$44 Million

Another blockbuster verdict that was the direct result of a clouted individual hiding in the system that protected him over and over again:
  • A federal jury awarded a Morgan Park man a record-breaking $44.7 million Thursday after finding that a Chicago police officer shot him in the head after a night of heavy drinking and that the troubled Police Department enabled the off-duty patrolman’s violent behavior.
How troubled?
  • Because the jury found that the Police Department has a widespread problem with disciplining officers and failed to maintain an early warning system, the city of Chicago is responsible for the $44.7 million award and LaPorta’s legal fees, which likely also will be millions of dollars.

    Kelly, 36, has been found mentally unfit for duty twice, arrested two times, accused of beating a girlfriend and treated for alcohol addiction. He has been sued six times and has been the subject of more than two dozen investigations into his on- and off-duty conduct, including one in which he was found to have assaulted a female sergeant.
Anyone want to clue us in on who protected him, over and over again? Who excused, condoned or covered this up? Because guess who's paying the price every single time crap like this gets papered over? You, us, 99% of coppers who do the job correctly and go home peacefully, calmly, soberly.

How about attacking the system that protects, promotes and excuses this behavior. Aside from a few DUI's, almost every single scandal that has rocked the Department in recent decades has at its heart a connected or clouted individual who thinks they operate outside of the rules. And unfortunately, their political sponsors allow them to, for a short while any way. Before they cost the city $44 million.

flailing and kicking into their own shit?

They're repeatedly rescued by their clout only
to do the same shit over and over again.

These are the "untouchables" of CPD.

The ones whose antics are LEGEN-FUCKING-DARY!

If they weren't clouted and protected
and were actually subjected to standards,
general orders, rules of conduct and the
laws of this land like the rest of everybody
else wearing a blue suit with a star pinned
to the chest, CPD wouldn't be derided as the
fucked-up clown funeral procession it has been
deliberately turned into.

Political control and interference yields
THIS!

And the politicians (and the media) have a
great fear of someone actually knowledgeable,
competent and morally/ethically intact being
in command of CPD.

"Some uptight 'nutron' might get in there

enforcing the law an' we can't have you guys

CPD is FUCKED-UP because Chicago Municipal

Knew this guy from the neighborhood and also the guy he shot. Both of them were goofs and acted like jerks going back to high school. When it became known that Kelly was in the academy, everyone that knew him was speechless and figured he would wash out. Next thing you know he was on the street as a ppo. He would prowl the Western Ave. bars and readily show his sidearm to anyone. One night he beat hell out of his attractive girlfriend who, it was rumored, he was going to marry. She took a beating but it kept her from permanently ruining her life by marrying this guy. Right from the beginning this guy was getting beef after beef. But, he was never disciplined. Everyone who knew him would remark that he must have really heavy clout but to this day I have never heard who it is. If anyone knows, please share.

$44 Million?!?!? Where does all that money come from?

Oh - that's easy. Just soak everyone coming to Chicago with high sales taxes, Parking fees, red-light cameras, and anything else that can shake some money out of them.

Do you know how much you could do with $44 Million??? Think about all the neighborhood playgrounds they could rebuild or build brand-new?

Or, just keep it in CPD. $44 Million for equipment, training, even a couple of new hires.

And that is only ONE settlement!! ONE settlement!!!

Chicago needs to get rid of clout. It costs everyone too much money and for what? So someone's relative, who is totally unqualified, can play police officer instead of doing something they may have the skills for, like manning the machine that makes french fries?

Where is the disgust?

Well, no one is going to open up their mouth because their own "loser" niece or nephew is also on the force as well.

Chances are, they have already gotten their two or three "merit promotions" by now and you just can't let go of a Sergeant or Lt. (God help us if they are even higher on the Totem Pole of Chiefs)

CPD is NOT a place for second-stringers and when you come down to it, a second-stringer would be a vast improvement on some of the fourth-string clouted!!

Its funny how everyone now is bashing Kelly ....but....everyone stood up for him when there were stories on social media and the news about him. Everyone backed him when Savini did story after story on Kelly.
Not a Savini fan but he was right about him. I hope Kelly gets charged and goes to the joint. The victim deserves alot more than 44million. Pain and suffering alone is worth more. Lifetime care will be very costly

Protected? It's buried in the story, but Kelly was arrested that night for assault to a sergeant. He was an asshole that night and no one on scene protected him.

Two drunk losers hillbies went out and got shit faced and one of the drunk hillbies got shot. Kelly was off duty. There was no reason other the culture to blame police officers for everything for this verdict So now everything someone does off-duty we get blamed? Look where the jurors are from that spoke: North Aurora and Plainfield, hillbilly capital of the world.

Officers on that scene did everything right.

There was another large settlement paid out 2 months ago because of his antics. He repeatedly tased a pregnant woman until she lost her baby a couple days later. And continued to harass and stalk the family wherever they moved. Let's not forget his shooting of a mental person dozens of times Plus a six-figure settlement for pistol-whipping a subject. In addition to telling subjects that he will plant drugs on them and a case on them.

Aren't the juries basically a part of this problem? I assume that the jury pool consists of people from this city-who are the very ones who will be paying for this verdict! (I don't count a certain demographic who routinely see multi-million $$$ signs at the slightest infraction, like only getting 2 pickles on their Whopper instead of 3, and who are usually exempt from having to pay taxes.

Its time to leave this job and city. The way the DOJ's and the police accountability reports have been used against us, yet either of the reports needed statical evidence is embarrassing.

The only potential challenger to Rahm was McCarthy (and I wouldn't hire McCarthy to cut my grass). But McCarthy is a better communicator and media hungry person than Rahm. Rahm needed this lawsuit to go bad so he can point to the fact that McCarthy was the Superintendent. $44 million, but nothing from Rahm campaign fund. Kelly was off-duty, he was arrested that night. No one covered up for him.

OT: So the great Capt. Eve Gushes shows up in 007 yesterday to give a presentation about her new unit, The Force Review Uint. All of us who know of her antics while she was here in 007 knew she would do or say something that would embarrass her or the department, And boy she didn’t disappoint... towards the end of her awesome presentation where she probably said “I” at least a dozen times, referencing how she did everything herself or at least giving herself full credit in creating every idea, she decided it was important to let everyone know how the people for this new unit were picked. She so elequently described how she took working officers to be in the unit and that it wasn’t staffed with “ Commander’s secretaries, or Commander’s girlfriends, or “other people’s garbage”. Yes she referred to other police officers, not to mention human beings, as garbage in front of the entire 007th district supervisory staff. And this is who will be in charge of reviewing trr’s for the entire department. It shouldn’t come as a surprise of her choice of words as there is an open EEOC complaint against her for throwing a bag of garbage at a P.O in roll call. And that incident happened right before her promotion to Captain. Only the best to lead this department....

The CPD certainly does have a two tier policy. In 2004 I was brand new to the job. We responded to a loud house party. We dispersed the house party and this kid was walking away while smoking weed.The nerve of him! So we stop him and find he has a whole lot of weed, cash and two cell phones on him. I cuff him and he starts yelling that his dad is a Lieutant. A sergeant talks to him and verifies yes indeed his dad is a boss and he orders me to take my cuffs off and let him go. This is how the future "Patrick Kelly's" of the Chicago Police Department are made.

If the media wants a good story to investigate, FIND OUT who the clout was for Kelly and who protected him!! The public needs to understand that the overwhelming majority of rank and file police officers would have NEVER been allowed to keep their jobs after doing what asshole Kelly has done his entire police career. He's a raging alcoholic who's been out of control on and off duty for a long time. He was part of a group on 3rd watch in 009 that walked around like they were the shit for years (back when Kelly and others had well under 10 years on the job). A couple in that little jag-off group of his have since lost their jobs (forced to resign to avoid being fired). All Kelly and his Clout have done is make every Chicago cop look bad. And on a side note, all-though Kelly needs to be made an example out of, no way did his white trash buddy and their family deserve $44 million dollars courtesy of the taxpayers. These juries have no common sense at all!

A person in 025 a few years back drove home drunk, flipped his car and smashed into a off dutys personal vehicle. Cops had the cop in the back of the squad ready to arrest him. A certain white shirt hears it on the radio, goes to the scene and takes the drunk cop out of the squad. That cop til this day still drives drunk and the white shirt has long since been retired.

I worked along side him in 009 for a short time and I have a different opinion of him. I thought he was a good Officer. I did not know about his past or his baggage nor do I condone it. I will say one thing, there was no physical evidence to link him to shooting his friend. Hi friend had the gsr on him not Kelly. I truly believe there will be a special place in hell for Laporta for lying after he shot himself. PK ma of done some stupid things but he did not deserve this.

Prime case for a special prosecuted, with his history there has got to be trail. I'll bet a lot of merit and clouted backers are worried about the fallout from this case. This money might have been put your pension. Keeping quiet and the going along to get along days are over. Bad cops need to be called out and fired for cause.

One of the jurors basically said this was done to teach the Chicago Police Department a lesson; unfortunately at everyone living here's expense! There is no doubt that this guy should have been launched, but the Department has virtually no control over the Clouted. Anyone with any time on the job has seen bosses and POs who once clouted were literally untouchable. I can actually remember a Lieutenant being pushed off a Watch because they tried to discipline Clouted Patrol Officers. Rahm himself, the Governor himself; will not stand up to Madigan or Burke! And the money lost on this settlement is peanuts compared to the money that will be lost if Amazon does not come here. I said this weeks ago: The Generosity of Chicago Juries, be they federal or local, is not something that Amazon wants to deal with. Employees get injured and have issues that end up in court. Is the Kochman case still in civil litigation and what was the final settlement?
Who ran that coverup and where are they now?

The problem lies in the over-promoted Merit hacks that committed the biggest of improprieties and not the low level blue shirt.
One of the ways the Dept tried handle the misfits was to bury them into a unit or promote them.
Start the reform at the top and hold the past supervisors responsible as well.

On to another point is what happens when the latest new recruit candidate pool is allowed to have an arrest record and various other characteristics that imply recklessness whether domestic or financial?

Just saw on channel 7 news they interview jury foreman, F/1 saying that the reason why this became a CPD code of silence issue is because when the office called 911 he identified himself as a police officer. She smugly assert this was to seek special treatment.

Media doesn't know or care that anytime a sworn member contacts the department they are required to identify themselves as officers.

This case was against the city for not taking action against him and allowing the blue code of silence. News flash!!! The city law department announced they are going to appeal the award. You just don't cut a 44 million dollar check
It's one of the largest if not the largest in city history. By appealing it, the city has a good chance that it will be reduced for the reason of being excessive. Happens all the time. You hear the large judgements and a year or two later it is reduced. Second if they appeal it you will never see the money until all appeals are over with, probably 7 years. Both lawyers and plaintiffs want the money sooner. Who knows what 7 years will bring

I don't think there is a doubt that this guy's employment with the city should have been terminated long ago and perhaps he should have been charged with some crime for previous acts, but how do you hold the city accountable for his off-duty actions outside his employment? Is the state held accountable for convicted felons they release early and who then commit murder or shoot someone? Are parents held accountable for the actions of their children? Are auto manufacturers held accountable for someone whose negligent or intentional actions of their product causes death or serious injury to someone. I believe the plaintiff was certainly entitled to damages from the person who caused the injuries, but why is burden put on the taxpayers?

Clout helped this copper keep his job incident after incident. He and his family are Bridgeport babies, enough said. Everyone knows what politicians are attached to that area, but the politicians are never investigated and jailed for their antics. This officer was off duty and drunk again, but had nothing to do with the suicide his friend attemted. There is pleanty of evidence to show suicide, including witnesses who gave statements of his depression and repeated intent to kill himself. Physical evidence and witness statements couldn't overcome the jury feeling sorry for the guy who shot himself and his parents plea for someone else to have to pay the bills for his actions. He was as drunk as the officer, but couldn't control his own actions and tried to end his own life. Now the officer gets blamed and everyone on the scene is made to seem like conspiring participants. Someone in another post alleged the female sgt may have been meritoriously promoted for dropping charges, but that is just some goof spouting off. That sgt did not drop the charges, she fully cooperated and went to court and testified in the criminal trial fter the officer was charged. The detective division decided what the officer was going to be charged with, and this whole verdict is simply a money grab by the family of the guy who shot himself and the typical greedy, snake attorney. The copper was wrong for not securing his weapon and for assaulting a department member, and he was criminal charged and subsequently administratively disciplined, inclusive of being intoxicated. This copper should have been fired years ago, blame the politicians for this and no one else. But this federal case is only a money grab and nothing more. The idiot copper didn't participate in the discharge of the gun, that was the personal choice of the injured person. He and his family already sued the officer personally, but the half mil they got from that wasn't enough for them and their attorney, they wanted more, so they tried to dirty up the department and other officers who had to respond to the stupidity of their loved one in order to take more money. The guy is wheelchair bound and mentally deficient by his own choices and his own actions, that's no one else's fault. The officer will never be charged with anything regarding this, the states atty office already looked at it twice and there is nothing there. The Dept is just going to turn up the heat to force him to quit.

FYI - The 44 million is already in an interest bearing account in escrow. That award will sit in a connected banks deposits until the appeals are all exhausted.

Rahm slush fund plus what he paid the connected law firm just took a nice hit. The city will get the $ amount lowered and the lawyers on both sides will agree on the $ the guy will get.

How an off duty conduct is related to the employer is bull shit. But, The Federal Judge found good reason not to toss the case after motions. The Federal Judge' are legit with integrity. unlike the make believe one' in Crook County.

This is why we can't get a fair shake in contract negotations and are easily divided by the Mayor and other politicians. How about we support each other once in a while. I have over 20 years on this job and I have noticed a drastic change in the Officers and how we treat each other. And sticking together doesn't mean there is a code of silence it means supporting each other. I am so glad I can retire in a few years. Close, the money will earn interest and if the judgement is upheld the plaintiff will receive the money plus interest. But it is bbt held in escrow. The courts do not lock up that money until the case is over and all all appeals are exhausted

In fact he took time for that incident after Gypsie Joe Sperando faked having debris in his eye so he could sit on the medical for the summer. He's also the only boss I know of who took the stand in federal court and testified against clouted bosses who were on trial for screwing over a couple of POs. He had nothing to gain and everything to lose but he did the right thing.

yes, you might be correct in this, but then you must also look at the " chain of command", the gold stars that reviewed each and every investigations , if they approved it or not and any comments that they added, " The Command Channel Review". Same as the McDonald Investigation where a police officer is now on trial after the gold stars all said it was a good shoot and now deny it.
