Nolle Pros = Lawsuit?

  • The war on cops is moving from the streets to the U.S. Supreme Court. Last week, the Justices heard a case that threatens police officers with financial ruin if they make arrests and the charges later get dropped.

It started with a late night bash. District of Columbia police officers were called by neighbors at 1 a.m. to investigate a rowdy party at an unoccupied row house. The police found 21 partygoers, liquor, trash, and used condoms strewn about, the smell of marijuana, and women with cash stuffed in their thongs. The partygoers scattered, hiding in closets.

When questioned, some told police “Peaches had invited them.” Some gave other stories. The police phoned “Peaches,” who admitted not having the owner’s permission to use the house. The police then called the owner, who confirmed no one had permission. Two hours after being summoned, the police made the decision to arrest the partygoers for trespassing — the judgment call at issue in this case.

The charges were later dropped, because it wasn’t clear beyond a reasonable doubt the partygoers knew they were trespassing. But sixteen turned around and sued the police for false arrest and violating their constitutional rights.
Luckily, President Trump nominated Neil Gorsuch to the Supreme Court and this suit should die an ignominious death:
  • The justices should put a stop to it. Fortunately, the Court has a long record of protecting the police from legal liability, provided there’s no evidence of malice or a deliberate violation of the Constitution.

If merely making an arrest puts cops at risk of getting sued and clobbered with legal fees and damage awards, what police officer will ever make an arrest? One mistake could mean losing their home and everything else. Faced with that risk, who would ever want to be a cop?
But in case you were wondering what the end-game is of the ACLU and Rahm's "consent decree:"
  • Twenty-six states and the federal Justice Department are weighing in with a strong warning that allowing the lower court ruling to stand would have “vast consequences” for law enforcement everywhere. On the other side, the American Civil Liberties Union is pushing to shrink or even eliminate the police’s legal immunity. The ACLU wants police to have no room for error.

Lemme guess. These coppers saw all these arrests and were foaming at the mouth cuz their “numbers” would impress their bosses. See what the “numbers” game can get you in. That’s why I laugh at the constant we need this we need that from bosses that never worked the streets. Numbers games get coppers jammed up. If it ain’t there don’t create. Not worth the headache

Why would you arrest the mopes if you weren't sure that the party goers knew they were not allowed to be there. If you go to a big party at someone's house do you really know if the owner has given permission to the party? Unless you are absolutely sure don't arrest. Time to change the thinking.

I think any make up of court would rule in the officers favor. Grouch actually scares me, he is so conservative he might interpret it that if the party goers did not receive a warning and given the opportunity to he might say their fourth amendment rights were violated. Don't equate conservative with backing the police, there is long history of conservative judges interpreting cases against the police in favor of a stricter interpretation of constitutional matters.

In reading the article and links, I immediately saw the problem as to how police were held liable for damages. The original Court Case was heard by a D.C. JURY.

With that jury pool there was no way the cops were not going to be held liable. The trial might as well have been held in a Black Lives Matter 'clubhouse', or at the local Black Panther HQ.

an aside: That same D.C. jury pool is why that special council asshole Bob Mueller has a Grand Jury in D.C. going after Paul Manafort in addition to an original one in NY. Anyone not a flaming leftist democrat is automatically 'guilty'.

St. Louis police would face limits on using pepper spray, tear gas under proposal

ST. LOUIS • Putting limits on when police officers can use chemical agents or order crowds to disperse would help protect demonstrators’ First Amendment rights, supporters of a bill filed this week argue.
Under the measure, the St. Louis Police Department can issue orders to disperse only if “a significant number or percentage of the assembly participants” fail to adhere to certain restrictions, engage in violence or destroy property, or if the mayor declares a public safety emergency.

Pause

It also requires police to issue at least one order to disperse — and multiple orders if possible — using an amplification system reaching 40 feet away, giving participants “reasonable and adequate” time to disperse and a safe and clear route for dispersal. At least one order would also be required before deploying chemical agents.

Officers would not be able to use chemical agents on protesters or groups who fail to disperse, only on individuals who have “caused or attempted to cause serious physical injury to another person.” Pepper spray and other agents could not be used on individuals who are already restrained.

Additionally, the bill would require all officers to have their name tags visible at all times and mandate that the department promptly process and release anyone who was arrested during an event.

Even with the solid legal footing of
a victim signing complaints against
the offender, the progressives want
to be able to "Punish" Policemen for
making a lawful arrest after a lazy-assed
democratic judge or prosecutor/state's
attorney deliberately fails to do their job?

If this is to be the newest and best anti-Police
gambit by the left, then there is no reason for
judges and prosecutors/state's attorney's to
retain the privilege of immunity.

Let EVERY living ass in the judicial system now
be equally imperiled.

If judges and prosecutors/state's attorneys have it
in their minds that it's perfectly fine and morally
acceptable to maroon The Police in this fashion,
then they too should be left naked and in the cold.

That way, EVERYBODY can gather around to point
and laugh not just at the poor slob Policemen caught
up in this horrible shit, but also at the judges, prosecutors
and state's attorneys who facilitated the deliberate trick
bagging of Policemen on orders of their liberal progressive
masters and bed mates.

Just had a late breaking thought...

So if the ACLU and liberal progressive judges
and prosecutors/state's attorneys are so hell
bent on using the Nolle Pros to deliberately
set up Policemen for retributive legal action
on the back end of legal and justifiable arrests
on a complaint signed by a victim/complainant,
then let's have fun with the current state of affairs,
shall we?

Go through all the steps as just as if you were
actually going to make the arrest...

Commit names and/or physical identifiers of the
miscreants to the report.

Advise the complainant to go to their local
branch court to obtain warrants/summonses
on the miscreants involved...

Voila'...
No punitive legal actions against Policemen
for making an arrest.

Watch the lefty progressive judges, prosecutors/
state's attorneys squirm when this tactic becomes
S.O.P.

Oh yeah...
They'll gin up all kinds of nasty-grams
to mayors and superintendents demanding
that they order The Police to "knock it off."

No more being back-doored with a bullshit
Nolle Pros by lazy-assed democrat affiliated
judges, prosecutors/state's attorneys.

Ignorant and deliberately tone-deaf supervisors
will shit-talk, brow-beat, bully and threaten you
because they won't be able to wrap their pointy,
meritcloutoriously promoted heads around what
you're doing...

The hard chargers will have a hard time too.

You see, real, actual "Patrolmen" have "adapt
and overcome" deeply ingrained if not hard wired.

Adapting and overcoming sometimes takes a little
extra time.

It takes a few years to acquire the deft touch,
the mental acuity and situational awareness
to facilitate being able to adapt and overcome
as a Policeman with a large, democrat-controlled
urban center Police Department and the unholy,
treacherous, potentially life-altering mess that it is.

...And you'll be resoundingly condemned and found
at fault for having the utter audacity for attempting
to mitigate or at least somehow manage the shit
that impacts you with at least a controlled collision.

Ignorant m/fers get all up in their own asses
with manufactured angst/ire about why you keep
trying to pump the brakes to protect yourself as
best you can.

Protect Yourselves From THEM.

ALWAYS.

DOJ issues 'last chance' warning to sanctuary cities

http://www.foxnews.com/politics/2017/10/12/doj-issues-last-chance-warning-to-sanctuary-cities.html

Excerpt:
n a notice reviewed by Fox News, the DOJ announced that five jurisdictions “have preliminarily been found to have laws, policies, or practices that may violate” a key federal statute concerning cooperation with federal immigration officials.

They are: Chicago, New Orleans, New York City, Philadelphia and Cook County, Ill.

Attorney General Jeff Sessions said in a written statement that sanctuary cities “adopt the view that the protection of criminal aliens is more important than the protection of law-abiding citizens and of the rule of law.”

The Justice Department said the five cities and counties in question will have until Oct. 27 to “provide additional evidence that the interpretation and application of their laws, policies, or practices comply with the statute.”

^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

As rahm talks about his "chicago values" which are criminal in nature, while violating federal immigration laws, finally looks like our prayers ,letters, emails, phone calls will be answered soon! The "forgotten men and women of chicago, crook county, state of corruption illinois" will God willing see some justice served!

So will Oct 27th, be the final date then after the feds come in and take the elected who aid and abet into federal custody? Will we be able to help them load up the busses full of criminals from the county building and city hall? Will the state police begin arresting the state elected violators?

fake dishonest media here will destroy you along with little tommy "im a pizza man" dart."Until this happens stay fetal, don't be that fish caught on a thin string and the 24/

Baltimore DA Marylin Mosby requested the Baltimore Police do a drug sweep in a known drug spot in her City Council Husband's ward. The drug activity was pissing off her husband and his constituents. The Police complied with her request, and that was when they interacted with Freddie Gray.

Six Bogus manslaughter indictments. That was the thanks they got from Ms. Mosby for trying to clean up her hubby's ward.

Stop painting everything the police do as wrong. We are both supposed to be working for the people.

This can be addressed if a judge finds probable cause first, and then the ASA nolles.

If that were to pass, cities might as well do away with police departments. There will be no arrests. When a citizen reports a crime online, the States Attorney reviews and if it sees the need, issues a warrant that the sheriff serves. But only on judge approval.

And how can one really prove the subject was knowingly and intentionally remaining on the land of the owner/agent?
Do a case report. Advise warrant. Done.

Why doesn’t the aclu just be the police? If they know it all, then they can do it all.

10-22/1017 Advise the complainant to go to their local branch court to obtain warrants/summonses on the miscreants involved...

It's called "known offender(s)" that'll usually stop a chase also depending on the crime.

But truthfully, thank you for proactive thinking

The appellate court decision is 41 pages. I skimmed it a bit and one thing I noticed is the court granted the plaintiffs (arrestees) partial summary judgment as to the false arrest.

Summary judgment means there are no facts at issue and the judge can rule as a matter of law, without a trial. It seems a bad move to me anyway. A fact at issue, in this case, is whether it was reasonable for the arresting officer to believe that, in fact, these arrestees did not know who the owner was, knew they were trespassing, despite their statement that they believed they had permission to party at the house. Happens all the time.

And, as a side note, doesn't the CTTV statute omit the knowledge requirement?

The greater issue is the immunity - still have to get to that.

"Go through all the steps as just as if you were
actually going to make the arrest...

Commit names and/or physical identifiers of the
miscreants to the report."

Heh...

You deliberately left out a couple of key steps
with which the alleged complainant CAN
obtain a warrant/summons.

Fixed it for ya...

If the alleged complainant gets blown-off while
trying to obtain a warrant/summons, failure to
provide service will be the fault of the court
and not The Police.

Don't be one of the "vexed."

That's just somebody throwing around terminology they've picked up from here to try to sound like they know what they're talking about. It doesn't even make sense if you really know how things work. Nice try!

The Soda Tax is dead?

Well, eventually. December 1st?

And you can thank CPS for our additional $200.00 a year additional tax. Have you noticed not one word from any politician.

Don't worry. CPS is not through yet. This was in addition to the new state money they were given. They will be crying and receive more in the next few months.
How can you complain. With the test scores they must be doing a great job and remember "it's for the children"
Not easy producing these results when you have less students, a constantly declining and receive addition funds every year

Are you volunteering to be the guinea pig for that little experiment when the time comes? That’s putting a lot of trust in judges and ASA’s that don’t give a shit about you or your family.

And ignore the white shirted gnats buzzing around
your ears about "you shoulda made an arrest."

Or better still, ignore/avoid the ones who threaten to
maroon your report in the queue because you
rightfully exercise the discretion you have
per G.O. and the law...

Shit's gotten really silly over the last
several years over Policemen doing what
needs to be done to protect themselves.

I figured there would be lawsuits filed years ago in BR 48 when the judge would rule " Finding of No Probable Cause " for cases with less than a gram of narcotics. No matter what the circumstances were for arrest and how the recovery of the narcotics occurred, it would always be finding of no probable cause based solely on weight....

And are you or who do you expect to tell the judge to change his rulings. That I would like to see. Heck, next time the judge rules no probable cause on one of y9ur case, you just stand up there and tell him to change ruling. Then let us know how that turns out
