"...not a violent person..."

  • The wife of Mayor Rahm Emanuel stood in a juvenile courtroom Monday and listened to an 18-year-old man apologize for punching her teenage son in the face and stealing his iPhone in a brazen mugging across the street from the Emanuel family’s home on Chicago’s North Side.

    Phillip Payne, who was 17 at the time of the Dec. 19 attack, pleaded guilty to theft and the aggravated battery of Zach Emanuel during a hearing attended by Amy Rule, the mayor’s wife. But Zach Emanuel has said he was jumped from behind by two people — and Chicago Police say an investigation into the second suspect is ongoing.

    Cook County Judge Lori Wolfson sentenced Payne to three years of probation and ordered him to perform 50 hours of community service. He was told to stay away from Zach Emanuel, was given a 6 p.m. curfew on school nights and could be held in custody up to 30 days if he violates his probation. He is supposed to stay away from drugs, gangs and guns, and he must work or pursue an education.

    [...] Wolfson said she thinks Payne understands “this is the last opportunity he’s going to have as a juvenile.” During the hearing, the judge expressed frustration when Payne’s public defender told her that Payne gets good grades in school.

    “You are capable of doing well in your life,” Wolfson told Payne.

    The judge later added, “Phillip is not a violent person.”
We're going to have to remember that one. Jumping someone from behind, putting them in a choke-hold, forcing them to unlock the iPhone, and leaving injuries serious enough that a personal physician was summoned to make a house-call in the middle of the night, doesn't qualify as "violent."

We shouldn't be surprised, seeing as how money-grabbing speed and red-light cameras qualify as "for the children" except when politically expedient to turn them off and a wedding dress in the crawl space qualifies as "residency."

Anyone else thinking Rahm didn't push for an actual prison sentence in case it cost him votes?

He is getting good grades, but really really needed an i-phone and could not afford it. Also he is not really violent, he could have hit the Rahm boy over the head with a lead pipe, a hatchet, or even shot him to get the i-phone. Now thanks to the judge, he will work hard to turn his life around and obtain a PhD in astrophysics. Isn't Chicago a wonderful place.

When Philip performs 2 rapes and steals 3 cars over the next few years, we'll remember the judge saying he's not violent. Because those are not violent. One involves a misplaced sign of love and another just involves property.

The judges at Juvie court are all like this. This is why we have the problems in this country that exist today. These kids are never really punished, or even really held accountable, when they're juveniles. They find out that there are minimal consequences. When they be one adults, they already know that not much happens when you get caught doing something wrong.

Maybe parents should be parents, and watch their kids, make sure they abide by curfews, and are disciplined properly no wonder crime is out of control!

Naw. Rahm would never pander to the criminal underclass just to keep his office. Nor would he ever throw his family under the bus by negating moral lessons about good/evil, crime/punishment for mere political expediency.

...or maybe that IS the lesson he's passing along here to the next generation? After all --

According to Chicago police, Zach Emanuel was talking on his phone on that Friday at about 10:05 p.m. across the street and a few houses down from his family's home in the 4200 block of North Hermitage Avenue when two males came up behind him. One of them "placed his arm around the victim's neck in a rear chokehold," and the second one hit the teen, knocking him down, according to a police report.


If the kid was talking on the phone to the college counselor, why would he have to unlock the phone for the robbers? Something is not quite right here.

When I was on the job I always enjoyed being the one who partook in the "right of passage" moment when my arrestee had just turned 17 and could be sent to the lockup and then be transferred to 26th St.

How is he charged Agg. Battery? He was punched, and maybe choked a little, but charged with Agg. Battery? Anybody can be charged Agg. Battery if it happens on the public way. Why is it that only when the mayors son gets punched or it is a politically worthy case does the so called offender get charged with Agg. Battery for which amounts to a Simple Battery? Abuse of power! Why do they get to pick and choose which offenders will be charged with the felony based on politics. It should be all, or none. Think about it.

Interesting how quickly this case was adjudicated. Second offender still at large? Why is that? Apparently the second offender is known. No hurry to apprehend or charge him. Why is that. Maybe we will find out after the election.

As to the judge saying he's not a violent person. Reminds me of Gacy's mother who said "He's a good boy."

Even Judges hear and say what they want to hear and say. Ignoring the facts of the case and hoping they will turn their life around is delusional and wishful thinking.

This kid, now an adult will be disciplined by the police in some confrontation that may not be so forgiving. This slap on the wrist by this juvenile judge and system will not be remembered or even brought up when this confrontation happens. Just another statistic of police using excessive force because the juvenile system is a failure. Its a failure to the juveniles and to the public which is victimized by the juvenile delinquents that are thrown back into society without ever being disciplined for their numerous offenses as juveniles. This juvenile should have been charged as an adult and seen real jail time. Not probation for this aggravated robbery. Oh I forget this is the mayors son and an election is going on. If that was my son I would want the offender prosecuted to the full extent of the law. Three years probation is not the full extent of the law. he punched the mayors son in the face and took his cell phone and the kid can laugh about it now. What a pussy father Rahm is. Disgusting politician.

Rahm doesn't think clearly when he's under duress. That's obvious at live press conferences, when he stumbles all over his words and barks at the reporters and stalks away. He didn't think this 'story' through before telling it to the police.

Now, he just wants it to disappear, because all those discrepancies make him look stupid.

He is in GED school. 5 more years and he has his GED. Then, on to Malcolm X College to study reading, writing, arithmetic. He may get to the equivalent of the 8th grade level of a private school with years of schooling and hard work. In between periods of probation, this time we really mean it probation, and double secret, really now, don't do it again probation.

Judge Wolfson is one of the best judges at juvenile court . Stuff like this is usually the result of a plea deal .The other thing here is the obsession at juvenile court and Cook county with disproportionate representation and detention alternatives .Every effort is made to give delinquents second, third and fourth chances and when they screw up , they still don't want to lock them up.Many of these kids have many police contacts before they even get into court on a case .Now that the law has changed to make them juveniles till they're 18 , it makes it even worse.It's really difficult to work with a 17 or an 18 year old who has had 20-25 police contacts before they're finally convicted and placed on probation., they're not in school and are heavily gang involved. The buzz word at juvenile court should be early intervention, get these kids when they're 13-14 and you have some chance with working with them.You're not doing them any favors by no filing, adjusting , diverting or screening out case after case, and then expecting probation to straighten them out when they're 18.

It's not a CPD change it's a state wide thing. Even with adult charges they'll keep them on Hamilton and move them to 26th after their 18th birthday.

My kid got robbed should I (A). Condemn the thug teen who did this or (B). Yes. And for the same reason Rahm ordered 3 snowplow passes through Logan Square for an inch-and-a-half of snow about 2 weeks from the election. It couldn't save Ald. Rey "Stumbles" Colon though.

Was this kid given too much of a "second chance"? Did Rahm somehow cut a deal - "take the rap and you will get a "nothing" sentence"? (just to get this out-of-the way?)

This is all conjecture, where is the proof?

It sounds good, but can you prove it?

What if this was your kid? Wouldn't you want him to have a "second chance" or would you want him to go to Stateville for five years to teach him a life lesson?

"We need compassion in the courts."
Said like a real connected, Alderman, Cop, Fireman, Lawyer, Mayor, and everyone else (who has clout).

If you have "clout", you get a pass. With others, "justice will be served."

In this case, some lowlife "gets a pass"???? That doesn't add up in court - except in Cook County Court where some "influence" must have been used. A phone call? A deal?

You can smell "clout" in this case for the criminal. But WHY?

2.) They couldn't have Zach testify. He couldn't tell the truth. He would have to perjure himself.

The Emanuel family made this a public issue. When your kid screws up, and embarrasses you and your political office, maybe you should keep it private.
