Another Lawsuit (UPDATE)

  • Three people who claim Chicago Police strip-searched them in public and falsely accused them of carrying heroin during a traffic stop last year are suing the city, calling the officers’ actions “exceeding all bounds of human decency.”

    Caprice Halley, Tevin Ford and a representative for the estate of Robert Douglas filed the suit in U.S. District Court Wednesday.
"...the estate of...?" That's entertaining.

Does anyone have an actual count of how many nuisance suits are filed against the City and Department on an annual basis? It has to be thousands. And does anyone know how much the City spends to settle these suits, without ever "admitting blame" or actually putting on a case? Millions we're sure.

The only (and we mean ONLY) good thing J-Fled ever did was encourage City Hall to fight these suits. Because the City actually started winning them. And winning them handily. Once plaintiff attorneys began to realize they'd have to work for their money with shitty cases, they stopped taking them.

As soon as Rahm took over, he announced that the previous policy of fighting cases would be dropped - because you know, plaintiff attorneys make largish contributions to democratic political reelection campaigns. And here's the result.

UPDATE: To the obviously delusional commentator who claims, "J-Fled gave us rifles, too," we weep for your poor uninformed brain. J-Feld did not "give" us anything. Daley needed to have a few hundred officers qualified on rifles as part of the Olympic package bid. Therefore, the idea of "patrol rifles," which had been proposed dozens of times over the course of our careers (and utilized by thousands of departments nationwide) was finally brought into being. J-Fled had about as much to do with it as you do making the sun rise in the east every morning.

  • i don't agree with your assessment of "the only good thing" Jodi Weis did....He got us Rifles (no Chicago guy would have ever done that, EVER)Oh and the Striker fire pistols like Springfield XD & Glock. we also got a 4 day work week under his tenure. (remember 6 days in a row?) We got tasers , the Chevy Tahoe , extra training , and thats off the top of my head. Most importantly he LEFT US ALONE. no compost meetings, pressure for #'s etc. Shit id trade McEgo or Cline and day for Weis.
We already explained the rifles. The pistols were part of a long failing effort to modernize sidearms. Daley's anti-gun bias kept it in the closet for years. The four-day work week had been proposed in every contract since the late 80's - early 90's. The FOP had studies that showed the 6th day led to more accidents, more CR numbers and more disciplinary issues, yet hte city did nothing about it for years. Tasers were here before J-Fled. Tahoes suck (2-wheel drive?) and where's all the equipment we were supposed to be carrying in the Tahoes? Extra videos at roll call doesn't count as extra training - classroom and hands-on and walk-through scenarios is training.

Left us alone? Did you forget the "town hall" style meeting he held citywide while Aunt Bea took notes and names of those complaining? And the vengeance that was taken against those foolish enough to speak out? Or Cozzi? And the accountability meetings (precursor to CompStat)? J-Fled was an egotistical asshole who took credit because he happened to be in the big chair when the logjam broke because Shortshanks needed the Olympics to conceal the massive financial mismanagement that was coming into view and that we see today.

I got sued in Federal Court. Weiss said fight it. We won. Asshole appealed, City fought the appeal too. We won again. Asshole went two rounds and didn't make a penny, his lawyer had to foot the bills. Under Rahm they would have paid. Fuck that, I told the truth, asshole lied like hell. It felt great to win in court. Twice.

Well I hate to say it, based on the video I saw on Channel 5. I think the coppers are wrong. I mean handcuffing the dude to the building and pulling his pants down in the field. Looking up his butt, come on guys. When are we, especially the young guys gonna learn. This society does not want us to take drugs off the street. They all hate us, I learned a long time ago to just do as little as possible. Definitely don't stick your neck out....for what??? Signed affidavit or not, the video will prove to be the most damning evidence against these officers.

This is where "Gray Area" intersects with "The Numbers Game". Now add in lack of supervision for the perfect trifecta.

This type of shit hits the news from time to time because impressionable kids with no time on the job who want to play SuperCop aren't smart enough to not "illegally strip search" the occupants of a vehicle stopped under questionable pretenses. Or as the plaintiffs' bottom-feeding attorney alleges was "rape". In broad daylight, to boot.

I'll bet everything I own that the involved officers' supervisors will do anything and everything in their power to distance themselves from this catastrophe-in-progress. And unless clouted, these officers are going to soon learn an invaluable life lesson courtesy of a flawed system designed to make them scapegoats.

I wish them the best of luck in a situation that sucks anyway it gets sliced. Hopefully they'll come to the realization that playing the dope game ain't worth the trouble just to keep from working a beat car on first watch. Most are used to make supervisors look good, nothing more. Supervisors that won't remember who the fuck they are and will deny under oath that they said "the lieutenant wants 5 heads per team tonight".

There is nothing special about being able to wear jeans to work to lock up loiterers, drinkers and someone with two bags of weed. Tactical, 06 and assorted hidden "Mission Cars" have been out of vogue for quite some time. And anyone who says the "perks" make it worth the risks have never been in the shoes of officers like this present bunch.

I have it on pretty good authority from a retired gold star friend that Jody di push the four day work schedule. He thought we would like him them. That is just pathetic.

We wait for cars every day because of this schedule. Hundreds of police officers a day sitting on their asses, for hours sometimes, every shift because ...we wait for cars. Nobody drives the same car every day because of the overlap so they treat them like pool cars. Beat tags get lost every day because of the switching. Start roll call on time? Why bother when there are no cars to send them out. Great idea Jodi. You were really pathetic.

This coincides nicely with some buzz I intercepted recently at an interagency meeting. ISP forensics lab has added a simple test to determine if fecal matter exists on narcotics evidence when it's being weighed and analyzed by them. A 29-cent swab and vial will instantly detect the presence of fecal matter and whether it is of human or animal origin. Seems a handful of lab employees were regularly getting sick (ecoli, etcetera) and thru a series of tests they concluded that a lot of drugs being tested had been exposed to human excrement. They have established a data base to cross reference who inventoried the drugs, name of offender, CPD report number and evidence/inventory number. They claim the system was established to be able to warn arresting officers of possible exposure to communicable diseases, but you can bet your ass they will use it to trick bag someone, especially when claims of illegal search and seizure surface.

I am a retired Lieutenant. I always told the officers that would listen, the next big scandal would be the filming of street stops. What percentage of arrest for drugs are outright illegal searches and perjury? Protect yourself and know the law. Putting your career on the line for a bullshit head just is not worth it. I just cannot believe it has not happened sooner. Reconsider your actions and give the public what they want...nothing.

Now home invasions or the kids who rob homes when they should be in school, the baby face rapists, take them down, but stripping someone in public and making a woman pull out a tampon, that is nasty.

CPD officers have been hearing that for the last 50 years. Nothing new. Only problem is towards the end of the month when numbers are low things change.
Also you have to be an idiot to believe that. The bosses say that to protect themselves. They can say I never asked for numbers or a quota, but always said Quality arrests.

Don't think that there is not collusion between certain private attorneys and some members of the Corporation Counsels office. I am not saying that everyone that works for the Corporation Counsel is crooked because that is obviously not true. This has been going on for years, long before Richard M. Daley. That is the real reason that so many of these cases are settled.

Hi SCC! Im always a big fan of yours. Since we are nitpicking the Weiss era on this thread, then maybe you or someone else can clear up the one good thing he supposedly did (at least to me). Is it true that he was supposedly taken by surprise by the Cozzi backlash and he approved are current work schedule to make up for it? The rumor at the time was that city hall was pissed he gave us the 4 and 2 schedule without us losing anything. Again, I just remember hearing that from a long time ago and I am probably wrong.

The gang leader’s criminal background includes 12 arrests but no convictions, authorities said. The arrests include such charges as aggravated assault, burglary and failure to register a firearm. The sheriff’s office would not reveal the man’s name, age or where he lives, citing privacy concerns.

Now he IS a Gang Leader yet Anita & Co have had at least 12 chances to take a swing at this mutt and have either pled down or out or failed ?????

-- Twice your financial future was put in the hands of an Illinois jury. It's great that you won, but was it worth the risk? I don't agree with the city fighting these. If there is no possibility of punitive damages, sure. It's not like the money the city is saving is going to efforts of improving the dying city. Pay the asshole whatever you want, as long as nothing out of my pocket is risked, I don't care.

well, the good thing about this video for the officers is that there is no way in hell this will EVER see a courtroom or a jury. They will farm this out to a private to get it settled in a timely manner and quietly. That is the good news, the bad news is that it will most likely be a beef and the coppers will take time.. Taking time, no big deal could always be worse. Those saying that the "coppers are gonna get indicted" are soft as soft can be. Ill bet everything I own that will never happen. If anything it is a violation of civil rights. Thats why we have the civil system, to sue for civil rights violations. Yes, officers can be arrested for civil rights violations but this wont be one of them. Cozzi was indicted by the feds because of a favor made to jfed to make him seem legitimate to the citizens. the searching officers will take 15-25 days, everyone else on the paper maybe 5-10 days and the supervisor on scene will take the same 5-10. Im gonna say this will be settled within 8 months if not sooner with an undisclosed settlement. They will definitely get alot of money though, no way around that. The city/officers dont really have a leg to stand on in a lawsuit which is why it will be gone. so at least some good news and bad news but it could have been much much worse maybe if that guy was still alive.. im sure a lesson will be learned by the officers though and hopefully by all the officers who saw the video. DONT DO THAT ANYMORE!!!

I learned that 27 years ago to not bother arresting a guy only to get it tossed on no PC. I find no PC right on the street and toss it out myself. SCC: too harsh on Weis. 19 years of the job, by far the best Superintendent we had. I have worked in patrol for the vast majority of my career, so I do not know what each of their personalities were like or whether they were good guys, but the biggest changes to patrol for me came when Weis was Superintendent.

1. Elimination of the 6-2 work week. That was the biggest struggle on this job if you were the working police. 6 straight days and court. 4-2 is much more manageable on the family, body and mind. Also, administration hates the 4-2 because the number of days we are off. I have no first hand knowledge but I was told that Weis convinced the city to switch to the 4-2 when the city wanted the issue bargained for in the contract because we work a few less hours.

2. Identifying the merit promotions and who put them in. It made the job/bosses more accountable to us.

3. Defending the lawsuits.

4. I know you dispute the rifles, but training, tactics (rifles) were offered far more when Weis was the Superintendent. I do not carry a rifle nor do I believe most in patrol should. When it first started and people were doing pat-downs with a slung rifle, it didn't work. But, I do not believe the issue of carrying rifles is pushed as hard without Weis.

Its similar with the emphasis of search warrants, executing search warrant and training for search warrants with Cline and how Hillard pushed uniform standards and fitness.

We all have opinions and from a district level, I think Weis was the best.

There are so many coppers in the hall waiting for cars in 011 that I can barely get out the door to leave. I'm not sure how long they wait, but it appears to be a long time. I remember old days it was roll call, radio room, get keys, radio, hit the street. Now it's roll call, wait, wait, wait, hour or two later, you get keys and hit the street. If McStupid would just come and take a look, he'd see it for himself--but since the waters part before he enters, he'll see a show, not what usually goes on.

These coppers will be fine. The video shows what it shows. Dude with his pants down was shot dead months ago. The female accuser is lying through her 4 teeth about her "strip search". Never happened. The coppers were walking dude back in the gangway because dude was showing them where the pack was after he decided to try to work out a deal with the coppers. He dropped his pants on his own after being asked if he had anything else on his person. All documented on the original reports. Its the coppers word and paper that actually goes along with what the video shows before they even knew they were on film. These are good coppers and genuinely nice guys. Their sgt. was on scene. Nobody's getting stripped or fired, and I doubt that anybody is even getting paid a dime. Now let the dog-asses use this incident as yet another excuse to do absolutely nothing at work. Because its incidents like this one that the lazy and miserable coppers will use as an excuse for why they would never even attempt to make a dope arrest or anything pro-active for that matter.

SCC: too harsh on Weis. 19 years of the job, by far the best Superintendent we had. I have worked in patrol for the vast majority of my career, so I do not know what each of their personalities were like or whether they were good guys, but the biggest changes to patrol for me came when Weis was Superintendent.

I have personal knowledge regarding the 4&2 schedule, so please listen, once and for all. After the pilot program in multiple districts, different stats were looked at by the city. Officers working the 4&2 took more time off than the other schedules. The city embraced this and Weis sold it as his thing for the troops. Period. The city bean counters picked it and that's why we have it.

im pretty sure I know these guys. Good guys. They are gonna stress out a little bit with this one but in the end they will be all right. These things come and go, in 15 years they will be looking back shaking their head with a smile and say, man that sucked! It will be fine for them but dont let the stress get to you too much on this one. Ive had worse myself and ended up fine. Just remember, your starting a long journey of civil and administrative hearings that will suck. You will think it will all never end. You wont want to do anything, touch anyone and will lose sleep. Don't think that there is not collusion between certain private attorneys and some members of the Corporation Counsels office. I am not saying that everyone that works for the Corporation Counsel is crooked because that is obviously not true. This has been going on for years, long before Richard M. Daley. It can be frustrating to know that the City paid out on a case that an officer feels passionate about, but often times it's the best solution to avoid the real risk of a run-away verdict, having to pay $100s of thousands in attorney's fees for the plaintiff's lawyer, and punitive damages against the officer. Anyone who's been to Corp Counsel in the last few years, especially those who have been there preparing for trial, know the hard work and dedication these attorneys have for the officers they represent. I've seen them go to the mat both professionally and personally numerous times to help the officers they represent.

I don't think so. If the Taser misfired, why did one of the 6 officers on the scene try a second time. There are a lot of unanswered questions here and don't automatically think the police handled this correctly.

well, the good thing about this video for the officers is that there is no way in hell this will EVER see a courtroom or a jury. They will farm this out to a private to get it settled in a timely manner and quietly. That is the good news, the bad news is that it will most likely be a beef and the coppers will take time.. Taking time, no big deal could always be worse. Those saying that the "coppers are gonna get indicted" are soft as soft can be. Ill bet everything I own that will never happen. If anything it is a violation of civil rights. Thats why we have the civil system, to sue for civil rights violations. Yes, officers can be arrested for civil rights violations but this wont be one of them. Cozzi was indicted by the feds because of a favor made to jfed to make him seem legitimate to the citizens. the searching officers will take 15-25 days, everyone else on the paper maybe 5-10 days and the supervisor on scene will take the same 5-10. Im gonna say this will be settled within 8 months if not sooner with an undisclosed settlement. They will definitely get alot of money though, no way around that. The city/officers dont really have a leg to stand on in a lawsuit which is why it will be gone. so at least some good news and bad news but it could have been much much worse maybe if that guy was still alive.. im sure a lesson will be learned by the officers though and hopefully by all the officers who saw the video. DONT DO THAT ANYMORE!!!

About your little article. You've obviously never been confronted by a person wielding a 12 inch butcher knife. I'd say the use of a taser (which didn't work by the way) and a bean bag shotgun was more than generous by the police on scene. If the man was holding a knife they would have been well within the guidelines of the use of force model to use deadly force and shoot him with real guns.

It's tragic that the man ended up dying but just about anyone with a heartbeat and the ability to move around is a dangerous threat with a knife. A 5 year old could kill you with a butcher knife and so can a 95 year old. You ought to know that having "spent two decades in the ghetto".

The bottom line is that you and I weren't there and we have no idea what those officers were confronted with and how the events unfolded. We can only guess. I for one am "PRO COP" and am willing to give the officers the benefit of the doubt. I'm sure they didn't wake up that morning, kiss their wives and children goodbye, and then say to themselves "it sure would be fun to kill a 95 year old World War II vet today for no good reason!"

ok ok ok. I will admit this because I know when to say that I was wrong. I went to work and pulled up the case and arrest reports. I will admit, I jumped on this right away, like right when the video and story went up and I monday morning quarterbacked it saying they were in trouble. I read the reports and I apologize completely. The coppers wrote very good paper and explained exactly what happened in the case. I do sincerely apologize for my previous negative comments. as they say in the NFL, "After further review" the coppers will be fine.. If they stick to the paper I really dont see how they can get in any trouble at all really even with the video. The paper almost tells the complete story of what you see in the video anyways. Good thing they were wise enough to write paper as it really happened and didnt make it something it wasnt because then it wouldnt have looked as good. A few minutes into the interview he says he had nothing to do with Cozzi's indictment. about 18 minutes later in the same interview he said he showed the tape to the Justice Department. Who referred the case to the FBI for prosecution? if Weiss never referred the case, then Cozzi was punished and story has a ending. Instead Weiss dug up the case and brought federal attention. Feds went for blood and a 5 year sentence in a federal prison for a charge that would result in probation in cook county. 5 years for battery of a drunk alcoholic. You cannot put lipstick on a pig and call it pretty.

People still credit Weiss with the 4-2 schedule. He had nothing to do with it. The 4-2 was designed to decrease the comp time the entire department had on the books. In the past, the City never counted our comp time in the red, since the City never considered it a debt. The City's bond rating was lowered. Comp time was a contributing factor. The department even had the nerve to tell a few members with a lot of time on the books to start checking the money box. Of course they had no right to do so. Soon after, Sgt's were allowed to sell back as much as 200 hrs a year. This benefit wasn't out of the kindness of the City's heart. If you the 4-2 schedule, and take a day off, you utilize 8 1/2 hours comp time. if you work VRI, do you get time and a half for 8 1/2 hrs? Why have they kept a couple units on the 10 hour day? it wasn't because they run so efficiently. If you want to take off a day, it's 10 hours comp time. You need to ask yourself, has the City ever approached us with an offer, a benefit, perk that was with our best interest? For those that say there are studies that site officers are more prone to make mistakes working longer hours, and the City took that into account...why do they let the same guys work VRI every RDO, and are not concerned that the long hours may effect their job performance. Give credit where credit is due...wasn't Weiss' idea.
