Nolle Pros = Lawsuit?
- The war on cops is moving from the streets to the U.S. Supreme Court. Last week, the Justices heard a case that threatens police officers with financial ruin if they make arrests and the charges later get dropped.
It started with a late night bash. District of Columbia police officers were called by neighbors at 1 a.m. to investigate a rowdy party at an unoccupied row house. The police found 21 partygoers, liquor, trash, and used condoms strewn about, the smell of marijuana, and women with cash stuffed in their thongs. The partygoers scattered, hiding in closets.
When questioned, some told police “Peaches had invited them.” Some gave other stories. The police phoned “Peaches,” who admitted not having the owner’s permission to use the house. The police then called the owner, who confirmed no one had permission. Two hours after being summoned, the police made the decision to arrest the partygoers for trespassing — the judgment call at issue in this case.
The charges were later dropped, because it wasn’t clear beyond a reasonable doubt the partygoers knew they were trespassing. But sixteen turned around and sued the police for false arrest and violating their constitutional rights.
Luckily, President Trump nominated Neil Gorsuch to the Supreme Court and this suit should die an ignominious death:
- The justices should put a stop to it. Fortunately, the Court has a long record of protecting the police from legal liability, provided there’s no evidence of malice or a deliberate violation of the Constitution.
If merely making an arrest puts cops at risk of getting sued and clobbered with legal fees and damage awards, what police officer will ever make an arrest? One mistake could mean losing their home and everything else. Faced with that risk, who would ever want to be a cop?
But in case you were wondering what the end-game is of the ACLU and Rahm's "consent decree:"
- Twenty-six states and the federal Justice Department are weighing in with a strong warning that allowing the lower court ruling to stand would have “vast consequences” for law enforcement everywhere. On the other side, the American Civil Liberties Union is pushing to shrink or even eliminate the police’s legal immunity. The ACLU wants police to have no room for error.

I know I am preaching to the choir, but for those not familiar with the court systems they toss winnable cases all the time. My first lawsuit was for false arrest on criminal trespass, with signed complaints. I'm now facing another for the same charge on a different arrests with sign complaints again. With everything going on I'm thinking it's time to jump ship to a new career.

Why would you arrest the mopes if you weren't sure that the party goers knew they were not allowed to be there. If you go to a big party at someone's house do you really know if the owner has given permission to the party? Unless you are absolutely sure don't arrest. Time to change the thinking.
I think any make up of court would rule in the officers favor. Grouch actually scares me, he is so conservative he might interpret it that if the party goers did not receive a warning and given the opportunity to he might say their fourth amendment rights were violated. Don't equate conservative with backing the police, there is long history of conservative judges interpreting cases against the police in favor of a stricter interpretation of constitutional matters.
In reading the article and links, I immediately saw the problem as to how police were held liable for damages. The original Court Case was heard by a D.C. JURY.
With that jury pool there was no way the cops were not going to be held liable. The trial might as well have been held in a Black Lives Matter 'clubhouse', or at the local Black Panther HQ.
an aside: That same D.C. jury pool is why that special council asshole Bob Mueller has a Grand Jury in D.C. going after Paul Manafort in addition to an original one in NY. Anyone not a flaming leftist democrat is automatically 'guilty'.

It also requires police to issue at least one order to disperse — and multiple orders if possible — using an amplification system reaching 40 feet away, giving participants “reasonable and adequate” time to disperse and a safe and clear route for dispersal. At least one order would also be required before deploying chemical agents.
Officers would not be able to use chemical agents on protesters or groups who fail to disperse, only on individuals who have “caused or attempted to cause serious physical injury to another person.” Pepper spray and other agents could not be used on individuals who are already restrained.

Actually, Riverside Police Chief is slightly wrong regarding the role of the police. They are supposed to be non partisans "just the facts, Ma'am." Police are not ENPLOyEES of the prosecution. Neutrality. You are not there to get convictions. Just develop facts.

If that were to pass, cities might as well do away with police departments. There will be no arrests. When a citizen reports a crime online, the States Attorney reviews and if it sees the need, issues a warrant that the sheriff serves. But only on judge approval.

The appellate court decision is 41 pages. I skimmed it a bit and one thing I noticed is the court granted the plaintiffs (arrestees) partial summary judgment as to the false arrest.
Summary judgment means there are no facts at issue and the judge can rule as a matter of law, without a trial. It seems a bad move to me anyway. A fact at issue, in this case, is whether it was reasonable for the arresting officer to believe that, in fact, these arrestees did not know who the owner was, knew they were trespassing, despite their statement that they believed they had permission to party at the house. Happens all the time.
And, as a side note, doesn't the CTTV statute omit the knowledge requirement?
The greater issue is the immunity - still have to get to that.

You deliberately left out a couple of key steps
with which the alleged complainant CAN
obtain a warrant/summons.
Fixed it for ya...
If the alleged complainant gets blown-off while
trying to obtain a warrant/summons, failure to
provide service will be the fault of the court
and not The Police.

I figured there would be lawsuits filed years ago in BR 48 when the judge would rule " Finding of No Probable Cause " for cases with less than a gram of narcotics. No matter what the circumstances were for arrest and how the recovery of the narcotics occurred, it would always be finding of no probable cause based solely on weight....

This can be addressed if a judge finds probable cause first, and then the ASA nolles.
And are you or who do you expect to tell the judge to change his rulings. That I would like to see. Heck, next time the judge rules no probable cause on one of y9ur case, you just stand up there and tell him to change ruling. Then let us know how that turns out
