No one should be voting for anyone that is or has served on this board or past boards. Our entire lodge is a laughing stock! I don't care who is to blame for starting this mess, but no one tried to stop it at any point. The last 4 meetings were useless and so has our representation by our FOP! Who gives a shit about a letter that was supposed to be sent or not sent? How about what the city plans on doing to our healthcare? Or how about what is going to happen to retirees benefits? Everyone is so damn worried about a f**king retro check that may or may not come they are missing the bigger picture! This mayor along with many other politicians are going to take away more than a retro check from us in the near future but we are stuck on a letter. Well I have two letters for every member of the lodge F and U for being backstabbing cowards! You job is not about yourselves, it is about our brotherhood! And you my friends dropped the ball!

The Letter fiasco.....why is Shields the only guy getting bad press over that? I'm neutral when it comes to the FOP "Team", but as a team (Many of them People with years of experience) How did that happen? Seems like petty BS and egos got in the way of representing us properly. Shields can't be the only guy to blame, other re-elected ofcr's have to help the new guy in his first term. Even the most naive optimists would have to believe in backroom deals/rigging after the many dismal contracts over the years.

There's no doubt Shields messed up, however how many on his board were around for previous negotiations but either set him up by not reminding him of the letter or being negligent themselves in not knowing about it.

There's little doubt remnants of the previous regime sabotaged him to a degree.

To fix the union, Shields AND any remnants of previous regimes should not run for re-election for the betterment of the union.

Rahm's Wet Dream has come true! Instead of rallying behind Shields with respect to the letter Fiasco, everyone has turned on him. THE LETTER CLEARLY SHOWS THAT RAHM HAS NOT ACTED IN GOOD FAITH WITH THE POLICE DEPARTMENT. The letter fiasco also shows that members of FOP at the highest level were working against Shields, because these guys were around for previous contracts and knew that letter was due. The Union has been busted by a COMBO of Shields incompetence and our own selfishness. When it became apparent that the letter had not been sent and Rahm was going to hold out we should have surrounded City Hall the way we did for Daley. That incident was devastating to the stuttering little pig's ego, and it would have had an effect on Rahm as well.

I love all the Monday morning quarterbacks!
First Shields made a name for himself while at the pension board stopping the likes of Huberman and Weiss from getting into our pension fund. He received a lot of attention and the majority of members, (those that vote anyway) elected him into office. Get over it. We all now know that this was a mistake, however we also elected other officers some of whom make up the board of trustees and they haven't done their jobs as well. Unfortunately Shields went down a road that was all about himself. Accusing those that have worked for or with the FOP for years of not being loyal and not working in the best interest of the membership. Shields then ultimately insisted that that "the contract letter" was written and mailed in a timely manner, which I believe there should have been verification through board members and evidently there was not. Again we have to have accountability here, that's why we're paying all you guys, that's why you're there to protect us. You all failed us on this one. Regardless, Shields then admits a year later that the letter was not sent and it was his fault. The number one priority of the FOP is to negotiate and enforce our contract. This clearly was not done. Shields now becomes the focus of the FOP and instead of moving forward the board and other members began to argue like teenage girls. Pathetic at best. He now becomes the problem and it's time for you to go and he should have resigned. He didn't, and instead of the board attempting to remove him at this juncture they all waged battle over self preservation, thereby bring embarrassment to all Chicago Police Officer's active and retired.
Now we have a letter and a press conference held by Shields with no backing of the board or other members accusing the city, arbitrators and past and present members of the FOP of being involved in rigging or fixing prior contracts. Shields provides no proof of this other then to say that's what he was told by Attorney Paul Geiger, who was not present during those negotiations and is not willing to make any statements as to his knowledge of these events. This clearly is meant to be a distraction and embarrasses us all yet again.
We now have to have an outside representative come in and clean house by removing our sitting president and stop the bleeding.
Shields will have his day in court. However if he had any proof we all know he would have already provided it to the Inspector General and media.
The truly sad part of all of this is that we are in the battle of our careers with the current contract expired over a year ago and our pensions being threatened.
We need real leadership today! Whoever is in charge needs to act responsibly and professionally for the good of the membership.
We have an election in a couple of months, let's hope that's not too late.

Off topic from the rumor mill...Just heard the if Rauner becomes governor the pension deal being discussed for police and fire with the city would likely be. You do 20 years for 50%no cola. After 20 years you go into a 401k. Kind of like N.Y.C. I'm guessing.

If I recall correctley the city refused to share or give the arbitrator financial information requested by FOP during the last contract negotiation. If logic follows this the city tells the arbitrator we cant pay and you cant question it cause we aint openning the books for no one. so the arbitrator takes what answer the city gives makes his decision based on it but also said "that doesnt prevent the union from recouping lost wages at future contracts". Now RhAM whines same song and I'm gonna take more than I give and you'll all end up in Obama care cause I was behind it in the first place.

Watch and see how fast Rahm is in Springfield trying to pass pension take backs from us. Can anyone find one (1) legislator that Donahue got to change their vote in the state's pension reform b.s. that was passed two weeks ago? The retiree's are an asset that can get on a bus and go to Springfield.

I was told that there was supposed to be a special board meeting this Friday. One of the things on that agenda was supposed to be amnesty to allow retirees back in the union.

Bill Dougtherty's first decision was to cancel that meeting until 7 Jan 14. Just far enough that they can approve it and just miss letting the retiree vote in the next election.

If Chicago pension reform passes in January the retirees will be on the busses to Springfield. Not to the capital but to the FOP hearing to throw this whole board out of office.

Now that is the biggest line of bullshit I've heard since this whole circus act started. Shields may be unfit to run the union, HOWEVER, our union has done absolutely NOTHING as far as improving wage and work conditions for us within the past 7 years. The whole board should resign and an outside audit needs to be conducted to go through every financial transaction done within the last decade. Thousands of grievances still sit unsettled- there's a dozen from my district alone which are over 2YRS OLD- a clear cut violation of basic contract protocol which should have been resolved in a few days; no raises- the last raise we had was negated by the increase in our state income tax so that was just money that went to directly to the thieves in springfield; continual diminishment of manpower with each passing year; time due denied- even after court ruled in our favor; substandard/broken equipment/deplorable work conditions (i.e. mold/sewage/cancer clusters in the stations); underfunded pension system including the 20 million owed by the city which FOP under Donahue forgave; illegitimate testing and promotional practices which have gone unchecked for YEARS.
We need to retain independent labor attorneys to do our contract negotiations- not political hacks who hold no interest for us as a union. There is no doubt in my mind that these contracts have been fixed and then negotiated under the false pretense of "good faith" bargaining. If you look back, the city has never really lost anything under these contracts; the same routine has always played out- we put our requests forth, they counter with something they know the union will reject, then we sit in limbo for years until it goes to an "arbitrator" who is supposed to make both sides give/take something. In the end, we always walk away with crumbs, while our union spins the new contract as a "win".

Take a look at the contract that gave us wage compression, 29 and a day, it eliminated the final 3% step raise at 30 years of service, but gave 75% pension, the city essentially dumps salaries and pension contributions as retirement rises.. This relieved the city of the 3% due anyone who was coming that step during the negotiation and in the future. The memorandum to allow retirement with paid health care wasnot in affect and officers felt safe in pulling the pin and paying for insurance only to find out later that insurance is going bye bye. The city wins on 2 fronts, dont have to pay step raise, officers at top tier retire at a higher than normal rate (and believe they'll be insured just cause they are paying their fare share). Next comes the 55 and out and the flood gates open, the city once again has top pay tier officers retiring at faster than normal rate with the promise of health care, which they will contest in the near future. City wins twice losing top salaried officers and no longer has to pay into pension fund for them and diminshes hiring saying look at the "stats". Next is the cry I can't pay for the pensions. Look i cant even give the latest retires born after 1955 the traditional 3% COLA. Lets face it we all wanna get out while we can live a while but those deals were to save the city money more than anything else. Maybe Shields is right it certainley looks like the city won.

Let us start with a little legitimacy building then shall we? Maybe we need someone to run under the following stipulations:

1. That the new regime will immediately cut their pay scales down to something more agreeable, say president gets base Lt. pay, VP get base Sgt. pay and everyone else gets whatever pay scale they're at as patrolmen.

2. That there are only three vehicles available to the top 3 officials: 1 to the president, 1 between all VP's that stays at the lodge after hours and 1 for whoever goes out on shootings.

3. That all grievances found to be violation of the contract are taken to their fullest conclusion and no "bargaining" with members or refusal to take each grievance to it's full conclusion.

4. That all bargaining sessions and their topics, who was present and the next scheduled meeting on those topics are posted on the website and updated by the end close of that business day.

5. That the position of "past president" be eliminated.

7. That all bids for vacancies be posted in real time on the website including the timestamp of when the bid was correctly filed and that no "accidentally late postings" are granted a bid.

8. That all ambiguous language currently existing in the contract and all future contracts be clarified and accountable to the grievance procedure.

9. That all future board meetings are audio taped and held for a period of 1 year and available for review in FOP offices upon request, with the minutes of each meeting emailed to every member.

10. That the membership retains full right as to whom their lodge shall choose to lend political support to, rather than the board making that decision.

11. That any member elected to office be returned to their prior unit of assignment upon the conclusion of their term, and that no elected official be granted "merit" promotion from any eligibility list.

12. That a maximum term limit will apply to all officials elected and appointed to a maximum of 2 terms.

13. That the union be disallowed from promoting any legislation that negatively affects it's membership.

14. That the membership be made instantly aware via website of any contact with MLAS or city officials regarding alteration of programs covered by contract.

15. Anything else that will provide true transparency of office, eliminate the possibility of favoritism or corruption and promote trust between the membership and their representation.

The lodge's sole purpose is to benefit it's membership by way of contract negotiation and protection of it's membership rights within that contract, nothing else. No president should have the authority to demote, replace or eliminate an elected position without a full hearing and conviction of charges before the full board.

There are plenty of other items that could be added to the list, but at it's core, our bylaws need to be changed and clarified to remove doubt and the perception or availability of corruption within our union.

There should be no "power" in union representation other than that which collective bargaining should bring.

Lets not forget one simple fact. Mike told the members who attended the February 21, 2012 General Membership Meeting that he was going to send a demand letter. It's in the minutes of that meeting. The meeting was a week before the deadline. He and he alone failed to live up to his statement and responsibility as president of our Lodge.

The comments posted here about electing all candidates without any past FOP experience is dangerous. We all need to take a deep breath and realize that inexperience is exactly what failed us. There are some people on this Board who have performed their jobs well. They should stay while removing some of the dead wood. If you don't know who they are. Shame on you. You are as much a part of the problem as Shields.

I, like many others, am ineligible to run for FOP office b/c of a lack of attended meetings.. Under these circumstances that are before us, I would hope they, FOP, rid the rule about "x" amount of meetings attended to run for office..After all, i'm an FOP member.. Employees who no longer want a union to represent them — whether it’s because the union is undemocratic, corrupt, violent, or just plain inept — are entitled to seek an election to determine if a majority of their coworkers want to drop the union. Such elections, which are conducted by the National Labor Relations Board (NLRB), are known as “decertification elections.”

Employees who want to vote a union out must circulate a petition calling for a decertification election. A sample petition is available below. They should not seek help from their employer, because the union can then complain that an unfair labor practice has tainted the election. Employees may take advantage of outside assistance, though. Signatures should be collected on non-work time and in non-work areas. It is important that the names of the union and the company be filled in before any signatures are collected.

It doesn’t matter why the employees are dissatisfied. But there are some timing issues that are important. The NLRB has a rule that a new union is given one year to represent the workers before a decertification election can be held. Unions that have already negotiated a contract for employees can usually be subjected to a decertification election near the expiration of the contract. Therefore, workers with an old union should start their decertification drive a few months prior to the expiration of their contract to be sure they don’t miss their window of opportunity.

If at least 30 percent of the workers in the bargaining unit sign the petition, then it must be sent to the NLRB’s closest regional office, along with a cover sheet, NLRB Form 502. Once the petitions have been received and validated, the NLRB will set a date for the decertification election, usually about 60 days in the future. Individuals on both sides may campaign to sway the employees. When the vote is held, if a majority of the workers who participate favor decertifying the union, or if the vote results in a tie, then the NLRB will officially remove the union’s recognition as the bargaining representative of the workers.

Mike Shields leveled a blockbuster allegation, arbitration a are rigged between the FOP and the City which includes MLAS. Mikes proof, a conversation with Lodge attorney Paul Geiger. No other proof than this conversation, that was the proof given to Joe Ferguson. At the union meeting a tape was played from the Board meeting where none other than Paul Geiger said in a loud voice he never told Shields that. This is a typical Mike Shields media stunt. Shields never tells the I.G.he has any other proof, in numerous media interviews he never offers any other proof. If Shields had offered solid proof none of this would have happened. Shields does what Shields does he counts on our suspicion to fill in the blanks on total baseless allegations. Now to top everything off he is assigned to 019th District yet MLAS lets him pick the District he goes to.......the 018th District. MLAS who he accused of rigging the arbitration with the FOP. Why would they do Mike Shields a solid? Somebody in 018 should ask him if he ever shows up to work.

Bill Dougtherty's first decision was to cancel that meeting until 7 Jan 14. Just far enough that they can approve it and just miss letting the retiree vote in the next election.

The meeting is scheduled for Jan 7, 2014. First Tuesday of every month. Nothing was scheduled or canceled.

I have been retired ten plus years and have paid my dues religiously. Right around four hundred bucks or so. So have about five thousand other retirees.

Shields was told more than once by more than one person to send the letter. he didn't for reasons known only to him. What should the other officers do? Send the letter on their own without his knowledge? It needed the signature of the Union President for Christ sake. Of course others knew it had to go in. Of course they know it was going to be a cluster fuck. Ask them why they didn't just sign his name and get it done. I would have. As it is, it turned into a $20 million or so mistake.

Shields has never adequately explained why he didn't send it. Even the civilians there knew it was supposed to go in. The secretary's he fired all knew that.

He has a hearing scheduled AFTER he was suspended and removed from office. I have been trying for two days to find out chapter and verse that gives the State Lodge President the authority to summarily suspend and remove from office an elected lodge president. Unsuccessfully.

I cannot find a copy of the state FOP constitution/bylaws. It is not available online without a user name/password.

They are calling this an "extreme situation" which it probably was. There is more we don't know about. It isn't such a bad thing Mike was removed. Something is wrong with that boy.

People are living longer. There are less cops to pay into the pension, less people in the state paying taxes. Soon private sector employees will be working to 67-70 and getting social security of $20-30k.
Should pensions be capped at 1x social security? 2x?
Getting quadruple social security for working half the years is fucked up.

I have always been suspicious of the dealings between the FOP board and the City. Heard that the FOP heads and the City trade deals all the time om placing people in units, etc.

A real eye-brow raiser was a few years ago. An ODPO got caught for DUI. Refused to blow for the criminal, but blew for the department. CCSAO got the ODPO's department blow results and used it at his criminal trial.

Anyway the FOP says it appealed the case to the State Supreme Court, but lost. Time on the case was real short. Suspiciously short. Wonder if FOP flushed this case as a favor to the City.

So for Mikey's allegation that we were stabbed in the back by our own in exchange for silver, I wouldn't doubt it at all. But the scum involved in it are too sharp to leave a paper trail. They learned well from the Daleys.

Everyone on the Board of Directors failed us. Everyone was so busy keeping their job that they forgot to do their job. The "retro letter" scandal was just the most visible fuck-up and when we told the truth about it over a year ago, we were lambasted by many of those expressing shock and dismay today. It is our studied opinion that too many of the current Board let a megalomaniac run unchecked for too many years for the sake of political gain and 10,000-plus coppers along with 6,000-plus retirees paid the price. This is not easily forgiven.

Not Chicago Lodge 7 but the State Lodge, Constitution/bylaws are behind a firewall which requires a user name and password issued BY THE STATE FOP since it is locked down on the State Lodge FOP server! I emailed them a copy of ID and the reason and they sent me confirmation. Now I can get in.

What's your state issued user name/password for the state website?

I've been to FOP meetings while you were in diapers.

Next comes the 55 and out and the flood gates open, the city once again has top pay tier officers retiring at faster than normal rate with the promise of health care, which they will contest in the near future. City wins twice losing top salaried officers and no longer has to pay into pension fund for them and diminshes hiring saying look at the "stats". Next is the cry I can't pay for the pensions. Look i cant even give the latest retires born after 1955 the traditional 3% COLA. Lets face it we all wanna get out while we can live a while but those deals were to save the city money more than anything else. Maybe Shields is right it certainley looks like the city won.

I, for one, feel we as police officers make too much money and maybe we should even ask legislators to lower our pension benefits and increase our contributions, while raising the minimum retirement age to 55 with a minimum of 25 years.

We should all pile into the districts with the highest need for police presence and service to let our citizens and residents know they come first, while making sure to use as little force as possible and always provide service with a smile.

Are you serious you think he needs a break what about all the officers who are going to loose thousands of dollar? Perhaps if you dig into your pockets and compensate everyone then we might think about it. Or should we wait until he burns the building down. He has destroyed so much of the image of what we have worked for and embarrassed us nationally and made accusations without a stich of proof other than he was told by and then when questioned Geiger said he knew nothing. So you don't think we have a problem?
You can say all you want about he was set up and it was a ploy or any excuse you come up with, Shields has totally screwed things up royally, no one else is to be blamed. And if you named trustees and sergeant at arms don't wake up perhaps you need to go for help yourselves.

Who wouldn't but thats the problem. The city didnt contribute the multiplier to the pension. If they had been paying into the fund the last 30 year there would be no pension problem

You should be allowed to run for office? Oh yeah? The requirement is not that stiff, half the meetings, 5 a year qualifies you. It isn't enough in my opinion. I've been going for 26 years. Unit rep for 9 years. I always carry a contract book with me, in the squad car or personal car, at home that contract is on the computer.

To run for office you should have that thing about memorized. Then the contract needs to be interpreted. Plus the bylaws.

When an officer asks a question they don't need someone to simply read the contract to them. Frank DiMaria does that. They want someone to tell them what it means, how it applies to their circumstances. You need to know about arbitration decisions too. That is like the supreme court of contract disputes.

So sure, go run for office you know nothing new kid on the block. Who would you help with your striking lack of knowledge?
