Cook County "Justice"

Amazing:
  • Keep sticking your neck out

    Charges have been dropped against a man accused of battering an off-duty police officer who intervened in a Wrigleyville street disturbance on June 22. The officer was rendered unconscious in the attack.

    One count of felony aggravated battery to a police officer against 29-year-old Tremaine Wilson was tossed out with a finding of no probable cause by Cook County Judge Marvin Luckman. The state then dropped a lesser charge of reckless conduct, according to court records.
We can debate the wisdom of  taking any sort of police action (aside from dialing 9-1-1) all day long. But this just reinforces the feeling that not a single entity has our backs.

Many judges are quite liberal and anti-police. So, such decisions are not unexpected. It is safer to just stay ultra fetal. Your efforts at pro-active policing will not be appreciated and may even be used against you.

Anyone who has ever been to felony court at Belmont/Western has a story about that senile judge, known as "Let em' go Luckman." If his actions didn't have such serious repercussions it would be funny. The media, if they actually cared, could do an unbelievable expose on his courtroom antics. But like I said, IF they actually cared. A very significant amount of Chicago crime stats, including murders could be traced back and attributed to his release of guilty defendants that were released based upon his limited mental capacity and unbelievable bench antics.

Yeah, about that judge, he's almost 90 yrs old and for years could not hear!!! We need to rebuttal, it is outrageous what took place. Better cameras are needed in that corner too, a pod camera. Quality video is necessary as we have Wrigley is a busy area and cops working do not to be anyone's punching bag. We need to request the indictment. It is all too crazy.

They are sending a message loud and clear, don't get involved. Something happened to the poor citizen who got stabbed helping the woman on the bus.

Also be careful looking for offenders in yards with locked privacy fences. Someone got a CL/CR number saying we didn't have a warrant to look in the yard. She had a home security camera. I guess she would rather criminals get away from Police.

You guys can beef about "Let em go Luckman", but what about "No Crime Stein"? I remember sitting in court at a attempt murder case he was presiding over in which the victim was a Chicago Police Officer. He found the defendant not guilty. The kicker was when he said in his ruling, and I quote, "I know the defendant is guilty but he's such a nice guy, I just cannot convict him". It was then that I realized that my life was meaningless to these people.

I once had had Luckman throw out a PCS arrest after we found rocks on a guy in the processing room. We locked him up for a warrant. Luckman said he didn't believe anyone would be dumb enough to bring drugs into a police facility. He needs to retire, he can't even hear most of the time.

This citizen appreciates coppers intervening on their time off. Whether a PO or civilian, it is only right to help someone else out if you have the skills and ability....The judge needs to go -->>is there something that can be done about his blatant "no probable" cause dismissals, when there was clearly probable cause? I would think there is some sort of action that can be taken by a group showing he is not doing his job and continues to put the community and officers' lives at risk.

I'm surprised at Luckman for doing that. He used to be great for signing search warrants. Would stop whatever he was doing to sign one. But he is in his 80s now. he has more than 25 years on the bench and would get maximum pension. maybe it's time to go. He may actually be senile.

Hey, DEAN the next time you give a speech about why the Police are not making street stops you can list this as one of the reasons why. If FOP had our best interest, they would take some type of action: Like having a meeting with the Chief Judge and complain. Hold a press conference and explain to the citizens what happens when the Police and common citizens take action. Have organized picketing outside the building where the court is located. The list of injustice against the police goes on and on and no action from FOP. That is what a real union chief would do. Let's face it, Dean can not or will not take any type of action. This case just reiterates the Red Line murder a few weeks ago. The family at the news interview all upset because no other passengers intervened while their family member got slashed to death on the train. Uh, sorry for your loss but this is a good reason why not to intervene off duty.

Another judge, Marvin Luckman, who refused to appoint a public defender to represent the homeless man, apparently was not familiar with the recently issued order by Evans

But in an interview, Luckman balked at the suggestion that he failed to follow rules for appointing a public defender.

"I couldn't care less about the transcripts," Luckman said. "I have been a lawyer for over 50 years. I have given public defenders to defendants who are indigent."

Why would I call 911? I would assume the City would need to buy me a cell phone and pay monthly for that service. Think about it every time you see a law being broken am I supposed to care.

As not a cop, I know that intervening can lead to anything from nothing to legal/political problems from the system to life and limb threatening issues from those outside of it....or both. One time I even got a nice formal letter of appreciation from an incident where the two admitted armed youths were let go by the hispanic magistrate.

My resolution after that last one was "if someone is dumb enough to be/live there and not be able to not be a victim, they need be so they can learn". And moved to another planet as soon as I could. In a better world now.

There IS one against padlock/chain on a gate. A neighbor was cited for it, but beat it at the hearing. I violate that law every day, and I intend to continue doing so.

VOTE!! And remember names like Luckman when they are on the Retention Ballot. Vote early or by absentee ballot so you don't have to deal with senile, poorly trained election staff or scurry to the polls before 7:00pm while you deal with work/family/ court, etc. on Election Day.

Hey, DEAN the next time you give a speech about why the Police are not making street stops you can list this as one of the reasons why. If FOP had our best interest, they would take some type of action: Like having a meeting with the Chief Judge and complain. Hold a press conference and explain to the citizens what happens when the Police and common citizens take action. Have organized picketing outside the building where the court is located. The list of injustice against the police goes on and on and no action from FOP. That is what a real union chief would do. Let's face it, Dean can not or will not take any type of action. This also proves that the FOP has no political muscle

No. You can have a locked gate that prevents access from outside, but not one that prevents someone from exiting. That way you're allowed to secure your property without endangering lives in the case of a fire or other emergency. I would advise anyone with a locking gate to think twice about using it. Police aren't as quick to jump over fences anymore. If your gate is locked, there's a good chance the police are stopping right there. If the police or fire department need to break into a locked yard to get access to you when you need help, you may not get the help you need in time. I guess you have to weigh the odds on whether you will need police or fire against how secure your property needs to be.

To say that the Democratic voters in this town are stupid would be a severe understatement.

Think about it...
The average Democrat worships abnormality. Season this abnormality with a massive dose of stupidity and you have the perfect storm. Democrats think that simple things like having a photo ID are beyond the intellectual prowess of their constituents. Democrats are not even smart enough to look at themselves in a mirror and figure out which bathroom they belong in.
The New Democrat prototype (the illegal alien) needs to be trained not to murder, rape, and pillage.
And now there's some insane expectation that these morons will ever have it together enough to step up to being contributing members of society?? ...let alone tend to their personal responsibilities??

From a father of a rather normal Chicago family that doesn't commit crime, my apologies to the police officers that saw their work wasted on this, and my outrage to the judge who can't possibly share with us a set of values that would create a livable, fair city. Releasing this "man" sets him free on all of us, young and old. And when he revisits you, it will be for an even worse crime - i hope your sense of right and wrong resets itself in that moment, because your calibration is way off right now...

It's really simple. Whenever you find yourself in front of a judge like him, don't testify, get selective memory, or just give the bare minimum testimony. Who cares if the judge tosses the case. Get paid and move on.

Can you name ANY judge voted for non-retention? You were probably in kindergarten when that happened. As far as I know, that was Judge Lawrence Passarella who let a thug go who beat the shit out of PO Cathy Touhy of 015. That was 30 years ago. I came on the job right at that time.

You are not supposed to have Locke gates, etc. The police do not need a warrant to enter yards or W hen chasing an offender. Just be sure to call in location and beware of dogs, etc. Plainclothes officers, please get to know uniform officers , so no one gets hurt.

Hey SCC, did ya hear the one about the POS that beat the case for shooting 004th dist tactical team ofc in the head? The offender that shot officer Tom Deroin was found not guilty. Well at least they made him a Sgt.
Whatever happened to Del Pearson's case? It wasnt looking to good for him. I havent seen his name on the Sgts list yet or have I missed it?

Entering a backyard, locked or unlocked is a lawful act by law enforcement as long as you're not there to gather evidence or intelligence without probable cause. Exigent Circumstance doctrine dictates Law Enforcement broad access based on finite circumstances, and entering a backyard via whatever means necessary while in pursuit of, or searching for and offender, or evidence of his or her criminal act is allowable. The owner/occupant doesn't have to like it, but like everything else, they do have to tolerate it. Know/learn the law folks, it really allows us to do our job. Knowing it ahead of time takes that doubt out of your head.

And to the Sgt or Lt who may be investigating the CR number mentioned in one of the replies to this thread, you may choose to use this information to unfound the allegation, and tell the complainant to pound sand. I mean inform them of the law and smile when you tell them you will be unfounding their complaint, and also that the officers were well within the law and were acting effectively, efficiently and appropriately while protecting them and their neighbors. And of course, thank them for their support.

I already weighed the odds. I've called the police (I am the police) once, for an intruder, in ten years. CFD loves to make entry, so I'm not worried about them getting on the property.
My gates are locked against the neighborhood thieves and the nosy bitch who lives across the street. I'm good with that.
