CSA Suspect Released Months Ago

First up, well done to everyone who worked this case. The Detectives working countless hours and beating the bushes. The ET's recovering evidence, including a wrapper with the suspect's DNA on it, the cops responding and securing the scene. A fantastic team effort. This guy is a career criminal with quite the history behind him:
  • A man arrested for sexual assault last summer but released by a judge has been charged with the brutal rape of a 15-year-old girl as she was on her way to school in the Belmont Cragin neighborhood on the Northwest Side, authorities said.

    A law enforcement source said detectives were led to Luis Alberto Pantoja, 25, through DNA collected from a condom wrapper recovered from near the backyard where the girl was attacked just before dawn on Dec. 17.


  • Pantoja has a long criminal record dating back to 2005, with arrests and charges for theft, possession of a stolen motor vehicle, domestic battery after an order of protection was filed, trespassing, possession of cannabis, failure to report an accident involving death/reckless homicide, leaving the scene of accident, and eluding police.
This however, disturbs us:
  • In August of 2013, Pantoja was arrested for criminal sexual assault. On Aug. 29, a public defender was appointed and appeared before Judge Maria Kuriakos Ciesil, who set bail of $200,000.

    On Pantoja's next court date Sept. 17, Judge Laura Marie Sullivan dismissed the charge on a finding of no probable cause, records show. Details were not available.
Details better become available pretty quick. Probable Cause is kind of an important standard in CSA cases. In fact, with the Felony Review system, an Assistant States Attorney is intimately involved with deciding whether of not a case goes forward or gets shunted off to "continuing investigations." In many cases (and the Detectives can tell you all about it), a case is pretty much tried in the Detective Area before the 101's get typed up and sent to court with the prisoner. Probable Cause is almost a foregone conclusion at that point. This judge found none to go on, setting this animal free to commit a particularly brutal assault on a 15-year-old girl?

Someone needs to be held accountable for this. Quickly.

Possibly the victim didn't appear for the preliminary hearing? State could still rely on hearsay as to what was told to CPD at that point, but might not want to invest the time if the victim is unlikely to testify truthfully at trial. Victim could have been here illegally, could have moved, been paid off.

Vote NO for Judge Laura Marie Sullivan for retention in the future....by the way, Who is Laura Marie Sullivan??...a thorough and brilliant Judge she is Not. She released a horrible criminal to the citizens...there is no justice. The dear 15 year old could be hers next time. Get rid of Judge Sullivan...there are plenty more where she came from...off with Judge Sullivan.

SULLIVAN is one of the worst judges in the system. She almost never finds offenders guilty no matter what the evidence. She takes reasonable doubt to unreasonable levels. She can add the blood of this victim to her hands.

If the ASA in the branch court did not agree with the judge's decision of no probable cause, he/she could have waltzed the matter over to the grand jury and got a true bill.

Maybe when/if the "details" become available, we may know more.

This is NOT Judge Sharon Sullivan from Skokie, who finds everyone not guilty, it's Laura Sullivan, who is an excellent judge, married to a Law Enforcement Officer. The only time State's Attorneys put on a preliminary hearing, rather than indict the case, is when they don't want to win! The victim must have changed her story, or been shown to be less than truthful, or for some other reason the case must have gone south after charging, or it would have been INDICTED.

Judges here are elected, not appointed.

The Democrat Central Committee controls who gets on the ballot so that is where they control who makes judge. That and when there is a vacancy, they make sure a sitting judge retires mid term, then they appoint a "temporary" replacement. The temp then runs for full judge.

Doesn't matter though how they select judges, it was fixed when they appointed judges too. It will be fixed regardless. Ed Burke and John Daley sit and decide who is let on the ballot. You will never get an honest process out of them.

um, hello, they can still easily go in front of a grand jury and indict. there's a reason this was sent to a prelim and not the 4th floor. something was wrong from the ASA's office point of view. it's VERY rare for a case involving violence to go to prelims. and anyway, they just take the case to the 4th floor and indict (same day even sometimes) and the case keep going. you guys should know this.

I know there was work done on this case by the detectives, but I cannot give them the applause they are getting on the media. The offender left behind a ton of evidence that was obvious to even the man who found the poor girl. Due to the circumstances, the state crime lab rushed the DNA testing on the evidence. Basically this was a DNA hit - offender was identified for police.

What really is disturbing is - why did the detectives bring the fugitive unit in to make the arrest? As a detective, why not make the arrests yourselves?

I don't think a finding of no probable cause affects the incident being recorded on the books. Does anyone know if it does? Someone would have to go back and unfound the case, and unless there's a 'hit squad' of dets doing that, I don't think it's possible.

Although I did hear awhile back that there WERE dets assigned to go back through 'suspended' cases and unfound them after the fact, even though they weren't originally assigned to the case.

Really surprised there was no probable cause. Case is reviewed by felony review who screen out cases and demand a good case before approving it. That said with the felony review approval, the probable cause is usually a formality because it is not a trial, just a brief hearing showing the elements of the case

***Ok, there are two Judge Sullivans that we are talking about. There is a Judge Sullivan in Skokie and a Judge Sullivan at Branch 50 (probable cause). I have seen both in action; The Skokie Sullivan is the one that lets EVERYONE go and hates the police. Branch 50 Sullivan is one of our (PO's) greatest allies. She is the best probable cause Judge I have ever seen. There MUST have something CRITICAL to the case that was missed.....lets just wait and see. Now-if you told me that Judge Sullivan from Skokie was filling in at branch 50...then FUCK HER!!!!!!!!

Day in and day out who is the judge that decides the everyday cases affecting your neighborhood?
No one has a clue. There is no accountability on the part of judges. Oh yeah, they are rated by the bar assoc.
When a judge does get a little heat, they simply move them from say, Skokie to bridgeview till the storm passes.
Why are there no statistics on judges, the number of no probable cause, not guilties, etc.

Judges and prosecutors are exempt from lawsuits, inquiries, investigations and even criminal charges unless their actions are grossly and willfully negligent or malicious (that is a very high standard to meet by the way). In the meantime, police officers can be sued and charged criminally.

I would love to know the full details of the reason why she found no probable cause.

Accountability for Judges or ASA????? There is NONE! They can abuse their positions without consequence and hold no culpability in our justice system. They are beyond reproach in every capacity. They are not subject to suspension w/o pay while someone reviews their conduct in the same manner officers are treated. Losing re-election is the only punishment a judge would see, and that is no where near enough retribution for allowing a criminal go free to commit another horrendous act. She should be disbarred, unable to practice law-ever, and band from holding public office of any kind, just for starters. Criminal negligence and/or accessory to a crime should be the charges pending against her. As for ASA- the police should not have to consult them for charges. This is another asinine practice that prolongs and hinders the process. ASAs only objective is to fill their resumes with easy convictions to obtain a higher seat; this compromises their position when criminals plead guilty to lesser charges thereby diminishing punishment and taking away the right of the victim to use the full force of law for a crime. These have been major issues in our system for YEARS, and yet nothing has been done to correct them. It's time to remove the insulation from responsibility of these officials and remind them who exactly they are here to serve- the law abiding citizens.

Who is her clout? Who sponsored her when she went in front of Ed Burke and John Daley etc. for a place on the ballot? You know someone heavy did it. She didn't become a judge because of her superior lawyer skills. No one does.

You get sponsored, no doubt about it. It is all a war of clout for the slating committee. They go down there and make whores of themselves telling how much they support the "party" and how many elections they worked and who they backed and how much Democratic dick and assholes they licked.

Someone reading this blog knows, for certain.

Who is Laura Marie Sullivan's clout? Out the clout. That at least gets them scrambling around like a room full of cock roaches when someone turns on the lights.

All I could find online is that she was admitted to the bar to practice law in 1987 and has been with the Cook County States Attorney Office until she made judge, date she became a judge is unknown. She was a supervisor in the criminal prosecutions unit at CCSA.

Mick Dumke of The Reader did a story on bond court including some stuff on Judge Sullivan in the Oct 16, 2013 edition.

Anyone knows her clout, post it please.

Our court system isn't perfect but it works. Anyone on this job can be charged at a whim. Excessive force, theft, perjury even homicide are all charges that p.o's have received for decades. Some justified, but most are unjustified. When you go to court as a defendant your views change. You want a defense attorney who can work the system in your favor. You want a judge who can interpret the law fairly. You see prosecutors in a different light, vindictive and political motivated in some instances. Speaking from experience.

You use what judges should be doing and that's judgement...follow up on violent repeated offenders and maybe your results will end up better then throwing cases up right away!

when I made detective their were 1800 dicks not counting Youth Officers or the Patronage Gang Crime Specialists. I believe before the last class we had 650 with youth detectives. It got so bad we were ordered to have fugitive arrest any one we wanted or the tac teams. How can you make arrests when your getting assignments on your day off, after this cold snap sex crimes and child sex abuse jobs will go through the roof. We are just detective phone police. When have you seen a detective do a canvass for a robbery or property crime. Used to be SOP. But then we were the police, we had to make arrests, and the lowest performers got dumped back to the districts..

I had over 30 yrs when I retired from C.P.D last year, Judge Sullivan in Br. 50 is an excellent judge. she has the interest of the citizens and police office in her verdicts at all times. I can't believe she would ever throw out a case without just cause. I/F.

This crap happens so frequently in Chicago, it's absurd. You have this jagoff, you have that Viramontes prick, a career criminal, who beat two girls with a bat a few years back in 014...and the list goes on. Sadly it will continue. Maybe conceal and carry will help weed out the misfits.

Say what you will about Burge, but I suspect he may have helped these "misguided youths" find a straighter path if he had an opportunity to spend a little time with them.

As for the next election, I'm doing what I did last time; going with a well researched list. That plan doesn't always work though. I didn't vote for our current State's Attorney because of her actions relating to Richie's nephew, but I felt better knowing that I didn't help her get elected.

Obviously you have been riding the VRI gravy train too long. The fugitive unit exists for this type of crime and has the manpower numbers. The question is, Why shouldn't you use the fugitive unit? Doesn't mean they weren't out looking for the jagoff. Ju means the fugitive unit is there to help locate and arrest. Great asset.

The dics may be busy going over reports, tightening up the the case with additional interviews, interviewing additional persons, doing supps for the DNA hit, supp reports for investigation, typing the interviews and so on. You're watching too much CSI dude. Typing is 80 to 90% of the time.

I'm no fan of Judge Sullivan but let's keep this in mind...she is not a rapist, shithead is. The only blame here is on the offender.


There will be times, often, that witnesses and victims don't cooperate or flip down the line but there's nothing you can do about that. Do your job right and if shithead beats it they beat it....don't let them beat cases because of your work.

It's time to stop blaming judges when these tools beat cases. Maybe it's time we, as a department, start taking pride in our investigations and don't give judges any reasons to turn these animals loose.

I'd like to know where you work and what you do in that district or unit. I'm guessing that you really don't DO shit, only talk it.
There's no question that there are meatheads in the detective division but if you think the clearance rate is a result of the caliber of detective assigned to a particular investigation you've never actually bern involved in one.
Reasons #1,2, and 3 for the abysmal clearance rates are the shitbag witnesses and victims and the inability of the CPD, and the unwillingness of the CCSAO to do anything about it.

Reason #4 is that fact that the CCSAO's criteria of approving felony charges is based on whether they think the case is winnable in court (see #s 1-3) not whether the crime was actually committed by the arrestee.

So, although you have met great detectives throughout the city they apparently don't think enough of you to tell the truth.

Fugitive was once a great unit when it was very first created. In the initial stage they only went after actual federal fugitives, ten most wanted kind of bad guys. Then they got local fugitives. Slowly, the unit became a joke, a numbers game, locking up shoplifters on bench warrants and looking for a "gimme" arrest from other units or districts.

Sorry to offend you, but I stand firm. This poster still believes in personal investigative pride, not lying to yourself about how much work a case really took to solve, and awards are absolutely meaningless to old school cops.

Really surprised there was no probable cause. Case is reviewed by felony review who screen out cases and demand a good case before approving it. That said with the felony review approval, the probable cause is usually a formality because it is not a trial, just a brief hearing showing the elements of the case

Why do you feel the need to critique the manner in which the animal was picked up and boo boo the fact the media is giving kudos to the detectives for solving this case regardless of whether it was because of a DNA match or some other technique? Because it was a DNA match it's not worthy in your eyes of being mentioned in the paper or on the news? I'm sure you're so smart that you would have ignored the DNA match, used an investigative technique only known to you, bypassed the fugitive unit and made the arrest solo. This judge is a former C.C.S.A who prosecuted hundreds of violent gang members and always respected the police officers and detectives she worked with.

Not knowing the particulars in this case, it is premature to condemn her before the facts are known.

No doubt this was another horrific example of our fucked up criminal justice system, and someone has to be held accountable but based on her record I doubt it highly that she would let this animal walk unless she had no choice.

I'm in the D unit and we (at least in the district I'm assigned to) ALWAYS have fugitives or the mission team pick up our arrests. Part of it is numbers, and part of it is we are too undermanned to go out looking for people....let alone there is never anyone to go out with to make an arrest.

I work in a BUSY district far from the area. With everyone spread out into their respective districts, good luck finding anyone to go out with, not to mention the time it takes for travel. Fugitives have your guy within hours. Maybe this wasn't their intended purpose, but they get the job done. They've got the manpower, covert cars, shackles and the proper weaponry if need be.

I'd rather be able to solve more cases by not wasting my time looking for someone than being able to say I was the one who first put my hands on the guy. Who cares how you get the guy as long as you get him?

Who cares if the case was a DNA hit? You use the tools you've got. And it's awfully presumptive of you that the dets are lying to themselves about how much work it took. You must be the greatest det in the city, or think you are. Know-it-all, salty dog. You must be a pleasure to work with.

This isn't the police dept. or D unit of old.

Is Judge Sullivan "a legacy" jurist? In terms of judicial slating and appointments, the Democrats have a soft spot when it comes to nepotism and family trees. Judge Harold Sullivan was the presiding judge for the Skokie courthouse for almost an eternity until he was pushed into retirement.

There is one appointed judge whose
grandfathers (maternal and paternal) were a former alderman and ward committeeman over seventy plus years ago and this still translates as "juice." It is shocking how many judges have connections dating back to players who predate Capone.

We can't wash the horrific memory of his presence off 19 because he has yet to leave!!! He lives in the old 19w w/c office.
And yes, he and other worthless, spineless turds like him will always get ahead. That said he has to look at himself in the mirror and know how far and wide he is hated, maybe one day he will have regrets.
Oh and about the lazy slobs in 19? Not all of us are lazy slobs here, just like you are probably one of the few in your (lucky) district.

Why I pass my arrests off to guys in the districts and units. I do not get credit for arrests, I get credit for closing cases. So, if I can give a officer a easy pinch and let them get credit for it, why not. Fugitive apprehension gets involved usually based off of our investigative alerts or a request is made by the lead detective. I never do a investigative alerts until the guys I have given the offender info tell me they have exhausted all leads. I call it looking out for each other, not laziness. Maybe stop in and see the detectives once in awhile and maybe you'll get thrown that bone some day.

My experience with the criminal justice system suggests there were problems with the August case.

Normally, in Cook County, the determination of probable cause in sex and murder cases is made by the grand jury rather than a judge at a preliminary hearing.

The grand jury proceeding is secret, and the witnesses are not subject to cross-examination by the defense. Whereas, the preliminary hearing is open to the public, and the witnesses are subject to cross.

When the prosecution proceeds to a preliminary hearing in a sex or murder case, normally, there is a problem with the case, probably a big one.

Here, after a finding of no probable cause, the prosecution could have presented the case to the grand jury. That is, if the prosecution felt it was a viable case.

However, I was not there so who knows what the problem was.
