Speedy Justice

  • A man who beat his murder case when prosecutors failed to give him a speedy trial was killed minutes after leaving Cook County Jail on Monday night, according to authorities.

    Kamari Belmont, 23, was being held on murder and robbery charges after he allegedly shot a man during a robbery and robbed another man a few hours later in 2015. The man he shot died weeks later.

    Cook County prosecutors dropped the murder charges the end of January after allowing too much time to elapse under the state’s speedy trial statute, according to court records and Belmont’s attorney.  The robbery charges remained and Belmont was ordered held on a $100,000 bond.

    At 5:30 p.m. Monday, a friend of Belmont posted the required $10,000 on the bond and Belmont was released at 11:12 p.m., according to jail officials.

    Belmont was a few block of the jail when a white SUV pulled up to his car on California Avenue and someone inside started shooting, police said. Belmont was hit several times.
We can already hear the wailing:
  • If only the police / sheriff / county kept him in jail, he'd be alive today!
But they didn't, and he isn't.

But what's this "speedy trial" loophole? If you can delay, delay and delay again, waiting for the always brilliant and on-the-ball Cook County States Attorney to miss a deadline, you get to walk on murder charges? Is there any sort of leave to re-file? There is no statute of limitations on murder, but seemingly endless opportunities to await a misstep that will get you into the 80% that get away with murder in Cook County.

Well, until you venture outside the walls of the jail that is. Out there, someone may be waiting.

You lose 60 % or your benefit, which means you get 40%. Your wife gets here full benefit, but if she dies first and her benefit is higher instead of getting her full benefit, that is also reduced by 60 %. Sad but true.

O/T To 12:34am You get less than a 1/3 of what your suppose to get because of the pension and your wife can collect her full benefit.Only catch is that you get penalized if you are still working before 66 yrs old and collecting.Anything you made over I believe $14000 you pay back a dollar for every two dollars you make over it. So if working and collecting your pension its best to wait till 66 yrs old then no penalty.Check out the SS web site or call them. They are very helpful which is almost hard to believe.

So as you see Rahm loves me too. He said if it wasn't for me the City NEVER would have gotten that 2% for the 55 and out, or the tier system for our insurance, or saved huge on that duty availability stipend. Anyway, I just want you all to know I'm confident we can keep the 55 and out for around only 5 or 6% in this next contract and just so the current recruits have something to feel good about I'm gonna let Rahm take away the Uniform Allowance for everyone hired after the new contract begins. That way the current recruits will feel like they got something too! Oh, and don't worry about the crappy vehicles either. I called Rahm and he said in the next contract we can have 450 new vehicles. I told him we were going to need a little more from him so he agreed to throw in 75 new bicycles and a dozen segways. Anyway, I have to run. If you have enough quarters, the WEP reduces your social security by 2/3's.
It does not affect your spouse.
Make an appointment at one of the Social Security Offices around and they tell you everything you need to know down to the penny.
With an appointment your wait is appox 15 minutes.

My social security was reduced by about 40℅. My wife collects her full benefits. So we get my pension, her full SS, my reduced SS.

From what I can recall the Long & short of it- you don't get it SS if this was your only job. If you have enough quarters put in (at least 8 I think) from previous employment you will get something. Your spouse is not affected by it. If she worked and put in to SS, she'll get her check like anybody else. Again, this is what I remember- I may get corrected on this and that would be welcome-it's been awhile,getting old brother/sister. Good luck.. P.S. -put as $ as u can in deferred comp.

Normally in Illinois if you get a pension and are eligible for SS (enough quarters)you would only get roughly 40% of what you were entitled to from SS thanks to Rostenkowski. IF you had enough years of what SS considered 'substantial income'(very close to working another full-time job paying SS for the required amount of years--roughly 20)your 40% SS is increased accordingly based upon the number of eligible 'substantial income' years.
Don't confuse SS eligible to 'receive' SS with SS eligible years to have your 40% increased by 'substantial income' years for the slight bumps up. Many/most people 'on the job' normally just qualify to receive the 40% of which they would normally receive if they didn't have a (CPD) pension.
It doesn't affect your spouses SS unless she likewise is in the same category. (i.e. eligible for SS AND also receiving the stipulated pension income)
Finally, there's also increase(s)in the amount of SS you can receive based upon when you decide to take it after eligibility. Good Luck sir/madam. STAY SAFE

Your social security is reduced by 60% , if U have a CPD pension , unless U have over 20years in the private sector paying into S/S , the penalty is reduced . I worked
full time for 8 years after i left/retired from CPD & paid into S/S, this reduced my
penalty some what . This Penalty is called the Wind Fall Elimination act of 1986 ? This was passed by a Democratic Congress because they felt receiving a City Government Pension & a S/S Government pension was a windfall ?? Thank U Mr. Rostenkowski .A lot of Teachers R also effected by this, & of course Fireman . As of know my wife's S/S is not effected by my CPD pension, but i understand that when she starts to receive a widows pension from the city, then her S/S pension will B penalized .

Your wife will get her full benefit. However, you will only collect about half of yours because of a pesky little amendment to the Social Security Laws by that fine upstanding Illinois Congressman Dan Rostenkowski. It's called The Windfall Elimination Provision (WEP) and it was passed because Washington felt that public servants like us, made too much money with our fat pensions, therefore we didn't need full benefits. Of course, the politicians who passed this, still to this day, collect multiple pensions because, of course, they need and deserve them right? Secondly, if your wife dies before you do, you get none of her benefits, thanks again to Mr. Rostenkowski and his fat cat buddies.

Social security has a calculator on its site. You need to plug in your withholdings by the years withheld to determine your benefit. Hopefully, you can get the amounts from the SS's site if you did not keep the statements. Since my wife is a school teacher with CPS her SS amount will be reduced too. I was able to come up with amounts for both of us. Not sure how our pension will affect your wife.

It is cut approx in half. So if you have worked a side job or several side jobs and you have paid enough into SS then you may be entitled to 500$ a month. But since you have a "Government Job" it will be around 250$. You can thank Dan Rostenkowski for that one.

No Offense SCC, but that 'Speedy Trial Loophole' is the VI Amendment to the US Constitution. In fact it's the first sentence: 'In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial...'

IIRC, in Illinois the defendant HAS to ask for a speedy trial during arraignment when entering his plea. Then the clock starts ticking for both sides. The 'clock time' is set by State Law. You can't invoke that right after you've asked for continuances. (this is my understanding of the law. your mileage may vary)

So in this guy's case -- and that'd be The Dead Guy LOL -- it appears the CCSA screwed the pooch big time.

an aside: Back in the 1980's I had to go to the old Traffic Court downtown for a Traffic Ticket (can't recall for what now, but it was NOT criminal). Before I could say anything the Judge looked at my Ticket and said: 'Case Dismissed, the defendant's 6th Amendment right to a Speedy Trial has been violated' (The court date was a few months after I got the ticket). I had no idea how that happened but I sure was a happy camper when I put my DL back in my wallet. How the Law's been revised since then, I don't have a clue. Maybe the Judge just wanted to piss someone off that day.

Maybe the lack of speed was a way to save the taxpayers money long-term. No trial, no trial costs, no additional jail/prison time, etc. Now they can investigate this murder and run through the process again, if they identify the shooter.

For the person wanting Social Security information. The reduction is based on a lot of factors. I worked full time for 28 years before becoming CPD and my benefit was cut almost in half. You can't figure it on line, you have to go there. Also, what I found out when going to SS, not all agents even know how to figure deductions. So, I had to go back twice. It's a daunting, unfair process.

Former Assistant Attorney General here. Speedy trial is constitutional. If the defense seeks a continuance, the time does not run against the state. However, some games can be played by the defense, such as, when the state is ready, and has its witnesses, ask for a continuance. Sure the time doesn't run, but how long before the state can get all the ducks in a row again?

I am curious how the robbery wasn't speedy trialed out? Was he not charged yet?

In any case, justice won out in the end.

Don't understand this case. Murder cases routinely go well beyond 2 years. In fact the few I have been involved in were all older than 2 years
Only thing I can see happened is that from say one the defendant demanded a speedy trial at EVERY court date and he never asked for a continuance, but that should have set off a red flag

To answer the "off topic" question about Social Security benefits for Chicago Police Officers; As you may already know, with "thanks" from former Illinois Congressman Dan Rostenkowski (who also became a convicted felon, now deceased), as a remedy to prop up an already failing Social Security System, Rostenkowski thought it "wasn't fair" that Chicago Police Officers, by law, receive a guaranteed pension, and also be entitled to Social Security benefits. Good ole' Rosty thought this amounted to "double dipping". So Rostenkowski proposed, and was successful, in ending Chicago Police officers contribution into the Social Security system, thus denying Chicago Police officers any claim to Social Security benefits at retirement. And as we all now know, due to the erosion of our pension, after years of poor contract negotiations and give backs, that "guaranteed pension", (that once paid your full medical benefits after retirement, until the day you died), is a shadow of what it once provided retirees. If however, you once had YEARS of working in a full time job BEFORE you became the Police (or work a side job that pays into Social Security), and provided that all your Quarters are paid up in the Social Security System, (that amounts to about 10 years straight, of payments into the system), then, regardless of what Social Security benefits you've earned and should rightfully have coming to you, you are "rewarded" (sarcasm), with you receiving only 40% of those benefits. Social Security keeps 60% of your earned benefits, merely because of the fact that you are a Chicago Police Officer with a policeman's pension. That means if you should be receiving $1000.00 per month in Social Security benefits,you now will receive $400.00 per month instead, with Social Security keeping $600.00 per month of your benefits that you already paid for, just because you are a Chicago Police Officer! The Windfall Elimination Provision reduces your SS by I believe about 40%. It was implemented to impact folks like us who payed into a pension that SS wasn't taken out of. It's a really convoluted formula they use to figure it out, but the bottom line is we're being screwed big time. Thanks, Dan.

You can figure it out on-line. There is a WEP calculator on the SS site. Also, at 30 years of "substantial" earnings the penalty goes away and you get the same SS as everyone else. The penalty goes away a little bit at a time starting with your 21st year of "Substantial" earnings. A little more of the penalty goes away each year until you hit 30 years. This is actually something to think about for the younger guys.

Why leave a comment if you have no idea of what you speak. There is no set amount for SS benefits as your monthly benefit is based on your lifetime earnings for which you have paid SS taxes.
You need 40 credits/quarters to collect and your entitled benefit will be reduced by anywhere from 40 to 60 percent because of the Windfall Elimination Provision which was sponsored by convict Rostenkowski.

Over here to the East just a few miles - a retired copper who just started collecting SS last year got a notice yesterday he was overpaid by $5300 last year. They did give him 30 days to repay it back.

It's not bullshit. Social Security was set up to replace a portion of a person's income when they retire. Before WEP SS would look at the average policeman's lifetime earnings and figure he just worked a low-income job. They would then give him minimum SS. That is where we used to make-out, getting the minimum. Didn't really deserve it and they figured it out and put WEP in place. I want every cent I can get too, but WEP is fair.
