Pension Lawsuit Filed
As predicted by just about everyone:
- Illinois’ largest government employee unions sued Tuesday to overturn Illinois’ new pension law, ripping the long sought, landmark money-saving changes as outright “theft” from workers that won’t pass a legal smell test.
The timing of the lawsuit served as a political rebuke, dropped on the eve of Democratic Gov. Pat Quinn’s State of the State address — a noon Wednesday speech in which the governor is expected to highlight approval of the pension measure as a reason voters should re-elect him.
The suit, filed in Sangamon County Circuit Court, had been expected following last month’s passage of a bill that seeks to curb annual cost-of-living increases for retirees and to increase the retirement age for many current workers. The goal is to close the state’s worst-in-the-nation $100 billion unfunded public pension liability within 30 years.
This may decide the fate of all pensions and so-called "reform" efforts in the near future. Keep track and stay informed.

Scum-Times is reporting on the lawsuit to get the information as to who posted the faces and voice recording of police officers on youtube. Has to be a citywide team members as none of their photos are shown. Also Frank DiMaria should be thrown out of the union and out of office for impeding the investigation. He as refused to cooperate with the detective handling the case. Just another dirty trick by the citywide guys. Moriarty has to be shitting bricks now.

City will owe a $1.07B payment to the pension fund. Rahm says he doesn't want to increase property taxes by 150% which is what would be needed to fund at this level. That would drive just about every tax payer (the ones that pay) out of the city, ala Detroit.
Due to the shit credit rating (worst in the country) the city/state must pay considerably more money. And every downgrade increases that tab.
Probably everyone in or close to retirement will not be hit too hard but major changes are coming. Property taxes, city income tax, tax on pensions, who knows what else. $27B only 31% funded maybe can't be fixed.
One thing is for sure none of the freebies will stop. Phones, food stamps, healthcare...oh whats the use.

So where does the union think the money to defend against their little lawsuit going to come from? If the state looses, where does the union think the money to pay the award going to come from? It's all going to come out of the pockets of the taxpayers, out of Joe Little Guys pockets. The selfish stupidity of unions knows no bounds.
Think about who your FOP endorsed in the past elections as they come around to your roll call. Dougherty and Donahue have to go permanently into retirement before they can do any more damage.
Funny part about trying to use the SCOIL to fuck the constitution in this respect...... for the SCOIL to desperately try and find a way to go against every past ruling they've made about this subject and somehow come to the conclusion that the state can get away with this bullshit, it truly translates into: THE STATE CAN REWRITE LAWS TO ABSOLVE THEMSELVES FROM LAWFUL DEBT OBLIGATIONS, PERIOD.
What the state is seeking, is to NOT be required to pay lawful obligated debt to an employee.
They're attempting to have their buddies in the SCOIL grant them the authority to walk away from debt without the creditor having any legal recourse against them for financially damaging them.
So, what does this spell for any businesses doing business with the state of Illinois if the state can walk away from constitutionally protected debts owed? You guessed it, if they can walk away and cut benefits when those benefits are protected by the constitution, any business can be shit upon and NOT paid because the SCOIL just gave the state case law to let them walk away scot free without paying their debts.
Not to mention, this lawsuit game of filing to embarrass Quinn was a fuckup pure and simple. The objective SHOULDl have been to delay filing as long as possible into the election year, thereby fucking the legislature from putting constitutional changes on the ballot this year. But no, these fucktards think it's cooler to try and embarrass Quinn instead, that or they're playing right along with the state.
Either way, changing the constitution to let the state run away from a financial obligation of the state violates other state AND federal laws.
No judge nor legislature can grant the authority to the state to abridge their lawful financial obligations to those it owes it's debts, NONE. To grant that authority grants states the right to not pay it's debts, which no state has or can ever be given that right to abridge it's debts unless given that right by the federal government. Which then triggers a flood of "bankruptcy without having the right to file bankruptcy".
Can't happen, even if they try and put it on the ballot, the constitution can't be changed to allow the state to walk away from debt.

TO 0403 am: It's unlikely it will have any effect on our pensions. Most of the "reforms" brought about by this legislation are already in place in our Pension system and the changes will likely be ruled unconstitutional.
The FOP has nothing to do with this. You must be really naive if you believe every endorsed candidate by any union always votes their way on every issue. Using your logic nobody should ever be endorsed by anyone. These politicians help you when they can most of the time, but survival is and always will be their motivation factors.
Pension reform is coming. You are going to like it and smile. Why? Because no one here will do anything about it. The city and state will take away the pensions and all anyone will do is bitch on the computer. They will do this before taking away one penny of welfare benefits.

OK we will work with you, If the city has no money how about: no city fees for Police or Fire. No, water bills, no city stickers, no dog license, waiver on all indebtedness, any fines incurred such as parking tickets waived,that would be a start. politicians never mention eliminating the gold braid pension , all appointed ranks should be included , captains and merit sgt , lt rank .
30 % are now merit so this would greatly reduce pension obligation if 30% of sgt , lt , 100% captain and command staff received pension based on the last rank they deserved .
think about it , FOP , PBPA should be all over this idea.
Why are elected official's pensions not part of the social security windfall elimination provision like teachers, firemen, policemen pensions are? Don't say they are elected. They still get a public paid pension like teachers,firemen and policemen.
Answer: another example of democrats taking from the workers who earned it and giving to the non workers.

Why does no one pay attention to the who you know golf braid pensions. The goofs that ran this department into the ground are also promised outrageous pensions just cause they were appointed by someone they know. Since McGoof took over he has only promoted more exempts,(only to steal pensions) than anyone ever before. Yea good thing you closed districts now you have even more commanders and chiefs and staffs for them and they now don't provide any services on the street to reduce shit or answer jobs.
Scenario 1. Commander making 150,000. Pension is 105,000. Rahm had his way pension cut now gets $78,500...(very livable since they knew someone to get that. Still well over any PO's pension if Rahman doesn't get his way.
Scenario 2 . Regular police officer making 85,000 20 years pension of 42,500. If Rahm gets his way. Goes down to 30,000!!!
Until someone addresses the fact that all these golf braids are stealing out pensions it will never work under any new cuts. They will always continue to outtake what they don't put in. This same senario in every branch of government. Tons of who they knew peeps are getting rich from tax payers.
Eventually the democrats will lose hold of their free loading taking population voting group. There won't be any more left to give and only the workers will get theirs since they are the only ones paying into the governments.
Working folks will just move out and go away and leave the savages and politicians to fend for them selves if they don't make the right decisions here. (Take a look at Detroit for that scenario) and yes it could happen over night if the politicians make the wrong decisions. That's why they play kick the can 30 40 years. They plan on being long then.

The state deserves to lose, and lose big time. The state employees contributed their share to the pension plans, without fail, from every single paycheck. The state, obligated to do the same, chose not to, and used those funds to pay for pork projects, or to keep taxes artificially low. They used the pension payments to pay bills that would have required a tax hike so in essence, the people of this state enjoyed lower taxes thanks to politicians stealing pension money that was legally due to the pension plans. This went on for decades, and now people like you are blaming the unions and the state employees? While I will admit that unions get greedy, they are not the cause of the pension mess. That is ALL on the thieving politicians in this corrupt state.
To 1:35am...are you an idiot? The union didn't negotiate the original pension. That's what we were promised for abiding by the rules, ie.live in the city, wierd hours, etc. That's our reward for being banged up and broken for our service to the city. We were promised a pension if we make it to retirement age. The union was able to compress the wages and knock a few years off of our career, but the pension was promised. I hate to sound like an asshole, but, I have lost friends to the animal, seen them permanently injured and disfigured, and been through more than a handful of surgeries due to on the job injuries. So, I absolutely feel that we deserve our GUARANTEED pension. Oh yeah, we pay property taxes...so if I have to pay a few extra bucks every year...no biggie.

Pensions were promised and backed by Law. Find another way to pay up your debts, Politicians. You're the ones who spent uncontrollably and are the reason for all this debt. YOU got us into it, now YOU get us out. And keep your Lying, Thieving, filthy Hands OFF our Pensions. Remember, if they Screw One of Us, they Screw ALL of Us.

It doesn't matter. The brain dead on the South and West Sides will continue to vote for the democrats. They have been conditioned to vote for the party of the Klan and are easily led by the nose. As such, nothing will change in this state. Socialists will continue to break us financially.

The pension is more than a promise. It is guaranteed by state law. There is a whole section in the State of Illinois statutes book on pensions and one in particular dealing with City of Chicago Police pensions.
For our asshole mayor to look for a way to squirm out of paying one dime less than is owed is an abomination.
Like getting a bill at home and declaring "this is unsustainable! I don't want to pay this and will seek to have a law passed so I don't have to."
