You do everything right, everything by the book, and a jury still thinks you're wrong because you're the police (and they're morons):
- Chicago taxpayers will spend $9.5 million to compensate a man who can barely move and cannot talk after hitting his head on the pavement while being jolted by a police Taser.
The incident occurred in July 2011, while Jose Lopez was being treated for chest pains by Chicago Fire Department paramedics.
Chicago Police officers called to assist paramedics in Little Village claim that Lopez refused treatment and became combative.
When one of the officers used a Taser to subdue the patient, Lopez fell backward and hit his head on the pavement.
So evidently, we're going to be instructed to let CFD fend for themselves lest some ignorant jury award millions of dollars.

As with most juries, we have people here who are were not smart enough to avoid jury duty, or subjects who want a platform to vent their anger against government, especially government's most visible agents; the police. We make satire about it on this site, but the anti-police attitude nurtured by the Media and Politicians is Genuine and Dangerous. The presence and availability of devices/cell phones, that can record and broadcast incidents Worldwide has forever changed the dynamics of interaction between police and miscreants. After all is said and done; unlike T.V. police dramas, subjects resist arrest and their is no neat or clean way to subdue a resister. The Perception, is all that matters. Whether the Dept. admits it or not, Tasers are viewed by many in the public as Excessive Force. The metal baton, is viewed as Excessive Force, and any form of kicking or striking with a closed fist, will all be viewed as excessive force by the ignorant public's Perception learned from film and television, which is Entertainment,not Education. If the paramedics and police would have just Left this chunk of shit to roll around on the sidewalk in his drug induced condition, the police and paramedics would have been sued and disciplined for not rendering aid. Police Officers are going to get hurt, because if they do not use a Taser, and just wrestle around on the concrete, the cops and future plaintiffs will all sustain injury. Doing Nothing is not an option. Meanwhile there is a study that states the Taser is used more often on Minorities, so Any Use of the Taser in Da Hood receives greater scrutiny. The only solution rests in Tort Reform. Yet, Politicians, like Rahm, who receive campaign donations from certain law firms are not going to push for that, so the money will continue to flow, and coppers will remain in the middle as scapegoats. Do NOTHING, ABSOLUTELY NOTHING, WITHOUT A SUPERVISOR PRESENT, AND PREPARE TO BE SUED, NO MATTER WHAT YOU DO. Unless Tort reform, with caps on payouts is enacted, these settlements will continue and lawyers and criminals will see it as playing the Ghetto Lottery. Baby "G"

The General Order is clear. The taser is not an option when you encounter a citizen an have knowledge that they have a pre-existing ailment. In this case the officer(s) responded to the call to assist EMS with a citizen who was expericing chest pains. Easy lawsuit!

I do not agree with you on this one. The man did not want to be forced to go the Hospital and the police had no business forcing him to go. We do not take our orders from the Chicago Fire Department and we do not inforce the rules they have. In the last month, I have responded twice to CFD ambulance assist calls and the paramedics wanted the police to physically force people to go to the hospital because of some rule CFD has. They even called me once to force a man to sign their waiver because he refused to sign it.

Why wasn't the patients refusal of treatment honored? If he doesn't want treatment and a release is signed (or video evidence of a refusal exists), pack up and leave.

What is the STANDING upon which a jury heard this case?
Yes, HARM is part of standing, which is obvious, however, a felon in the commission of armed robbery shooting at store operators and or police trying to apprehend him who get shot is certainly receiving demonstrable harm. OK so that criminal was harmed, but it doesn't, heck it CAN'T provide standing to sue to gain financially from his crime committed.
If the tazer deployment is by the book, on good cause, then the harm can not be any different than being shot with a pistol or rifle.
Ok, so the guy "got combative". Well, he was refusing treatment right? If that is the case, and force was applied to him because he was refusing..... then he was battered AND harmed as result. In that case then some loot is appropriate BECAUSE force was applied unjustly.
So it can't be that what he did was by the book. Or, it can't be that he was harmed unjustly. It can't be both, it has to be one or the other. It comes down to WHY fore was used - and that is where the rub is. "he got combative" is not a full disclosure description. More information is required to assess that situation.
Proper action is - Well dude refused treatment so let him be.It may be the stupidest decision possible, he may DIE as a result of his own decision. SO BE IT. Look at the last shoot by the CFD Lt, a good shoot, he's a hero. If it were a CPD Lt there would be multiple investigations, BLM would be asking for a grand jury, federal civil rights investigation and a FBI investigation. Might have gotten stripped and for the next 5-10 years he would have to worry about the investigation being reopened

If you get hurt at work and need to go on disability make sure and be certain that the Head of Human Resources gets your full and entire medical file sent to the pension board. Don O'Neill has been working with the union to sell out officers by not sending medical records to the pension board for hearings regarding duty disability. This has been happening for the last few years and needs to be brought to the attention of officers risking there lives every day.
The union and Human Resources have silently been working together to end duty disability benefits. Just like the union was on board with the city to end retirees healthcare. Officers need to speak up and the Union as well as Human Resources for the Police Department need to be held accountable.

Several years ago, I was assigned to backup EMS on a call of two intoxicated brothers who had gotten into a fight in their home. The lead paramedic insisted that I forcibly make the one brother go with them to the hospital for treatment of a minor cut on his forehead. The paramedics reasoning was that the guy was too intoxicated to make that decision on his own. I spoke to the guy, realized he was coherent enough to refuse treatment and told the paramedic as much. The paramedic had a hissy fit and said that I had to make the guy go. I took out my handcuffs and gave them to the paramedic and told him "If you want to take him against his will, then have at it" Of course the paramedic didn't and I left the scene. Sometimes you just have to use a little common sense.
It's simple: CFD calls for assistance, person refusing medical attention: CFD should write on the their pad/tablet refusal if they also refuse to sign the waiver. We do not force people for medical attention unless he/she is a clear and present danger to self or others. We also do not follow orders from ems or their battalion chiefs. Sorry CFD, it's time you fight your own battles, stay fetal.

It may different in IL but here EMS is obliged to involuntarily commit someone who is erratic or incapacitated due to intoxication or mental illness. I'm sure some guy high out of his mind on crack/meth suffices that definition.
This is more a case of a jury drooling over a "police brutality" case in the current climate and handing a shithead a tax payer payout.

He couldn't explain it to my satisfaction, probably because he's not really too bright.
But there is some sort of rule out there - which is bizarre in and of itself.

The paramedics reasoning was that the guy was too intoxicated to make that decision on his own. I spoke to the guy, realized he was coherent enough to refuse treatment and told the paramedic as much. The paramedic had a hissy fit and said that I had to make the guy go. I took out my handcuffs and gave them to the paramedic and told him "If you want to take him against his will, then have at it" Of course the paramedic didn't and I left the scene. Sometimes you just have to use a little common sense.
And that we don't take orders from paramedics. When was the last time you read about a big judgement against a paramedic. None that I read. No they have you do their job and you get sued.

Payday coming for a couple of female POs because of a certain swat Sgt stalking and harassing them. Complaint after complaint against this nut job and the Dept failed to investigate.

FOIA request. Dept will be embarrassed and sued. Many victims to include civilians and POs. IAD failed to properly investigate. Past history spanning two decades.

If they feel so strong about him getting proper medical treatment, Tell them to chase him. There is nothing stopping them. About time CFD understands we don't take orders from them

CFD medic here, it's not our rules it's the law that if somebody is intoxicated from drugs or alcohol they cannot refuse treatment ( not really treatment just giving the moron a ride to the hospital to sleep it off). This guy that supposedly had chest pain ( I doubt it) and wanted to refuse they should've let him refuse. If somebody is having a legitimate heart attack they are not going to refuse care. Just document everything and you're fine. If he leaves the scene good riddance I'm not chasing him or begging him to go and I would never ask the police to chase any fool who refuses treatment / transport. I can't speak for these other medics but sounds like lack of experience.

so the lawmakers of Illinois found fit to more-or-less give you the power to make an arrest? or at the very least a civil commitment? What are the repercussions then for refusal? and what force do they tell you you can use? or have you even thought of these questions? and please cite the law... if he escapes are you on the hook?
