We've seen some really dumb reasons for lawsuits before, but this one takes the cake:
- A former officer in the Chicago Police Department’s news office has filed a lawsuit alleging she was unjustly transferred out of the department after she reported that another officer yelled and swore at her during a workplace confrontation.
Laura Kubiak, now a patrol officer who worked in the Office of News Affairs from 2000 to 2013, filed the suit in U.S. District Court on Tuesday against the city and two of her former supervisors.
The suit alleges that another officer in the division accosted her without provocation. When Kubiak reported the alleged assault to her supervisors, the other officer was not disciplined, while she was transferred to another, more dangerous, position as a patrol officer, she claims.
Um....wasn't that what you were hired to do? The fact that you managed to land a cushy gig for half of your career instead of doing what you were hired to do in the first place strikes us as some bizarre sense of entitlement all the way around. Gathering newspaper clippings, writing press releases, and answering calls from the media seems like intern work, not a job that pays $86,000 a year.

- On Wednesday, city officials said they stand by their actions.
"The City believes the evidence will demonstrate that the decision to return Laura Kubiak to her previous assignment was a valid personnel decision in line with CPD's efforts to civilianize the department and put more officers on the street," a spokeswoman said in a written statement.
And this is playing out as you probably expected:
- Kubiak went on leave shortly after she lost her News Affairs post, her attorney M. Megan O'Malley said. Once her leave ends, Kubiak is planning to retire because she feels the incident has damaged her career, O'Malley said.
"She's not just a police officer, she's a resident of the city," O'Malley said. "As a private citizen she is concerned about this pattern of retaliation. Being a police officer doesn't give someone a free pass to violate the law. It's unfortunate that the city chose to protect the officer that assaulted her and punish the victim."
Punished? No pay was lost. No benefits were denied. You are still getting a pension (not really earned though). You get treated far worse by citizens when you work the streets.
You serve in News Affairs (and most other Units) at the whim of the Superintendent or political-powers-of-the-day. In fact, Officers give up numerous contractual protections to go there. You have no right to that spot, and certainly no expectation of keeping the spot once you get on bad paper with someone heavier than you. It's part of the game.

Hearing this young ladies sorrowful story of unjust loss of position and ill treatment almost reduced me to tears. The poor poor soul. I wanted to weep.
I am an officer with a simular situation I work In a unit and was a very hard worker. I was passionate about my job and really enjoyed what I was doing. I tried to bring some work related problem to my supervisors about my collages and found myself being singled out, verbally attached everyday and even isolated. I was counseled on various petty things, given a horrible review and placed on some behavior program for problem workers.needless to say I am back in patrol working a bt car. I do not have a problem working the street but I do have a problem for being bullied by my supervisors and my peers. I tried to do what was right and nepotism and clout won in the end. I did not follow through with a law suit as planned but after hearing this story and many others that have come to light I am thinking that it might be time to see an attorney because this shit needs to stop. Being wrongfully launched from my previous unit for doing what is right being a squeaky wheel, rat, whistle blower, etc proved to be the Reason I ended up in the position I am in. I wish this officer luck but know how this city and department work. I am sure she will be dragged over the coals. It really sucks to think that having juice takes precedence ofer doing what is right. Pathetic!
Changing the subject a bit, but what about that new computer the CPD has developed that predicts crime and allows us to nip criminals in the bud. It is revolutionizing police work.

Read the entire complaint posted on WBBM News Radio. States Kubiak and colleagues have previously complained about his rage and there were witnesses. Zala ran toward Kubiak and Perez, yelling, swearing pointing his fingers in her face and finally swung at her. Kubiak reports incident to supervisors who did did nothing. Finally one month later there is an IAD complaint, which was sustained against Zala. Within days Kubiak and Perez were sent back to districts. Zala still working in News Affairs.
Complaint states Zala had excessive force lawsuit against him. That lawsuit cost taxpayers $155,000. Complaint mentions Jose Estrada, also had excessive force lawsuit against him. His girlfriend was sprayed with water from a fire hydrant, which cost the taxpayers $50,000.
Imagine how I felt after working on a team for 6 years(3rd highest in arrests) and became pregnant, only to be dumped after I had my baby.Before all you cynical pricks chime in,I was not on maternity leave half my career, this was my first and last child during my 20 yrs with the CPD. I entertained the thought to complain to the EEOC, but decided against it for many reasons.Four and the door for me,good luck and good riddance.

The new guy has no clue what he was or is doing and but he still got his guys in. Now the unit is a shell of its former self with a lot of misfits in it, but life goes on. Get over it, and go back to being a working police officer.

I worked the south side my whole career but did get a six year respite in a good spot that came out of doing good work and being appreciated by a good boss who rose up the ranks. Right or wrong, you decide. But it did come to an end and I was sent back to my district and my thoughts were, "Hey man, Helluva good run"!!!! Was forever grateful.

Only spots you can count on are bid spots, and even then there's always someone with more seniority who can bump you. Personally, I dont see a reason for wasting personnel on liaisons to the media- that's what we pay a superintendent 300k to do. I was a journalist for nearly 15 years, joined cpd, made less than 40 percent what laura makes. And I was a competitive writer who could get a job in the real world writing for magazines that grossed tens of millions in revenue. Laura could never keep that pace in the real world. They would set the dance music too fast for her! I spent all my career in a beat car and enjoyed all of it. Working patrol was a rich, fulfilling and gratifying experience. She should realize that one door closes, another door opens.

If a judge hears this case it opens up the debate for "hazard" pay, any officer assigned and working in any street capacity should receive extra pay. Why should the house mouses and personal assistants of the department receive equal pay as someone who is actually out in the street being the police?
I always thought that the CPD had a spot for everyone. I never complained about the desk dollies, etc. I was ecstatic anyone else wanted or was chosen to be inside so I was never the "volunteered" female for it. I might have gone postal. But I do think there are too many officers, and probably supervisors, that never actually worked the street for any length of time, or even made a felony arrest. Something is definitely wrong with that. And, quit complaining. If the job is so bad for you, just find a new one or retire.

Some people who have never sued the city and always are yelling for someone to sue, really do not understand the process. It is expensive to start ( you pay expenses) and can easily cost you 10 grand up front. You have to find an attorney who will take the case on contingency or you will pay a lot more up front. Then, your entire past is exposed and laid out for close examination.Things are put in a bad light for you and put out of context. Then, if you lose, you pay the expenses of the city which can run 15 grand or more. It is a taxing and stressful endeavor and should not be taken lightly. Minorities and females stand a better chance then white males who are looked upon as entitled not disadvantaged.
The city should start some sort of mandatory rotation system so officers like Kubiak rotate from these cushy jobs to street patrol every year or so. That way a lot more people would get the opportunity. However, the best way would be to do what the Wisconsin State legislature did to the state patrol. They mandated by law how many inside jobs and what they are that can be filled by sworn officers.
In reality, she is now making more money.
She now gets holiday pay, court time, pay for details etc. Also, the parking is esier in the districts ( for the most part )
She should be thanking her boss for letting her enjoy some of the perks of the job, just like the rest of us

My HRI made 10 years while we were at 1300 W. Jackson. She told us shed spent 5 years there at that point. She stuck around even after Cline cleared house.
Imagine that. Most of U'r 20 years as a gym instructor and then U bounce? No rough neighborhoods, weekends and holidays off, and a normal work schedule.
This is like what goes up, must come down type thing. Coppers take these gigs full well knowing they're gonna get dumped sooner or later. When that happens though they want judges to give them they're EZ gig back.

Workplace violence is a zero-tolerance issue. But, citizens should know, even if the officer wins in court, there will be no discipline for the supervisors, command members or civilian bosses that failed to log her complaint and, instead, moved her out of the workplace. It is how the CPD 'doesn't' work.

While I'm sorry she was bothered by some ignorant guy in her office (and a lot of us have been through it), her mistake was not suing HIM. But she has suffered no financial harm by being transferred, whatever the reason, so she has no standing. (retired female here)

You must not be the police or you would know that in court cases that usually doesn't come out unless it directly affects the allegations. You must be watching too much TV. Usually a shoplifting case or a funeral case from years ago are not pertinent to this case and will not be allowed.

I am an officer with a simular situation I work In a unit and was a very hard worker. I was passionate about my job and really enjoyed what I was doing. I tried to bring some work related problem to my supervisors about my collages and found myself being singled out, verbally attached everyday and even isolated. I was counseled on various petty things, given a horrible review and placed on some behavior program for problem workers.needless to say I am back in patrol working a bt car. I do not have a problem working the street but I do have a problem for being bullied by my supervisors and my peers. I tried to do what was right and nepotism and clout won in the end. I did not follow through with a law suit as planned but after hearing this story and many others that have come to light I am thinking that it might be time to see an attorney because this shit needs to stop. Being wrongfully launched from my previous unit for doing what is right being a squeaky wheel, rat, whistle blower, etc proved to be the Reason I ended up in the position I am in. I wish this officer luck but know how this city and department work. I am sure she will be dragged over the coals. It really sucks to think that having juice takes precedence ofer doing what is right. Pathetic!

Other than that if you work somewhere and try to screw over someone with more clout or let's make it simple and say if you try to screw over someone who is liked more than you are, you will not win. It's true in the private sector and true in public sector. No one owes you anything. You do not have a right to a fantasy work environment and all you are doing is making enemies. Even if your nemesis was an officer who had beefs before, there is no rule that says that you must be kept and they must be launched. Perhaps they bring something to the table that you don't? The employer has the obligation to make sure the parties aren't working together. Looks like they did. Don't see any damages that occurred. It sounds like the Dept protected her against more work place violence. She should be more grateful.

Workplace violence is a zero-tolerance issue. But, citizens should know, even if the officer wins in court, there will be no discipline for the supervisors, command members or civilian bosses that failed to log her complaint and, instead, moved her out of the workplace. It is how the CPD 'doesn't' work.

25+ years ago I looked at joining a western department. On the application there was a signature line that had to be signed that you acknowledge that police work has inherent dangers. Another one that it is a 24/7 operation and that you may have to work irregular hours.
This is a joke, right? She forgot what the job really is. Because she it too easy for too long.
Real police laugh at danger. They don't see themselves as the one at risk. It is the person causing the trouble that is the one in trouble.

There are officers qualified to work in some of these unit positions and they deserve to be treated with respect and not like second class citizens. The problem I found with working in units is that certain clouted individuals think that they the can do whatever the hell they want because of who they know. They brag about who they know all the time and seem to zone in and harass the members they know have no juice. I am in patrol but have had the opportunity to work for many units throughout my career. I loved the job I was dumped from but knew that in time I would probably be sent back to patrol. I do miss the two to three hour lunches every day and all the overtime. Oh well, all good things come cc to an end. I did not sue or file a beef. Why bother, we all know how this system works. I consider myself lucky to have had the opportunity to learn new skills and work in areas of the department that many non clouted people will have the opportunity to work in. Until the corruption is put into check and the clouted system is dismantled things will never change. I will be long gone by then and I could care less at this point because my time here with CPD is almost up.

Not sure who is confused or not telling the truth. But a check with the BGA shows she is getting paid $86,130, the pay of a 25 year officer If she was in the 95 class she would have less than 20 years on so how could she be making pay for 25 plus
SCC I usually agree with most of your positions, but in this case I don't agree with you.
This officer was assaulted in the workplace and the determination was upheld. She shouldn't have been the one launched to a less desirable assignment. The person who initiated the confrontation and assaulted the officer should have been given the heave ho.
Let's examine this under the prism of an applicable scenario in private industry. A more senior female is assaulted by a less senior male in the workplace. Female is removed from her position and placed in a less prestigious position, more distant location and with less desirable hours. This is a straight forward case of sex discrimination.
The city claims that she was put back on the street as part of a "reorganization" but if she was the only one "reorganized" immediately after the sustained complaint, it's illegal retaliation.
The impression that I got was that the City condoned workplace violence and placed the blame and responsibility on the wrong party.
Not too long ago you posted a lawsuit brought by an officer who was singled out for punishment. He was singled out by his superiors and micromanaged. He was forced to walk stairwells in public housing complexes and sit in between two high rise public housing complexes. The same callous disregard "hey you're the police deal with it" could have been applied to him too.
Just like there is high crime in some districts, it's still more common for men to assault women. Call me old fashioned in this respect, it always makes a man look bad if he was not defending himself.

Everytime Laura called the D unit for information she was always on top of her game. Most pleasent person I ever spoke to.
It seems good people that make the bosses look like no nothing fools get dumped. Not the first time a patrolman that knows ten times more then the bosses got dumped. They used all her skills and paid her back with a dump.
This is the norm with CPD. The bosses make tall $$ and use the bright people until some one calls out a slug.

Okay, I don't know her but I do know you need to have tough skin to survive this job. There are some really fine individuals on this job but they are few and far in between. You have bosses who get a kick out of screwing with people, the back stabbers and gossips, hot heads and bullies, it can be a hard road for some. We once had a new officer leave the department because he spoke with a lisp and of course the jackasses had to torture the guy. Yeah I know, people will say he should never have come on if he were that soft but as so-called adults you would think we would treat each other with common decency. 17. In or around 2009, Officer Veejay Zala (male) was detailed to the ONA.
18. In or around this same time, a member of the Chicago community filed a federal lawsuit against Officer Zala accusing him of, inter alia, battery and excessive force.
19. Defendant City of Chicago denied the allegations and defended Officer Zala in
federal court and the case ultimately went to trial.
20. A jury found Officer Zala guilty of battery and excessive force, among other things.
21. Officer Zala was detailed to the ONA during the trial of the case against him and when the jury found him guilty.
25. Throughout his detail with the ONA, he often lost his temper and directed his outbursts toward his colleagues, and more pointedly toward females, including Officer Kubiak.
35. Other ONA employees witnessed Officer Zala’s assault of Officer Kubiak.
36. One employee who witnessed the assault later expressed to Officer Kubiak fear that Officer Zala was going to pull out his gun and shoot Officer Kubiak.
37. ONA Officer Robert Perez most directly witnessed the assault, as he was with
Officer Kubiak when Officer Zala came at her.
41. On or around November 12, 2012, Officer Kubiak requested a meeting with Defendant Biggane to discuss the incident. Defendant Biggane responded that she was too busy.
42. Officer Kubiak continued to thereafter request a meeting with Defendant Biggane to discuss Officer Zala’s assault. Defendant Biggane continued to respond that she was too busy.
43. On or around November 27, 2012, Officer Kubiak went into Defendant Biggane’s
office and again asked to discuss the assault. Defendant Biggane again refused.
44. It was clear to Officer Kubiak that Defendants Stratton and Biggane did not want to discuss, and did not want her to further report, Officer Zala’s violent and unlawful conduct.
45. Nevertheless, on or around December 3, 2012, after failing to obtain a meeting with Defendant Stratton or Biggane, Officer Kubiak submitted a memorandum to Lieutenant Biggane complaining of Officer Zala’s assault.
50. Officer Robert Perez also provided a statement to the Internal Affairs investigators in or around January 2013, corroborating Officer Kubiak’s complaint against Officer Zala.
52. Officer Jose Estrada, like Officer Zala, had also been a recent defendant in an excessive force lawsuit that went to trial.
53. He too was found guilty of excessive force by a federal jury.
54. He too was rewarded with a detail to the ONA.
55. In or around mid-February 2013, Officer Kubiak was verbally informed that her
IAD complaint against Officer Zala had been sustained.

You are confusing 'assault' with 'battery'. She claims she was verbally assaulted, from what I can see. A battery is physical contact. That is not what she alleges.
You are also confusing being punished by being made to work UNUSUAL and CONTRIVED assignments with being ASSIGNED TO ROUTINE PATROL, just like the other nine thousand patrolmen on the Department.
And, then there's that little tidbit about being assigned to a 'dangerous' district? But she lives in that dangerous district. It's safe enough to live in, but not to work in?
No, this is not like workplace violence in the private sector. The devil is always in the details. There is a culture within the CPD which dictates certain 'favored', or clouted, or connected, or related, females, in particular, are carried from the moment they leave the academy. They are coddled, catered to, privileged and they believe they are ENTITLED to it. When it is minimized or taken away from them and they are treated exactly like the mere mortals who work the streets, they DEMAND it be returned to them.
And that is what we have a problem with. NOT that she reported her coworker's actions.
The bosses should rotate all jobs...three years and out...to include detectives, TAC, narcotics etc....what makes these juice babies so special

She was harmed by her co-worker being a completely out of control misfit and making her workplace hostile. Furthermore she was reassigned to a less desirable shift and prestigious position only because of this incident. Meanwhile the out of control male employee goes on his merry way. That's how she was harmed.
I've had a few out of control men vent their spleen at me on my City job. The cowards target women because they know the likelihood of getting knocked on their ass is nil. I'll add that male employees should not have to endure this either.

It sounds to me like working a beat car in a district is a much safer assignment than that Office of News Affairs. That office is full of crazy mo fo's. Are any of them former postal employees? Hell no, give me a beat car!

She was in the Training Academy for 9 years; some people are slow learners. Lots of people sat next to her in those 9 years.

She will never work one day in a beat car. After years out of patrol, she wouldn't have a clue what to do. She'd be lucky to find the transmit button on the radio.
When she comes back from holiday, leave, vacation or whatever they are calling it, she will either go on the medical for a while or simply retire. She will get at least 72.5% pension. Likely her take home pay will increase and she won't have to come to work. I love this country!

She's a police officer....she should have Filed Charges at that Point and had Perez take the Mook into custody.
They used all her skills and paid her back with a dump.
This is the norm with CPD. The bosses make tall $$ and use the bright people until some one calls out a slug.
750 K sounds like a good settlement here.

Who is his juice ? Look no further. He is a member of the Alpha Girls and WTA. Our CEO has his back.
Laura refused an offer by our CEO to run PR for WTA. That was when our CEO was writing policy and keeping the command people in line.
Just last Jan, our CEO tuened down the hall with a six figure salary to come back part time as a head of a new policy making group.
WTA will be trading soon on the NY stock exchange.

The problem is the bosses have lost control of the troops. Oh they will still fuck with the unclouted, most of all the white guys, but put a little juice in or some 0-something and they start getting nervous.
Im thankful for the steady paycheck and all the good people Ive met thru the years but this really is a lousy organization to be hooked up with.
You young coppers build a good family life and base your life around them. Not this outfit.

She was harmed by her co-worker being a completely out of control misfit and making her workplace hostile. Furthermore she was reassigned to a less desirable shift and prestigious position only because of this incident. Meanwhile the out of control male employee goes on his merry way. That's how she was harmed.
I've had a few out of control men vent their spleen at me on my City job. The cowards target women because they know the likelihood of getting knocked on their ass is nil. I'll add that male employees should not have to endure this either.

Prestige? Really? You're going to boil it down to prestige? I'm trying hard not to laugh. It's a payscale. All police OFFICERS get the same pay, whether they are assigned to news affairs or a beat car. Prestige is an artificial concept, meant to mollify, not financially compensate.
Yes, I've had my share of pompous asses as coworkers, too, in beat cars and in units. But never did I cry about my loss of PRESTIGE when I was reassigned! Oh. My. God. Prestige. Now I've heard it all.
And please don't tell me how I don't know how it is to be a female in this male-dominated profession. Female retired sergeant here. Been there. Lived through that. Never sued for loss of PRESTIGE. You make your own prestige. You don't sue to get some.
