Nobody Recalls
- As an unconscious David Koschman was being rushed to a hospital, a nephew of Mayor Richard M. Daley was rushing with friends to a closed River North bar where prosecutors believe his friends “concocted their stories” about the violent confrontation that would cost Koschman his life.
Daley nephew Richard J. “R.J.” Vanecko, Bridget Higgins McCarthy, her husband Kevin McCarthy and Craig Denham took cabs to the Pepper Canister, an Irish pub at 509 N. Wells St. where they’d been drinking earlier that night in April 2004.
The bar — owned at the time by a politically connected couple — was already closed for the night. But somebody let in Vanecko and his friends after hours on April 25, 2004. How long they stayed there hasn’t been disclosed.
Vanecko’s friends told a grand jury they didn’t recall any discussion at the Pepper Canister about the confrontation that had just occurred oustide the late-night bars along Division Street where Vanecko allegedly punched Koschman in the head, according to court filings last week by Dan K. Webb, the court-appointed special prosecutor in the case.
Webb doesn’t believe them.
No shit Webb. No one believes anything connected with this story.
Unfortunately, someone is going to be left holding the bag and we just don't see Webb having enough to make it stick to a member of the Daley clan.

His Mom is in a constant state of mourning. Pain known only by those who have lost a child to senseless violence. Being a Daley he probably is not guilty, and if he isn't innocent, he should be. You just don't throw the King's nephew in the slam for murder. It just isn't done. It's like convicting a Kennedy of murder, or convicting Obama's lost son.

If Vanecko was a copper and Webb was still a federal prosecutor, you could have bet there would have been wires,taps and overhears on Vanecko and his entire crew before, during and after the grand jury and subsequent investigation.

Excellent points. If this was a cop, people on this blog would raise hell, and rightfully so, for bringing a case with absolutely no evidence. I can only believe that my brethren who comment about conspiracy have never done a lick of police work and understand no more than a civilian about investigations and court, and that's just embarrassing.

Obviously you are not The Police and don't spend much time at 26 Cal on your own cases to see what else is going in the court rooms there.
Someone said if you played ball for the Daleys, you get promoted. I wonder if any of the police or detectives (whose notes have been lost) ever got promoted.
People forget it was the blue shirt, the responding officers, who probably did the most work on this case at the beginning. They got the names of the offending parties / witnesses and put them in their case report.
They should be commended. On the first note, I wonder if they got in trouble for being so thorough??

Absolutely 100% correct. But one point ... wasn't there some point in time where it was determined that Vancecko was the offender? (Either he admitted it - or someone id'd him, or something like that) ...
Regardless, with the facts as they were:
- conflicting statements as to whether Koschman started it (even Koschman's friends, I believe, said Koschman was the aggressor)
- even if some said Koschman did NOT start it.
- In any other case - North side, South Side, West SIde - THIS CASE WOULD NOT HAVE BEEN CHARGED. PERIOD.
- There is some B.S. with the file going missing and then reappearing, I will give you that.
-There is also some nonsense going on about the GPR suddenly found that has a witness statement that Koschman did NOT start it - I will give you that also.
BUT EVEN IF THIS GPR HAS BEEN THERE ALL THE ALONG THE CASE WOULD NOT HAVE BEEN CHARGED.

Really??? Am I to assume from your comment that the ASA's have recently been charging a ton of cases rather than rejecting every other case. Is that why there are so many people in jail as you say? Or are the judges and juries all of a sudden convicting most of those charged? Stop pretending…it's embarrassing.
These "friends" may have immunity, but anyone who knows them, comes in contact with them or has kids in school with their kids should call them out on it and shun them….they are as guilty as the dude who threw the punch.

Vanecko flanked and totally blindsided this kid with the type of hit that could easily cause severe damage (in this case it did). YIKES!! Calm down buddy. When you say everyone but you is stupid regarding this case, are you also talking about the grand jury members? The judge, the special prosecutors? Anywhere else but Cook County would have brought charges years ago. But, yes, we are all stupid. Now, let the jury decide this matter and let the witnesses tell their story on the stand. The excuse, " I don't recall" will not help them at that time.
By some of the comments I have read here, there seems to be a lot of anger by police officers on both sides of the issue. Really? Why? There should be just sadness, sadness that a young man was killed or sadness that political pressure was used or sadness that the police did a poor job in the investigation.

Another Christmas gone. The Koschman boy still lays cold in the grave. The Daley and Vanecko families enjoyed a rich feast and exchanged presents with their loved ones.
