IPRA Re-opening Cases

  • It's been 100 days since Sharon Fairley, a former federal prosecutor, was appointed to head the Independent Police Review Authority (IPRA).

    Mayor Rahm Emanuel appointed her in December amid the protests that began with the release of the shooting video of Laquan McDonald. Wednesday Fairley announced a number of new reforms for the agency.

    Fairley has been spotted on scene at recent incidents in which police officers fired weapons. She introduced her team of investigators, attorneys and community liaisons at a press conference, as well as announcing changes to how the agency reviews allegations of police misconduct.
And what else?
  • A team of former prosecutors, some from the Chicago area and some from other parts of the country will randomly select 20 to 40 cases to review. While they are all closed, Fairley says she will make changes or take action if there is cause.

I'm going to make every effort to keep my weapon holstered and not take it out unless absolutely necessary. I will take take care of my police duties in the most safe manner possible. I am well aware that if I discharge my weapon the State Attorney, IPRA, DOJ and the fine members of the "community" I strive to keep safe will make every effort to put me in jail. In the mean time, the person upon whom I discharge my weapon will be heralded as a pillar of the community who should be afforded every benefit of the doubt due to his (it is usually his) inauspicious upbringing.

what about the group of retired officers that include such famous crime fighters as Patricia Hill, Richard Wooten, and a slew of others, who are bending the DOJ's ears? Maybe the DOJ should pull up their activity records and make sure they really were not police impostors. I believe the records will show they were, and their agenda is simply we want everything run by people of color.

No such thing as random...
Specific officers with more then one shooting incident or lawsuit will be targeted...
Specific detectives who handle the police shooting or have more then one lawsuit, who they have a hard on for, will be targeted.
And,,, I mean targeted... These officers and detectives have had bulls eyes on their backs for years and here is the city's chance to go after them.
FOP should be notified of each case that is being re-examined and track to see if specific officers are being targeted
It should also be spelled out if the cases are being re-opened just for training purposes or will discipline or criminal charges be sought based on new findings.

OT - I'm surprised to see that yesterday's IL SUP CT decision on the pension case wasn't your lead story.

As a Republican, I was actually sorry to see the City lose this one. But as an attorney, I am here to tell you that that case was correctly decided as a matter of law. What does "shall not be diminished or impaired" mean. It means exactly what is says. Duh.

Grab the lube baby, cause that great big locomotive of Democratic taxation is headed straight for your brown eye.

If this isn't enough to send cops into orbit over the residency requirement, I don't know whatever will be.

Just my opinion but that doesn't sound exactly kosher.

Granted, the political atmosphere (that is, the politically correct atmosphere) today is that police don't have the same Rights as citizens OR criminals. Be that as it may, Fairley's statement *seems to violate* that U.S. Constitution thingy, the Fifth Amendment to be precise.

Here's the relevant part: ......

Ergo, since the cases are all "Closed" those involved have already faced 'jeopardy'. So contrary to the wishes of whiny libtards and the 'catered to constituency', there are no do-overs in the USA. You get one bite at the apple and that's it -- period, end, stop.

Doesn't this decision set a precedent for our diminished benefits?? Especially the outrageous increase to retiree health care for officers who want to retire prior to 55! Family premiums went from $800/month to almost $2300/month in the last 3 years! If that's not considered in the category of "significantly diminished promised benefits" I don't know what is! This needs to be addressed quick! Because we all know 55 insurance option will gone probably on the next contract....

If you don't agree with an FOP appointed attorney you have the right to hire your own and have the lodge pay, so long as that attorney is willing to earn the rate all FOP attorneys agree to get paid.

With that said, be careful about paying for your own advise and counsel. Some attorneys will tell you anything you want to hear as long as you're paying them. I've known many officers who were either dead wrong, stupid, or too arrogant to just accept the fact they fucked up. Instead everyone else is the enemy instead of mitigating the damage.

Lastly, you should always get a second opinion. I laugh at coppers that endlessly shop around for a deal on an automobile, but when it comes to their profession and freedom, they ask the cop sitting next to them in a squad car.

I empathize with you on many different levels. I have been down your road over the years of my career, now retired. The rigged tests, answers given out, secret code words, secret study groups etc. etc and on and on. Frankly, no one outside of the department really cares. NBC and the BGA did an expose on the rigged 1987 lieutenants and sergeants exam and the evidence was overwhelming that they were rigged. No one cared. The federal courts approved the " merit selections" despite all of the evidence that they could easily be rigged as they were in Atlanta and Detroit. And, look at what the merit promotions provided? Just about the entire command staff of the department are " Merit" promotions. No one cares, period and no one will ever do a damn thing about it. It is my opinion that these rigged promotions and political patronage is what really has done in the department and killed morale and the incentive to ever do any work. It has contributed to corruption and coverups, incompetence and wasteful management. No one cares

Hahahahaha - this statement is pretty much the truest thing I've ever read on the blog and that says a lot because scc hits the nail on the head pretty often. These impostors' careers were complete jokes. Everyone knew it then, everyone knows it now. DOJ is interviewing some of the laziest, most utterly useless "cops" that have ever put on the uniform.

The FOP is for sure in bed with city and not out to help. Example Being that in regards to Dean Angelo. In Dec of 2013 Chicago police started the "Sworn Limited Duty Program" where officers who are unable to return to full duty and unrestricted police duty can return to work in a limited capacity provided they can do all 4 requirements below.
Safely handle and Use their firearm
Walk independently without the assistances of crutches or canes
Safely arrest a person who is actively resisting
Drive a vehicle

This example speaks volumes about the FOP and the President selling us out.

That's not exactly true. The Black Caucus has publicly stated that they want to speak to ALL of the candidates, and that they are not supporting ANYONE. Williams does not have many friends within the caucus. They don't particularly like any of the black exempts. Since the McDonald video has surfaced, the caucus members feel betrayed by all of the Black exempts, since it's likely that many of them knew of the existence of the video but did not share that knowledge with members of the caucus. Now that Rahm is in the proverbial shithouse with the Black community (and the caucus), they are beginning to flex their newly found political muscle in a whole lot of new directions.

Why nothing about the IL Supreme Court ruling from yesterday?

Doesn't this decision set a precedent for our diminished benefits?? Especially the outrageous increase to retiree health care for officers who want to retire prior to 55! Family premiums went from $800/month to almost $2300/month in the last 3 years! If that's not considered in the category of "significantly diminished promised benefits" I don't know what is! This needs to be addressed quick! Because we all know 55 insurance option will gone probably on the next contract....

Those in the know, please explain.

Funny you mention this, because I was just thinking about this exact topic the other day. Poverty in correlation with crime in America and 3rd world countries. It's quite funny when know-it-Alls bring this example up. Well, in Africa, something as simple as stealing a chicken gets you a tire around your body, a lighter fluid bath, and a chance to borrow a lit match.

It's actually not hard to follow, unless your education is from some backwards school system like Texas: poverty leads to crime, that leads to more crime which leads to more crime.

Example: billy is poor(that is poverty), billy decides to sell what Nancy Regan told him to just say no to(that is crime), billy is robbed(his crime led to another crime), billy shoots robber a week later(Billy's crime led to a crime being committed unto him and he committed a crime unto his crime'e). Billy is then shot by the robbers friends in retaliation.

That is your lesson in poverty leading to crime. Sure, if as soon as people are pulled out of their mothers vagina they go right to college, graduate, & form businesses for their own communities this may be all avoided. But in the real world, where you are statistically more likely to stay poor if you are born poor, that doesn't seem as likely.

(Honestly,bno, everyone in Africa does not live in grass huts and I am sure South Africa has its very fair share of drive bys)

Yeah listen Im not a sheister or anything close to it but even I know a CR investigation is simply a administrative process. The shitbirds at IPRA are not cops and they cant charge, or even recommend charging, anyone with a criminal offense. Double Jeopardy is "A second prosecution for the same offense after acquittal or conviction or multiple punishments for same offense in a criminal trial". So if none of this happened then there was no criminal trial.

Again Im no Lawyer but Im guessing the DOJ/FBI are getting IPRA to get new CR#'s because if they fail to gather enough evidence to prosecute in a criminal case IPRA can still fuck you administratively, get you fired, and the Govt. assholes can leave town with them, and the dumb ass's in the public, calling it a "win".

Then they wanted us to hold the scene for over 5 HOURS while their "ballistic trajectory" expert got out of bed and drove up from Springfield. Only after the Lt asked how long it would, did they fess up that they didn't know who was responding. After an hour, they falled the ISP lab and they came out. What a joke. Oh and none of them wear any kind of ID, so make sure you see their credentials before you let them on any scene!!

Saw retired "Sergeant" Joe Mosely on tv woth other retired black officers saying there wasnt enough blacks in supervisory ranks....this from a guy who got 2 merit promotions and a command spot at CHA becaise of his sister. Quit the job cause

On a side note speaking of poverty and grass huts and no drive bys....I remember one time back when I came on the job in Oct 1995. I was working with a black copper in 007 and I asked him why so many people in 007 did not clean up their yard and houses and why their was garbage everywhere. (Mind you I was new and grew up in Northlake) He responded "That's what happens when you are poor" (AKA the white man keeping you down is what he was getting at) then I responded that city garbage collection is free and it cost nothing to pick up trash in your home or yard and I explained how I didn't get the correlation between being poor and filthy. I figured if you were home all day, unemployed that you'd have a cleaner house and yard than mine because I'm working all day. Oh and since this time I went to Colombia and met my wife. She was poor as could be. Making $600/month living in a shack but a heart of gold and a good person with a pretty Colombian face to boot. Her $200/month home with plastic patio furniture in her home? Spotless. No dirt. No grime. No roaches. No garbage strown about. So being poor has nothing to do with shootings or cleaning up garbage. Oh and my wife never did any drive bys in Colombia (at least that I know of). Needless to say that cop asked the WC to not work with my anymore. The truth...Ah how it hurts sometimes.

Unless...if poor investigations are found and a pattern shows up, will even more cases then be re-opened? Will any of these cases be referred for prosecution or separation? Is she looking at how well her investigators did in each case ? Something is in her mind and it sounds like fishing.

Yet despite such hardships, only five people of Chinese ancestry went to jail in the entire state of California in 1965.

Similarly, Jewish immigrants to America during the late nineteenth and early twentieth centuries also repudiated criminality despite having to face extreme economic deprivation. Historian Max Dimont describes them:


"The majority of these immigrants had arrived penniless, all their worldly belongings wrapped in a bundle.... Most of [them] arrived in New York. Some made their way into other cities,... but the majority remained in New York, settling in the Lower East Side of Manhattan, [which was] a neighborhood of the poor. Sociologists, with their impressive charts showing the number of toilets (or lack of the), the number of people per room, the low per capita income, paint a dismal picture of the Lower East Side Jewish slum. But their charts do not capture its uniqueness. Though it bred tuberculosis and rheumatism, it did not breed crime and venereal disease. It did not spawn illiteracy, illegitimate children, or deserted wives. Library cards were in constant use."

Alderman blames 'poverty' for a shooting. Are these goofs ever going to quit? DOesn't everyone live in a grass hut in Africa? Are there a lot of drive-bys there? I don't know. And you'd think the impoverished would steal candy bars to relieve their plight, not shoot each other.

It is rough, though. Morgantown, W. Va. is the heroin-overdose center of the U.S. right now. The Obama administration's War On Coal had pushed unemployment to over 20% in former mining areas. You see this downstate here too. It had a lot to do with the rural/semi-rural do-it-yourself meth explosion. I know people who moved to what they thought was going to be a "retreat" and the ones up the road turned out to be a bunch of crank zombies with the obligatory five dismantled cars out front, cooking away on that stuff, crawling around the fields at night burning the s__t out of themselves stealing ag ammonia for the process, flashing lights and yelling and shooting at hallucinations up in the trees all the time and endlessly "guarding their property" as though there was anything there but dirty diapers and busted chairs and so forth.

Not a pretty picture.

Get rid of 70% of alderman , biggest waste of tax payer money .
Return the 3% COLA at the mandatory retirement age , this will give Police Officers a reason to stay on on share knowledge with rookies .
Also get rid of duty availability , replace it with 6% pensionable pay increase for 3rd Watch and 8% for 1st Watch .
Incentive to get experienced officers off desk duty and off 2nd Watch . Win. Win . Last 4 years Officers will be bidding for 1st &3rd Watches.
Will open up spots on second watch .

Btw SCC off topic but just wanted to put this out there : my buddy from 015 told me couple days ago that a sergeant on afternoons told the troops in roll call that the reason the Dets got shot at in 011 the other day was because nobody is doing stops anymore in our district...

Unf*king believable. Is this what passes as management the days? After my boiling blood cooled down I just realized it's not worth it anymore. I realized that we have a lot of house mouses out there that were never the police or worked the ghetto streets enough to understand what the troops go through out here. They've drank large amounts of the Kool Aide and they'll regurgitate anything just to stir up young watches to their mindless mantra of more ISRs.

Wednesday I took the stats from my district’s three tac teams and two mission teams and gave them to justice. The kid second from last got made meritorious Sgt. I showed the how clout babies get made Lt. and then only spend a few days in patrol based on who they were married to and who their parents were. Two parents were on the job gets you only two days in patrol! Pictures of shitty vehicles and C.O. book orders over the last couple of years that were bullshit/illegal. Glad I made copies because as soon as it was announced that justice was coming a whole lot of pages went missing from the old C.O. books.

Everyone wants fop to do something for them. Well how many of you hard chargers took the time to go to fop and talk to the justice department? Why was turn out was poor? Because all of the brave anonymous posters here were afraid to step up to the plate. But let’s see how many unqualified goofs decide it’s time to make a couple of meetings so I can run for treasurer or another office. Shit I almost can balance my check book that should qualify me for office!

On a side note speaking of poverty and grass huts and no drive bys....I remember one time back when I came on the job in Oct 1995. I was working with a black copper in 007 and I asked him why so many people in 007 did not clean up their yard and houses and why their was garbage everywhere. (Mind you I was new and grew up in Northlake) He responded "That's what happens when you are poor" (AKA the white man keeping you down is what he was getting at) then I responded that city garbage collection is free and it cost nothing to pick up trash in your home or yard and I explained how I didn't get the correlation between being poor and filthy. I figured if you were home all day, unemployed that you'd have a cleaner house and yard than mine because I'm working all day. Oh and since this time I went to Colombia and met my wife. She was poor as could be. Making $600/month living in a shack but a heart of gold and a good person with a pretty Colombian face to boot. Her $200/month home with plastic patio furniture in her home? Spotless. No dirt. No grime. No roaches. No garbage strown about. So being poor has nothing to do with shootings or cleaning up garbage. Oh and my wife never did any drive bys in Colombia (at least that I know of). Needless to say that cop asked the WC to not work with my anymore. The truth...Ah how it hurts sometimes.

Same here.
My mother's family was poor as could be.
But the house was always immaculate, the few clothes they had were always clean and the five children knew right from wrong and had good manners.
Education was valued above 'things' and every single one of them grew up to be stable, responsible citizens.
They had self-respect.
No one gives you that, or takes it from you. It's on YOU to have it, or not.

As of being charged for lying to Feds, no AUSA will take a case of the person has not been read their Miranda warnings. New DoJ guidelines, for FBI and ATF mostly, state that the interviews must be recorded. So..... If you find yourself in a room with a guy/gal that identified themselves as a DOJ agent, who tells you are being recorded and reads you your rights you should only have one response "I need an attorney" repeat as necessary.

I don't know if he/she is a troll or not, but whoever it is, is definitely not stupid. There is a class of retirees out here that were born after the last COLA law was enacted and went into effect that DO NOT receive one. I was born before that date and have the standard 3% non-compounding COLA and my partner who retired after me but is younger, DOES NOT have one. Not certain but fairly confident that it is up to Springfield anyways and is out of rahms hands, other than, perhaps, him lobbying on it's behalf.

Maybe understand or know your contract better before being so heavy handed with your comments.

In the United States, the majority of reported and investigated serial killers are white males, from a lower-to-middle-class background, usually in their late twenties to early thirties. However, there are African American, Asian, and Hispanic (of any race) serial killers as well, and, according to the FBI, based on percentages of the U.S. population, whites are not more likely than other races to be serial killers.
