Retiree Update
From an e-mail for some readers who were asking about it via the Krislov lawsuit:
- Judge Cohen was furious with the City’s claim that it will take about 19 weeks for each year 2014, 2015 and 2016 to complete each audit, and that one cannot be started until the preceding year is completed. He chewed the city out for its slow reconciliation;
rejected the city’s submission that it will take 19 weeks for each year , one after the other, (i.e., more than a year to complete 2014-2016) to get the audit and reconciliation done for each year;
and was bothered as well by the Funds’ lack of concrete responses about the plans for 2018.
He ordered everyone back on 9/26 at 10:00AM, to report on both, or he will order a full hearing on the city’s actions. We’ll see. He also ordered the Funds (although not the City) to copy us with all communications sent to participants regarding retiree healthcare. You can let us know if you receive anything from any of them, including the City.
The main focus is still on our pending petition with the Illinois Supreme Court, which we filed on September 7. So the City and Funds’ responses should be due September 28. We’ll likely want to reply; we’ll keep you posted.
We continue to believe that the most compelling group of you are the class 3a people whose City work did not qualify them for medicare coverage, and we are considering taking another shot at asking for an injunction against the City or Funds adversely changing the existing plan during the litigation. This popped up because the Municipal and Laborers Funds’ attorneys said that their funds were not required to provide coverage, municipal was especially noncommittal. I reminded Judge Cohen about his declaring that it is the funds’ who have primary obligation to provide healthcare coverage to annuitants, and they appear to be disavowing any such obligation. We may file something on this before the 26th. Those of you who are in the class 3a and don’t qualify for medicare might want to show up for the September 26 hearing.
Hope this answers some of the questions. We don't have the answers and the only real answers are going to come from the lawyers, so drop them a line at KrislovLaw.com

I always get worried when a politically connected judge gets "furious" or "outraged". Many times it is part of the theater to make it look like he/she is being fair to both parties, when in all likelihood the outcome has already been predetermined by clout.
Sounds like the ruling on the soda tax.
Rahmie and O'Shea found $25,000,000 for BAM overnight without any problems. Oh by the way how is BAM doing?
Krislov is doing a great job but they do need some financial help ~ PLEASE send them what you can, $10, $20 or more...any donation to the cause because this affects us all.
It's amazing that I have to read this shit here. Thought Bella was put on the FOP payroll to handle retiree issues even though he refused to work as a field rep. Guess 600 a month plus 25 an hour isn't enough to get him to do his job.
Don't forget, the "furious and outraged" are words from the Plaintiffs, not necessarily fact.
The City cannot remember which books are cooked. It will take them a while. Burke is the lead Alderman for Finance. Let's ask him!
The first response is correct.
This is a theater. To show the public they are concerned.
But in fact the outcome has already been determined.
Just think about our contract it has already been decided and if
You think otherwise close your eyes. The check is in mail.....
What a mess!
Is class 3a coppers hired after 1995?
It's been 9 months since I lost my heath insurance through the city, been paying about $800 a month with a $7100 deductible which has to be paid before insurance begins to cover anything; so I don't go to the doctor even though I should. If I never worked, never paid taxes I would get free healthcare, free housing(no property taxes), free food (no soda tax) etc. I feel like a schmuck. Sad.
And, as one of those in this subclass, I ask all of you hired before 1993 to send the lawyer a little dough......
The premiums for insurance out here are BRUTAL.....Obamacare screwed everything up, and insurance companies are making their profits skyrocket due to putting 22+ million on virtually free insurance either thru Medicaid expansion or full subsidy to an insurance company.
Premiums are from $1750 to $2600 A MONTH with deductibles as high as $10,000.......
We all need to fight this to the bitter end......this city told us all upon hiring that we were included.......and per our state Constitution we should still be included.......
I thought I read a lot of this case but I can't find any class 3a, it's
• Classes
o I. Korshak sub class – retired before 31Dec87
o II. Window sob-class – retire between 01Jan88-23Aug89
o III. Sub Class 3 – anyone who contributed before 23Aug89 amendment
o IV. Sub Class 4 – anyone hired after 23Aug89, but before 2003
or so I thought
Although retired and not directly affected by the outcome of this lawsuit, I've nonetheless made three contributions to the law firm as finances permit on behalf of my brothers and sisters, OTJ. I suggest, if possible, others contribute according to one's own financial ability, however slight, just to keep their lawyers on top of the City and fight for what's right on their behalf. Just my $.02. Stay Safe out there.
Thank you, Clint.
Hey, to all of you retired, active, and the CFD. Put something in the kiddy, this is going to the high court. The best thing, Tiny Dancer is going to dance for all of us.

This judge has been pretty good, thus far, so there's no need to alienate him with your unsubstantiated speculation.
Sure, Why not fuck the only people who dedicated their Lives to service to your City. True Class by Chicago Politicians, ..... as usual.
The whole point of the delays, yes both the 19 weeks drama AND the judges delays is to provide exactly that - more delays.
The truth is - when you rob peter to pay Paul long enough, and you refuse to stop growing already augmented and over-inflated promises that have you robbing Peter to pay Paul, eventually Peter has nothing left to rob, and then only is Peter DONE with being robbed, now Paul is pissed off too, because he isn't getting paid. At that point, Paul is doubly angry because Paul has recently experienced a rash of thefts himself and he is broke - now not getting a check either.
Where do ya think Peter was getting the money Ya was robbing Peter of to pay Paul with in the First place? Peter was embezzling it from Paul in order to pay the thieving Piper to begin with.
What is happening is that the longstanding circle jerk called Democrats promising the world and fools actually buying into it DESPITE THE MATH proving it CAN'T be done, is crashing.....and burning......in slow motion before our eyes.
Why are they changing it during litigation ongoing? Well GEE Wally, Rahm and his democrat buddies did that EXACT same thing, more than once, during the waning days of the already lost Gun Rights litigation too - gee, intentionally DELAYING for the sake of ONLY delaying.
At some point there are only two things gains from delay- funnelling more taxpayers money to crooked lawyers who KNOW their clients are indeed guilty, aaaaaand, a means of keeping the crooks out of jail just a liiittttlllleeeee bit longer trying to get past the next election (because if that election goes a certain way, well then a REST button can be hit and start the whole delay process over again).
Society created and hired a whole group of people to put a stop tp this kind of criminal RACKETEERING.
We call them "Police".
We the people look forward to the day when they stop being fetal, instead standing up to the crooks and liars and thieves, standing up to do the job they asked to be hired to do. As we watch these corrupt crooks rob the police blind, delay endlessly (which is another way to say deny) promises made to police that functioned for decades as BRIBES to not arrest them, as they even go to the lengths of hanging cops out to dry for doing their bidding all along, maybe, just maybe, PoliceMen will act to restore long lost Honor......because they finally admit to themselves that they have been on the wrongside, have ben led astray by the promise of riches if they just became, bit by bit, the very things they signed on to arrest. The Criminal Elements.
Yeah, I know, I know, its harsh. Butyou know what? It is TRUE too. All along we WARNED you guys and gals. We hollered and snapped - and even still today you say "1st and 16th" and "fetal". What yall fail to understand even today is that you have actually BEEN "fetal" all along....as you just looked the other way year after year as politicians LIES grew larger and their THEFT grew large as well. You watched it grow so long as what they promised YOU grew also.
And now they are throwing you under the bus, more and more each day.
Still your hope rests with getting what you were promised, rather than fulfilling your promise called your Oath. And you honestly wonder why society increasing sees YOU as corrupt? You actually wonder WHY?
Are you folks OWED, both explanation AND the compensation you were promised? ABSOLUTELY!!!!!
Are We The People OWED what WE PAY FOR?
You Better Believe it.
We have paid and paid and paid and paid and paid, and we are still waiting for what we paid for. Now, not only will you not arrest the crooked politicians, but you won't arrest street criminals either. Yeah, fetal isn't the answer - indeed the opposite actually is.
Heck it only took City Hole a week to draft the plan to phase out the retiree healthcare benefit plan, and six or more years (?) to get to the bench of appointed Cohen?
Who's fooling who?
Stall, delay, obstruct, resist, deny is all day - everyday.
No balls judges allow this.
Chew furiously on this Cohen.
About 7 years ago Mark Donahue called an emergency meeting of reps. Seems City was pushing for a quick settlement with a newly discover "oversight" of medical insurance premiums to the tune of $18M. If we just took the cash, the City would bump up the payment to a few starving widows who are getting crumbs. Instead of asking for a forensic accounting.
Plaintiffs need to call for a forensic audit. The City lies. Will tell you "we don't have that info" or "it will take a year to get it".
Could the City be that f#cked up? Seeing as people are receiving notices for unpaid parking tickets from 20 years ago, who knows?
I'm pulling for the retirees .
They got the shaft from asshole Rahm.
I hope the courts stick it in Rahm's ear.
When I joined the CPD in 1966, it took me about 6 months to figure out that the City, the County, and the State of Illinois were branches of organized crime. I spent the rest of my 26 year career operating on that theory, and it has proven true. I did little work, had much fun, & never expected or got promotion. So far I've collected $850,000 in retirement benefits. If the City eventually craps out a few thousand in health care payments, hurray!! Who in their right mind can expect anything else from the Bridgeport Crime Family?

So far the CFD put in nothing
Well hopefully Judge Cohen can remember and wake the Fuck Up to who the Hell we have for Mayor , that's all the answer he needs to know why the whole city is all screwed up . in all ways and in all Dept.
Lil' Dean's administration (Bella included) did little to nothing regarding this case. Why?

FOP should have a bus at 9 AM on the 26th for a ride to the courthouse. But the bus should be from a place that has parking since
there is no parking anymore around the hall. It is no secret that Lodge 7 is considering another location for the lodge due to the parking situation.

THEY COULD sell that FOP building for quite a profit and find a place in a central shit-hole location like the sergeants did at 1616 W Pershing (39th and Ashland)
Judge Neil Cohen's wife is none other than Susan S. Sher. She was Daley's Corporation Counsel and later top aide to then FLOTUS Michelle Obama.
The Union should be paying ALL of the expenses to Krislov ,Not the members, were broke because of this bullshit already !!!!

It appears the healthcare case is eventually going to be decided by the Illinois Supreme Court which unanimously ruled in favor of the state retirees in an almost identical case. Most judges try to avoid rulings that they know will be overturned
