Hey Look! Dart Does His Job
- Cook County Sheriff’s officials say they’ve filed an objection to a gang leader’s state application to carry a concealed firearm — and they’re opposing hundreds of other applications, too.
The high-ranking Latin Kings leader possesses a state firearm owner’s identification card, which allows him to own a gun. He got the card because he doesn’t have any felonies on his record, said authorities, who declined to name him.
But with the gang affiliation, the dozen arrests (including a firearm charge) and the association with other criminals, red flags were raised and an objection filed, even though Dart spent so much time whining about his people having to do work as directed by law.
Dart will no doubt make this a central theme of his reelection campaign - he prevented a gun from falling into the wrong hands.....as required by the duties of his office. You know.....his job.

Not quite true, the CCW holder MUST be asked by the officer if they have a firearm in their possession. There is no mandatory requirement to notify the officer if not asked.
FWIW, many CCW instructors advise their students to immediately advise the officer that they are licensed and in possession of a firearm. Is this really any different than stopping another LEO? Unless other factors are evident, I don't think so.
I wonder if NRA and Tea Party members will also be barred from Constitutional Rights because of their affiliation..

Just to be clear, there is only a Duty to Inform if the officer asks. If the officer does not ask, then later in the stop the officer finds the concealed weapon and makes an arrest the officer will have a big problem on his hands. This is assuming the citizen is carrying their FOID & CCL.

First, if a gang banger wants to carry a gun, not having a permit is not going to stop them. Second, if someone has never been found guilty of anything why do they lose their rights? A license to carry is not a license to kill. If a person has committed a violent crime in the past they should be in jail. You are completely WRONG. Read the law. It is up to the OFFICER to ask if the person stopped has a concealed weapon, and then again to ask where that weapon is. It's written in plain English. Read before you speak and violate someone's constitutional rights.

Food for thought. You stop a CCW permit holder. Do you have a gun? yes. Where? right here.. and they show it to you. Now this is a car stop for speeding. What right do you have to seize the weapon, take it back to your squad and run the serial number? What if they say no? What if you take the gun, and since most officers have -0- gun handling skills, crank a round off with it, hitting the motorist ( or yourself) by mistake. What justification do you have to even touching his or her weapon in the first place? I was watching Alaska State troopers on NetGEO and sure enough, they grabbed the gun from the guy.

I thought the police need reasonable suspicion to ask about a weapon in the car? If I get pulled over for a tail light, am respectful, and don't resemble someone reported of committing a crime, as the officers approach my car to ask for my license, should I just blurt out "I have a concealed carry permit and gun" so you then both draw down on me for a tail light? I am from the mind set that if I get pulled over (while carrying) act the same way I would as if I wasn't carrying. Respectful. I will fail to tell you I have a gun should you fail to ask. If you ask, you better have a damn good reason for asking.

While CPD may not have taken the initiative, at least the CC class I took included repeated and strongly emphasized instructions to immediately and preemptively state "I am a CC permit holder and I am carrying a firearm. It is located ____. My permit is located _______".

Just a quick clarification-By statute you have to ask them if they have a permit or are carrying, our statute did not go with the you are required to tell right away. Just FYI

Only partly true, which is why we need a cheat-sheet or additional training. The citizen does NOT have to tell you he is legally carrying. You must ask and he is required to tell you IF YOU ASK. If you don't ask he is not required by law to offer that information. Having said that, I'm willing to bet that the VAST majority of legally carrying citizens will offer the info before being asked.

its only an offense if the cop asks and a licensee does not disclose he or she is in possession of a firearm.
in fact the way the law is written it is not entirely clear if it is actually an offense not to disclose, or whether it is a requirement that carries no penalty for failure to do so. another feature of a very badly written law.
oddly, people who are not licensed are under no such obligation to disclose.

These are the situations you will get when you dismiss cases and send dopers to "diversion programs" and "drug courts."
If the incompetents at the SA's Office gave gang members ONE drug conviction -- even with a sentence of conditional discharge -- they'd be disqualified from concealed carry.

No, an officer's safety is paramount and protected by many federal decisions; according to the fed. most cops are killed during traffic stops.
It's a simple safety question that he/she may ask on a traffic stop in order to protect themselves. Any reasonable or law abiding citizen would oblige.
If you are carrying correctly and legally, you'll be on your way, if not, then that was your decision and you should expect some form of legal action.

The driver only has to tell if asked, but needs to be concealed and carrying. If it is broken down inoperable, not immediately accessible,unloaded, or in a locked container, they do not have to tell you because they are not in the act of exercising the permit rights and not subject to that portion.

His temper tantrums are beyond bizarre. He went off on two Sheriff's police officers at the academy for not acknowledging his presence threatening their jobs.
